ensure continued United States leadership in engineering
biology.</official-title></form><legis-body style="OLC"><section section-type="section-one" id="HB8948F23AB374B2C9369F68ECC69B196"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bioeconomy Research and Development Act of 2021</short-title></quote>.</text></section><section id="HFFE0839FC80340318BA3986D6D1BA946"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress makes the following findings:</text><paragraph id="H953A563F16FE4A2895EE5BE0BF04C40A"><enum>(1)</enum><text>Cellular and molecular processes may be used, mimicked, or redesigned to develop new products, processes, and systems that improve societal well-being, strengthen national security, and contribute to the economy.</text></paragraph><paragraph id="H5A345F03BFDD4B5A9B142CA6A0FBF8A4"><enum>(2)</enum><text>Engineering biology relies on a workforce with a diverse and unique set of skills combining the biological, physical, chemical, and information sciences and engineering.</text></paragraph><paragraph id="HE992851D74E441CB9844EA80C978CFB8"><enum>(3)</enum><text>Long-term research and development is necessary to create breakthroughs in engineering biology. Such research and development requires government investment as many of the benefits are too distant or uncertain for industry to support alone.</text></paragraph><paragraph id="H5BE6625092F34F7184534AB21DDF3B10"><enum>(4)</enum><text>Research is necessary to inform evidence-based governance of engineering biology and to support the growth of the engineering biology industry.</text></paragraph><paragraph id="id79dd7f31d03549c0a48b49f578ddc54b"><enum>(5)</enum><text>The Federal Government has an obligation to ensure that ethical, legal, environmental, safety, security, and societal implications of its science and technology research and investment follows policies of responsible innovation and fosters public transparency.</text></paragraph><paragraph id="id92de293bdf264c059e31df3eaf0a1d1a"><enum>(6)</enum><text>The Federal Government can play an important role by facilitating the development of tools and technologies to further advance engineering biology, including user facilities, by facilitating public-private partnerships, by supporting risk research, and by facilitating the commercial application in the United States of research funded by the Federal Government. </text></paragraph><paragraph id="H43A5022210D946BB986763AD54483B94"><enum>(7)</enum><text>The United States led the development of the science and engineering techniques that created the field of engineering biology, but due to increasing international competition, the United States is at risk of losing its competitive advantage if it does not strategically invest the necessary resources.</text></paragraph><paragraph id="HA41E6F817E7446A98FBFB20654C61163"><enum>(8)</enum><text>A National Engineering Biology Initiative can serve to establish new research directions and technology goals, improve interagency coordination and planning processes, drive technology transfer to the private sector, and help ensure optimal returns on the Federal investment.</text></paragraph></section><section id="H3803E42FEBF44CAD9EA271517E28E6F3"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HD99CEAE773824FD4A202504857764420"><enum>(1)</enum><header>Biomanufacturing</header><text>The term <term>biomanufacturing</term> means the utilization of biological systems to develop new and advance existing products, tools, and processes at commercial scale.</text></paragraph><paragraph id="H7D124A6582A64FDABE29EB9B52E0A5A4"><enum>(2)</enum><header>Engineering biology</header><text display-inline="yes-display-inline">The term <term>engineering biology</term> means the application of engineering design principles and practices to biological systems, including molecular and cellular systems, to advance fundamental understanding of complex natural systems and to enable novel or optimize functions and capabilities.</text></paragraph><paragraph id="HA801D1467167495CBB0CF1E4CDDB0AE8"><enum>(3)</enum><header>Initiative</header><text>The term <term>Initiative</term> means the National Engineering Biology Research and Development Initiative established under section 4.</text></paragraph><paragraph id="H42E5A73BBB1B4F1BA10D1A4255245234"><enum>(4)</enum><header>Omics</header><text display-inline="yes-display-inline">The term <term>omics</term> refers to the collective technologies used to explore the roles, relationships, and actions of the various types of molecules that make up the cells of an organism.</text></paragraph></section><section id="H8BFD5B74C03C46E3A87E3EDEB7C0A49E"><enum>4.</enum><header>National Engineering Biology Research and Development Initiative</header><subsection id="H0383AE9C625647C5B9BC8E577F64D898"><enum>(a)</enum><header>In general</header><text>The President, acting through the Office of Science and Technology Policy, shall implement a National Engineering Biology Research and Development Initiative to advance societal well-being, national security, sustainability, and economic productivity and competitiveness through—</text><paragraph id="id5034CC46EEE14FA78C92C2DFD83596DB"><enum>(1)</enum><text>advancing areas of research at the intersection of the biological, physical, chemical, data, and computational sciences and engineering to accelerate scientific understanding and technological innovation in engineering biology;</text></paragraph><paragraph id="H1CFA3C121D10407495B97B406C5D9004"><enum>(2)</enum><text display-inline="yes-display-inline">advancing areas of biomanufacturing research to optimize, standardize, scale, and deliver new products and solutions;</text></paragraph><paragraph id="H73FBDD1FD1FC46808374C8A090653668"><enum>(3)</enum><text>supporting social and behavioral sciences and economics research that advances the field of engineering biology and contributes to the development and public understanding of new products, processes, and technologies;</text></paragraph><paragraph id="id9a4e998837184def95ea0375ee1f7e11"><enum>(4)</enum><text>improving the understanding of engineering biology of the scientific and lay public and supporting greater evidence-based public discourse about its benefits and risks; </text></paragraph><paragraph id="H764FC18988054359BA7A4CC6A160FEFC"><enum>(5)</enum><text>supporting research relating to the risks and benefits of engineering biology, including under subsection (d); </text></paragraph><paragraph id="H9C164299B0594F45837B7129714C8C46"><enum>(6)</enum><text display-inline="yes-display-inline">supporting the development of novel tools and technologies to accelerate scientific understanding and technological innovation in engineering biology;</text></paragraph><paragraph id="id00cbaeeefe8340a095ebf16dd5540bce"><enum>(7)</enum><text>expanding the number of researchers, educators, and students and a retooled workforce with engineering biology training, including from traditionally underrepresented and underserved populations; </text></paragraph><paragraph id="H2F2D0AA19379452CBA2E60F5398689C7"><enum>(8)</enum><text>accelerating the translation and commercialization of engineering biology research and development by the private sector; and</text></paragraph><paragraph id="H1C2DB36F2085424E98F02F784E38E309"><enum>(9)</enum><text>improving the interagency planning and coordination of Federal Government activities related to engineering biology.</text></paragraph></subsection><subsection id="H5CDC6D8891AE4C4B8DC098E3193EF632"><enum>(b)</enum><header>Initiative activities</header><text>The activities of the Initiative shall include—</text><paragraph id="HFD66CD0F71CD4BB5B0B00BD86B7D02BA"><enum>(1)</enum><text>sustained support for engineering biology research and development through—</text><subparagraph id="H9BAF0C4F5A4546F699B96C958CDC6945"><enum>(A)</enum><text>grants to fund the work of individual investigators and teams of investigators, including interdisciplinary teams; </text></subparagraph><subparagraph id="H577B6ECD887644CEB605D175BE4A495C"><enum>(B)</enum><text>projects funded under joint solicitations by a collaboration of no fewer than two agencies participating in the Initiative; and</text></subparagraph><subparagraph id="HE2EC1C22B18443A6BDC1FD46C30823CB"><enum>(C)</enum><text>interdisciplinary research centers that are organized to investigate basic research questions, carry out technology development and demonstration activities, and increase understanding of how to scale up engineering biology processes, including biomanufacturing;</text></subparagraph></paragraph><paragraph id="HC5662EA1C0CA4C158A1730F7B9A55BB9"><enum>(2)</enum><text>sustained support for databases and related tools, including—</text><subparagraph id="id9ac025c7c51944c383166e25d0f8b26f"><enum>(A)</enum><text>support for curated genomics, epigenomics, and other relevant omics databases, including plant and microbial databases, that are available to researchers to carry out engineering biology research in a manner that does not compromise national security or the privacy or security of information within such databases;</text></subparagraph><subparagraph id="id11bcbe5b84ac4ca9ac3d8f65aad822b3"><enum>(B)</enum><text>development of standards for such databases, including for curation, interoperability, and protection of privacy and security; </text></subparagraph><subparagraph id="HE97849C307894E70B7089446A3750A6C"><enum>(C)</enum><text display-inline="yes-display-inline">support for the development of computational tools, including artificial intelligence tools, that can accelerate research and innovation using such databases; and</text></subparagraph><subparagraph id="ida492b7ce41794ebf81794e12d8c55010"><enum>(D)</enum><text>an inventory and assessment of all Federal government omics databases to identify opportunities to improve the utility of such databases, as appropriate and in a manner that does not compromise national security or the privacy and security of information within such databases, and inform investment in such databases as critical infrastructure for the engineering biology research enterprise; </text></subparagraph></paragraph><paragraph id="H40B5A467B112498AAF0A772D84D6C493" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">sustained support for the development, optimization, and validation of novel tools and technologies to enable the dynamic study of molecular processes in situ, including through—</text><subparagraph id="id8f145d9207d740f0a743784d574f3467" commented="no"><enum>(A)</enum><text>research conducted at Federal laboratories; </text></subparagraph><subparagraph id="id9FF4B57A07344424A2E641345592C2AC" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">grants to fund the work of investigators at institutions of higher education and other nonprofit research institutions;</text></subparagraph><subparagraph commented="no" id="idB0277ACE41F74727898ED3B7C68B3CB0"><enum>(C)</enum><text display-inline="yes-display-inline">incentivized development of retooled industrial sites across the country that foster a pivot to modernized engineering biology initiatives; and </text></subparagraph><subparagraph id="idB2B18CCE0BB745D99B205998A7C6055C" commented="no"><enum>(D)</enum><text display-inline="yes-display-inline">awards under the Small Business Innovation Research Program and the Small Business Technology Transfer Program, as described in section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>); </text></subparagraph></paragraph><paragraph id="H1AE3228CDA3D4DC8BDE6BBF5C2D805AA"><enum>(4)</enum><text>support for education and training of undergraduate and graduate students in engineering biology, biomanufacturing, bioprocess engineering, and computational science applied to engineering biology and in the related ethical, legal, environmental, safety, security, and other societal domains;</text></paragraph><paragraph id="H1AD37B37304B4A0EA84ED20FD8A1C704"><enum>(5)</enum><text>activities to develop robust mechanisms for documenting and quantifying the outputs and economic benefits of engineering biology; and</text></paragraph><paragraph id="HCD662F0F257040F1AC1BF8F96B0B81C9"><enum>(6)</enum><text>activities to accelerate the translation and commercialization of new products, processes, and technologies by—</text><subparagraph id="H9EFA049725744044BD5AE3D5A4942F1C"><enum>(A)</enum><text>identifying precompetitive research opportunities;</text></subparagraph><subparagraph id="H8E48D2DB7CC840F78E655A0E26B13912"><enum>(B)</enum><text>facilitating public-private partnerships in engineering biology research and development;</text></subparagraph><subparagraph id="HA4151D5C9BA24AD280CA397657ECB1C9"><enum>(C)</enum><text>connecting researchers, graduate students, and postdoctoral fellows with entrepreneurship education and training opportunities; and</text></subparagraph><subparagraph id="HB030272088E041BAA282FAF1FB4B3631"><enum>(D)</enum><text>supporting proof of concept activities and the formation of startup companies including through programs such as the Small Business Innovation Research Program and the Small Business Technology Transfer Program.</text></subparagraph></paragraph></subsection><subsection id="HB461C9C57E294D1DB964F658376E5FDB"><enum>(c)</enum><header>Expanding participation</header><text>The Initiative shall include, to the maximum extent practicable, outreach to primarily undergraduate and minority-serving institutions about Initiative opportunities, and shall encourage the development of research collaborations between research-intensive universities and primarily undergraduate and minority-serving institutions.</text></subsection><subsection id="HF1BDA6A8C4B24276A1E5FFAAAF5797FE"><enum>(d)</enum><header>Ethical, legal, environmental, safety, security, and societal issues</header><text>Initiative activities shall take into account ethical, legal, environmental, safety, security, and other appropriate societal issues by—</text><paragraph id="HFB453BFCD9BF4126A46EBE0F0EADAFC2"><enum>(1)</enum><text>supporting research, including in the social sciences, and other activities addressing ethical, legal, environmental, and other appropriate societal issues related to engineering biology, including integrating research on such topics with the research and development in engineering biology, and encouraging the dissemination of the results of such research, including through interdisciplinary engineering biology research centers described in subsection (b)(1); </text></paragraph><paragraph id="idde764f639a254570b062054316835ff0"><enum>(2)</enum><text>supporting research and other activities related to the safety and security implications of engineering biology, including outreach to increase awareness among Federal researchers and Federally-funded researchers at institutions of higher education about potential safety and security implications of engineering biology research, as appropriate; </text></paragraph><paragraph id="HF52873C704FC4DFB93001EC065D8A67A"><enum>(3)</enum><text>ensuring that input from Federal and non-Federal experts on the ethical, legal, environmental, safety, security, and other appropriate societal issues related to engineering biology is integrated into the Initiative;</text></paragraph><paragraph id="id512F2989B9F94D3294E238535A8B6B4A"><enum>(4)</enum><text>ensuring, through the agencies and departments that participate in the Initiative, that public input and outreach are integrated into the Initiative by the convening of regular and ongoing public discussions through mechanisms such as workshops, consensus conferences, and educational events, as appropriate; and</text></paragraph><paragraph id="id25F1A929CF6A47E5812C0C1353BCDA77"><enum>(5)</enum><text display-inline="yes-display-inline">complying with all applicable provisions of Federal law. </text></paragraph></subsection></section><section id="H140CB8B48ED74AD7ADA823C83759F061"><enum>5.</enum><header>Initiative coordination</header><subsection id="H1F013A11E49F4187BADB2ED0CBEBEDE4"><enum>(a)</enum><header>Interagency committee</header><text display-inline="yes-display-inline">The President, acting through the Office of Science and Technology Policy, shall designate an interagency committee to coordinate activities of the Initiative as appropriate, which shall be co-chaired by the Office of Science and Technology Policy, and include representatives from the National Science Foundation, the Department of Energy, the Department of Defense, the National Aeronautics and Space Administration, the National Institute of Standards and Technology, the Environmental Protection Agency, the Department of Agriculture, the Department of Health and Human Services, the Bureau of Economic Analysis, and any other agency that the President considers appropriate (in this section referred to as the <quote>Interagency Committee</quote>). The Director of the Office of Science and Technology Policy shall select an additional co-chairperson from among the members of the Interagency Committee. The Interagency Committee shall oversee the planning, management, and coordination of the Initiative. The Interagency Committee shall— </text><paragraph id="HBC6765F7995E4E30AD1A94B8F13D16FB"><enum>(1)</enum><text display-inline="yes-display-inline">provide for interagency coordination of Federal engineering biology research, development, and other activities undertaken pursuant to the Initiative;</text></paragraph><paragraph id="H56D554B3C2BF4C549624A482B1B5E0F3"><enum>(2)</enum><text display-inline="yes-display-inline">establish and periodically update goals and priorities for the Initiative;</text></paragraph><paragraph id="HD328F3FFBE5D455C85BFC753D9F7D2EA"><enum>(3)</enum><text>develop, not later than 12 months after the date of the enactment of this Act, and update every 3 years thereafter, a strategic plan submitted to the Committee on Science, Space, and Technology and the Committee on Energy and Commerce of the House of Representatives and the Committee on Commerce, Science, and Transportation and the Committee on Health, Education, Labor, and Pensions of the Senate that— </text><subparagraph id="H9B0E6B17D05F4C05A4743D9A9A270A39"><enum>(A)</enum><text display-inline="yes-display-inline">guides the activities of the Initiative for purposes of meeting the goals and priorities established under (and updated pursuant to) paragraph (2); and</text></subparagraph><subparagraph id="HF84DBB620DBC49D893FB59A71B90276F"><enum>(B)</enum><text>describes—</text><clause id="H78C00CEC4AC04291A891AD3E3F5777BB"><enum>(i)</enum><text display-inline="yes-display-inline">the Initiative’s support for long-term funding for interdisciplinary engineering biology research and development;</text></clause><clause id="H14CC0901059E4A4B9E1463F0641A506B"><enum>(ii)</enum><text display-inline="yes-display-inline">the Initiative’s support for education and public outreach activities;</text></clause><clause id="H0841E65067BC48748F6E0989D33ED73C"><enum>(iii)</enum><text display-inline="yes-display-inline">the Initiative’s support for research and other activities on ethical, legal, environmental, safety, security, and other appropriate societal issues related to engineering biology including—</text><subclause id="idf41be4b97b1c4bd5aa4ef896fd449a80"><enum>(I)</enum><text>an applied biorisk management research plan;</text></subclause><subclause id="id14a17c4282724b0eb8078d16cb1780da"><enum>(II)</enum><text>recommendations for integrating security into biological data access and international reciprocity agreements;</text></subclause><subclause id="id12FF035793CE494AA921599CE9018475"><enum>(III)</enum><text>recommendations for manufacturing restructuring to support engineering biology research, development, and scaling-up initiatives; and</text></subclause><subclause id="id59e1efd98b0f431b82d4d6ec501bddb9"><enum>(IV)</enum><text>an evaluation of existing biosecurity governance policies, guidance, and directives for the purposes of creating an adaptable, evidence-based framework to respond to emerging biosecurity challenges created by advances in engineering biology; </text></subclause></clause><clause id="H01A67247288F4930AE189C66589FAB6D"><enum>(iv)</enum><text display-inline="yes-display-inline">how the Initiative will contribute to moving results out of the laboratory and into application for the benefit of society and United States competitiveness; and</text></clause><clause id="H9EE0F73D4F844F84957FD2E053F988FB"><enum>(v)</enum><text display-inline="yes-display-inline">how the Initiative will measure and track the contributions of engineering biology to United States economic growth and other societal indicators;</text></clause></subparagraph></paragraph><paragraph id="id9823b9398f7b4ff5a87cff0c70d5740f"><enum>(4)</enum><text>develop a national genomic sequencing strategy to ensure engineering biology research fully leverages plant, animal, and microbe biodiversity, as appropriate and in a manner that does not compromise national security or the privacy or security of human genetic information, to enhance long-term innovation and competitiveness in engineering biology in the United States; </text></paragraph><paragraph id="H826ACEFF05C942A4B3CB1758B39859E2"><enum>(5)</enum><text display-inline="yes-display-inline">develop a plan to utilize Federal programs, such as the Small Business Innovation Research Program and the Small Business Technology Transfer Program as described in section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>), in support of the activities described in section 4(b)(3); and</text></paragraph><paragraph id="H75ACBDF3128344268C7A54DCFDCCFC19"><enum>(6)</enum><text>in carrying out this section, take into consideration the recommendations of the advisory committee established under section 6, the results of the workshop convened under section 7, existing reports on related topics, and the views of academic, State, industry, and other appropriate groups.</text></paragraph></subsection><subsection id="HD4B0189129F4421FB74E52E77AA968A1"><enum>(b)</enum><header>Triennial report</header><text display-inline="yes-display-inline">Beginning with fiscal year 2022 and ending in fiscal year 2028, not later than 90 days after submission of the President’s annual budget request and every third fiscal year thereafter, the Interagency Committee shall prepare and submit to the Committee on Science, Space, and Technology of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report that includes—</text><paragraph id="H8A476366F4B94B32ACC89A3B41A5DC41"><enum>(1)</enum><text display-inline="yes-display-inline">a summarized agency budget in support of the Initiative for the fiscal year to which such budget request applies, for the following 2 fiscal years, for the then current fiscal year, including a breakout of spending for each agency participating in the Program, and for the development and acquisition of any research facilities and instrumentation; and</text></paragraph><paragraph id="H9AB60FD1E1DE4A888D4574C642F54D98"><enum>(2)</enum><text>an assessment of how Federal agencies are implementing the plan described in subsection (a)(3), including—</text><subparagraph id="id3AEFB55CE5D04A72867957EEFB726EFB"><enum>(A)</enum><text>a description of the amount and number of awards made under the Small Business Innovation Research Program and the Small Business Technology Transfer Program (as described in section 9 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/638">15 U.S.C. 638</external-xref>)) in support of the Initiative;</text></subparagraph><subparagraph id="ida202c37679294c7ea6eca035bb0edaf8"><enum>(B)</enum><text>a description of the amount and number of projects funded under joint solicitations by a collaboration of no fewer than 2 agencies participating in the Initiative; and</text></subparagraph><subparagraph id="id359D425BCC0C4BD0865BF968A7E8A6A1"><enum>(C)</enum><text>a description of the effect of the newly funded projects by the Initiative.</text></subparagraph></paragraph></subsection><subsection id="H117AFD80EC62422593E4D6364829232E"><enum>(c)</enum><header>Initiative office</header><paragraph display-inline="no-display-inline" id="HA573E8C5867E4F0281670FB7EE2175B6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The President shall establish an Initiative Coordination Office, with a Director and full-time staff, which shall—</text><subparagraph id="H1B237E77F0D24C5092AF4C17D32A925F"><enum>(A)</enum><text>provide technical and administrative support to the interagency committee and the advisory committee established under section 6;</text></subparagraph><subparagraph id="H53C5F83EE9AE4044900A051593BB4675"><enum>(B)</enum><text>serve as the point of contact on Federal engineering biology activities for government organizations, academia, industry, professional societies, State governments, interested citizen groups, and others to exchange technical and programmatic information;</text></subparagraph><subparagraph id="H784A159EAF074854936E645B34C5B2CC"><enum>(C)</enum><text>oversee interagency coordination of the Initiative, including by encouraging and supporting joint agency solicitation and selection of applications for funding of activities under the Initiative, as appropriate;</text></subparagraph><subparagraph id="H2EBC7761135B4F79AA6E3269938A019D"><enum>(D)</enum><text display-inline="yes-display-inline">conduct public outreach, including dissemination of findings and recommendations of the advisory committee established under section 6, as appropriate; </text></subparagraph><subparagraph id="id04b347aa30614267a345debf743664a6"><enum>(E)</enum><text>serve as the coordinator of ethical, legal, environmental, safety, security, and other appropriate societal input; and </text></subparagraph><subparagraph id="HE25690FFD186428FBB9BC563563E0FCD"><enum>(F)</enum><text>promote access to, and early application of, the technologies, innovations, and expertise derived from Initiative activities to agency missions and systems across the Federal Government, and to United States industry, including startup companies.</text></subparagraph></paragraph><paragraph id="id29234df67bcc4cfaaf0928d165659213"><enum>(2)</enum><header>Funding</header><text>The Director of the Office of Science and Technology Policy, in coordination with each participating Federal department and agency, as appropriate, shall develop and annually update an estimate of the funds necessary to carry out the activities of the Initiative Coordination Office and submit such estimate with an agreed summary of contributions from each agency to Congress as part of the President’s annual budget request to Congress. </text></paragraph><paragraph id="HC12810E4DAB442318E002964DC630103"><enum>(3)</enum><header>Termination</header><text>The Initiative Coordination Office established under this subsection shall terminate on the date that is 10 years after the date of the enactment of this Act.</text></paragraph></subsection><subsection id="idcc986e049a9a46c6b277d32303b5f0e1"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to alter the policies, processes, or practices of individual Federal agencies in effect on the day before the date of the enactment of this Act relating to the conduct of biomedical research and advanced development, including the solicitation and review of extramural research proposals. </text></subsection></section><section id="HBADDC38FC2F94B90B759FFDA152A056A"><enum>6.</enum><header>Advisory committee</header><subsection id="H327CDF441F6A401181DC17ADFD438B28"><enum>(a)</enum><header>In general</header><text>The agency co-chair of the interagency committee established in section 5 shall, in consultation with the Office of Science and Technology Policy, designate or establish an advisory committee on engineering biology research and development (in this section referred to as the <quote>advisory committee</quote>) to be composed of not fewer than 12 members, including representatives of research and academic institutions, industry, and nongovernmental entities, who are qualified to provide advice on the Initiative.</text></subsection><subsection id="H46FC99E451684CCCAC8A1284D5BC0343"><enum>(b)</enum><header>Assessment</header><text>The advisory committee shall assess—</text><paragraph id="HD692E6683FD3470FB8FC83187F0AC095"><enum>(1)</enum><text>the current state of United States competitiveness in engineering biology, including the scope and scale of United States investments in engineering biology research and development in the international context;</text></paragraph><paragraph id="H53E3B7DEDD9C43A7AAEA958EB5B23687"><enum>(2)</enum><text>current market barriers to commercialization of engineering biology products, processes, and tools in the United States;</text></paragraph><paragraph id="HFCFC33D3EA8E4EC08C15F731CD6D3002"><enum>(3)</enum><text display-inline="yes-display-inline">progress made in implementing the Initiative;</text></paragraph><paragraph id="H1706CE22E00D45998ECD7B98F562938C"><enum>(4)</enum><text display-inline="yes-display-inline">the need to revise the Initiative;</text></paragraph><paragraph id="H20D11CD74CB64008BA4AFA6AC0A15055"><enum>(5)</enum><text display-inline="yes-display-inline">the balance of activities and funding across the Initiative;</text></paragraph><paragraph id="H261DE1FF66A641649D57DF7ED4243160"><enum>(6)</enum><text>whether the strategic plan developed or updated by the interagency committee established under section 5 is helping to maintain United States leadership in engineering biology;</text></paragraph><paragraph id="HFF31082C0E3D49FAB0C415E66E5D2C21"><enum>(7)</enum><text display-inline="yes-display-inline">the management, coordination, implementation, and activities of the Initiative; and</text></paragraph><paragraph id="H8FEA0A181CEA438DAD466B2AA62BD72F"><enum>(8)</enum><text display-inline="yes-display-inline">whether ethical, legal, environmental, safety, security, and other appropriate societal issues are adequately addressed by the Initiative.</text></paragraph></subsection><subsection id="H955CD4AC7C9543CE9C885E34363BA96E"><enum>(c)</enum><header>Reports</header><text>Beginning not later than 2 years after the date of enactment of this Act, and not less frequently than once every 3 years thereafter, the advisory committee shall submit to the President, the Committee on Science, Space, and Technology of the House of Representatives, and the Committee on Commerce, Science, and Transportation of the Senate, a report on—</text><paragraph id="H7F711CCD0CED4578A19ECE21D819EF28"><enum>(1)</enum><text>the findings of the advisory committee’s assessment under subsection (b); and</text></paragraph><paragraph id="H72FF87494AEE45F0A703C385F68359AD"><enum>(2)</enum><text display-inline="yes-display-inline">the advisory committee’s recommendations for ways to improve the Initiative.</text></paragraph></subsection><subsection id="H42A764E584E64D148329D6467952611B"><enum>(d)</enum><header>Application of Federal Advisory Committee Act</header><text>Section 14 of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Advisory Committee.</text></subsection><subsection id="id6E62D2C4865849518B85DD05DBEDD79C"><enum>(e)</enum><header>Termination</header><text>The advisory committee established under subsection (a) shall terminate on the date that is 10 years after the date of the enactment of this Act. </text></subsection></section><section id="HFA74CE948E614FA78604363ED80613E1"><enum>7.</enum><header>External review of ethical, legal, environmental, safety, security, and societal issues</header><subsection id="H05885BEA8F25478A9CD86F4FBC5A1AF3"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, the Director of the National Science Foundation shall seek to enter into an agreement with the National Academies of Sciences, Engineering, and Medicine to conduct a review, and make recommendations with respect to, the ethical, legal, environmental, safety, security, and other appropriate societal issues related to engineering biology research and development. The review shall include—</text><paragraph id="HA248BEA91C4C48108BBB86C28579B4F6"><enum>(1)</enum><text display-inline="yes-display-inline">an assessment of the current research on such issues;</text></paragraph><paragraph id="HBCA4FF1A9C5F422CAD3680A8D9C1D85E"><enum>(2)</enum><text display-inline="yes-display-inline">a description of the research gaps relating to such issues;</text></paragraph><paragraph id="HD3355293688C4037AD45EA9680598180"><enum>(3)</enum><text display-inline="yes-display-inline">recommendations on how the Initiative can address the research needs identified pursuant to paragraph (2); and</text></paragraph><paragraph id="HD6F399A402F64ABCA914E5ED04F97CF7"><enum>(4)</enum><text display-inline="yes-display-inline">recommendations on how researchers engaged in engineering biology can best incorporate considerations of ethical, legal, environmental, safety, security, and other societal issues into the development of research proposals and the conduct of research. </text></paragraph></subsection><subsection id="H3EEC34BD34C24A1BBCAC15032AEE1B87"><enum>(b)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">The agreement entered into under subsection (a) shall require the National Academies of Sciences, Engineering, and Medicine to, not later than 2 years after the date of the enactment of this Act—</text><paragraph id="H734761BD4CDD4C30B21B9B8129A8EC18"><enum>(1)</enum><text>submit to the Committee on Science, Space, and Technology of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate a report containing the findings and recommendations of the review conducted under subsection (a); and</text></paragraph><paragraph id="H4C02F8A3B5F94A488A8B50C4E851125F"><enum>(2)</enum><text display-inline="yes-display-inline">make a copy of such report available on a publicly accessible website.</text></paragraph></subsection></section><section id="H1B926FA33B6E432DA52212BB42DD75E3"><enum>8.</enum><header>Agency activities</header><subsection id="H2217E41069084C31AD0027D3DE9D886F"><enum>(a)</enum><header>National Science Foundation</header><text display-inline="yes-display-inline">As part of the Initiative, the National Science Foundation shall—</text><paragraph id="HFC4370BF649848D79B61023CBA4E88F3"><enum>(1)</enum><text>support basic research in engineering biology through individual grants, collaborative grants, and through interdisciplinary research centers;</text></paragraph><paragraph id="H0018F06A0F4644128CEC2AD46A175716"><enum>(2)</enum><text>support research on the environmental, legal, ethical, and social implications of engineering biology;</text></paragraph><paragraph id="H3EE637F107A941DBBC269317ABC07079"><enum>(3)</enum><text display-inline="yes-display-inline">provide support for research instrumentation for engineering biology disciplines, including support for research, development, optimization and validation of novel technologies to enable the dynamic study of molecular processes in situ;</text></paragraph><paragraph id="HB820B1EA9C8B461E9D93DDCB03306781"><enum>(4)</enum><text display-inline="yes-display-inline">support curriculum development and research experiences for secondary, undergraduate, and graduate students in engineering biology and biomanufacturing; and</text></paragraph><paragraph id="H9451453ECD4B40358EDCBDDB22968FE3"><enum>(5)</enum><text>award grants, on a competitive basis, to enable institutions to support graduate students and postdoctoral fellows who perform some of their engineering biology research in an industry setting.</text></paragraph></subsection><subsection id="HD658986B380E47B086284739FCEB3ECF"><enum>(b)</enum><header>Department of Commerce</header><text display-inline="yes-display-inline">As part of the Initiative, the Director of the National Institute of Standards and Technology shall—</text><paragraph id="H9585F468102648169A98C7C58988CEB4"><enum>(1)</enum><text>establish a bioscience research program to advance the development of standard reference materials and measurements and to create new data tools, techniques, and processes necessary to advance engineering biology and biomanufacturing;</text></paragraph><paragraph id="HA70128ED07B94E53B3AEA2CE851796E4"><enum>(2)</enum><text>provide access to user facilities with advanced or unique equipment, services, materials, and other resources to industry, institutions of higher education, nonprofit organizations, and government agencies to perform research and testing; and</text></paragraph><paragraph id="H5BEF8CDF4C5245FB8CC6C4418BF3BE80"><enum>(3)</enum><text>provide technical expertise to inform the potential development of guidelines or safeguards for new products, processes, and systems of engineering biology.</text></paragraph></subsection><subsection id="H2516BD1B046B4563B90D2E35B825A77C"><enum>(c)</enum><header>Department of Energy</header><text display-inline="yes-display-inline">As part of the Initiative, the Secretary of Energy shall—</text><paragraph id="H7435F25528474F66BB578D0390885819"><enum>(1)</enum><text>conduct and support research, development, demonstration, and commercial application activities in engineering biology, including in the areas of synthetic biology, advanced biofuel development, biobased materials, and environmental remediation;</text></paragraph><paragraph id="H52CFD3969757462FB39E8FC2B74BD8CB"><enum>(2)</enum><text display-inline="yes-display-inline">support the development, optimization and validation of novel, scalable tools and technologies to enable the dynamic study of molecular processes in situ; and</text></paragraph><paragraph id="H9268DD5086A84373A41443D86CE81185"><enum>(3)</enum><text>provide access to user facilities with advanced or unique equipment, services, materials, and other resources, including secure access to high-performance computing, as appropriate, to industry, institutions of higher education, nonprofit organizations, and government agencies to perform research and testing.</text></paragraph></subsection><subsection id="ida66dc1593dcc4429b183c87fcd8f5765"><enum>(d)</enum><header>Department of Defense</header><text>As part of the Initiative, the Secretary of Defense shall—</text><paragraph id="id80b17e3c5e78436481399f9f19242a98"><enum>(1)</enum><text>conduct and support research and development in engineering biology and associated data and information sciences;</text></paragraph><paragraph id="id8ea3b8507e5641b1882e9f8ea77e7e73"><enum>(2)</enum><text>support curriculum development and research experiences in engineering biology and associated data and information sciences across the military education system, to include service academies, professional military education, and military graduate education; and</text></paragraph><paragraph id="ide5e1042aa27e44748a1d28cac28e89fa"><enum>(3)</enum><text>assess risks of potential national security and economic security threats relating to engineering biology. </text></paragraph></subsection><subsection id="H9A9B6DC4E1364022BCBFFE35B808E362"><enum>(e)</enum><header>National Aeronautics and Space Administration</header><text display-inline="yes-display-inline">As part of the Initiative, the National Aeronautics and Space Administration shall—</text><paragraph id="HA19CD844217944D194936D562E25653E"><enum>(1)</enum><text>conduct and support basic and applied research in engineering biology, including in synthetic biology, and related to Earth and space sciences, aeronautics, space technology, and space exploration and experimentation, consistent with the priorities established in the National Academies’ decadal surveys; and</text></paragraph><paragraph id="HA67209A30B0842658A9187C987034898"><enum>(2)</enum><text>award grants, on a competitive basis, that enable institutions to support graduate students and postdoctoral fellows who perform some of their engineering biology research in an industry setting.</text></paragraph></subsection><subsection id="ided4f5dae171640f8ac79a632edd9547b"><enum>(f)</enum><header>Department of Agriculture</header><text>As part of the Initiative, the Secretary of Agriculture shall—</text><paragraph id="id35c9bb12f6a64b76b4700e4c30188af0"><enum>(1)</enum><text>support research and development in engineering biology, including in synthetic biology and biomaterials;</text></paragraph><paragraph id="idec8546909fee4dedac1d031917e2c528"><enum>(2)</enum><text>award grants through the National Institute of Food and Agriculture; and</text></paragraph><paragraph id="id7410e13407264d4387cf8ec7e4522a74"><enum>(3)</enum><text>support development conducted by the Agricultural Research Service. </text></paragraph></subsection><subsection id="HA35FECA59EF147A997852FC3CA96A265"><enum>(g)</enum><header>Environmental Protection Agency</header><text display-inline="yes-display-inline">As part of the Initiative, the Environmental Protection Agency shall support research on how products, processes, and systems of engineering biology will affect or can protect the environment.</text></subsection><subsection id="idc9861f8b57d148dba9529f2b47ca4b46"><enum>(h)</enum><header>Department of Health and Human Services</header><text>As part of the Initiative, the Secretary of Health and Human Services, as appropriate and consistent with activities of the Department of Health and Human Services in effect on the day before the date of the enactment of this Act, shall— </text><paragraph id="id467f3b735bf64fbca06a43eb6f2a1661"><enum>(1)</enum><text>support research and development to advance the understanding and application of engineering biology for human health;</text></paragraph><paragraph id="idb74702fc372a4ecd902891969163366a"><enum>(2)</enum><text>support relevant interdisciplinary research and coordination; and</text></paragraph><paragraph id="idc7e6b671b59242a69f0fb78e89a13802"><enum>(3)</enum><text>support activities necessary to facilitate oversight of relevant emerging biotechnologies.</text></paragraph></subsection></section><section id="id64cef061b04643a49196d8b5d6baddd1"><enum>9.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act shall be construed to require public disclosure of information that is exempt from mandatory disclosure under section 552 of title 5, United States Code.</text></section></legis-body></bill>
