<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1417</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210428">April 28, 2021</action-date><action-desc><sponsor name-id="S355">Mr. Cruz</sponsor> (for himself and <cosponsor name-id="S350">Mr. Rubio</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish a Venezuela Reconstruction Fund, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preserving Accountability for National Assets Act of 2021</short-title></quote> or the <quote><short-title>PANA Act </short-title></quote>.</text></section><section id="id2f409fd9732d4fbea2792ea926fec548"><enum>2.</enum><header>Venezuela Restoration Fund</header><subsection id="id539c597b45324298914f190b2a965299"><enum>(a)</enum><header>Establishment</header><text>There is established in the United States Treasury a fund, to be known as the <quote>Venezuela Restoration Fund</quote>, which shall consist of amounts deposited in the Fund under subsection (c).</text></subsection><subsection id="idc4889c069a2e4e6a8764ae7e07e6aa17"><enum>(b)</enum><header>Uses</header><text>Amounts in the Fund—</text><paragraph id="idc70b7e31801647cc82ac986906dda12d"><enum>(1)</enum><text>shall be available to the Secretary of State only for the purposes described in paragraph (2), without fiscal year limitation or need for subsequent appropriation; </text></paragraph><paragraph id="id0aeeb678971c4355be88c66e4d7db3fc"><enum>(2)</enum><text>shall be used only for the purposes of—</text><subparagraph id="id9033ea90fde64664bb6d1734bfb1740d"><enum>(A)</enum><text>strengthening democratic governance and institutions, including the democratically elected National Assembly of Venezuela;</text></subparagraph><subparagraph id="idbfdf157bb3cd4e0ab036715ba8703fba"><enum>(B)</enum><text>defending internationally recognized human rights for the people of Venezuela, including support for efforts to document crimes against humanity and violations of human rights;</text></subparagraph><subparagraph id="id588f975b3a5446fc8d068ecc9f0e30ee"><enum>(C)</enum><text>supporting the efforts of independent media outlets to broadcast, distribute, and share information beyond the limited channels made available by the Maduro regime; and</text></subparagraph><subparagraph id="id6aaa2b2088e04f81bca5f9d67421b278"><enum>(D)</enum><text>combatting corruption and improving the transparency and accountability of institutions that are part of the Maduro regime; </text></subparagraph></paragraph><paragraph id="idb5a810969f9d49478e09f59624b93722"><enum>(3)</enum><text>may support governmental and nongovernmental parties in advancing the purposes described in paragraph (2); and</text></paragraph><paragraph id="id51fc0b8c2e074153852f150bb447f395"><enum>(4)</enum><text>shall be allocated in a manner complementary to existing United States foreign assistance, diplomacy, and anti-corruption activities.</text></paragraph></subsection><subsection id="ida2807891addb45cfa17349d91c8bfce7"><enum>(c)</enum><header>Funding</header><text>Beginning on or after the date of the enactment of this Act, notwithstanding any other provision of law, in the case of any funds or assets forfeited to the United States by an individual or entity connected to the regimes of Hugo Chávez and Nicolás Maduro in Venezuela, the funds or assets will be deposited in the Venezuela Reconstruction Fund established under subsection (a).</text></subsection><subsection id="id124203a267094c19be1c8ca223256fea"><enum>(d)</enum><header>Reporting</header><text>Not later than 1 year after the date of the enactment of this Act and not less frequently than annually thereafter, the Secretary of State shall submit a report to the appropriate congressional committees that includes—</text><paragraph id="idcd0b79c6ffb04a15b3798ce4be727e80"><enum>(1)</enum><text>an accounting of the amount and sources of funds that have been deposited into the Venezuela Restoration Fund; and</text></paragraph><paragraph id="idfd16033d1cba4d11893407dec5d9f2a3"><enum>(2)</enum><text>a summary of the obligation, amounts, and expenditure of such funds.</text></paragraph></subsection></section></legis-body></bill>
