which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 49, United States Code, to require the Secretary of Transportation to establish a motor vehicle recall assistance program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H2A97A54E26E64176AE66C7047094A9D2"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Auto Recalls Toward Safety Act of 2021</short-title></quote> or the <quote><short-title>PARTS Act of 2021</short-title></quote>.</text></section><section id="idB664867650344390BFD5B2214D83E45E"><enum>2.</enum><header>Motor vehicle recall assistance program</header><subsection id="id5d358eb4182a45d28a42a1fe625c1349"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/301">chapter 301</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="ida957e1e9924344949aeff2756f76cf16"><section section-type="subsequent-section" id="idf2acad1ce2e44480bbc9dbb18cfb43cd"><enum>30129.</enum><header>Motor vehicle recall assistance program</header><subsection id="id27f6e526c25b444b8edbdb1b425e6ef5"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idec9ba8ff938047c6a78686b52807a7c5"><enum>(1)</enum><header>Open recall</header><text>The term <term>open recall</term> means a motor vehicle recall—</text><subparagraph id="id3A9C42F7BF754B308DCC39025E31297A"><enum>(A)</enum><text>for which a notification by a manufacturer has been provided under section 30119; and</text></subparagraph><subparagraph id="id66B35E17D09C4D08B9EFE187B3DF48EB"><enum>(B)</enum><text>that has not been remedied under section 30120.</text></subparagraph></paragraph><paragraph id="idfad9867c3e95450f97e9e151ba7b061b"><enum>(2)</enum><header>Registration</header><text>The term <term>registration</term> means the process for registering a motor vehicle in a State (including registration renewal).</text></paragraph><paragraph id="id48D1D628A11F4E2AAF69288A7C90A251"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph></subsection><subsection id="id10a0cdfe741548e68e83d2709f87b145"><enum>(b)</enum><header>Program</header><paragraph id="id60BAD08BD695413181AB73A9850FB4AA"><enum>(1)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this section, the Secretary shall establish a program under which the Secretary shall provide grants and other assistance, including technical assistance, to States in informing owners and lessees of a motor vehicle about open recalls on the motor vehicle at the time of registration of the motor vehicle in the State.</text></paragraph><paragraph id="ide1a001748d6d4e35822566abe67c0f62"><enum>(2)</enum><header>Eligibility</header><text>To be eligible to receive assistance under this subsection, a State shall— </text><subparagraph id="id920AB8DDF17A492FAFFA9504424C3144"><enum>(A)</enum><text>submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require; and</text></subparagraph><subparagraph id="idDFD6A8AE4C724D62A851CBFABAA25089"><enum>(B)</enum><text>agree—</text><clause id="id203D4C5AD4C34240A5B7A2C5B2652E35"><enum>(i)</enum><text>to notify each owner or lessee of a motor vehicle presented for registration in the State of any open recall on that motor vehicle; and </text></clause><clause id="idC069F18195034BE98DA371492EFCE948"><enum>(ii)</enum><text>to provide to each owner or lessee of the motor vehicle presented for registration—</text><subclause id="id7A0A410AC60340FD8BE8E4E66D23B2E0"><enum>(I)</enum><text>the open recall information for the motor vehicle at no cost; and</text></subclause><subclause id="idD1347C47A0EE4431A8D25EB5497646A9"><enum>(II)</enum><text>such other information as the Secretary may require.</text></subclause></clause></subparagraph></paragraph><paragraph id="id6f3ad6eff4554b0c845bcf6af458c60d"><enum>(3)</enum><header>Factors for consideration</header><text>In selecting recipients for assistance under this subsection, the Secretary shall take into consideration the methodology of a State for—</text><subparagraph id="id64a0e034371647efa2b20e95423c1e22"><enum>(A)</enum><text>identifying open recalls on a motor vehicle;</text></subparagraph><subparagraph id="ide7d155f8adc64a67a7228668e3bb3e4c"><enum>(B)</enum><text>informing the owner or lessee of a motor vehicle of an open recall; and</text></subparagraph><subparagraph id="idc3d30350cc4e497ab90cc25d53bdb23c"><enum>(C)</enum><text>measuring performance in—</text><clause id="id98AD836A487D4F62B29B135DD718D893"><enum>(i)</enum><text>informing owners and lessees about open recalls; and</text></clause><clause id="id10FBB4E2FE4A43FF8C56CA70ED723D5D"><enum>(ii)</enum><text>remedying open recalls. </text></clause></subparagraph></paragraph><paragraph id="id8F3AFDB5F4BB4AC4A60454B61068470C"><enum>(4)</enum><header>Grants</header><subparagraph id="id899A9FB761E847339711BE542D658DAE"><enum>(A)</enum><header>Limitation</header><text>A State may receive not more than 1 grant under this subsection.</text></subparagraph><subparagraph id="idc4b1cf45a1bf4e55a7bebbe064e76978"><enum>(B)</enum><header>Performance period</header><text>A grant provided under this subsection shall require a performance period of 2 years. </text></subparagraph></paragraph><paragraph id="idd5832eb7c7a741899588e13960b52263"><enum>(5)</enum><header>Report to the Secretary</header><text>Not later than 90 days after the date of completion of the performance period under paragraph (4)(B), each State that receives a grant under this subsection shall submit to the Secretary a performance report that contains such information as the Secretary considers to be necessary—</text><subparagraph id="id63B986A2379440E991AAB3AC83B4B73B"><enum>(A)</enum><text>to evaluate the extent to which open recalls have been remedied in the State; and</text></subparagraph><subparagraph id="idF5F7CF3EC3F64246BF13210647D04B58"><enum>(B)</enum><text>to enable a comparison of—</text><clause id="idF19A9BF66CFA40A9A0B4438AAF4288E0"><enum>(i)</enum><text>recall completion under this subsection; and</text></clause><clause id="id8EE03E3286A14E13BAD55F4E98D95F24"><enum>(ii)</enum><text>existing recall completion data.</text></clause></subparagraph></paragraph><paragraph id="id91004ab7cfd2440590a66072acfe9d2e"><enum>(6)</enum><header>Evaluation and report to Congress</header><text>Not later than 180 days after the date on which the Secretary receives from a State a performance report under paragraph (5), the Secretary shall—</text><subparagraph id="id7817F6DE28F14BB2A9E81EBDE12664A9"><enum>(A)</enum><text>evaluate the extent to which open recalls have been remedied in the State; and </text></subparagraph><subparagraph id="id15F6AEC3D84149E0B37DC92E2A5FC73B"><enum>(B)</enum><text>submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives and make publicly available a report describing the results of the evaluation under subparagraph (A).</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id533CF037D18F4C939175DA3EBB53B445"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/301">chapter 301</external-xref> of title 49, United States Code, is amended by striking the item relating to section 30128 and inserting the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="id7D1FB5EF3EF541F2862F18BD39A5BB84"><toc><toc-entry bold="off" level="section">30128. Vehicle rollover prevention and crash mitigation.</toc-entry><toc-entry bold="off" level="section">30129. Motor vehicle recall assistance program.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id08C52C38299D4EE58F9469DFD133D73B"><enum>3.</enum><header>Recall completion reports and scorecard</header><subsection id="id4153DAD1371C4D0CA0EEF05E1C97DFD7"><enum>(a)</enum><header>Reports on notification campaigns</header><text display-inline="yes-display-inline">Section 30118 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idF5FFAEA2CA1C406EA22A638D064ED52B"><subsection id="id5b6e9ef0ee5848b680cd529d7c5a2a04"><enum>(f)</enum><header>Reports on notification campaigns</header><paragraph id="idB802417554FD47A5BDD1F8B10C699C3E"><enum>(1)</enum><header>In general</header><text>Each manufacturer that is conducting a campaign under subsection (b) or (c), or any other law (including regulations), to notify manufacturers, distributors, owners, purchasers, or dealers of a defect or noncompliance shall submit to the Administrator of the National Highway Traffic Safety Administration—</text><subparagraph id="id7D09C7B7B30747CE83D724791DDB7015"><enum>(A)</enum><text>by the applicable date described in section 573.7(d) of title 49, Code of Federal Regulations (or a successor regulation), a quarterly report on the campaign for each of 8 consecutive quarters, beginning with the quarter in which the campaign was initiated; and</text></subparagraph><subparagraph id="id0D2D7E67419E4BFA8C5A708AD714497B"><enum>(B)</enum><text>an annual report for each of the 3 years following completion of the last quarter for which a quarterly report is submitted under subparagraph (A).</text></subparagraph></paragraph><paragraph id="idF9E288637AD04561A893E611B4EFA9D7"><enum>(2)</enum><header>Requirements</header><text>Except as otherwise provided in this subsection, each report under this subsection shall comply with the requirements of section 573.7 of title 49, Code of Federal Regulations (or a successor regulation).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id74FE3C1796DC4298B13D4A3DDADB89AE"><enum>(b)</enum><header>Scorecard and notification to owners and lessees of unremedied vehicles</header><text>Section 30120 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id7C62450F4BC64512B3771ECB1F76F17A"><subsection id="id68deb016bb654358846f72b384d7eaea"><enum>(k)</enum><header>Recall remedy scorecard</header><paragraph id="idD26445F1D6284DDC835D5C9C36D66CB9"><enum>(1)</enum><header>In general</header><text>The Administrator of the National Highway Traffic Safety Administration shall publish an annual scorecard of recall completion rates for each manufacturer submitting a report under section 30118(f) during the year covered by the scorecard.</text></paragraph><paragraph id="id0457ABCE13974F678EEDD9E4862E4DA1"><enum>(2)</enum><header>Requirement</header><text>The annual scorecard under paragraph (1) shall include—</text><subparagraph id="idC5A88957676C47DBAACD7479696B4287"><enum>(A)</enum><text>for each manufacturer submitting a report under section 30118(f) during the year covered by the scorecard—</text><clause id="idD28611C8B71141219CF43E86589897CD"><enum>(i)</enum><text>the total number of—</text><subclause id="id5D9658582A5742ED9F0DD67671D80BC5"><enum>(I)</enum><text>recalls issued by the manufacturer during the year covered by the scorecard; and</text></subclause><subclause id="id10E27ECBFD824CD5B1B8185FDFC6A5C5"><enum>(II)</enum><text>vehicles of the manufacturer subject to a recall during the year covered by the scorecard; and</text></subclause></clause><clause id="id11D10B1D716545FEB45C9D33209D2E6E"><enum>(ii)</enum><text>the percentage of vehicles of the manufacturer that—</text><subclause id="id9EAE65ED76A64D018606CBCDAFF8B711"><enum>(I)</enum><text>were subject to a recall at any time during the year covered by the scorecard; and</text></subclause><subclause id="id51D4C9A0F03C4C959E604C9E93CB908E"><enum>(II)</enum><text>have been remedied under this section; and</text></subclause></clause></subparagraph><subparagraph id="id8FF52052024A40A09B9DA8C0635DB298"><enum>(B)</enum><text>for each campaign that is the subject of a report submitted under section 30118(f) during the year covered by the scorecard—</text><clause id="id720E9B9CE6014BEC9FC3F9DD5B3CA858"><enum>(i)</enum><text>the total number of recalls issued by the manufacturer pursuant to the campaign—</text><subclause id="id6B19FCC6EFBA41A0B37F58BE4462FB5F"><enum>(I)</enum><text>during the year covered by the scorecard; and</text></subclause><subclause id="id8178703DF5DA48839EC78B06CEE57664"><enum>(II)</enum><text>since the date on which the campaign was initiated;</text></subclause></clause><clause id="id2D120969230E47B5B2BE243EB1EC79DF"><enum>(ii)</enum><text>the total number of vehicles of the manufacturer subject to the campaign—</text><subclause id="idCA21CB88879745FC827DECAEE8B19B89"><enum>(I)</enum><text>during the year covered by the scorecard; and</text></subclause><subclause id="id84137DAA5F134BF1821FC0919BBCE333"><enum>(II)</enum><text>since the date on which the campaign was initiated; and</text></subclause></clause><clause id="idDE2DA56D4F1B488ABD2117946513485B"><enum>(iii)</enum><text>the percentage of vehicles subject to the campaign that have been remedied under this section—</text><subclause id="id0F7503A0699B491AA73483D4447D681A"><enum>(I)</enum><text>during the year covered by the scorecard; and</text></subclause><subclause id="idE0A24D260D4F40BF817EED580112DACE"><enum>(II)</enum><text>since the date on which the campaign was initiated.</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
