which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Energy Policy and Conservation Act to reinstate the ban on the export of crude oil and natural gas produced in the United States, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Block All New Oil Exports Act</short-title></quote> or the <quote><short-title>BAN Oil Exports Act</short-title></quote>.</text></section><section id="id7D0B5A4B7A5449DD8CCA3CCA811622F8"><enum>2.</enum><header>Domestic use of energy supplies and related materials and equipment</header><subsection id="id85B537C0DE87409C97CEC4E389326877"><enum>(a)</enum><header>In general</header><text>The Energy Policy and Conservation Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6201">42 U.S.C. 6201</external-xref> et seq.) is amended by inserting after section 101 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBC95D665043F4C72925D30991F50C234"><section id="id29AA0764516B491691F3ABD0342DA7A9"><enum>103.</enum><header>Domestic use of energy supplies and related materials and equipment</header><subsection id="ide6f7865436de4cefa395c63813ae85fe"><enum>(a)</enum><header>Export restrictions</header><text>The President, by rule, under such terms and conditions as the President determines to be appropriate and necessary to carry out the purposes of this Act, may restrict exports of—</text><paragraph id="id46aaa825230d49a3ae304d7b7d939df8"><enum>(1)</enum><text>coal, petroleum products, natural gas, or petrochemical feedstocks; and</text></paragraph><paragraph id="id64e9fc39d24e48ca87c7e665a3262495"><enum>(2)</enum><text>supplies of materials or equipment that the President determines to be necessary—</text><subparagraph id="idE44DB3ABA649453C8FCCB9332A1CF5B7"><enum>(A)</enum><text>to maintain or further exploration, production, refining, or transportation of energy supplies; or</text></subparagraph><subparagraph id="idE1014C89FDAF49E1B35E4FA9A5D7247D"><enum>(B)</enum><text>for the construction or maintenance of energy facilities within the United States.</text></subparagraph></paragraph></subsection><subsection id="id2dec45ae795a4bdaa6079673624efd9f"><enum>(b)</enum><header>Prohibition of export of crude oil and natural gas</header><paragraph id="id214267cc4e1a441c89977d8e625ac50e"><enum>(1)</enum><header>Rule</header><text>Subject to paragraph (2), the President shall exercise the authority provided under subsection (a) to promulgate a rule prohibiting the export of crude oil and natural gas produced in the United States.</text></paragraph><paragraph id="id0709918A96304C0DAC112066ACCF59E2"><enum>(2)</enum><header>Exemptions</header><subparagraph id="id98C46CB1995148A499C04B04C2C330D6"><enum>(A)</enum><header>In general</header><text>In accordance with subparagraph (A), the President may exempt from a prohibition on the export of crude oil and natural gas under paragraph (1) any crude oil or natural gas exports that the President determines to be consistent with—</text><clause id="idD6A1055D004B44F881DA7F97E5A833EB"><enum>(i)</enum><text>the national interest; and</text></clause><clause id="id1467CEBED39641FBA8FFB71A9F943A04"><enum>(ii)</enum><text>the purposes of this Act.</text></clause></subparagraph><subparagraph id="id787cd1571f7542a1afdd8b461820fa1e"><enum>(B)</enum><header>Requirements</header><text>An exemption from a rule prohibiting crude oil or natural gas exports under paragraph (1)—</text><clause id="idEE3419F1A7BD47DE9B5B8E145E751279"><enum>(i)</enum><text>shall be—</text><subclause id="id3A294F42476842A99E5E0C2547EE64A4"><enum>(I)</enum><text>included in the rule; or</text></subclause><subclause id="idF9A3469C255941EB8399CDC9D54E24E1"><enum>(II)</enum><text>provided for in an amendment to the rule; and</text></subclause></clause><clause id="id4F0B4B3BBB5646859DE16DFBA1361103"><enum>(ii)</enum><text>may be based on—</text><subclause id="idDC29BFBD59F148978FDE115CFB1FF0D5"><enum>(I)</enum><text>the purpose for export;</text></subclause><subclause id="idC7D040E1A6954E0BA3C1E3F071D7E57C"><enum>(II)</enum><text>the class of seller or purchaser;</text></subclause><subclause id="id941BAADD0FCF4FE599C3A9CD69050B2D"><enum>(III)</enum><text>the country of destination; or</text></subclause><subclause id="id4B7B258354A14F87BEDD70A1538D1A2E"><enum>(IV)</enum><text>any other reasonable classification or basis that the President determines to be—</text><item id="idBC89C414ACD14212B3038BCA0B5B6D55"><enum>(aa)</enum><text>appropriate; and</text></item><item id="id2763FF73C9954622A01FFF59D614EA7E"><enum>(bb)</enum><text>consistent with—</text><subitem id="id16B7DFA11307402496918082EA134854"><enum>(AA)</enum><text>the national interest; and</text></subitem><subitem id="id29391D6A62064A2789D16E7E2DA7B184"><enum>(BB)</enum><text>the purposes of this Act.</text></subitem></item></subclause></clause></subparagraph></paragraph></subsection><subsection id="id1955E7620F6B4C97A878DF489612D162"><enum>(c)</enum><header>Imposition of restrictions</header><paragraph id="id2BA9742C7F1049E7ABB18C4BA1C66447"><enum>(1)</enum><header>In general</header><text>In order to implement any rule promulgated under subsection (a), the President may direct the Secretary of Commerce to impose such restrictions as are specified in the rule on exports of—</text><subparagraph id="id9BA0DA8039EC423390AE90CB58891FF7"><enum>(A)</enum><text>coal, petroleum products, natural gas, or petrochemical feedstocks; and</text></subparagraph><subparagraph id="idB03920C225094331BA56BB4397EC4B03"><enum>(B)</enum><text>supplies of materials and equipment described in paragraph (2) of that subsection.</text></subparagraph></paragraph><paragraph id="id790E096578294F6FBD0F4F261B5BB946"><enum>(2)</enum><header>Procedures</header><text>The Secretary shall impose restrictions under paragraph (1) pursuant to procedures established under the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801</external-xref> et seq.).</text></paragraph></subsection><subsection id="id3e672429f5554e36991138595d321538"><enum>(d)</enum><header>Restrictions and national interest</header><text>Any finding by the President pursuant to subsection (a) or (b) and any action taken by the Secretary of Commerce pursuant to those subsections shall take into account the national interest as related to the need to leave uninterrupted or unimpaired—</text><paragraph id="idc3e20c179b5e41e5a38228c20de5f84b"><enum>(1)</enum><text>exchanges in similar quantity for convenience or increased efficiency of transportation with persons or the government of a foreign state;</text></paragraph><paragraph id="idcd12a149d1f340348dc4441e8c9d78fd"><enum>(2)</enum><text>temporary exports for convenience or increased efficiency of transportation across parts of an adjacent foreign state before reentering the United States; and</text></paragraph><paragraph id="id95a6d95b7bc74555a964ae9c64076f09"><enum>(3)</enum><text>the historical trading relations of the United States with Canada and Mexico.</text></paragraph></subsection><subsection id="idc420e958e524425b9c3493b207107d96"><enum>(e)</enum><header>Waiver of notice and comment period</header><paragraph id="idfd39e8a80b4042d48e8149fd1e61244a"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, shall apply with respect to the promulgation of any rule pursuant to this section.</text></paragraph><paragraph id="id7B23A40B1C584176BD958E4B62533D09"><enum>(2)</enum><header>Waiver</header><subparagraph id="idCCD37323CC58468A86380BFCDB092B11"><enum>(A)</enum><header>In general</header><text>The President may waive with respect to the promulgation of any rule pursuant to this section the notice and comment provisions of subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, only if the President determines that compliance with the requirements may seriously impair the ability of the President to impose effective and timely prohibitions on exports.</text></subparagraph><subparagraph id="idc094c7415b4f4c15857cedea4c192b24"><enum>(B)</enum><header>Opportunity for comment</header><text>If the notice and comment provisions of subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, are waived under subparagraph (A) with respect to a rule promulgated under this section, the President shall provide interested persons an opportunity to comment on the rule as soon as practicable after the date on which the rule is promulgated.</text></subparagraph></paragraph><paragraph id="id19f6f17ac1054c47a2824f2966a1e351"><enum>(3)</enum><header>Enforcement and penalty provisions</header><text>If the President determines to request the Secretary of Commerce to impose specified restrictions pursuant to subsection (c), the enforcement and penalty provisions of the Export Control Reform Act of 2018 (<external-xref legal-doc="usc" parsable-cite="usc/50/4801">50 U.S.C. 4801</external-xref> et seq.) shall apply to any violation of the restrictions.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idAE63AA8976554BECBD4C996D1AD56247"><enum>(b)</enum><header>Clerical and conforming amendments</header><paragraph id="id8FBBCF5D238B47ACA79C2AF11B588A69"><enum>(1)</enum><header>Clerical amendment</header><text>The table of contents for the Energy Policy and Conservation Act (42 U.S.C. prec. 6201) is amended by inserting before the item relating to section 104 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA5B49EF39F1A43B0A1ACF4248ED7F9DA"><toc><toc-entry bold="off" level="section">103. Domestic use of energy supplies and related materials and equipment. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="id8C368C807F5F45089D09CB0C9A7C6971"><enum>(2)</enum><header>Conforming amendment</header><text>Section 101 of division O of the Consolidated Appropriations Act, 2016 (<external-xref legal-doc="usc" parsable-cite="usc/42/6212a">42 U.S.C. 6212a</external-xref>), is amended by striking subsections (b) through (d).</text></paragraph></subsection></section></legis-body></bill>
