<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1413</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210428">April 28, 2021</action-date><action-desc><sponsor name-id="S369">Mr. Markey</sponsor> (for himself and <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Transportation to issue a final rule revising motor vehicle seat back safety standards.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" id="H78F6A2A1ACDF40C8BF023C9B3591B74D"><section section-type="section-one" id="id2002D69D7CE24C9793EB482C1C603A8D"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Modernizing Seat Back Safety Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="S1"><enum>2.</enum><header>Motor vehicle seat back safety standards</header><subsection id="idB391B59FDBB84F7C8BC1A39207DE5FA1"><enum>(a)</enum><header>Findings; purposes</header><paragraph id="id68A2A7E8BE794D40B7B64338DB2C1CA1"><enum>(1)</enum><header>Findings</header><text>Congress finds that—</text><subparagraph id="id82acd1e182ba44c894130c95902631c5"><enum>(A)</enum><text>crashes involving seat structural failures in passenger motor vehicles pose a significant public health and safety threat, particularly to children occupying rear seats;</text></subparagraph><subparagraph id="idf371f33df0e94413aee328b77736ce61"><enum>(B)</enum><text>thousands of preventable fatalities and life-threatening injuries have occurred as a result of motor vehicle seat failures;</text></subparagraph><subparagraph id="idcdd4792cfa634f1faddeb7cc5d953e7b"><enum>(C)</enum><text>the National Highway Traffic Safety Administration has neglected to improve the motor vehicle seat integrity standard for more than 50 years, to the detriment of passenger motor vehicle safety; and</text></subparagraph><subparagraph id="idbc6c7139dc064524a1f07b5a3729d51f"><enum>(D)</enum><text>this Act is introduced in honor and memory of the victims of motor vehicle seat failures in crashes, including those whose precious lives were cut far too short as a result of seat failures and those whose catastrophic injuries dramatically changed their lives, including Taylor Grace Warner, Jayden-Faith Fraser, Emily Reavis, Owen Reavis, Teddy Schwab, Jaklin Romine, Russell Selkirk, Travis Oldhouser, Thomas Comella, Geneva Massie, Crystal Collins, Mary Portis, Dzemila Heco, Aaliyah George, Heikki Helava, and Clyde M. Sneed.</text></subparagraph></paragraph><paragraph id="idF15340EF9A7F4FCF8CD611582AE70F7D"><enum>(2)</enum><header>Purposes</header><text>The purposes of this Act are—</text><subparagraph id="ideaa8cc606b094f78abaa5516d3d39c08"><enum>(A)</enum><text>to reduce the number of preventable deaths and injuries caused by motor vehicle seat failures; and</text></subparagraph><subparagraph id="ided62587731704ea09d61375653959abc"><enum>(B)</enum><text>to improve passenger motor vehicle safety.</text></subparagraph></paragraph></subsection><subsection id="id34F48E4925A047E481163440CB895514"><enum>(b)</enum><header>Final rule</header><text display-inline="yes-display-inline">Not later than 2 years after the date of enactment of this Act, subject to subsection (c), the Secretary of Transportation shall issue a final rule updating section 571.207 of title 49, Code of Federal Regulations, to reduce the potential for injury to all motor vehicle occupants due to seat back failure during all types of vehicle impact.</text></subsection><subsection id="id6aec0178c107433e9fde7cfe4baf5ac6"><enum>(c)</enum><header>Compliance date</header><text>In issuing the final rule pursuant to subsection (b), the Secretary of Transportation shall establish a date for required compliance with the final rule of not later than 2 motor vehicle model years after the model year during which the effective date of the final rule occurs.</text></subsection></section></legis-body></bill>
