which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To designate any alien who is or has been engaged in economic espionage or the misappropriation of trade secrets inadmissible and deportable.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="idA72A1065BCBC44C8A3D43E7702ED2E44"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Theft of Intellectual Property Act of 2021</short-title></quote>.</text></section><section section-type="subsequent-section" id="id80137624D27848E09BA7A0422B20DCE7"><enum>2.</enum><header>Immigration consequences of trade secret theft and economic espionage</header><subsection id="id4DA1A98F4A5948CD825F6BBA7BCBE1A7"><enum>(a)</enum><header>Inadmissibility</header><text display-inline="yes-display-inline">Section 212(a)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)</external-xref>) is amended—</text><paragraph id="id66C7148542394E1FA09BC7488A3FF550"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (A)(i)—</text><subparagraph id="idF8ACE9FBCC2A4B59AA9B4C10065606CD"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>(I) to violate</quote> and inserting <quote>that violates</quote>; and</text></subparagraph><subparagraph id="id7BA0E735D72A418BA8CB18BC7E0012EE"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>or (II)</quote> and all that follows and inserting a semicolon; and</text></subparagraph></paragraph><paragraph id="id70B7C18667A944A29E2076BAF5B53A2E"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2C2CB23DFEB04646A18CED8A553762CC"><subparagraph id="idD623EA2B311C44628534955A22E5F86F"><enum>(H)</enum><header>Theft of sensitive information or trade secrets</header><text>Any alien who a consular officer, the Secretary of Homeland Security, the Secretary of State, or the Attorney General knows, or has reasonable grounds to believe—</text><clause id="id8BF5E9BE0B1E411BBDF7DDE14933F0B2"><enum>(i)</enum><text>has engaged in, is engaging in, or is seeking admission to the United States to engage in any activity that—</text><subclause id="id853B5B98F3E0459C8C8BDAF325CAEE2F"><enum>(I)</enum><text>violates or evades any law prohibiting the export from the United States of goods, technology, or sensitive information; or</text></subclause><subclause id="id086ACD3598744435825EAB48622FF6E6"><enum>(II)</enum><text>violates any law of the United States relating to the theft or misappropriation of trade secrets or economic espionage; or</text></subclause></clause><clause id="id6350916DE58F49DC91FC39C1268DA465"><enum>(ii)</enum><text>has been convicted of conspiracy related to an activity described in clause (i),</text></clause><continuation-text continuation-text-level="subparagraph">is inadmissible.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id7C552047AF2F4FFEAE1B5FC185587C8D"><enum>(b)</enum><header>Deportability</header><text>Section 237(a)(4) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(4)</external-xref>) is amended—</text><paragraph id="id5C0DB0AF91F8447BB288FE8EBC44245E"><enum>(1)</enum><text>in subparagraph (A)(i), by striking <quote>or to violate or evade any law prohibiting the export from the United States of goods, technology, or sensitive information,</quote> and inserting a semicolon; and</text></paragraph><paragraph id="idBD76A5E355FD4A27A0B1B26CD84F0AC2"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id82FF69B77FE34AACA554C12EFB8B3E3D"><subparagraph id="id1F0E3F686FF548F2816281ACE626A137"><enum>(G)</enum><header>Theft of sensitive information or trade secrets</header><text>Any alien who—</text><clause id="idE7CB5C5AF6E34EB98EF15DB20D6AF9AD"><enum>(i)</enum><text>has engaged, is engaged, or at any time after admission engages in any activity that—</text><subclause id="id2F2D6C882D9741528828BDA127F6994F"><enum>(I)</enum><text>violates or evades any law prohibiting the export from the United States of goods, technology, or sensitive information; or</text></subclause><subclause id="id3C688B24FE204068956473D844B1A0D7"><enum>(II)</enum><text>violates any law of the United States relating to the theft or misappropriation of trade secrets or economic espionage; or</text></subclause></clause><clause id="id1A8E93A9D1A143249C990DA10C8BEF89"><enum>(ii)</enum><text>has been convicted of conspiracy related to an activity described in clause (i),</text></clause><continuation-text continuation-text-level="subparagraph">is deportable.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="idEAF4B67434264B24AE3EDFFA1F128924"><enum>3.</enum><header>Annual report of inadmissible and deportable foreign nationals</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Secretary of Homeland Security, in cooperation with the Attorney General, shall submit a report to the Chair and Ranking Member of the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name> and of the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name> that identifies—</text><paragraph id="id06B263CE02434C378E65D849757E26CB"><enum>(1)</enum><text>the nationality and visa admission category of each of the foreign nationals who was determined, during the reporting period, to be inadmissible under section 212(a)(3)(H) of the Immigration and Nationality Act, as added by section 2(a), or deportable pursuant to section 237(a)(4)(G) of such Act, as added by section 2(b); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id477A7A3658684A4F84211C814CEC5B30"><enum>(2)</enum><text>the research institutions, United States private industries, United States Government agencies, and taxpayer-funded organizations with which such foreign nationals were associated. </text></paragraph></section></legis-body></bill>
