<distribution-code display="yes">II</distribution-code><calendar>Calendar No. 2</calendar><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 13</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date>January 6, 2021</action-date><action-desc><sponsor name-id="S365">Mr. Scott of South Carolina</sponsor> (for himself, <cosponsor name-id="S344">Mr. Hoeven</cosponsor>, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, <cosponsor name-id="S374">Mr. Cotton</cosponsor>, <cosponsor name-id="S378">Mr. Lankford</cosponsor>, <cosponsor name-id="S357">Mrs. Fischer</cosponsor>, <cosponsor name-id="S376">Ms. Ernst</cosponsor>, <cosponsor name-id="S383">Mr. Sullivan</cosponsor>, <cosponsor name-id="S372">Mrs. Capito</cosponsor>, <cosponsor name-id="S391">Mr. Young</cosponsor>, <cosponsor name-id="S373">Mr. Cassidy</cosponsor>, <cosponsor name-id="S343">Mr. Boozman</cosponsor>, <cosponsor name-id="S347">Mr. Moran</cosponsor>, and <cosponsor name-id="S381">Mr. Rounds</cosponsor>) introduced the following bill; which was read the first time</action-desc></action><action><action-date>January 19, 2021</action-date><action-desc>Read the second time and placed on the calendar</action-desc></action><legis-type>A BILL</legis-type><official-title>To establish an advisory committee to make recommendations on improvements to the security, integrity, and administration of Federal elections. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>2020 Bipartisan Advisory Committee</header><subsection id="idd494b9fa76b3431c810af21c3a928a17"><enum>(a)</enum><header>Establishment</header><text>There is established within the Election Assistance Commission the 2020 Bipartisan Advisory Committee (referred to in this section as the <quote>Advisory Committee</quote>).</text></subsection><subsection id="id8306DD7D963141328E49AC26A078B1B3"><enum>(b)</enum><header>Membership</header><paragraph id="id1A2E479F1AD649DAB04DE0D120B6D3F8"><enum>(1)</enum><header>Composition</header><text>The Advisory Committee shall be composed of 18 members of whom—</text><subparagraph id="id67DB7360AD734550AA68E5EB93F04982"><enum>(A)</enum><text>nine shall be appointed by the leader of the Republican caucus in the Senate (in consultation with the minority leader of the House of Representatives), one of which shall be appointed as a Co-Chairperson of the Advisory Committee; and</text></subparagraph><subparagraph id="idCD439B1A48554F73B1CA956DA55AC7F4" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>nine shall be appointed by the Speaker of the House of Representatives (in consultation with the leader of the Democratic caucus in the Senate), one of which shall be appointed as a Co-Chairperson of the Advisory Committee.</text></subparagraph></paragraph><paragraph id="id4F6DB1474DDC4254B9FA7AC11A110106"><enum>(2)</enum><header>Representation</header><text>Individuals appointed to the Advisory Committee under paragraph (1) shall be geographically balanced and shall include representatives of Federal, State, and local governments and of the legal, cybersecurity, and election administration and technology communities.</text></paragraph><paragraph id="ID4F911B8DB59248E29F059E5131713461"><enum>(3)</enum><header>Date</header><text>The appointments of the members of the Advisory Committee shall be made not later than 90 days after the date of enactment of this Act. </text></paragraph></subsection><subsection id="ID49FC1DF7437F4D65827F32F3B59A5C61"><enum>(c)</enum><header>Period of
 appointment; vacancies</header><paragraph id="id074CAA8C186848F69A84BF8EB7E8B53B"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), a member of the Advisory shall be appointed for the duration of the Advisory Committee.</text></paragraph><paragraph id="id1F6AD7A9B88144609A9C1C03ED2D2F51"><enum>(2)</enum><header>Removal</header><text>A member may be removed from the Advisory Committee at any time at the upon concurrence of both of the Co-Chairpersons of the Advisory Committee. </text></paragraph><paragraph id="id2ABA6BEF0A7647CD9CF8FFBE31E586FA" commented="no"><enum>(3)</enum><header>Vacancies</header><text>A vacancy in the Advisory Committee—</text><subparagraph id="id76B0CB8404734FF6A1DF2A252ED8694F" commented="no"><enum>(A)</enum><text>shall not affect the powers of the Commission; and</text></subparagraph><subparagraph id="id484DA57A7CD74ED1BC86CBF65528ABB5" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>shall be filled in the same manner as the original appointment. </text></subparagraph></paragraph></subsection><subsection id="id758b78c21a304a19809933583b698abe"><enum>(d)</enum><header>Duties</header><paragraph id="id5709721CE0AC404FBB50D7FA7C205453"><enum>(1)</enum><header>Study</header><subparagraph id="idbfc28a4c52124fbfac4b02fc4d7f83d2"><enum>(A)</enum><header>In general</header><text>The Advisory Committee shall, consistent with applicable law, study the integrity and administration of the general election for Federal office held in November 2020 and make recommendations to State legislatures to improve the security, integrity, and administration of Federal elections.</text></subparagraph><subparagraph id="idd325dfc049404fd382fca189151bbf8f"><enum>(B)</enum><header>Matters studied</header><text>The matters studied by the Advisory Committee shall include— </text><clause id="id50f67f412dd141b8b125862919be86ad"><enum>(i)</enum><text>the effects of the COVID–19 pandemic on the administration of the general election for Federal office held in November 2020;</text></clause><clause id="idfb2341bb5d3241fcb02350cbf72c37c3"><enum>(ii)</enum><text>the election practices adopted by Federal, State, and local governments in response to the COVID–19 pandemic, including—</text><subclause id="id7C21F0022A624B5385E0C0BECEA87F5D"><enum>(I)</enum><text>practices that undermined the security and integrity of the election; and </text></subclause><subclause id="idBE1C7AC2FA9C4900AEA692DF60A4F476"><enum>(II)</enum><text>practices that strengthened the security and integrity of the election;</text></subclause></clause><clause id="idb26bba83f4d841be95ef85a4c8dc92c3"><enum>(iii)</enum><text>the laws, rules, policies, activities, strategies, and practices regarding mail-in ballots, absentee ballots, and vote-by-mail procedures, including—</text><subclause id="idD2AF992864F142E587CD1D1A6E885D39"><enum>(I)</enum><text>measures that undermined the security and integrity of the election; and</text></subclause><subclause id="idDBC53D6C4B864DCD8D96774575CF595F"><enum>(II)</enum><text>measures that strengthened the security and integrity of the election;</text></subclause></clause><clause id="id543dd18dc4b34d9ea4bf5f41144aba6b"><enum>(iv)</enum><text>any laws, rules, policies, activities, strategies, and practices that would have allowed improper or fraudulent votes to be cast in such election and the scope of any improper and fraudulent votes that were cast in the election; </text></clause><clause id="idcc4e0a8fb2304e75b021fd3eb8eba3e2"><enum>(v)</enum><text>any laws, rules, policies, activities, strategies, and practices, or failure to apply such laws, rules, policies, activities, strategies, and practices, that would have allowed improper or fraudulent voter registration and the scope of any improper or fraudulent voter registration; and</text></clause><clause id="idc676b3389b6c4b9db0c81c0696eaa6e5"><enum>(vi)</enum><text>any laws, rules, policies, activities, strategies, and practices that would bolster public confidence in the integrity of future general elections for Federal office and reduce the perceived possibility of fraud, including, but not limited to, voter identification statutes for both in-person and absentee voting, increased voter list maintenance policies pursuant to the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/52/20501">52 U.S.C. 20501</external-xref> et seq.), and use of the Electronic Registration Information Center. </text></clause></subparagraph></paragraph><paragraph id="id46F7ABFC7FEB401EBAE9F226087425B4"><enum>(2)</enum><header>Reports</header><subparagraph id="id8B90C8B05FB44D74AAD722F077D1C4B3"><enum>(A)</enum><header>Initial report</header><text>Not later than 180 days after the date of the enactment of this Act, the Advisory Committee shall submit to the Election Assistance Commission and the appropriate Congressional committees a report on the matter studied under paragraph (1). Such report shall include—</text><clause id="idD180534CE9B044C9A3D2616E41606EF5"><enum>(i)</enum><text>precinct-by-precinct data highlighting the number and incidence of any improper and fraudulent votes that were cast in the election; and</text></clause><clause id="id7AA856C6D6E4498A97B7C44E937F6E3E"><enum>(ii)</enum><text>precinct-by-precinct data highlighting the number and incidence of any improper and fraudulent voter registrations.</text></clause></subparagraph><subparagraph id="id1B17D7C3F39745EEBB5E51759CB8A570"><enum>(B)</enum><header>Recommendations</header><clause id="idD0F7201B2CA54856B59C39BF2C4D7354"><enum>(i)</enum><header>In general</header><text>Not later than 360 days after the date of the enactment of this Act, the Advisory Committee shall submit to the Election Assistance Commission and the appropriate Congressional committees recommendations on the following:</text><subclause id="id06df1e4db6f949a6a5c43eff7b3b9ac6"><enum>(I)</enum><text>The best practices that should be adopted by at each level of local and State Government for administering elections for Federal office—</text><item id="id517E77D452124388BD0FE2236E919C28"><enum>(aa)</enum><text>during the COVID–19 pandemic; and</text></item><item id="id5BEDE7C4694A47A39A91A2B61C961184"><enum>(bb)</enum><text>during other national emergencies.</text></item></subclause><subclause id="idd53ad6367b254654af1bd9831ea1a071"><enum>(II)</enum><text>The best practices that should be adopted at each level of local and State Government to mitigate fraud and increase the integrity and security of mail-in ballots, absentee ballots, and vote-by-mail procedures.</text></subclause><subclause id="idead8534d1b174193b92a13d3d5636339"><enum>(III)</enum><text>The best practices that should be adopted at each level of local and State Government to prevent improper or fraudulent votes from being cast.</text></subclause><subclause id="id47cb452721bb409d89879da183e08b53"><enum>(IV)</enum><text>The best practices that should be adopted at each level of local and State Government to prevent improper voters from being registered.</text></subclause></clause><clause id="id176EA7636A5F44B4807967C5BBECEA93"><enum>(ii)</enum><header>Minority views</header><text>In the case of any recommendation with respect to which one-third or more of the Committee does not concur, the report shall include a justification for why such members do not concur.</text></clause></subparagraph><subparagraph id="id6EC8B8D42D8E4678925720C67ECC324C"><enum>(C)</enum><header>Appropriate Congressional committees</header><text>For purposes of this paragraph, the term <term>appropriate Congressional Committees</term> means—</text><clause id="id3D3535FBE3A740C89CEDDDC1B73C27B4"><enum>(i)</enum><text>the Committee on Rules and Administration of the Senate;</text></clause><clause id="id72957437F274458E965563BF7444747E"><enum>(ii)</enum><text>the Committee on the Judiciary of the Senate;</text></clause><clause id="id4EC6C0C912B0411C89E41DAA8DEA7502"><enum>(iii)</enum><text>the Committee on House Administration of the House of Representatives; and</text></clause><clause id="id24C09899034940698E05ADF7E97E5F62"><enum>(iv)</enum><text>the Committee on the Judiciary of the House of Representatives.</text></clause></subparagraph></paragraph></subsection><subsection id="idCB6849C84AB049AF9E25FBB514F8CB3B"><enum>(e)</enum><header>Commission personnel matters</header><paragraph id="id559246B4C84949219ED5781220A8E28B"><enum>(1)</enum><header>Prohibition on compensation of members</header><text>The members of the Advisory Committee may not receive pay or benefits from the United States Government by reason of their service on the Advisory Committee.</text></paragraph><paragraph id="idC85AE2B4C736461CBB59C3CCA958F0AC" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Staff</header><subparagraph commented="no" display-inline="no-display-inline" id="id9BDB50298F15409FA3B76A597022A4F3"><enum>(A)</enum><header>In general</header><text>Each Co-Chairperson of the Advisory Committee may appoint not more than 5 subject matter experts to serve as staff to the Advisory Committee. </text></subparagraph><subparagraph id="IDB23DD631FF0E49B589B943F8049F018B" commented="no"><enum>(B)</enum><header>Compensation</header><text>The Co-Chairpersons of the Advisory Committee may fix the compensation of the staff of the Advisor Committee without regard to chapter 51 and subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code, relating to classification of positions and General Schedule pay rates, except that the rate of pay for the staff may not exceed the rate payable for level V of the Executive Schedule under section 5316 of that title. </text></subparagraph></paragraph></subsection><subsection id="id1b915a6788a84084977c7fc03528eb22"><enum>(f)</enum><header>Termination</header><text>The Advisory Committee shall terminate 90 days after the date on which the Advisory Committee submits the report required under subsection (d).</text></subsection><subsection id="ide12d2c7dd61440c3bce612dee0ca6139" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header>Nonapplicability of FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Advisory Committee. </text></subsection></section></legis-body><endorsement><action-date>January 19, 2021</action-date><action-desc>Read the second time and placed on the calendar</action-desc></endorsement></bill>
