which was read twice and referred to the <committee-name committee-id="SLIA00">Committee on Indian Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act with respect to the collection and availability of health data with respect to Indian Tribes and Tribal organizations, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H0946542B2C53493A849674DE8AF007D3"><section section-type="section-one" id="HEFEDD51CD3C84CB29DE138D1801D22F5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Tribal Health Data Improvement Act of 2021</short-title></quote>.</text></section><section id="H0714BCF0017B43449E4337BC2FC3DE27"><enum>2.</enum><header>Collection and availability of health data with respect to Indian Tribes</header><subsection id="H2324824B1A7E4008BB221664398788E0"><enum>(a)</enum><header>Data collection</header><text display-inline="yes-display-inline">Section 3101(a)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300kk">42 U.S.C. 300kk(a)(1)</external-xref>) is amended—</text><paragraph id="H7AEF23661A874A65822D2851288F245C"><enum>(1)</enum><text>by striking <quote>, by not later than 2 years after the date of enactment of this title,</quote>; and</text></paragraph><paragraph id="HA138CAD27F0D494E9DFDF70E94B434A2"><enum>(2)</enum><text>in subparagraph (B), by inserting <quote>Tribal,</quote> after <quote>State,</quote>.</text></paragraph></subsection><subsection id="H544843BADA984115B8E7D3C37C122C64"><enum>(b)</enum><header>Data reporting and dissemination</header><text display-inline="yes-display-inline">Section 3101(c) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300kk">42 U.S.C. 300kk(c)</external-xref>) is amended—</text><paragraph id="H4B1B00D4DB994D0AAD5C4B404FB0EBA5"><enum>(1)</enum><text>by amending subparagraph (F) of paragraph (1) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HA19CAB973A404158812F72D7E94FE653"><subparagraph id="H7789C9549C15430DB989FD146079ACD3"><enum>(F)</enum><text display-inline="yes-display-inline">the Indian Health Service, Indian Tribes, Tribal organizations, and epidemiology centers;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HDD95253AB95A4598A906DB08F71A54C6"><enum>(2)</enum><text>in paragraph (3), by inserting <quote>Indian Tribes, Tribal organizations, epidemiology centers,</quote> after <quote>Federal agencies,</quote>.</text></paragraph></subsection><subsection id="HAE136FF05B564C12BFFE975750319FED"><enum>(c)</enum><header>Protection and sharing of data</header><text display-inline="yes-display-inline">Section 3101(e) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300kk">42 U.S.C. 300kk(e)</external-xref>) is amended—</text><paragraph id="idA1188FBCFDD54C0DB6095583DFE54788"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subparagraph id="id5A37D8E8ADAF46A0AEC09744F8189B99"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>..</quote> and inserting <quote>.</quote>;</text></subparagraph><subparagraph id="id7770232F71FF4465BB5F0B76C9D0E430"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>The Secretary shall</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id015D5BA2317845ADBA6719D8F60CE5EB"><subparagraph id="id71096786F46247549C65E276DC783B62"><enum>(A)</enum><header>In general</header><text>The Secretary shall</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id7753436E73CE463E85773D72A1FF1668"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id14FBDF20A9344FB59B6F7FC434A54554"><subparagraph id="idA502CF89B86D48E68CA4A76CA31227A6"><enum>(B)</enum><header>Epidemiology centers and Indian Tribes</header><text display-inline="yes-display-inline">With respect to data access for epidemiology centers and Indian Tribes, the Secretary shall establish a data sharing strategy, in consultation with the Secretary’s Tribal Advisory Committee, for purposes of providing access to data to the epidemiology centers and Indian Tribes that protect data privacy and security and data governance while ensuring that epidemiology centers and Indian Tribes have access to data sources necessary to accomplish their public health responsibilities and plans for use.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id2A49D6C7D30E43AB85B3D87972748008"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H793FE72A44C14B61AED5DA35D30DE698"><paragraph id="HB6CC754310CE4846A91B3D78E43EEF31"><enum>(3)</enum><header>Tribal public health authority</header><text display-inline="yes-display-inline">Beginning not later than 180 days after the date of the enactment of the <short-title>Tribal Health Data Improvement Act of 2021</short-title>, the Secretary shall make available all requested data collected pursuant to this title with respect to health care and public health surveillance programs and activities, including such programs and activities that are federally supported or conducted, to—</text><subparagraph id="HD00D958531B74BD8A8D14F632521DF5A"><enum>(A)</enum><text>the Indian Health Service;</text></subparagraph><subparagraph id="HAE93170D7478411594791EA9C110FBBA"><enum>(B)</enum><text display-inline="yes-display-inline">Indian Tribes and Tribal organizations; and</text></subparagraph><subparagraph id="HEB0858877EEC4596A4C868F789D1E791"><enum>(C)</enum><text display-inline="yes-display-inline">epidemiology centers.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HF11046666E5D4942A9D091B6D0E0ECC8"><enum>(d)</enum><header>Technical updates</header><text display-inline="yes-display-inline">Section 3101 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300kk">42 U.S.C. 300kk</external-xref>) is amended—</text><paragraph id="H6AAE20877EB44620983469A12C63267B"><enum>(1)</enum><text>by striking subsections (g) and (h); and</text></paragraph><paragraph id="H392EDF296DA046D1AF2A8A5433DC22DB"><enum>(2)</enum><text>by redesignating subsection (i) as subsection (h).</text></paragraph></subsection><subsection id="HA230509D177D45068E12CD32F7409316"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">After executing the amendments made by subsection (d), section 3101 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300kk">42 U.S.C. 300kk</external-xref>) is amended by inserting after subsection (f) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H44D0127D83054796A690F2131EB8506B"><subsection id="HA787B07DE1524E4E8B6AA491937160FB"><enum>(g)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="HDDC82095CF2C4ECAA0F2F01BDD1076B6"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>epidemiology center</term> means an epidemiology center established under section 214 of the Indian Health Care Improvement Act, including any epidemiology center serving Indian Tribes regionally or serving urban Indian organizations nationally that is receiving funding from the Indian Health Service.</text></paragraph><paragraph id="id50D272F4F705437B89BC1DEBA59CC875"><enum>(2)</enum><text>The terms <term>Indian Tribe</term> and <term>Tribal organization</term> have the meanings given to the terms <term>Indian tribe</term> and <term>tribal organization</term>, respectively, in section 4 of the Indian Self-Determination and Education Assistance Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H83A77B91AD0549C8804D8E2677E7A3E9"><enum>(f)</enum><header>Technical correction</header><text display-inline="yes-display-inline">Section 3101(b) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300kk">42 U.S.C. 300kk(b)</external-xref>) is amended by striking <quote><header-in-text level="subsection" style="OLC">Data analysis.—</header-in-text></quote> and all that follows through <quote>For each federally</quote> and inserting <quote><header-in-text level="subsection" style="OLC">Data analysis.—</header-in-text>For each federally</quote>.</text></subsection></section><section id="H1D186148ED6045A29516B3C6FFF54C99"><enum>3.</enum><header>Improving health statistics reporting with respect to Indian Tribes</header><subsection id="HD33455C529EF41FDA724354430B873F1"><enum>(a)</enum><header>Technical aid to States and localities</header><text display-inline="yes-display-inline">Section 306(d) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/242k">42 U.S.C. 242k(d)</external-xref>) is amended by inserting <quote>, Indian Tribes, Tribal organizations, and epidemiology centers</quote> after <quote>jurisdictions</quote>.</text></subsection><subsection id="HE62BE741FF134E16A24E3DD8B238BB6A"><enum>(b)</enum><header>Cooperative health statistics system</header><text display-inline="yes-display-inline">Section 306(e)(3) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/242k">42 U.S.C. 242k(e)(3)</external-xref>) is amended by inserting <quote>, Indian Tribes, Tribal organizations, and epidemiology centers</quote> after <quote>health agencies</quote>.</text></subsection><subsection id="HCEF9B67EA3FB4614B9B775827E22452E"><enum>(c)</enum><header>Federal-State-Tribal cooperation</header><text display-inline="yes-display-inline">Section 306(f) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/242k">42 U.S.C. 242k(f)</external-xref>) is amended—</text><paragraph id="HEF6B526A3E8F43429544A814B18447EF"><enum>(1)</enum><text>by inserting <quote>, the Indian Health Service,</quote> after <quote>Commerce and Labor</quote>;</text></paragraph><paragraph id="H368CF7F156444D72AF72BD714F9BDA55"><enum>(2)</enum><text>by inserting <quote>, Indian Tribes, Tribal organizations, and epidemiology centers</quote> after <quote>State and local health departments and agencies</quote>; and</text></paragraph><paragraph id="idDA1D868F89F940329B9730432CB1099B"><enum>(3)</enum><text>by striking <quote>he shall</quote> and inserting <quote>the Secretary shall</quote>.</text></paragraph></subsection><subsection id="H52C5F1D0FB3946588DF813FD14CE84A4"><enum>(d)</enum><header>Registration area records</header><text display-inline="yes-display-inline">Section 306(h)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/242k">42 U.S.C. 242k(h)(1)</external-xref>) is amended—</text><paragraph id="idD5E93B1FBFA5400BA5A13EBA4DB7CA36"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>in his discretion</quote> and inserting <quote>in the discretion of the Secretary</quote>; and</text></paragraph><paragraph id="id78A010990CB04AB781C9E7310D707FF9"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>Hispanics, Asian Americans, and Pacific Islanders</quote> and inserting <quote>American Indians and Alaska Natives, Hispanics, Asians, and Native Hawaiian and other Pacific Islanders</quote>.</text></paragraph></subsection><subsection id="HF0AFBB762D55401F99692804D25BE4D5"><enum>(e)</enum><header>National Committee on Vital and Health Statistics</header><text display-inline="yes-display-inline">Section 306(k) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/242k">42 U.S.C. 242k(k)</external-xref>) is amended—</text><paragraph id="H9E343B4A9AFF4A36B125BA28F7B27BE3"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>, not later than 60 days after the date of the enactment of the Health Insurance Portability and Accountability Act of 1996,</quote> each place it appears; and</text></paragraph><paragraph id="H5955EE8F200841B5BC9B7D13859558D1"><enum>(2)</enum><text>in paragraph (7), by striking <quote>Not later than 1 year after the date of the enactment of the Health Insurance Portability and Accountability Act of 1996, and annually thereafter, the Committee shall</quote> and inserting <quote>The Committee shall, on a biennial basis,</quote>.</text></paragraph></subsection><subsection id="H2526658214D64B52AF1CBA153A845911"><enum>(f)</enum><header>Grants for assembly and analysis of data on ethnic and racial populations</header><text display-inline="yes-display-inline">Section 306(m)(4) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/242k">42 U.S.C. 242k(m)(4)</external-xref>) is amended—</text><paragraph id="H45EF1BA7D53C46F88244521A83630F22"><enum>(1)</enum><text>in subparagraph (A)—</text><subparagraph id="HB6E23A386B4D4A40B88A6E17CAF86A93"><enum>(A)</enum><text>by striking <quote>Subject to subparagraph (B), the</quote> and inserting <quote>The</quote>; and</text></subparagraph><subparagraph id="HFC3911F3624F4026B6F5E626C4F533F5"><enum>(B)</enum><text>by striking <quote>and major Hispanic subpopulation groups and American Indians</quote> and inserting <quote>, major Hispanic subgroups, and American Indians and Alaska Natives</quote>; and</text></subparagraph></paragraph><paragraph id="HC699ACE4374947C6B8F748B6583EF88B"><enum>(2)</enum><text display-inline="yes-display-inline">by amending subparagraph (B) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H31B74718AF2149B8B5E5144278C5FC01"><subparagraph id="H30FD01578AC44099A1873262FC5E3E12" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">In carrying out subparagraph (A), with respect to American Indians and Alaska Natives, the Secretary shall—</text><clause id="HBF20AA75BF35447A89B364D9F959ECAE"><enum>(i)</enum><text display-inline="yes-display-inline">in consultation with Indian Tribes, Tribal organizations, the Tribal Technical Advisory Group of the Centers for Medicare &amp; Medicaid Services maintained under section 5006(e) of the American Recovery and Reinvestment Act of 2009, and the Tribal Advisory Committee established by the Centers for Disease Control and Prevention, and in coordination with epidemiology centers, develop guidance for State and local health agencies to improve the quality and accuracy of data with respect to the birth and death records of American Indians and Alaska Natives;</text></clause><clause id="HA59147470056409AA3A51CFF2E636C16"><enum>(ii)</enum><text display-inline="yes-display-inline">confer with urban Indian organizations to develop guidance for State and local health agencies to improve the quality and accuracy of data with respect to the birth and death records of American Indians and Alaska Natives;</text></clause><clause id="id86E493DB87B1415BA312E804EFC29A60"><enum>(iii)</enum><text display-inline="yes-display-inline">enter into cooperative agreements with Indian Tribes, Tribal organizations, Urban Indian organizations, and epidemiology centers to analyze and address misclassification and undersampling of American Indians and Alaska Natives in data systems at the Federal, State, and local levels, with respect to—</text><subclause id="H993C38E1B2B74CB68B458EF8EEA886AB"><enum>(I)</enum><text>birth and death records; and</text></subclause><subclause id="H5760BCDFAE3B4EE0B4856825A43116F1"><enum>(II)</enum><text>Federal, State, and local health care and public health surveillance systems, including with respect to chronic and infectious diseases, unintentional injuries, environmental health, child and adolescent health, maternal health and mortality, foodborne and waterborne illness, reproductive health, and any other notifiable disease or condition;</text></subclause></clause><clause id="HFCA4E20C13C44A10AC34D8B5C062859C"><enum>(iv)</enum><text display-inline="yes-display-inline">adopt, based on local, statewide, Tribal, and national best practices, uniform standards for the collection of health data on race and ethnicity;</text></clause><clause id="idCE5EA3774B9F44CBAB59A7FB406F8FD2"><enum>(v)</enum><text display-inline="yes-display-inline">encourage States to enter into data sharing agreements with Indian Tribes and epidemiology centers to improve the quality and accuracy of public health data regarding American Indians and Alaska natives, including by addressing misclassification and undersampling of American Indians and Alaska Natives in State and local public health data systems, including with respect to vital statistics, chronic and infectious diseases, unintentional injuries, environmental health, child and adolescent health, maternal health and mortality, foodborne and waterborne illness, reproductive health, and any other notifiable disease or condition;</text></clause><clause id="idD3390FA55A6045E49DC1FF7D92F8778B"><enum>(vi)</enum><text display-inline="yes-display-inline">encourage States to adopt, based on local, statewide, Tribal, and national best practices, uniform standards for the collection of health data on race and ethnicity; and</text></clause><clause id="id9A5A8243CB5F433D960AE9CF7C4FFF28"><enum>(vii)</enum><text display-inline="yes-display-inline">180 days after the date of enactment of the <short-title>Tribal Health Data Improvement Act of 2021</short-title> and biennially thereafter, issue a report on—</text><subclause id="id51E5796EBBA84924959646B7154128B9"><enum>(I)</enum><text display-inline="yes-display-inline">which States have data sharing agreements with Indian Tribes, Tribal Organizations, urban Indian organizations, or epidemiology centers to improve the quality and accuracy of health data, listed by data system name; and</text></subclause><subclause id="id405275C81C6141B88DD0D3EA2E887447"><enum>(II)</enum><text display-inline="yes-display-inline">actions taken by the Director of the Centers for Disease Control and Prevention to encourage States to enter into data sharing agreements with Indian Tribes, Tribal Organizations, urban Indian organizations, and epidemiology centers to improve the quality and accuracy of health data.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H07AB18A1DFC5467889445CD45C98FE59"><enum>(g)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 306 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/242k">42 U.S.C. 242k</external-xref>) is amended—</text><paragraph id="H944037B5C76D434E95D69627765100B6"><enum>(1)</enum><text>by redesignating subsection (n) as subsection (o); and</text></paragraph><paragraph id="HF1935DC14C7B49CD97A46F6C1CAD8A1D"><enum>(2)</enum><text>by inserting after subsection (m) the following:</text><quoted-block style="traditional" display-inline="no-display-inline" id="H12EBE38468A14ACEA9A8156085797A45"><subsection id="H05D669B79A14426B941750E2159A640C"><enum>(n)</enum><text>In this section:</text><paragraph id="H5D638E67E1E64472A54BC8D960D0E794"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>epidemiology center</term> means an epidemiology center established under section 214 of the Indian Health Care Improvement Act, including any epidemiology center serving Indian Tribes regionally or serving urban Indian organizations nationally that is receiving funding from the Indian Health Service.</text></paragraph><paragraph id="id4E357A3DC9934B8BADFCD5FBF8CC304B"><enum>(2)</enum><text display-inline="yes-display-inline">The terms <term>Indian Tribe</term> and <term>Tribal organization</term> have the meanings given to the terms <term>Indian tribe</term> and <term>tribal organization</term>, respectively, in section 4 of the Indian Self-Determination and Education Assistance Act.</text></paragraph><paragraph id="H3FE05139CF87434E97A4443121646D5A"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>Urban Indian organization</term> has the meaning given to that term in section 4 of the Indian Health Care Improvement Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2BEDB8CCD272488BB2B2D13A1ACDB6BD"><enum>(h)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Section 306(o) of the Public Health Service Act, as redesignated by subsection (g), is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0C2E689C07324B359E9DD0B590247054"><subsection id="HE2F26302F1A1461CB094D3063EF6A342"><enum>(o)</enum><text display-inline="yes-display-inline">To carry out this section, there is authorized to be appropriated $185,000,000 for each of the fiscal years 2021 through 2025.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
