which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To waive certain pay limitations for Department of Agriculture and Department of the Interior employees engaged in emergency wildland fire suppression activities, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wildland Firefighter Fair Pay Act</short-title></quote>.</text></section><section id="id706EB32D00A141DBB7587C39F30B2C01"><enum>2.</enum><header>Waiver of premium pay limitations for Department of Agriculture and Department of the Interior employees engaged in emergency wildland fire suppression activities</header><subsection id="id4BF7AC3247564FB68507431FF15D831B"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id80A8285C388E4BBD8BB3EEA6E4F55950"><enum>(1)</enum><header>Covered employee</header><text>The term <term>covered employee</term> means an employee of the Department of Agriculture or the Department of the Interior.</text></paragraph><paragraph id="id6C4BA91694DE4E93A8196DD28E69C1CF"><enum>(2)</enum><header>Covered services</header><text>The term <term>covered services</term> means services performed by a covered employee that are determined by the Secretary concerned to be primarily relating to emergency wildland fire suppression activities.</text></paragraph><paragraph id="id38DDA69F11134F2B890E1E448C8EECC1"><enum>(3)</enum><header>Premium pay</header><text>The term <term>premium pay</term> means the premium pay paid under the provisions of law described in section 5547(a) of title 5, United States Code.</text></paragraph><paragraph id="id72F7FCF4CBD44AE983FFF6122197A225"><enum>(4)</enum><header>Secretary concerned</header><text>The term <term>Secretary concerned</term> means—</text><subparagraph id="idFC73E19399B741BC8FD6CFA172C9F262"><enum>(A)</enum><text>the Secretary of Agriculture, with respect to an employee of the Department of Agriculture; and</text></subparagraph><subparagraph id="id1758D547786D436FB11037A33910721A"><enum>(B)</enum><text>the Secretary of the Interior, with respect to an employee of the Department of the Interior.</text></subparagraph></paragraph></subsection><subsection id="idBA87B932023642F1A11FB69AD8B6BFFB"><enum>(b)</enum><header>Waiver of premium pay period limitation</header><text>Any premium pay for covered services shall be disregarded in calculating the aggregate of the basic pay and premium pay for the applicable covered employee for purposes of a pay period limitation under section 5547(a) of title 5, United States Code, or under any other provision of law.</text></subsection><subsection id="id2184482B45F84E808B3D8A33DD5DA8FD"><enum>(c)</enum><header>Waiver of annual premium pay limitation</header><text>Any premium pay for covered services shall be disregarded in calculating any annual limitation on the amount of overtime pay payable in a calendar year or fiscal year under section 5547(b) of title 5, United States Code.</text></subsection><subsection id="id077FB58B4F2B4677B7AF3AC96A1832E5"><enum>(d)</enum><header>Pay limitation</header><text>A covered employee may not be paid premium pay if, or to the extent that, the aggregate amount of the basic pay and premium pay (including premium pay for covered services) of the covered employee for a calendar year would exceed the rate of basic pay payable for a position at level II of the Executive Schedule under section 5313 of title 5, United States Code, as in effect at the end of that calendar year.</text></subsection><subsection id="idcb0efd517024422983fe592049c67251"><enum>(e)</enum><header>Treatment of additional premium pay</header><text>If the application of this section results in the payment of additional premium pay to a covered employee of a type that is normally creditable as basic pay for retirement or any other purpose, that additional premium pay shall not be—</text><paragraph id="id0c52a8a1d60049eeac9d21c62db2d3b4"><enum>(1)</enum><text>considered to be basic pay of the covered employee for any purpose; or</text></paragraph><paragraph id="id2f2546b2e3cd475b975c68515a5e895a"><enum>(2)</enum><text>used in computing a lump-sum payment to the covered employee for accumulated and accrued annual leave under section 5551 or 5552 of title 5, United States Code. </text></paragraph></subsection><subsection id="id331C6DC2616C4D408900CD3647985A75"><enum>(f)</enum><header>Overtime rates</header><text>Section 5542(a)(5) of title 5, United States Code, is amended by striking <quote>the United States Forest Service in</quote>.</text></subsection><subsection id="id48E978A3C8C94EFCBE8C4B1E26AFF3D6"><enum>(g)</enum><header>Effective date</header><text>This section and the amendment made by this section shall take effect as if enacted on January 1, 2020.</text></subsection></section></legis-body></bill>
