which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide relief to workers impacted by COVID–19 and support for reopening businesses, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HC509036F93C641D6AB52A5B3C9E53035"><section section-type="section-one" id="H72CF9C4C7AAD4FF49ECC4ECADFE000FF"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Back to Work Bonus Act</short-title></quote>. </text></section><section section-type="subsequent-section" id="H0B9BDC1B0FB147E789C3ABB2BE873324"><enum>2.</enum><header>Time-limited back-to-work bonuses</header><subsection id="H95C930ACFD7A4721B125B97A5FC087D0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 2104(b) of the Cares Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9023">15 U.S.C. 9023(b)</external-xref>) is amended—</text><paragraph id="HE929E405F6FB42939C7ECF3750083172"><enum>(1)</enum><text>by redesignating paragraph (4) as paragraph (5); and</text></paragraph><paragraph id="HC988D3C3476A4E45AE975EF75D0B54FB"><enum>(2)</enum><text>by inserting after paragraph (3) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HACD1295F243A489298AC0DEAB0D1BE19"><paragraph id="H4768C3BC268C4D0E992A55588C7F2127"><enum>(4)</enum><header>Back-to-work bonuses</header><subparagraph id="HE227C029865F45C596549DF0DB736574"><enum>(A)</enum><header>In general</header><text>Any agreement under this section may also provide that the State agency of the State may make a one-time lump sum payment to each individual who—</text><clause id="H6AE7EA8813FC4103A1017226FD87735E"><enum>(i)</enum><text display-inline="yes-display-inline">was eligible for Federal Pandemic Unemployment Compensation under paragraph (1) for any week beginning after the date of enactment of the <short-title>Back to Work Bonus Act</short-title>;</text></clause><clause id="HF43D96EC59E841B1ABE8BC5AEE3E62C1"><enum>(ii)</enum><text display-inline="yes-display-inline">is no longer so eligible (as determined by the State), as a result of earnings due to commencing employment; and</text></clause><clause id="H432DC4853B7C4BCA99AD6FB3D4B836C6"><enum>(iii)</enum><text display-inline="yes-display-inline">as verified by the individual’s employer pursuant to subparagraph (E)—</text><subclause id="HA67035DD9783493B9415959B25E80EFC"><enum>(I)</enum><text>has been employed by a non-governmental employer throughout the individual’s qualifying period;</text></subclause><subclause id="HAEBA91C893AD4EACB06669287B9F8428"><enum>(II)</enum><text>is employed for wages equivalent to an annual salary of not more than $75,000; and</text></subclause><subclause id="H55445F0FC1A0453B9091D74FA2464376"><enum>(III)</enum><text>remains employed with an intent to continue such employment.</text></subclause></clause></subparagraph><subparagraph id="H240D6E2CDBF04588BF2570E5822C81E3"><enum>(B)</enum><header>Amount</header><text>A payment made to an individual under this paragraph shall be paid in a lump sum amount of—</text><clause id="HC5F6A02B1620482B8CE55D2E3D53EFBA"><enum>(i)</enum><text>$1,200 in the case of an individual who on average is working at least 30 hours or more per week during the qualifying period; or</text></clause><clause id="HFB7F4D0BC2E647E6A8F313BE3A08CF85"><enum>(ii)</enum><text>$600 in the case of an individual who on average is working at least 20 hours or more per week, but less than 30 hours, during the qualifying period.</text></clause></subparagraph><subparagraph id="H4CF1A2F918724E788C35827A459F6CDC"><enum>(C)</enum><header>Qualifying period</header><text>For purposes of this paragraph, the term <term>qualifying period</term> means, with respect to an individual, a period—</text><clause id="H21B71D107EB54CCB8E9A4CDBB8ECD648"><enum>(i)</enum><text>beginning on the date the individual commenced employment as described in subparagraph (A)(ii); and</text></clause><clause id="H721B199896B94F36B4C667CFDB74C5EA"><enum>(ii)</enum><text>extending at least 4 consecutive weeks from such date.</text></clause></subparagraph><subparagraph id="H75279E8E93424AFFA4C6A57B7722027B"><enum>(D)</enum><header>Duration</header><text>No lump sum payment may be made to any individual under this paragraph with respect to a qualifying period beginning on or after July 1, 2021.</text></subparagraph><subparagraph id="H432B8C46076F4AA2954672DD2A6E3683"><enum>(E)</enum><header>Employer verification</header><text display-inline="yes-display-inline">Before making a lump sum payment to an individual pursuant to this paragraph, a State agency shall require verification from the individual’s employer—</text><clause id="H3E326D15B19D46828C4B0215F374AF16"><enum>(i)</enum><text>of the individual’s employment status;</text></clause><clause id="HBB91D2939C334AB79D2B3683F2BB31CB"><enum>(ii)</enum><text>of the wages paid to the individual during the qualifying period; and</text></clause><clause id="HC6084423491542638DD49A80A51769BA"><enum>(iii)</enum><text>of the hours worked by the individual during the qualifying period.</text></clause></subparagraph><subparagraph id="H72C4341ECDF2434594957472F58C961C"><enum>(F)</enum><header>Limitation</header><text display-inline="yes-display-inline">A State may not provide more than one payment under this paragraph to an individual.</text></subparagraph><subparagraph id="H4824171F881A49A2AFB060C3C6173127"><enum>(G)</enum><header>Special rule</header><text display-inline="yes-display-inline">Payments made pursuant to an agreement under this paragraph shall not be considered to violate the withdrawal requirements of section 303(a)(5) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/503">42 U.S.C. 503(a)(5)</external-xref>) or <external-xref legal-doc="usc" parsable-cite="usc/26/3304">section 3304(a)(4)</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H22BA4BFDC1A94043AF595D872A4983B3"><enum>(b)</enum><header>Conforming amendments</header><text>Section 2104 of such Act is amended—</text><paragraph id="H983B1D25519C4B3397B022D8F37FB939"><enum>(1)</enum><text display-inline="yes-display-inline">in subsections (d) and (f), by inserting <quote>, payments under subsection (b)(4),</quote> after <quote>Federal Pandemic Unemployment Compensation</quote> each place it appears; and</text></paragraph><paragraph id="HE2BB9CAF112A4980B3F6B7A719B316F2"><enum>(2)</enum><text>in subsection (g)—</text><subparagraph id="H060E2DADA90C46B890DD3578F8731C54"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HAF682F867B12497DB3EDDC4F2D20191E"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HE90CA6F81F9244FF85EDA0A69E27A8BB"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6715BB4A589E4EF692BDC038CE644E57"><paragraph id="H692851398DA34816955BE663DBC4F249"><enum>(3)</enum><text display-inline="yes-display-inline">the purposes of the preceding provisions of this section, as such provisions apply with respect to payments under subsection (b)(4), shall be applied with respect to unemployment benefits described in subsection (i)(2) to the same extent and in the same manner as if those benefits were regular compensation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="H163E22D585A346C3B0143E5247960AF4"><enum>3.</enum><header>Accelerated funding increase for reemployment services and eligibility assessments</header><text display-inline="no-display-inline">Section 314(g)(1)(D) of the Congressional Budget Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/2/645">2 U.S.C. 645(g)(1)(D)</external-xref>) is amended by—</text><paragraph id="H63FA03EE7F684CA0AB007D12AE0941CC"><enum>(1)</enum><text>in clause (i), by striking <quote>$133,000,000</quote> and inserting <quote>$433,000,000</quote>; and</text></paragraph><paragraph id="H516435025CC542569731C4004F11A3B0"><enum>(2)</enum><text>in clause (ii), by striking <quote>$258,000,000</quote> and inserting <quote>$433,000,000</quote>.</text></paragraph></section><section id="H41F92379D20E4A9B9056E86D763DDFD0"><enum>4.</enum><header>Eligibility for reemployment services</header><subsection id="H79BA51974DA84E73A74044BD67A1F852"><enum>(a)</enum><header>CARES Act</header><paragraph id="HB4A9DAA4163E4C868489C98DAC59DA44"><enum>(1)</enum><header>Pandemic Unemployment Assistance</header><text>Section 2102 of the Cares Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9021">15 U.S.C. 9021</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H2C460D568C124105830ECE03B4B7EBD2"><subsection id="HF2FD96980E7143B791915ADA3DEF85D7"><enum>(i)</enum><header>Eligibility for reemployment services</header><text display-inline="yes-display-inline">Pandemic unemployment assistance under this section shall be treated as unemployment compensation for the purposes of section 306 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/506">42 U.S.C. 506</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H7DDF76B9B438404992062954CF92FCB7"><enum>(2)</enum><header>Pandemic Emergency Unemployment Compensation</header><text>Section 2107 of the Cares Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9025">15 U.S.C. 9025</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H57D09B0FF6DB4F908594705CF3E1A961"><subsection id="HBB93E87FC6FA46248C7411A4ABDA0A12"><enum>(h)</enum><header>Eligibility for reemployment services</header><text display-inline="yes-display-inline">Pandemic emergency unemployment compensation under this section shall be treated as unemployment compensation for the purposes of section 306 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/506">42 U.S.C. 506</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HCCD307B8DF944D30B42E7385326E655D"><enum>(b)</enum><header>Social Security Act</header><text display-inline="yes-display-inline">Section 306(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/506">42 U.S.C. 506(a)</external-xref>) is amended—</text><paragraph id="HA2923ED706AD4A738A92E07B0026997F"><enum>(1)</enum><text>by striking <quote>individuals referred to reemployment services as described in section 303(j)</quote> and inserting <quote>claimants for unemployment compensation, including claimants referred to reemployment services as described in section 303(j),</quote>; and</text></paragraph><paragraph id="HAC4A57083AD648EBB6FDA3FD6B03F33E"><enum>(2)</enum><text>by striking <quote>such individuals</quote> and inserting <quote>such claimants</quote>.</text></paragraph></subsection></section><section id="HABFA0983ED1345EA8426963C47C69893"><enum>5.</enum><header>Reinstating federal work search requirement</header><subsection id="H2C5CEFD495B54711BEC805ED312614E8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 4102(b) of the Families First Coronavirus Relief Act (<external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C. 3304</external-xref> note) is amended by striking <quote>work search,</quote> after <quote>with respect to</quote>.</text></subsection><subsection id="H8E723072DF39412FBD1F59BDF84E401E"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendment made under subsection (a) shall take effect on the date that is 30 days after the date of enactment of this Act. </text></subsection></section></legis-body></bill>
