which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 23, United States Code, to provide for efforts relating to Move Over laws, to amend title 49, United States Code, to require crash avoidance technology on motor vehicles, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Roadside First Responders Act</short-title></quote>.</text></section><section id="idFBF4F0A0A9E24B0D82C5C8755C318C58"><enum>2.</enum><header>Move Over laws</header><subsection id="idEFAAA50D21BF446C97E925C04B0264DC"><enum>(a)</enum><header>Highway safety programs</header><text display-inline="yes-display-inline">Section 402 of title 23, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id647E3FF9A70A4DCC883AC04EBEDEF185"><subsection id="id5D851713B3384FD48471264F804E3E91"><enum>(o)</enum><header>Move Over laws</header><paragraph id="idBC480D4A7AC54AE49105AD077B820928"><enum>(1)</enum><header>Definition of Move Over law</header><text>In this subsection, the term <term>Move Over law</term> means a State law intended to ensure first responder and motorist safety by requiring motorists to change lanes or slow down when approaching an authorized emergency vehicle that is parked or otherwise stopped on a roadway.</text></paragraph><paragraph id="id833F3E200B3048B99675943643CC6490"><enum>(2)</enum><header>Compliance with Move Over laws</header><text>For each of fiscal years 2022 through 2026, subject to the requirements of the highway safety plan of a State under subsection (k), as approved by the Secretary, a State may use a portion of the amounts received under this section to implement statewide efforts to improve compliance with Move Over laws in the State.</text></paragraph><paragraph id="id61199638959C443EB04DF5ADCFDE55E4"><enum>(3)</enum><header>Use of funds</header><text>Statewide efforts under paragraph (2) may include—</text><subparagraph id="idA1597E9E27754717B592323E7DCC9187"><enum>(A)</enum><text>purchasing and deploying digital alert technology that is capable of sending alerts to civilian drivers to protect first responders on the scene and en route; and</text></subparagraph><subparagraph id="idA334394E1AD1453BBAC3A21777073247"><enum>(B)</enum><text>educating the public about Move Over laws in the State through public information campaigns.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id13019778074C4F958B28EEFFF62F991A"><enum>(b)</enum><header>Study on Move Over law public awareness campaigns</header><paragraph id="idEEEF2ABD14F84E2689D15DECFC082CA3"><enum>(1)</enum><header>In general</header><text>The Secretary of Transportation shall seek to enter into an agreement with the National Academies of Sciences, Engineering, and Medicine under which the National Academies of Sciences, Engineering, and Medicine shall carry out a study on the efficacy of Move Over laws (as defined in section 402(o) of title 23, United States Code) and related public awareness campaigns.</text></paragraph><paragraph id="id64369871A78C4569B7EF029295A56ABE"><enum>(2)</enum><header>Report</header><text>On the completion of the report under paragraph (1), the National Academies of Sciences, Engineering, and Medicine shall submit to the Secretary of Transportation and to Congress and make publicly available a report on—</text><subparagraph id="id1B6C24C9366D4FDFB6B41BDA617875BE"><enum>(A)</enum><text>the findings of the study; and</text></subparagraph><subparagraph id="id083B300E868545E8A66D1E0FBBB9787D"><enum>(B)</enum><text>any recommendations to improve public awareness campaigns related to the laws described in that paragraph.</text></subparagraph></paragraph></subsection><subsection id="idE1D83D3ACC1B43B4B13FB45660CD77A6"><enum>(c)</enum><header>National priority safety programs</header><paragraph id="id268F0F298B044F0EA78203C9FBCBACC7"><enum>(1)</enum><header>In general</header><text>Section 405 of title 23, United States Code, is amended—</text><subparagraph id="idC5A1091C70B6402DBB5673017835B274"><enum>(A)</enum><text>in subsection (a)—</text><clause id="id0398607F29F74D4DA972E6CC90E4226A"><enum>(i)</enum><text>in paragraph (6), by striking <quote>5</quote> and inserting <quote>4</quote>;</text></clause><clause id="idE7EBD2C76DEE4D44B2C5C1C580EDFB2D"><enum>(ii)</enum><text>by redesignating paragraphs (8) through (10) as paragraphs (9) through (11), respectively; and</text></clause><clause id="idBBBE1A0047874A0B88FECDD896E74F0C"><enum>(iii)</enum><text>by inserting after paragraph (7) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7C8CDBCF19E241D8BEC322A7BF4DBAB7"><paragraph id="id1EC0F14EBE7C48529BFCA14216F25DC1"><enum>(8)</enum><header>Preventing roadside deaths</header><text>In each fiscal year, 1 percent of the funds provided under this section shall be allocated among States that meet requirements with respect to preventing roadside deaths (as described in subsection (i)).</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id039960B3B3E94858B68CDB6451615CC8"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5A0D699F9998428BB07C88EC39E28F4E"><subsection id="idFB80515D14CC49DBB3FC439BE82175E4"><enum>(i)</enum><header>Preventing roadside deaths</header><paragraph id="id9660198B9C3543C6A7275D26BE28F745"><enum>(1)</enum><header>In general</header><text>The Secretary shall award grants to States to prevent death and injury from crashes involving vehicles striking vehicles and individuals stopped at the roadside.</text></paragraph><paragraph id="id6F525F87E65D405981EA22C635A9E807"><enum>(2)</enum><header>Federal share</header><text>The Federal share of the cost of carrying out an activity funded through a grant under this subsection may not exceed 80 percent.</text></paragraph><paragraph id="id23D1391F9ED84F069832A64D864F9267"><enum>(3)</enum><header>Eligibility</header><text>A State shall receive a grant under this subsection in a fiscal year if the State submits to the Secretary a plan that describes how the State will use funds provided under the grant, in accordance with paragraph (4).</text></paragraph><paragraph id="idA3B71F875ECF481C9B665EA0B88DAC07"><enum>(4)</enum><header>Use of funds</header><text>Amounts received by a State under this subsection shall be used by the State—</text><subparagraph id="idEF504CAA6D384F9E9F3626989E8DA738"><enum>(A)</enum><text>to purchase and deploy digital alert technology (as described in section 4(b) of the <short-title>Protecting Roadside First Responders Act</short-title>);</text></subparagraph><subparagraph id="idD2E00D40A70D4FAFAFDEE85AEC6DB290"><enum>(B)</enum><text>to educate the public about the safety of vehicles and individuals stopped at the roadside in the State through public information campaigns for the purpose of reducing roadside deaths and injury; </text></subparagraph><subparagraph id="idD0A700AB52BD480192A3BA6F2AFD2CE5"><enum>(C)</enum><text>for law enforcement costs related to enforcing State laws to protect the safety of vehicles and individuals stopped at the roadside; and</text></subparagraph><subparagraph id="idED61BD654ED64AC1B3850DFB51AE6AD8"><enum>(D)</enum><text>for programs to identify, collect, and report data to State and local government agencies relating to crashes involving vehicles and individuals stopped at the roadside.</text></subparagraph></paragraph><paragraph id="idA2E40A1AC4DA42AC9F51F88F1493F2A5"><enum>(5)</enum><header>Grant amount</header><text>The allocation of grant funds to a State under this subsection for a fiscal year shall be in proportion to the apportionment of that State under section 402 for fiscal year 2009.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id06942A4ABC6042C48196957A454F46D1"><enum>(2)</enum><header>Sense of Congress relating to funding</header><text>It is the sense of Congress that the national priority program for preventing roadside deaths under subsections (a)(8) and (i) of section 405 of title 23, United States Code, should receive new and additional funding in comparison to the funding level for all national priority programs under section 405 of title 23, United States Code, for the first fiscal year beginning after the date of enactment of this Act. </text></paragraph></subsection></section><section id="idDBB694C15C7445F4B2FB01644070694D"><enum>3.</enum><header>Crash avoidance technology</header><subsection id="idC5CD2010DB5C4EBF850A23D88CDF48D6"><enum>(a)</enum><header>In general</header><text>Subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/301">chapter 301</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id5089AC68D92B4E79823EB4384FDF5869"><section id="id7244477DFBD94C12ADB547A74753DB0F"><enum>30129.</enum><header>Crash avoidance technology</header><subsection id="id888FA3FCACB646038F79AFDE8DA6423C"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this section, the Secretary shall issue a final rule to establish minimum performance standards with respect to crash avoidance technology and to require that passenger motor vehicles (as defined in section 32101) and commercial motor vehicles (as defined in section 31101) manufactured for sale in the United States on or after the compliance date under subsection (b) are equipped with—</text><paragraph id="idE818D920EC624603870D1EE227818A33"><enum>(1)</enum><text>a forward collision warning and automatic emergency braking system that—</text><subparagraph id="id420A344C05A74ED6B0CE0FD6DEE0751D"><enum>(A)</enum><text>alerts the driver if the distance to a vehicle ahead or an object or person, including a pedestrian, a bicyclist, and any other road user, in the path of travel ahead is closing too quickly and a collision is imminent; and</text></subparagraph><subparagraph id="id372B7E9713644FDBAAE9C126ABBA4364"><enum>(B)</enum><text>automatically applies the brakes if the driver fails to do so;</text></subparagraph></paragraph><paragraph id="id7C7329424A3E4300B526C73D4DB1E436"><enum>(2)</enum><text>a lane departure warning and lane keeping assist system that—</text><subparagraph id="idAA2A8068C4834E30B93E9C6B4012FED5"><enum>(A)</enum><text>warns the driver to maintain the lane of travel; and</text></subparagraph><subparagraph id="idD3BF534012944EA7A967BBC7E2D6CC88"><enum>(B)</enum><text>corrects the course of travel if the driver fails to do so; and</text></subparagraph></paragraph><paragraph id="id68313A74203C4FE49078A54502720C25"><enum>(3)</enum><text>a blind zone detection system that—</text><subparagraph id="id989305D384124CEDAD899E660150425C"><enum>(A)</enum><text>warns the driver if another vehicle, an object, or a person, including a pedestrian, a bicyclist, and any other road user, is in the blind zone of the vehicle; and</text></subparagraph><subparagraph id="id0753D55518214C889A71FB64179DA947"><enum>(B)</enum><text>provides an additional alert if the driver attempts to change the course of travel while another vehicle, an object, or a person, including a pedestrian, a bicyclist, and any other road user, is in the blind zone of the vehicle.</text></subparagraph></paragraph></subsection><subsection id="idCCE87187F7804077917729BEC6E50F2F"><enum>(b)</enum><header>Compliance date</header><text>Compliance with the final rule under subsection (a) shall be required beginning for the model year that begins not later than 2 years after the date on which the final rule is published in the Federal Register.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idDDE416C600524C258213C7A73D6B79C5"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/301">chapter 301</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/30128">section 30128</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id894D182FC67C499482E6191C8AAE689A"><toc><toc-entry bold="off" level="section">30129. Crash avoidance technology.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="idD15B7114F56B4460B31214D997397DDD"><enum>4.</enum><header>Requirements for Federal vehicle fleets</header><subsection id="id4236F55C372A4831A5518D92EF83C467"><enum>(a)</enum><header>Crash avoidance technology</header><text>Not later than 5 years after the date of enactment of this Act, in accordance with section 30129 of title 49, United States Code, the head of each Federal agency shall ensure that each new passenger motor vehicle (as defined in section 32101 of that title) and commercial motor vehicle (as defined in section 31101 of that title) purchased or leased as part of a Federal fleet of the agency is equipped with—</text><paragraph id="id7C75DFB518484D949E9256443900B3C9"><enum>(1)</enum><text>a forward collision warning and automatic emergency braking system that—</text><subparagraph id="id017F06E8BE7E407793F427E7FF68FE10"><enum>(A)</enum><text>alerts the driver if the distance to a vehicle ahead or an object or person, including a pedestrian, a bicyclist, or any other road user, in the path of travel ahead is closing too quickly and a collision is imminent; and</text></subparagraph><subparagraph id="id975C20987EED4A31AC71835DDC25C89D"><enum>(B)</enum><text>automatically applies the brakes if the driver fails to do so;</text></subparagraph></paragraph><paragraph id="id9951204CA5FD4F118451E52ABACCE961"><enum>(2)</enum><text>a lane departure warning and lane keeping assist system that—</text><subparagraph id="id4FD2E1CAF5E14FC1AF8F9DBDACAECB4C"><enum>(A)</enum><text>warns the driver to maintain the lane of travel; and</text></subparagraph><subparagraph id="idD95A6864AA614A059B16CF093F6386A6"><enum>(B)</enum><text>corrects the course of travel if the driver fails to do so; and</text></subparagraph></paragraph><paragraph id="idE053008702EA44A990709A4CFDC89F72"><enum>(3)</enum><text>a blind zone detection system that—</text><subparagraph id="idCF02E6A4787344C794BFCF310E7C7A25"><enum>(A)</enum><text>warns the driver if another vehicle, an object, or a person, including a pedestrian, a bicyclist, and any other road user, is in the blind zone of the vehicle; and</text></subparagraph><subparagraph id="idEBBBAC6C4A2B438F9EA228DF01F1B001"><enum>(B)</enum><text>provides an additional alert if the driver attempts to change the course of travel while another vehicle, an object, or a person, including a pedestrian, a bicyclist, and any other road user, is in the blind zone of the vehicle.</text></subparagraph></paragraph></subsection><subsection id="id282A2CA1F2BE4415B61F80BB30436504"><enum>(b)</enum><header>Digital alert technology</header><text>Not later than 5 years after the date of enactment of this Act, the head of each Federal agency shall ensure that each vehicle in a Federal fleet of the agency—</text><paragraph id="id9D573323BCD64A53B89E8E7C5BE50F69"><enum>(1)</enum><text>if the vehicle is used for emergency response activities, is equipped with digital alert technology that is capable of sending alerts to civilian drivers to protect first responders on the scene and en route; and</text></paragraph><paragraph id="id0D0508732FD64D0EABAFA1D7EFF6EA58"><enum>(2)</enum><text>is equipped with digital alert technology (which may be provided by an aftermarket device) that is capable of receiving alerts regarding nearby first responders.</text></paragraph></subsection></section></legis-body></bill>
