which was read twice and referred to the <committee-name committee-id="SSSB00">Committee on Small Business and Entrepreneurship</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Small Business Act to prohibit abortion providers from receiving a covered loan under the paycheck protection program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H1713106AAB8C44BC9C0954980E127E2B"><section commented="no" section-type="section-one" id="HA39083753BEF424F9FA4620199189FE1"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Abortion Providers Loan Elimination Act</short-title></quote>.</text></section><section id="H219DE26B653941C59E2089BE1808ED1B"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="HC23AC88FACDD41F0B6582BEB12D4F099"><enum>(1)</enum><text display-inline="yes-display-inline">The Coronavirus Aid, Relief, and Economic Security Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>) disqualified affiliations from applying for and receiving loans through the paycheck protection program established under section 7(a)(36) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>). </text></paragraph><paragraph id="HBA6EBF5450BF4BE8BB13AADE33AA57E4"><enum>(2)</enum><text display-inline="yes-display-inline">Section 7(a)(36)(D)(vi) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7">15 U.S.C. 7(a)(36)(D)(vi)</external-xref>), as added by the Coronavirus Aid, Relief, and Economic Security Act, established that affiliation rules apply to nonprofits for the purpose of determining whether a nonprofit has 500 or fewer employees. </text></paragraph><paragraph id="H9818210573B54A059E6514375BA8A67F"><enum>(3)</enum><text>Planned Parenthood Federation of America, a national organization with central control over its affiliates and which has nearly $2,000,000,000 in assets and 16,000 employees, improperly applied for, and received $80,000,000 in loans through the paycheck protection program.</text></paragraph><paragraph id="id1726f71f943d436e9f28bc7b6886a76c"><enum>(4)</enum><text>In May of 2020, the Small Business Administration sent letters to the 38 Planned Parenthood affiliates who had improperly applied for and received funds under the paycheck protection program contrary to the letter of the law, instructing the affiliates to return the funding.</text></paragraph><paragraph id="id1017e67109bb4ed2838200340582613d"><enum>(5)</enum><text>According to the most recently available data, 7 affiliates did so, but the remaining 31 affiliates kept the received funding despite receiving notice that they had received such funds illegally.</text></paragraph><paragraph id="idf5172f335a354d4dabf9a4428cac564a"><enum>(6)</enum><text>As of March 23, 2021, 3 of the 31 Planned Parenthood affiliates again applied for and received second draw loans under section 7(a)(37) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(37)</external-xref>) for a combined $4,800,000 of additional funding.</text></paragraph></section><section id="HCF099756CF38455FA9054A34E8402FEC"><enum>3.</enum><header>Paycheck Protection Program</header><subsection id="HE9BC8F1F59BF4560A3BC9DCB15ABDDBE"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Section 7(a)(36) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7D44812514574159B59408F1E7D97C53"><subparagraph id="H0CC00546A7294AA5B47635B5146D9EA8"><enum>(W)</enum><header>Prohibition on Covered Loans for Abortion Providers</header><clause id="H0C9FF08A5FEF44C88566E64621BA0EE4"><enum>(i)</enum><header>In General</header><text display-inline="yes-display-inline">Except as provided in clause (ii), no individual or entity that provides abortions shall be eligible to receive a covered loan.</text></clause><clause id="H352F4CE2C5C847E1A78F4134F7084FF9"><enum>(ii)</enum><header>Exceptions</header><text>Clause (i) shall not apply to—</text><subclause id="H39AACA630B2B4EC29B2A4C5FA4582BDA"><enum>(I)</enum><text>a hospital, as defined in section 1861(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(e)</external-xref>); or </text></subclause><subclause id="HC88F133943CC468681EF1BC1533EDD9C"><enum>(II)</enum><text>an entity that exclusively provides abortions described in section 507(a) of the Further Consolidated Appropriations Act, 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/94">Public Law 116–94</external-xref>).</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H498973461AFF4AF38B832A3BA3065B41"><enum>(b)</enum><header>Effective Date</header><text>The amendment made by this section shall be effective as if included in the enactment of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>).</text></subsection></section><section id="H7EAEC6C082D945F793A5D360E3EA9781"><enum>4.</enum><header>Inspector General report</header><text display-inline="no-display-inline">Not later than 6 months after the date of enactment of this Act, the Inspector General of the Small Business Administration shall conduct an investigation and submit to Congress a report on the number of covered loans made to the Planned Parenthood Federation of America pursuant to section 7(a)(36) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>) and to other individuals or entities that provide abortions.</text></section></legis-body></bill>
