<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Slate Act of 2021</short-title></quote>.</text></section> <section id="id85597d1612814fb39907e97b3046fb16"><enum>2.</enum><header>Sealing of certain records</header> <subsection id="id672d3cfee8a6497388e0787f8e3804c6"><enum>(a)</enum><header>Amendment</header><text>Subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/227">chapter 227</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>

<section id="id92138acaad6e4ae2a835a3b9ff763520"><enum>3560.</enum><header>Automatic sealing of certain records</header>
<subsection id="id70a779424c0d45f18aed47f26685bfe4"><enum>(a)</enum><header>Definitions</header><text>In this section—</text> <paragraph id="ide8781c390b104b99985fd39546cacb7b"><enum>(1)</enum><text>the term <term>covered individual</term> means an individual who—</text>
<subparagraph id="id70e45963487d4dc9bbfd21873efb5d82"><enum>(A)</enum><text>is not a sex offender;</text></subparagraph> <subparagraph id="idcc0a5f647a0a4b68b1ad8c46493e7d7a"><enum>(B)</enum><text>has been—</text>
<clause id="idEBFE714AF04E4E20B498BDDFEFDD7E8A"><enum>(i)</enum><text>arrested for a Federal offense for which the individual was not convicted; or</text></clause> <clause id="id927ca82de7f0455a8959de186f568c26"><enum>(ii)</enum><text>convicted of an offense under section 404 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/844">21 U.S.C. 844</external-xref>) or any Federal nonviolent offense involving marijuana;</text></clause></subparagraph>
<subparagraph id="id231e0b1b6e5842f8ba67178a7bfae91e"><enum>(C)</enum><text>in the case of a conviction described in subparagraph (B)(ii), has fulfilled each requirement of the sentence for the offense, including—</text> <clause id="idd82e3e55f6b345b694475e414481269b"><enum>(i)</enum><text>completing each term of imprisonment, probation, or supervised release; and</text></clause>
<clause id="id66727f143ae4486b8fc8611c172f0b73"><enum>(ii)</enum><text>satisfying each condition of imprisonment, probation, or supervised release; and</text></clause></subparagraph> <subparagraph id="id5f3aeb0dee334dc882ebde1e5adbabe2"><enum>(D)</enum><text>has not been convicted for any offense related to treason, terrorism, access and transmission of sensitive defense information, or other national security related convictions;</text></subparagraph></paragraph>
<paragraph id="idAC76C99B0AB24B8886525168CDD9B602"><enum>(2)</enum><text>the term <term>marijuana</term> has the meaning given the term <term>marihuana</term> in section 102 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>); </text></paragraph> <paragraph id="id8e44f46703ac4ce5a96aaaccd249ba75"><enum>(3)</enum><text>the term <term>nonviolent offense</term> means an offense that is not a crime of violence, as defined in subparagraphs (A) and (C) of section 3156(a)(4); and</text></paragraph>
<paragraph id="idf0284080314c4cbf9a209effffd9681a"><enum>(4)</enum><text>the term <term>sex offender</term> has the meaning given the term in section 111 of the Adam Walsh Child Protection and Safety Act of 2006 (<external-xref legal-doc="usc" parsable-cite="usc/34/20911">34 U.S.C. 20911</external-xref>).</text></paragraph></subsection> <subsection id="id94251f02960a48ab9efe513c1c3bef29"><enum>(b)</enum><header>Automatic sealing for certain arrests and nonviolent offenses</header> <paragraph id="id0670c8a0d710486c9358c8194561c5ed"><enum>(1)</enum><header>In general</header><text>At the time of sentencing of a covered individual for a conviction for an offense pursuant to section 404 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/844">21 U.S.C. 844</external-xref>) or any Federal nonviolent offense involving marijuana, the court shall enter an order that each record and portion thereof that relates to the offense shall be sealed automatically on the date that is 1 year after the covered individual fulfills each requirement of the sentence, including—</text>
<subparagraph id="iddb5a70413b1a44079885af6546121aaa"><enum>(A)</enum><text>completing each term of imprisonment, probation, or supervised release; and</text></subparagraph> <subparagraph id="id86cc514e54f3435ab1749959fb2582d4"><enum>(B)</enum><text>satisfying each condition of imprisonment, probation, or supervised release.</text></subparagraph></paragraph>
<paragraph id="id7facdbd5caa440ef8fd1997e7e016d88"><enum>(2)</enum><header>Acquittal; determination not to file charges</header>
<subparagraph id="id23615d66c16b40938141e5d6dfd13306"><enum>(A)</enum><header>Acquittal</header><text>Not later than 60 days after the date on which a covered individual is acquitted, exonerated, or otherwise subject to a judgment which did not result in a conviction for a Federal offense, each record or portion thereof that relates to the Federal offense shall be sealed automatically.</text></subparagraph> <subparagraph id="id1ef53dd9afe245b49ae73867d0390dcb"><enum>(B)</enum><header>Determination not to file charges</header> <clause id="id001a7dab58ec4d11b8d561c84be8baec"><enum>(i)</enum><header>In general</header><text>If a covered individual is arrested for a Federal offense and the Government does not file charges against the covered individual in relation to the Federal offense before the date that is 180 days after the date on which the arrest was made, each record or portion thereof that relates to the arrest and Federal offense shall be sealed automatically on such date.</text></clause>
<clause id="idbab3d532d1fc4ef3bea67375afbac5c1"><enum>(ii)</enum><header>Unsealing for filing of charges</header><text>At the request of the Government, a court may unseal a record sealed under clause (i) in order for the Government to file charges against the covered individual in relation to the Federal offense described in clause (i).</text></clause> <clause id="id442fde6d31364f91a0eccdacd0745007"><enum>(iii)</enum><header>Limitation</header><text>If a record is unsealed under clause (ii), the record may only be resealed in accordance with <italic></italic>paragraph (1) or subparagraph (A) of this paragraph.</text></clause></subparagraph></paragraph></subsection>
<subsection id="id433caedd414448b79fb40200a1b18a30"><enum>(c)</enum><header>Effect of sealing order</header>
<paragraph id="id1705ac6d06df41b288a5a29fe7552276"><enum>(1)</enum><header>Protection from access</header><text>Except as provided in paragraph (4), a record that has been sealed under this section or section 3560A shall not be accessible to any person.</text></paragraph> <paragraph id="ide929fdf6bf334d29ae1cf904d9570896"><enum>(2)</enum><header>Protection from perjury laws</header> <subparagraph id="id0fb69befae994939b59806814b06c19e"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), an individual whose record has been sealed pursuant to this section shall not be required to disclose the existence of or any information contained in the individual’s sealed record, and shall not be subject to prosecution under any civil or criminal provision of Federal or State law relating to perjury, false swearing, or making a false statement, including under section 1001, 1621, 1622, or 1623, for failing to recite or acknowledge any information that has been sealed with respect to the offense, or respond to any inquiry made of the individual, relating to the protected information.</text></subparagraph>
<subparagraph id="id3107ad39bd1c47b8b99c88aa8bf54526"><enum>(B)</enum><header>Exception</header><text>An individual whose record has been sealed pursuant to this section shall disclose information contained in such record—</text> <clause id="idd98a3fdb408f4ec5a73a8bce869e1f96"><enum>(i)</enum><text>when testifying in court;</text></clause>
<clause id="id1e5c0ddcaed149d4926f63bd633c4bec"><enum>(ii)</enum><text>in the course of questioning by a law enforcement officer in connection with a subsequent criminal investigation; or</text></clause> <clause id="id3a01343c22934441ad59efb3e7143a0f"><enum>(iii)</enum><text>in connection with employment described in subclause (I) or (II) of paragraph (4)(A)(ii) that the individual is seeking.</text></clause></subparagraph></paragraph>
<paragraph id="id596a215e1af341069ce491f1943b8d03"><enum>(3)</enum><header>Background checks</header><text>Except as provided in paragraph (4), the existence of a record of an individual which has been sealed pursuant to this section, or the information contained therein, shall not be included in any background check conducted on such individual.</text></paragraph> <paragraph id="id0c566e49f4af41b7841a3ae54a840e32"><enum>(4)</enum><header>Exceptions</header> <subparagraph id="id09cfefff797945dcbff632317b9b2772"><enum>(A)</enum><header>Law enforcement and court access</header><text>An officer or employee of a law enforcement agency or a court may access a record of an individual which has been sealed pursuant to this section and is in the possession of the agency or court, or another law enforcement agency or court, solely—</text>
<clause id="idf1779b5c7a1440c0b8c2ecc768d554bf"><enum>(i)</enum><text>for investigatory or prosecutorial purposes; or</text></clause> <clause id="ide7801c73b34b4647a4a0c06e53960b31"><enum>(ii)</enum><text>for a background check that relates to—</text>
<subclause id="id8de96eda3f004b17978b2ac0afee05f0"><enum>(I)</enum><text>employment with a law enforcement agency;</text></subclause> <subclause id="id58013107ce274e39ab2435558d4e8ddc"><enum>(II)</enum><text>any position that a Federal agency designates as a—</text>
<item id="id3bf77a88738b435f92f2f7fb7687307f"><enum>(aa)</enum><text>national security position; or</text></item> <item id="idfc45156a3ebc444ababd1e64b6c7e646"><enum>(bb)</enum><text>high-risk, public trust position; or</text></item></subclause>
<subclause id="id304a7faa81af4243aaee1bdba4ca6a25"><enum>(III)</enum><text>the manufacture, importation, sale, transfer, possession, or carrying of firearms, explosives, or ammunition.</text></subclause></clause></subparagraph> <subparagraph id="idc62619b675914da49ddd88bd6eaa8370"><enum>(B)</enum><header>Disclosure</header><text>An officer or employee of a law enforcement agency or a court may disclose information contained in a sealed record only in order to carry out the purposes described in subparagraph (A).</text></subparagraph></paragraph></subsection>
<subsection id="id00ec0a983ee84a9ba93ebd6a1d602189"><enum>(d)</enum><header>Individual access</header><text>Any individual whose record has been sealed pursuant to this section or section 3560A may access the information contained in the individual’s sealed record.</text></subsection> <subsection id="id69a470147db543a78b48150713b09818"><enum>(e)</enum><header>Penalty for unauthorized disclosure</header> <paragraph id="ide232c34cf38e482cb7578f286e962256"><enum>(1)</enum><header>In general</header><text>Whoever knowingly accesses or discloses information contained in a record sealed under this section or section 3560A in a manner that is prohibited under this section, shall be fined under this title, imprisoned for not more than 1 year, or both.</text></paragraph>
<paragraph id="idf3d723ab47a4480198f40a7203bdeec4"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this subsection prevents a covered individual or an individual who was the crime victim (as such term is defined in section 3771(e)) from accessing or disclosing information contained in record sealed under this section or section 3560A.</text></paragraph></subsection> <subsection id="id28f64c2d738141ee8861336c7b64f8ee"><enum>(f)</enum><header>Rule of construction</header><text>Nothing in this section or section 3560A shall abrogate or constrain the authority of a judge or judicial body to vacate a judgment or sentence.</text></subsection>
<subsection id="iddb1aaa78c2a64d71969c9e3670a46381"><enum>(g)</enum><header>Rulemaking</header><text>The Attorney General shall, by rule, establish a process to ensure that any record in the possession of a Federal agency required to be sealed under this section is automatically sealed in accordance with this section.</text></subsection> <subsection id="id4fc617e1bd4c46db90d375a1fbd39fda"><enum>(h)</enum><header>Applicability</header><text>This section shall apply to an arrest that occurred or conviction that was entered before, on, or after the date of enactment of this section. Not later than 2 years after the date of the enactment of this section, the Attorney General shall ensure that any record related to an arrest or conviction that occurred or was entered prior to the automatic sealing of such a record, which record is required to be sealed under this section, is so sealed.</text></subsection>
<subsection id="ide353c216fc234e479d6ccfd29a52045d"><enum>(i)</enum><header>Employer immunity from liability</header><text>An employer who employs or otherwise engages an individual whose criminal records were sealed pursuant to this section shall be immune from liability for any claim arising out of the misconduct of the individual, if the misconduct relates to the portion of the criminal records that were sealed pursuant to this section.</text></subsection> <subsection id="id3a6fa7bb34564a83b3786c95745af3ab"><enum>(j)</enum><header>Establishment of partnerships</header> <paragraph id="id41a7a345c5624f5f866f63776285614b"><enum>(1)</enum><header>In general</header><text>The Administrative Office of the United States Courts or the Attorney General may enter into a contract with or make grants to an organization with expertise in creating digital and technological systems to develop an efficient and effective process for automatically sealing records in accordance with this section.</text></paragraph>
<paragraph id="idc5e8fbfc4d194032815673164d5bddd7"><enum>(2)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this subsection—</text> <subparagraph id="idFEA0EF7DDE3343CEAAA49D81F45886DB"><enum>(A)</enum><text>$2,000,000 to the Administrative Office of the United States Courts; and</text></subparagraph>
<subparagraph id="id677F0D41316F40EEA0A351ED29EA52A9"><enum>(B)</enum><text>$2,000,000 to the Attorney General. </text></subparagraph></paragraph></subsection></section> <section id="idadf8595e086b4d13913dc185921d257c"><enum>3560A.</enum><header>Sealing of certain records upon petition</header> <subsection id="idad08b80582124b96b23035471b38f866"><enum>(a)</enum><header>Definitions</header><text>In this section—</text>
<paragraph id="id71803742605544e7a95e4c0d2bdee43c"><enum>(1)</enum><text>the term <term>covered nonviolent offense</term> means a Federal criminal offense that is not—</text> <subparagraph id="idc32440fede6a4775b197accfdb43be78"><enum>(A)</enum><text>a crime of violence (as defined in subparagraphs (A) and (C) of section 3156(a)(4)); or</text></subparagraph>
<subparagraph id="id570437d6e32b486fa2576f71bcf447d5"><enum>(B)</enum><text>a sex offense (as that term is defined in section 111 of the Sex Offender Registration and Notification Act (<external-xref legal-doc="usc" parsable-cite="usc/34/20911">34 U.S.C. 20911</external-xref>));</text></subparagraph></paragraph> <paragraph id="id4072301bc93440049417e46ab5aab244"><enum>(2)</enum><text>the term <term>eligible individual</term> means an individual who—</text>
<subparagraph id="idcd9bbafd34c44277a14b6b5114face0c"><enum>(A)</enum><text>has been convicted of a covered nonviolent offense;</text></subparagraph> <subparagraph id="id820c971868c24352a53ab041ea7b6438"><enum>(B)</enum><text>has fulfilled each requirement of the sentence for the covered nonviolent offense, including—</text>
<clause id="id14d3f9ec89a54ab6835310ca64e51736"><enum>(i)</enum><text>completing each term of imprisonment, probation, or supervised release; and</text></clause> <clause id="id7f632cb866594bd9b86afba44d24f701"><enum>(ii)</enum><text>satisfying each condition of imprisonment, probation, or supervised release;</text></clause></subparagraph>
<subparagraph id="id20e6ca49b5884065b6b3bc3dc0e9ccc0"><enum>(C)</enum><text>has not been convicted of more than 2 felonies that are covered nonviolent offenses, including any such convictions that have been sealed (except that for purposes of this subparagraph, 2 or more felony convictions that are covered nonviolent offenses arising out of the same act, or acts committed at the same time, shall be treated as one felony conviction);</text></subparagraph> <subparagraph id="id3c0eaa8b637e4207bfab271f3e9f4c51"><enum>(D)</enum><text>has not been convicted of any felony that is not a covered nonviolent offense; and</text></subparagraph>
<subparagraph id="id4ecd049c46004a68824671c27bb5c14a"><enum>(E)</enum><text>has not been convicted for any offense related to treason, terrorism, access and transmission of sensitive defense information, or other national security related convictions;</text></subparagraph></paragraph> <paragraph id="id31a5303679954d04ae903ba44457afb3"><enum>(3)</enum><text>the term <term>petitioner</term> means an individual who files a sealing petition;</text></paragraph>
<paragraph id="id9ff8d0f921f94dae90769e8d9cf37d27"><enum>(4)</enum><text>the term <term>protected information</term>, with respect to a covered nonviolent offense, means any reference to—</text> <subparagraph id="iddab6b2d55b4e420290198a0672a798ef"><enum>(A)</enum><text>an arrest, conviction, or sentence of an individual for the offense;</text></subparagraph>
<subparagraph id="id0450fec961fe487ebb7e9fa76e2c8eb4"><enum>(B)</enum><text>the institution of criminal proceedings against an individual for the offense; or</text></subparagraph> <subparagraph id="id57cdd0dd3a3745a987751a412a873779"><enum>(C)</enum><text>the result of criminal proceedings described in subparagraph (B);</text></subparagraph></paragraph>
<paragraph id="ide3538ebbed9144458ed2102462f090fb"><enum>(5)</enum><text>the term <term>sealing hearing</term> means a hearing held under subsection (c)(2); and</text></paragraph> <paragraph id="id00cd235133774f6fb253ab7ffeb5aae6"><enum>(6)</enum><text>the term <term>sealing petition</term> means a petition for a sealing order filed under subsection (b).</text></paragraph></subsection>
<subsection id="id64222c6f859d440d980fd6fb58616281"><enum>(b)</enum><header>Right To file sealing petition</header>
<paragraph id="id152af811a0694391b7b9b6ec97de2341"><enum>(1)</enum><header>In general</header><text>On and after the date that is 1 year after the date on which the eligible individual has fulfilled each requirement described in subsection (a)(2)(B), an eligible individual may file a petition for a sealing order with respect to a covered nonviolent offense in a district court of the United States.</text></paragraph> <paragraph id="id7b65ae1a0f8b44e7832b8a8d3e1708c1"><enum>(2)</enum><header>Notice of opportunity to file petition</header> <subparagraph id="idca1c388a441745778f54d320f69afb6a"><enum>(A)</enum><header>In general</header><text>If an individual is convicted of a covered nonviolent offense and will potentially be eligible to file a sealing petition with respect to the offense upon fulfilling each requirement of the sentence for the offense as described in subsection (a)(2)(B), the court in which the individual is convicted shall, in writing, inform the individual, on each date described in subparagraph (B), of—</text>
<clause id="idb513bbaea7ed4ab384fd7f3b8257bd80"><enum>(i)</enum><text>that potential eligibility;</text></clause> <clause id="id320cbd2d864d48799b5a35c219474e7c"><enum>(ii)</enum><text>the necessary procedures for filing the sealing petition; and</text></clause>
<clause id="id641548a36d224d48927df32672fda10f"><enum>(iii)</enum><text>the benefits of sealing a record.</text></clause></subparagraph> <subparagraph id="idcfc339484bbb4607a86c49f63cf4697f"><enum>(B)</enum><header>Dates</header><text>The dates described in this subparagraph are—</text>
<clause id="id2f3632fa90a64135af5ff849496c2485"><enum>(i)</enum><text>the date on which the individual is convicted; and</text></clause> <clause id="iddbbba48b07bf4fb39735c83bb51005fc"><enum>(ii)</enum><text>the date on which the individual has completed every term of imprisonment, probation, or supervised release relating to the offense.</text></clause></subparagraph></paragraph></subsection>
<subsection id="ida9f391b1dc254b22be3673a0a875e745"><enum>(c)</enum><header>Procedures</header>
<paragraph id="id4ee55952536f40cb9a9c2a2de97302d7"><enum>(1)</enum><header>Notification to prosecutor</header><text>If an individual files a petition under subsection (b), the district court in which the petition is filed shall provide notice of the petition—</text> <subparagraph id="idb5355f8c1e644ee4adc9f2127f4f9707"><enum>(A)</enum><text>to the office of the United States attorney that prosecuted the petitioner for the offense; and</text></subparagraph>
<subparagraph id="ide8ca0c82052d4e46a4514165b66d93a7"><enum>(B)</enum><text>upon the request of the petitioner, to any other individual that the petitioner determines may testify as to the—</text> <clause id="ide30f25abcc124d5cb5ad5eba2d703879"><enum>(i)</enum><text>conduct of the petitioner since the date of the offense; or</text></clause>
<clause id="id031bc730e4074b3eb8c9d12a65d91574"><enum>(ii)</enum><text>reasons that the sealing order should be entered.</text></clause></subparagraph></paragraph> <paragraph id="idCBAF4A2A4071435E8FD81395B6A0450A"><enum>(2)</enum><header>Notification to crime victims</header><text>Upon receipt of a notification under paragraph (1)(A) by an office of the United States attorney, the office shall make reasonable efforts to identify any individual who was a crime victim (as such term is defined in section 3771) of the offense and provide notice of the petition. </text></paragraph>
<paragraph id="ide0c904ef82b44278ba306e6881032850"><enum>(3)</enum><header>Hearing</header>
<subparagraph id="idbc1ebeb04d954f75a355bb1175d67850"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the date on which an individual files a sealing petition, the district court shall—</text> <clause id="ida342b280969f4f05a16fe681f8ff4de2"><enum>(i)</enum><text>except as provided in subparagraph (D), conduct a hearing in accordance with subparagraph (B); and</text></clause>
<clause id="idfbfbc83f97e24a3ab9e6edde1c6347a3"><enum>(ii)</enum><text>determine whether to enter a sealing order for the individual in accordance with paragraph (4).</text></clause></subparagraph> <subparagraph id="id0c3d93a627814a1a80aca8c8cba8d767"><enum>(B)</enum><header>Opportunity to testify and offer evidence</header> <clause id="id9767743c72274a65ad5c977f826d17b5"><enum>(i)</enum><header>Petitioner</header><text>The petitioner may testify or offer evidence at the sealing hearing in support of sealing.</text></clause>
<clause id="id29e377fbd9414e558edffe62fc1fa9d6"><enum>(ii)</enum><header>Prosecutor</header><text>The office of a United States attorney that receives notice under paragraph (1)(A) may send a representative to testify or offer evidence at the sealing hearing in support of or against sealing.</text></clause> <clause id="id44c1ef76d76f45c59827062361fa49cc"><enum>(iii)</enum><header>Other individuals</header><text>At the request of a petitioner, the district court in which the petition is filed shall issue a subpoena requiring an individual who receives notice under paragraph (1)(B) to testify or offer evidence at the sealing hearing as to the issues described in clauses (i) and (ii) of that paragraph.</text></clause></subparagraph>
<subparagraph id="id25b4aa60583044ab83205a28dbb3b9fe"><enum>(C)</enum><header>Magistrate judges</header>
<clause id="id60d1664d50a640a7b84a7987e11b49da"><enum>(i)</enum><header>In general</header><text>A magistrate judge may preside over a hearing under this paragraph, and submit to a judge of the court proposed findings of fact and recommendations for the disposition, by a judge of the court, of any sealing petition filed under this subsection.</text></clause> <clause id="idd954378646ef40d2ae235a4660aafd3c"><enum>(ii)</enum><header>Recommendations</header><text>Not later than 14 days after being served with a copy, any party may serve and file written objections to the proposed findings and recommendations of the magistrate judge as provided by rules of court. A judge of the court shall make a de novo determination of those portions of the report or specified proposed findings or recommendations to which objection is made. A judge of the court may accept, reject, or modify, in whole or in part, the findings or recommendations made by the magistrate judge. The judge may also receive further evidence or recommit the matter to the magistrate judge with instructions.</text></clause></subparagraph>
<subparagraph id="id2fe5fa1766fb4bee96c4114f325de6fe"><enum>(D)</enum><header>Waiver of hearing</header><text>If the petitioner and the United States attorney that receives notice under paragraph (1)(A) so agree, the court shall make a determination under paragraph (4) without a hearing.</text></subparagraph></paragraph> <paragraph id="id3691fe4801a6441cbe60825aee6d17bf"><enum>(4)</enum><header>Basis for decision</header> <subparagraph id="idc04cc6de4f3f49759b0253c421bb66ce"><enum>(A)</enum><header>In general</header><text>In determining whether to enter a sealing order with respect to protected information relating to a covered nonviolent offense, the court—</text>
<clause id="id1293e84c9ae341aaa35f62731c0db41a"><enum>(i)</enum><text>shall consider—</text> <subclause id="id7bed004d4b4541708d7aa1c28f18cd6a"><enum>(I)</enum><text>the petition and any documents in the possession of the court; and</text></subclause>
<subclause id="id8c72d96bd8124b09956babd0c4f6c364"><enum>(II)</enum><text>all the evidence and testimony presented at the sealing hearing, if such a hearing is conducted;</text></subclause></clause> <clause id="idc3209064f5614cf793da27780bf4adeb"><enum>(ii)</enum><text>may not consider any non-Federal nonviolent crimes for which the petitioner has been arrested or proceeded against, or of which the petitioner has been convicted; and</text></clause>
<clause id="id6d86c50d55134dd79665e2da4105af05"><enum>(iii)</enum><text>shall balance—</text> <subclause id="idcbc42e89ffd84e0c81e4849ec932d389"><enum>(I)</enum> <item commented="no" display-inline="yes-display-inline" id="id1195e1b06ce44d29825333eca2332d74"><enum>(aa)</enum><text>the interest of public knowledge and safety; and</text></item>
<item id="id97e1de01919a4f6691b6b9022f73c7a6" indent="up1"><enum>(bb)</enum><text>the legitimate interest, if any, of the Government in maintaining the accessibility of the protected information, including any potential impact of sealing the protected information on Federal licensure, permit, or employment restrictions; against</text></item></subclause> <subclause id="idb7cf4c3f130e4dd0aafe54d49d62f834"><enum>(II)</enum> <item commented="no" display-inline="yes-display-inline" id="ida57b82d200784277a8a0f8d28b2f8901"><enum>(aa)</enum><text>the conduct and demonstrated desire of the petitioner to be rehabilitated and positively contribute to the community; and</text></item>
<item id="idf93e1cb6bd9b42ad8c14c4d625a3c171" indent="up1"><enum>(bb)</enum><text>the interest of the petitioner in having the protected information sealed, including the harm of the protected information to the ability of the petitioner to secure and maintain employment.</text></item></subclause></clause></subparagraph> <subparagraph id="idd7513111d82e4d8b943141deb761d23d"><enum>(B)</enum><header>Burden on government</header><text>The burden shall be on the Government to show that the interests under subclause (I) of subparagraph (A)(iii) outweigh the interests of the petitioner under subclause (II) of that subparagraph.</text></subparagraph></paragraph>
<paragraph id="id553360c3fa504b02a3a088abaafdbc81"><enum>(5)</enum><header>Waiting period after denial</header><text>If the district court denies a sealing petition, the petitioner may not file a new sealing petition with respect to the same offense until the date that is 2 years after the date of the denial.</text></paragraph> <paragraph id="id4019fe422e0e4333b1c41e1fd8a6ae2f"><enum>(6)</enum><header>Universal form</header><text>The Director of the Administrative Office of the United States Courts shall create a universal form, available over the Internet and in paper form, that an individual may use to file a sealing petition.</text></paragraph>
<paragraph id="id662e226252c3488eb67e5da252876ed0"><enum>(7)</enum><header>Fee waiver</header><text>The Director of the Administrative Office of the United States Courts shall by regulation establish a minimally burdensome process under which indigent petitioners may obtain a waiver of any fee for filing a sealing petition.</text></paragraph> <paragraph id="id856e993e9acd41c7b30442c1d0d480d2"><enum>(8)</enum><header>Effect of sealing</header><text>Subsections (c) through (e) of section 3560 shall apply to any record that is sealed under this section.</text></paragraph>
<paragraph id="id55be06fa29ca4917beed6184d4c8c5b2"><enum>(9)</enum><header>Public defender eligibility</header><text>The district court shall appoint counsel in accordance with the plan of the district court in operation under section 3006A to represent a petitioner for purposes of this section.</text></paragraph></subsection> <subsection id="ida03074de9dea45689d26352736832a7d"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to require a covered individual (as such term is defined in section 3560) to submit a sealing petition with respect to records required to be automatically sealed under section 3560.</text></subsection>
<subsection id="id2e8d39a6c74948dc824f2a39a35dddeb"><enum>(e)</enum><header>Reporting</header><text>Not later than 2 years after the date of enactment of this section, and each year thereafter, each district court of the United States shall issue a public report that—</text> <paragraph id="ide6b69787b13a49fdbdda42f06b2b00be"><enum>(1)</enum><text>describes—</text>
<subparagraph id="id96568b8374364abc9a8db7d7fb723c82"><enum>(A)</enum><text>the number of sealing petitions granted and denied under this section; and</text></subparagraph> <subparagraph id="id2a7de5f4ee4844e684b412cca74280d8"><enum>(B)</enum><text>the number of instances in which the office of a United States attorney supported or opposed a sealing petition;</text></subparagraph></paragraph>
<paragraph id="idffa2304804c04e1784c4d96b0e1a8d74"><enum>(2)</enum><text>includes any supporting data that the court determines relevant and that does not name any petitioner; and</text></paragraph> <paragraph id="id8f7e520d40364cff8e468679ec80a080"><enum>(3)</enum><text>disaggregates all relevant data by race, ethnicity, gender, and the nature of the offense.</text></paragraph></subsection>
<subsection id="id8833d359b7c54da980b5741cd020e9ef"><enum>(f)</enum><header>Employer immunity from liability</header><text>An employer who employs or otherwise engages an individual whose criminal records were sealed pursuant to this section shall be immune from liability for any claim arising out of the misconduct of the individual, if the misconduct relates to the portion of the criminal records that were sealed pursuant to this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> <subsection id="id85a7f60220924d9da9df9fec51de6dfc"><enum>(b)</enum><header>Table of sections</header><text>The table of sections for subchapter A of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/227">chapter 227</external-xref> of title 18, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/18/3559">section 3559</external-xref> the following:</text>
