which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend and enhance the High Seas Driftnet Fishing Moratorium Protection Act to improve the conservation of sharks, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sustainable Shark Fisheries and Trade Act of 2021</short-title></quote>.</text></section><section id="ide96a467391e0442bacc93f85412bf0dc"><enum>2.</enum><header>Shark conservation and trade fairness certification</header><text display-inline="no-display-inline">Section 610 of the High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826k">16 U.S.C. 1826k</external-xref>) is amended—</text><paragraph id="ide4968b73a0f041ed95aa3d7ccc5b7338"><enum>(1)</enum><text>in subsection (a)(2)—</text><subparagraph id="idF9D050CAF2704BC1B153E7842D1B5F26"><enum>(A)</enum><text>by striking subparagraph (A) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id13BDB532F2664A8E8F23FA43AE47ABA6"><subparagraph id="idE31EB699AF154065A1201D637650AB8E"><enum>(A)</enum><text>that nation or any individual or entity from that nation has imported shark products into the United States or seeks to import shark products into the United States; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id3e15d020ab5b4fb6a778bf60a7e7fde8"><enum>(B)</enum><text>in subparagraph (B)—</text><clause id="id2D2FB3F2F5424D27A93620610D70D089"><enum>(i)</enum><text>by striking <quote>adopted</quote> and inserting <quote>sought and obtained, not later than the effective date specified in paragraph (8) of subsection (g), a certification from the Secretary under that subsection that the nation has in effect</quote>; and</text></clause><clause id="idAB2D16B456024FA0BEA403DB33E36E99"><enum>(ii)</enum><text>by striking <quote>, taking into account different conditions</quote>;</text></clause></subparagraph></paragraph><paragraph id="id9cdd8b862d49460393eb76d7e6f6f9ad"><enum>(2)</enum><text>in subsection (b), in paragraphs (2) and (3), by striking <quote>subsection (a)</quote> each place it appears and inserting <quote>subsection (a)(1)</quote>;</text></paragraph><paragraph id="ide151706206834891a947b0ca8e3fb8ca"><enum>(3)</enum><text>in subsection (c)—</text><subparagraph id="idFB13BCC2C2B64E02B055306C0532B489"><enum>(A)</enum><text>in paragraph (1), by striking <quote>subsection (a)</quote> and inserting <quote>subsection (a)(1)</quote>; and</text></subparagraph><subparagraph id="id85e3f2480a7543f9aa134c17ec2670c0"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBC539243D04643359B97B4DCC2243A9D"><paragraph id="idBA9D2C6BA6954F278BEEF15C03DCBCFC"><enum>(6)</enum><header>Applicability to certain countries</header><text>This subsection does not apply to nations identified under subsection (a)(2).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idB6E2D4A7AD114621A6445D69F31A4F75"><enum>(4)</enum><text>in subsection (d)—</text><subparagraph id="id7D18C459FF4841C18BEDA81F19EBD3D4"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>or (g)</quote> after <quote>under subsection (c)</quote>; and</text></subparagraph><subparagraph id="id6b787525db2043c68b8594f490cad41c"><enum>(B)</enum><text>in paragraph (3), by inserting <quote>or (g)</quote> after <quote>under subsection (c)</quote>; and</text></subparagraph></paragraph><paragraph id="ided7b50dceb0240fc9dcea3228629d188"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb4f1501c4c5e4d8b82e9cdd657e96577"><subsection id="id82b8b3f0eba94ad79f333f120457ac7b"><enum>(g)</enum><header>Shark conservation and trade fairness certification</header><paragraph id="id76031E5DFAF148128458242762F92DDF"><enum>(1)</enum><header>Prohibition on importation</header><subparagraph id="id68f11d516e004f0db595374c67d1801e"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), shark products may not be imported into the United States unless the shark products were landed in a nation to which the Secretary has issued a certification or partial certification under paragraph (2).</text></subparagraph><subparagraph id="id0181EBECCE4E49EC8952A85F855AB3D9"><enum>(B)</enum><header>Exceptions</header><text>The prohibition under subparagraph (A) shall not apply to shark products that are—</text><clause id="id6DA8DED5E2424CBF8B84699FE045188B"><enum>(i)</enum><text>traded, owned, held, or otherwise possessed by an employee or agent of a governmental agency for law enforcement purposes;</text></clause><clause id="id197FBCFE005A47C49D2E41A36A08B3A3"><enum>(ii)</enum><text>used for noncommercial subsistence purposes in accordance with Federal, State, tribal, or territorial law;</text></clause><clause id="id7389323CC9364E6696720F2A39DF717B"><enum>(iii)</enum><text>used solely for display, education, conservation, or research purposes by an accredited zoo, aquarium, museum, college, or university; or</text></clause><clause id="id33D6EF13B2E6411C97D8EF2481AEB677"><enum>(iv)</enum><text>used by any other person under a State or Federal permit to conduct noncommercial scientific research.</text></clause></subparagraph></paragraph><paragraph id="idb7647a9cfc104f088032d1b2afc53364"><enum>(2)</enum><header>Certifications</header><text>Pursuant to the regulations prescribed under paragraph (5), the Secretary—</text><subparagraph id="id3c8fa963e540451e972d2984c1982a9a"><enum>(A)</enum><text>shall grant a certification to any nation that has adopted and effectively enforces regulatory programs to provide for the conservation and management of sharks, and measures to prohibit shark finning, that are comparable to those of the United States; and</text></subparagraph><subparagraph id="id44a1916d6a4940758a9e9951051218b0"><enum>(B)</enum><text>may grant a partial certification to a nation if the Secretary determines that the nation—</text><clause id="ida3cec02e450f43d9953f2d87e2209461"><enum>(i)</enum><text>has adopted and effectively enforces regulatory programs that are comparable to the regulatory programs of the United States to provide for the conservation and management of a specific species of shark imported into the United States or used to produce shark products imported into the United States; and</text></clause><clause id="id7862452818b14b44bc9756a099d1ca9f"><enum>(ii)</enum><text>has in effect an effective ban on shark finning that is comparable to that of the United States.</text></clause></subparagraph></paragraph><paragraph id="id87f16eca25124df1bb9d2499b82f8f45"><enum>(3)</enum><header>Expiration; renewal</header><text>A certification or partial certification issued under this subsection—</text><subparagraph id="idB780E331AF6D4C15AED6C70BB10FA7F0"><enum>(A)</enum><text>shall be effective for not more than 3 years from the date of issuance; and</text></subparagraph><subparagraph commented="no" id="id37ED38C0A7DC49C584A4DD3668D4E83B"><enum>(B)</enum><text>may be renewed in accordance with the provisions of this subsection relating to the initial issuance of the certification.</text></subparagraph></paragraph><paragraph id="id6AE790CF62034590B468606B66C7CDDE"><enum>(4)</enum><header>Certain determinations</header><text>The Secretary shall make a determination with respect to whether to renew under paragraph (3) or revoke pursuant to paragraph (5)(A)(ii) a certification or partial certification issued under this subsection not later than 180 days after the submission of the application for renewal or the petition for revocation, as the case may be.</text></paragraph><paragraph id="id365f3b3d7aec42beaf78b03fbd4df144"><enum>(5)</enum><header>Regulations</header><subparagraph id="id4e2827756ce745d39386e4c115fa948f"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date of the enactment of the <short-title>Sustainable Shark Fisheries and Trade Act of 2021</short-title>, the Secretary shall prescribe regulations under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/5">chapter 5</external-xref> of title 5, United States Code, with respect to the submission, evaluation, revocation, and renewal of applications for certifications and partial certifications under paragraph (2). Such regulations shall—</text><clause id="idae01b3a63664464aa93170a1b81127c3"><enum>(i)</enum><text>prescribe the content and format of applications and standards for the information to be provided in such applications; and</text></clause><clause id="id14a2a0f9868444cd81982ee4a163e93f"><enum>(ii)</enum><text>establish a process for petitioning the Secretary for revocation of the certification or partial certification of any nation, including standards for the information required to be provided to demonstrate that the nation no longer meets the criteria established under this subsection for the certification.</text></clause></subparagraph><subparagraph commented="no" id="idd6bc2e31ca954781a3fa63abfe4b0ff5"><enum>(B)</enum><header>Criteria for certification or partial certification</header><text>The regulations prescribed under subparagraph (A) shall establish criteria for determining whether a nation has and effectively enforces regulatory programs to provide for the conservation and management of sharks, and measures to prohibit shark finning, that are comparable to those of the United States, which shall include, at a minimum, a requirement that such programs—</text><clause commented="no" id="id7CB242C7591B4168A022C4E4FB22BC5F"><enum>(i)</enum><text>be consistent with the national standards for fishery conservation and management set forth at section 301(a) of the Magnuson-Stevens Conservation and Management Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1851">16 U.S.C. 1851(a)</external-xref>);</text></clause><clause commented="no" id="id12A926539D1B4543BA93F51FFF88936D"><enum>(ii)</enum><text>provide for regularly updated management plans, scientifically established catch limits, and bycatch assessments and minimization;</text></clause><clause commented="no" id="id01E444BD660846B5BAFD7C6E22B42253"><enum>(iii)</enum><text>include a program to prevent overfishing of sharks and rebuild overfished stocks;</text></clause><clause commented="no" id="idF34A1591E7C64E779165E0CFCED9AD1E"><enum>(iv)</enum><text>require reporting and data collection;</text></clause><clause commented="no" id="id59BF0DFC1812468488DA2DCC23847D8C"><enum>(v)</enum><text>be consistent with the International Plan of Action for Conservation and Management of Sharks of the Food and Agriculture Organization of the United Nations; and</text></clause><clause id="idb8cc9947d4df40cf9bcbecefea2f537e"><enum>(vi)</enum><text>include a mechanism to ensure that, if the nation allows landings of sharks by foreign vessels that are not subject to such programs, only shark products that comply with such programs are exported to the United States.</text></clause></subparagraph></paragraph><paragraph commented="no" id="id198fe58be9ae41ffae5723d6243901c1"><enum>(6)</enum><header>Publication; public comment</header><text>The Secretary shall—</text><subparagraph commented="no" id="idC8CB3CEC9FB641BCA7040F175DBABB56"><enum>(A)</enum><text>publish in the Federal Register notice of applications, petitions, and decisions with respect to certifications, renewal of certifications, or revocation of certifications under this subsection; and</text></subparagraph><subparagraph commented="no" id="idBBD16C9675D24DE786F4AA863E9927EB"><enum>(B)</enum><text>provide an opportunity for public comment with respect to such applications, petitions, and decisions.</text></subparagraph></paragraph><paragraph commented="no" id="id864D1187AB9547039BE645802939327F"><enum>(7)</enum><header>Final agency action</header><text>A decision of the Secretary with respect to the issuance, renewal, or revocation of a certification or partial certification under this subsection, or a failure to make a determination under paragraph (4) in the time required by that paragraph, shall be considered a final agency action for the purposes of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/7">chapter 7</external-xref> of title 5, United States Code.</text></paragraph><paragraph id="idA960179FB2B04F258295C514F6BACF9D"><enum>(8)</enum><header>Effective date</header><text>The prohibition under paragraph (1) shall take effect on the earlier of—</text><subparagraph id="id66e6b8e862324ed18ab46c639543571c"><enum>(A)</enum><text>the date on which regulations are prescribed under paragraph (5); or</text></subparagraph><subparagraph id="idf10d47f5f89940b6a2673f03e6c14fa1"><enum>(B)</enum><text>the date that is 3 years after the date of the enactment of the <short-title>Sustainable Shark Fisheries and Trade Act of 2021</short-title>.</text></subparagraph></paragraph><paragraph id="id454d22eea436484ab2826c040554f336"><enum>(9)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="idfd5968632984426189f691e59ee367cf"><enum>(A)</enum><header>Shark</header><text>The term <term>shark</term> means any species of the subclass Elasmobranchii.</text></subparagraph><subparagraph id="id1b4cf0f9200b4267b6da96e066f74cb9"><enum>(B)</enum><header>Shark product</header><text>The term <term>shark product</term> means live sharks, whole sharks, and the meat, skin, oil, fins (including wings and tails), gill rakers, cartilage, jaws, teeth, liver, or any product containing meat, skin, oil, fins (including wings and tails), gill rakers, cartilage, jaws, teeth, or liver derived from sharks.</text></subparagraph><subparagraph id="idd10f0bc320024735868635414f1cb733"><enum>(C)</enum><header>Shark finning</header><text>The term <term>shark finning</term> means the removal of a shark’s fins, including the tail, and discarding the remaining carcass of the shark at sea.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idf884fc531009439ebfc01efbf245ce87"><enum>3.</enum><header>Actions to strengthen international fishery management organizations</header><text display-inline="no-display-inline">Section 608(a) of the High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826i">16 U.S.C. 1826i(a)</external-xref>) is amended—</text><paragraph id="ideb9fb89f87644a0aaeb69708ffbfda90"><enum>(1)</enum><text>in paragraph (1), by striking subparagraph (F) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2A6B610212BD48EB9D3915354BD921E5"><subparagraph id="id96678BFA45D446328B1B01EE48ED4374"><enum>(F)</enum><text>to adopt shark conservation and management measures and measures to prevent shark finning that are consistent with the International Plan of Action for Conservation and Management of Sharks of the Food and Agriculture Organization of the United Nations;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id3f9236bef65d47a2834ea3120b808911"><enum>(2)</enum><text>by striking paragraph (3) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3A4C1D2C05464553957E0ACEC2F05152"><paragraph id="id0A19DB848089407A8A4489E95F29C056"><enum>(3)</enum><text>seeking to enter into international agreements that require measures for the conservation and management of sharks and measures to prevent shark finning that are consistent with the International Plan of Action for Conservation and Management of Sharks; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id8b4c0205ddda42dea241f7660c47b947"><enum>4.</enum><header>Inclusion of rays and skates in Seafood Traceability Program</header><text display-inline="no-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Commerce shall revise section 300.324 of title 50, Code of Federal Regulations to include rays and skates on the list provided for under subsection (a)(2) of that section.</text></section><section id="idb641766e4d5d4319b715eeb06a4d994b"><enum>5.</enum><header>Rules of construction</header><subsection id="id69FF21EBED244FCD8581651728CAA63E"><enum>(a)</enum><header>Additional or more stringent requirements</header><text display-inline="yes-display-inline">Nothing in this Act, or an amendment made by this Act, shall be construed to preempt any Federal or State law establishing additional or more stringent requirements than the requirements of subsection (g) of section 610 of the High Seas Driftnet Fishing Moratorium Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1826k">16 U.S.C. 1826k</external-xref>), as added by section 3.</text></subsection><subsection id="id9B97D4E6B1474451A9ED28EA881F5242"><enum>(b)</enum><header>Agency responsibilities</header><text>Nothing in this Act, or an amendment made by this Act, shall be construed to infringe on the duties of any agency other than the Department of Commerce, or to impose additional duties, in enforcing the agency's responsibilities related to imports.</text></subsection></section><section id="idf0f3c6668d89424cac945817a65f3594" commented="no"><enum>6.</enum><header>Funding</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Secretary of Commerce to carry out this Act, and the amendments made by this Act—</text><paragraph id="idae514647d93d458c8dc0357d215a7760" commented="no"><enum>(1)</enum><text>$325,000 for fiscal year 2022;</text></paragraph><paragraph id="id1c6eba8617e6419fa4e43673b227184e" commented="no"><enum>(2)</enum><text>$325,000 for fiscal year 2023;</text></paragraph><paragraph id="id14b314b81ccf461ca8f0ee90a3a27d9e" commented="no"><enum>(3)</enum><text>$400,000 for each of fiscal years 2024, 2025, and 2026; and</text></paragraph><paragraph id="id5de8f2b433c6498ea485253e853f46f5" commented="no"><enum>(4)</enum><text>$250,000 for fiscal year 2027.</text></paragraph></section></legis-body></bill>
