<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1369</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action stage="Introduced-in-Senate"><action-date date="20210426">April 26, 2021</action-date><action-desc><sponsor name-id="S153">Mr. Grassley</sponsor> (for himself, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, and <cosponsor name-id="S384">Mr. Tillis</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require United States educational institutions to include information regarding financial transactions with the Government of the People’s Republic of China or its affiliates in any petition for certification or recertification with the Student and Exchange Visitor Program.</official-title></form><legis-body><section id="id27577193E9524FAD8C3D33B8B7F2D46C" section-type="section-one"><enum>1.</enum><header>Supporting documents required for certification with the Student and Exchange Visitor Program</header><text display-inline="no-display-inline">Section 641(d) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1372">8 U.S.C. 1372(d)</external-xref>) is amended—</text><paragraph id="idCE1DF7366A9B451D831579D60BBBAF86"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1)(A), by striking <quote>institution,,</quote> and inserting <quote>institution,</quote>; </text></paragraph><paragraph id="id59AC9673827449889EA48576C2D6642B"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (2) as paragraph (3);</text></paragraph><paragraph id="id4D4D25891E4240AD83BD0FE8038A43F3"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id69F8E786EC1B42F5841F4272D58E30DF"><paragraph id="id38E0DABA44824CDAA3A7A50270C94D84"><enum>(2)</enum><header>Supporting documents required for certification</header><text display-inline="yes-display-inline">Institutions of higher education and other approved educational institutions petitioning for certification or recertification with the Student and Exchange Visitor Program to authorize the attendance of nonimmigrant students described in subparagraph (F)(i) or (M)(i) of section 101(a)(15) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)</external-xref>) shall include with such petition—</text><subparagraph id="id3C71C7C979F9466CB23619174F4F2ED3"><enum>(A)</enum><text display-inline="yes-display-inline">final copies of any contracts, agreements, or documentation of financial transactions between the institution or its affiliated student or faculty groups, foundations, or related entities and any educational, cultural, or language entity that is directly or indirectly funded by the Government of the People’s Republic of China; and</text></subparagraph><subparagraph id="idA60F961484784953B4B4DC4DC5B6D1B7"><enum>(B)</enum><text>a detailed description of any financial contributions from the Government of the People’s Republic of China or its affiliates to any student or faculty groups affiliated with such institution.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idAFD1F947A0644465B3AA4F27FCC3BA9B"><enum>(4)</enum><text>in paragraph (3), as redesignated—</text><subparagraph id="id060C7496572344598399FBDE0B435209"><enum>(A)</enum><text>by striking <quote>specified information, such approvals</quote> and inserting the following: “information and documentation described in paragraphs (1) and (2)—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id366E3D1C60E84AD688F0FFD322BF753C"><subparagraph id="id45A3B793B432445BA0B65E5A2D59E6B0"><enum>(A)</enum><text>such approvals</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id26E69A2F1D7B407C9D7CDE844D092FF1"><enum>(B)</enum><text>by striking the period at the end and inserting the following: “; and</text><quoted-block style="OLC" display-inline="no-display-inline" id="idDF44CBD391F14C55BA1D34B88627ADED"><subparagraph id="id0BCA557CE7B645CDA6FC9D217ACBC6B4"><enum>(B)</enum><text>if such failure involves the information or documentation described in paragraph (2), the Student and Exchange Visitor Program shall conduct an out-of-cycle review of the institution.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
