which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Federal Communications Commission to establish a new Tribal priority window for the 2.5 gigahertz band, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H92E691160A77465C91B027AFDB5007F9"><section section-type="section-one" id="H3019840E337E40AA98F56B36A56BFE66"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Extending Tribal Broadband Priority Act of 2021</short-title></quote>.</text></section><section id="H2B0BC658FBCD4859AF2F25BCA55B7F6D"><enum>2.</enum><header>Establishment of new 2.5 GHz Tribal priority window</header><subsection id="idB2954957FE514298BF3700744C401B78"><enum>(a)</enum><header>Commission defined</header><text>In this section, the term <term>Commission</term> means the Federal Communications Commission.</text></subsection><subsection id="HEBD1C706C8F245BF8654B9BD4DDCC1EF"><enum>(b)</enum><header>New Tribal priority window</header><text display-inline="yes-display-inline">The Commission shall—</text><paragraph id="H04E107DD1A6F433C8851BB7D030AA90B"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 30 days after the date of enactment of this Act, establish a new Tribal priority window for the 2.5 gigahertz band, under the same terms and conditions as the Tribal priority window established in the Report and Order in the matter of Transforming the 2.5 GHz Band adopted by the Commission on July 10, 2019 (FCC 19–62), for any portions of the band—</text><subparagraph id="idC47AF06288AD495EA9BBC4B61119BFB2"><enum>(A)</enum><text display-inline="yes-display-inline">that remain available for assignment in accordance with that Report and Order; and</text></subparagraph><subparagraph id="id5EA5823C2D204ADFA5C39CD1288BB805"><enum>(B)</enum><text display-inline="yes-display-inline">for which the Commission did not receive an application during the Tribal priority window established in that Report and Order; and</text></subparagraph></paragraph><paragraph id="H3873E61D68224A04A71172A102C35F15"><enum>(2)</enum><text>accept applications in the new window established under paragraph (1) during the period that—</text><subparagraph id="H04FCB3CD903A4B77917B5228E61F7455"><enum>(A)</enum><text>begins on the date on which the window is established; and</text></subparagraph><subparagraph id="H1FB91E0BC83548DC80A76E2F256A05B6"><enum>(B)</enum><text>ends on the date that is 180 days after the date on which the window is established, or such later date as the Commission considers appropriate.</text></subparagraph></paragraph></subsection><subsection id="HA9915F77AFC24218B5BFED392A934771"><enum>(c)</enum><header>Exception from certain procedural requirements</header><text display-inline="yes-display-inline">To the extent that the Commission determines that section 553 of title 5, United States Code, chapter 6 of that title (commonly known as the <quote>Regulatory Flexibility Act</quote>), subchapter I of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>), or any other provision of law would prevent the Commission from establishing the new Tribal priority window by the date required under paragraph (1) of subsection (b) or from beginning to accept applications in that window as required under paragraph (2)(A) of that subsection, that provision shall not apply to any action taken by the Commission, or any rule or order issued by the Commission, to establish that window or to begin accepting applications in that window (as the case may be).</text></subsection></section></legis-body></bill>
