which was read the first time </action-desc></action><action><action-date>April 27, 2021</action-date><action-desc>Read the second time and placed on the calendar</action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the recognition of the Lumbee Tribe of North Carolina, and for other purposes.</official-title></form><legis-body><section id="HB08A37121084457C8862FA4B15A77C84" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lumbee Tribe of North Carolina Recognition Act</short-title></quote>.</text></section><section id="H84D0694F13BC4E8A88E2C537718C8583"><enum>2.</enum><header>Federal recognition</header><text display-inline="no-display-inline">The Act of June 7, 1956 (70 Stat. 254, chapter 375), is amended—</text><paragraph id="H06020A95E15C467B94FF565DB84DBFA8"><enum>(1)</enum><text>by striking section 2;</text></paragraph><paragraph id="H8B6794A564724BDABA9204AAA9B35A4A"><enum>(2)</enum><text>in the first sentence of the first section, by striking <quote>That the Indians</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H2EE96F4907C84BDFB07EA9FCF1227487" style="OLC"><section id="HFC53A530DEDD4B9084F5599A5D5D3794"><enum>3.</enum><header>Designation of Lumbee Indians</header><text display-inline="no-display-inline">The Indians</text></section><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H1811C78AD0CC441FAC9385CBD21D59FC"><enum>(3)</enum><text>in the preamble—</text><subparagraph id="HCC283D8147D141B1808978092CE45196"><enum>(A)</enum><text>by inserting before the first undesignated clause the following:</text><quoted-block display-inline="no-display-inline" id="HDD6CC75C64A8435089FAE6A590AFFE94" style="OLC"><section id="HAEA479A571E646DD81D40BFF6B8CA6D6" section-type="section-one"><enum>1.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text></section><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="H4E5E8CF44E9F452A80F1FE6696912440"><enum>(B)</enum><text>by designating the undesignated clauses as paragraphs (1) through (4), respectively, and indenting appropriately;</text></subparagraph><subparagraph id="H0720C85BD019416CBB229E343EF03F3A"><enum>(C)</enum><text>by striking <quote>Whereas</quote> each place it appears;</text></subparagraph><subparagraph id="HBF8C7EDF75AF469882560B0B28DF6224"><enum>(D)</enum><text>by striking <quote>and</quote> after the semicolon at the end of each of paragraphs (1) and (2) (as so designated); and</text></subparagraph><subparagraph id="H7A81C5BA78F94EE2A543B1F22340CABC"><enum>(E)</enum><text>in paragraph (4) (as so designated), by striking <quote>: Now, therefore,</quote> and inserting a period;</text></subparagraph></paragraph><paragraph id="HEAB7F8D6F95F4F73931EDA6173C1D00F"><enum>(4)</enum><text>by moving the enacting clause so as to appear before section 1 (as so designated);</text></paragraph><paragraph id="H681D9A1750DB4A19AAE759593CDDD772"><enum>(5)</enum><text>by striking the last sentence of section 3 (as designated by paragraph (2));</text></paragraph><paragraph id="H2E93BDF41255450E85E509EFE72018D3"><enum>(6)</enum><text>by inserting before section 3 (as designated by paragraph (2)) the following:</text><quoted-block display-inline="no-display-inline" id="H4CFACDD6BF05490DBEF8398DE1A73015" style="OLC"><section id="HA0D6D23EE2504E708FBBCC1C7A3684CC"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H655FB8C4493F43018FF013D9C7242F92"><enum>(1)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="H3522D0F0CD5441588885B9C8B4AAA02A"><enum>(2)</enum><header>Tribe</header><text display-inline="yes-display-inline">The term <term>Tribe</term> means the Lumbee Tribe of North Carolina or the Lumbee Indians of North Carolina.</text></paragraph></section><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H7841E156E34A48318A6BDCE54405333F"><enum>(7)</enum><text>by adding at the end the following:</text><quoted-block id="H62943B11B03644C3BE9A57D696356697" display-inline="no-display-inline" style="OLC"><section id="HFF9C5E329D7C4506B69BA12114E52FE5"><enum>4.</enum><header>Federal recognition</header><subsection id="H3F00AE279A9A44D9914CAC77B90484FC"><enum>(a)</enum><header>In general</header><text>Federal recognition is extended to the Tribe (as designated as petitioner number 65 by the Office of Federal Acknowledgment).</text></subsection><subsection id="H7F939E7F18AC4FAD8D65983F89D95F41"><enum>(b)</enum><header>Applicability of laws</header><text>All laws and regulations of the United States of general application to Indians and Indian tribes shall apply to the Tribe and its members.</text></subsection><subsection id="H11457C9F1E004C9EA6153D0D249E183E"><enum>(c)</enum><header>Petition for acknowledgment</header><text>Notwithstanding section 3, any group of Indians in Robeson and adjoining counties, North Carolina, whose members are not enrolled in the Tribe (as determined under section 5(d)) may petition under part 83 of title 25 of the Code of Federal Regulations for acknowledgment of tribal existence.</text></subsection></section><section id="HB8F73363766F4CE0A945F2CF082D0647"><enum>5.</enum><header>Eligibility for Federal services</header><subsection id="H15BA9D7742604186BE1F2C3CD8A9EE04"><enum>(a)</enum><header>In general</header><text>The Tribe and its members shall be eligible for all services and benefits provided by the Federal Government to federally recognized Indian tribes.</text></subsection><subsection id="H2CC340AB836A4ED58880F2F7AFCCAB6C"><enum>(b)</enum><header>Service area</header><text>For the purpose of the delivery of Federal services and benefits described in subsection (a), those members of the Tribe residing in Robeson, Cumberland, Hoke, and Scotland counties in North Carolina shall be deemed to be residing on or near an Indian reservation.</text></subsection><subsection id="H32B998D2336548BDB4CDB2C2640601D7"><enum>(c)</enum><header>Determination of needs</header><text>On verification by the Secretary of a tribal roll under subsection (d), the Secretary and the Secretary of Health and Human Services shall—</text><paragraph id="H6AE095EED9F94C0795C29788084DBCFF"><enum>(1)</enum><text>develop, in consultation with the Tribe, a determination of needs to provide the services for which members of the Tribe are eligible; and</text></paragraph><paragraph id="H9985F72DA2D54A0EA52D515C1AA8BC61"><enum>(2)</enum><text>after the tribal roll is verified, each submit to Congress a written statement of those needs.</text></paragraph></subsection><subsection id="HDAD50E3000994D07A74CE0AA288FB059"><enum>(d)</enum><header>Tribal roll</header><paragraph id="H1F7F069DD8814BB093A84497A675C705"><enum>(1)</enum><header>In general</header><text>For purpose of the delivery of Federal services and benefits described in subsection (a), the tribal roll in effect on the date of enactment of this section shall, subject to verification by the Secretary, define the service population of the Tribe.</text></paragraph><paragraph id="HA3D6A6B22BAB4958AF68611C5802604E"><enum>(2)</enum><header>Verification limitation and deadline</header><text>The verification by the Secretary under paragraph (1) shall—</text><subparagraph id="H6C4BB546B44F479D928F1F828A1B618D"><enum>(A)</enum><text display-inline="yes-display-inline">be limited to confirming documentary proof of compliance with the membership criteria set out in the constitution of the Tribe adopted on November 16, 2001; and</text></subparagraph><subparagraph id="HFC6E28A0C4B941299602961DBD7D8EF6"><enum>(B)</enum><text display-inline="yes-display-inline">be completed not later than 2 years after the submission of a digitized roll with supporting documentary proof by the Tribe to the Secretary.</text></subparagraph></paragraph></subsection></section><section id="H93AC25FAF7754273990964475AA3CA0C"><enum>6.</enum><header>Authorization to take land into trust</header><subsection id="H761D38C6CDD740F687DC93541DB114DB"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary is hereby authorized to take land into trust for the benefit of the Tribe.</text></subsection><subsection id="H2EB2E1EA71834B90A910D726693DF02A"><enum>(b)</enum><header>Treatment of certain land</header><text>An application to take into trust land located within Robeson County, North Carolina, under this section shall be treated by the Secretary as an <term>on reservation</term> trust acquisition under part 151 of title 25, Code of Federal Regulations (or a successor regulation).</text></subsection></section><section id="H2083766872D2478E938FCE1D65535562"><enum>7.</enum><header>Jurisdiction of State of North Carolina</header><subsection id="H8113CB05B2B546428BFC615EC5E8FE43"><enum>(a)</enum><header>In general</header><text>With respect to land located within the State of North Carolina that is owned by, or held in trust by the United States for the benefit of, the Tribe, or any dependent Indian community of the Tribe, the State of North Carolina shall exercise jurisdiction over—</text><paragraph id="HF54102696A4F459DAD4A697F6499BA99"><enum>(1)</enum><text>all criminal offenses that are committed; and</text></paragraph><paragraph id="HADCF169C33A746E0BAD2878603FEB961"><enum>(2)</enum><text>all civil actions that arise.</text></paragraph></subsection><subsection id="H83D7D42A86DE4957941BB5251C46DFAC"><enum>(b)</enum><header>Transfer of jurisdiction</header><paragraph id="H2B4C6B1C323C4E6BBD86212DA89BCA71"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the Secretary may accept on behalf of the United States, after consulting with the Attorney General of the United States, any transfer by the State of North Carolina to the United States of any portion of the jurisdiction of the State of North Carolina described in subsection (a) over Indian country occupied by the Tribe pursuant to an agreement between the Tribe and the State of North Carolina.</text></paragraph><paragraph id="HF2FFFD8D934F45839955CB2E4A3392AB"><enum>(2)</enum><header>Restriction</header><text>A transfer of jurisdiction described in paragraph (1) may not take effect until 2 years after the effective date of the agreement described in that paragraph.</text></paragraph></subsection><subsection id="H7614759B7CE14597888DB7FE105ECEBE"><enum>(c)</enum><header>Effect</header><text>Nothing in this section affects the application of section 109 of the Indian Child Welfare Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/25/1919">25 U.S.C. 1919</external-xref>).</text></subsection></section><section id="H837F9DEA2C1A463EB023E3B9A0FF6D39"><enum>8.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated such sums as are necessary to carry out this Act.</text></section><section id="H26ECDE2F642F4E87990A7D1C39153590" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>9.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lumbee Tribe of North Carolina Recognition Act</short-title></quote>.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body><endorsement><action-date>April 27, 2021</action-date><action-desc>Read the second time and placed on the calendar</action-desc></endorsement></bill>
