<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1363</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210426">April 26, 2021</action-date><action-desc><sponsor name-id="S350">Mr. Rubio</sponsor> (for himself, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, and <cosponsor name-id="S355">Mr. Cruz</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit recipients of disaster recovery relief assistance from the Department of Housing and Urban Development from penalizing applicants that declined assistance from the Small Business Administration.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Disaster Assistance Simplification Act</short-title></quote>.</text></section><section id="idE7C61C11E671426DBA3502A277BFFE10"><enum>2.</enum><header>Duplication of benefits for disaster relief</header><subsection id="id99FE782948EE473BBAC8A60E351E3416"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="id4008EE60F9B94DFDA84132677CE87421"><enum>(1)</enum><text>the term <term>Administration</term> means the Small Business Administration; and</text></paragraph><paragraph id="idC1826C5C227D48779D83A3247B567D2E"><enum>(2)</enum><text>the term <term>Secretary</term> means the Secretary of Housing and Urban Development.</text></paragraph></subsection><subsection id="idB5068741EE704413B146E31754E2CD47"><enum>(b)</enum><header>Prohibitions</header><text>With respect to a grant provided to a grantee under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301</external-xref> et seq.) related to a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>), the Secretary and the grantee shall not—</text><paragraph id="idE7D0F5F53737446FA744CBB1FAE8753A"><enum>(1)</enum><text>take into consideration whether an applicant for assistance from the grantee applied and was approved for, but declined, assistance related to the major disaster from the Administration under section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>); or</text></paragraph><paragraph id="idFFCD46EDC9044EC3AF8FC3C7339BA2FC"><enum>(2)</enum><text>reduce the amount provided to an applicant described in paragraph (1) by any amount that the applicant would have received from the Administration if the applicant had not declined the assistance.</text></paragraph></subsection><subsection id="idDEB575A714B54B99BEC5DFC6D52902ED"><enum>(c)</enum><header>Application</header><text>Subsection (b) shall apply with respect to applicants for assistance from a grantee under title I of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5301">42 U.S.C. 5301</external-xref> et seq.) with respect to a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) who applied for assistance from the Administration under section 7(b) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>) related to the major disaster before, on, or after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
