<official-title>To reduce the size of the seat of the Government of the United States to the area composed of the principal Federal monuments, the White House, the United States Capitol, the United States Supreme Court Building, and the Federal executive, legislative, and judicial office buildings located adjacent to the Mall and the United States Capitol, to provide for the retrocession of the remaining area of the District of Columbia to the State of Maryland, and for other purposes.</official-title>

<section section-type="section-one" id="HD406A69F9F8143E8A77ECC3B3A319027" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>District of Columbia-Maryland Reunion Act</short-title></quote>.</text></section> <section id="H1A417722A4174A4AB340F2760181F11A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H43A25B0D3B4F41B0B94D412993A2CBB5"><enum>(1)</enum><text>Article I, section 2, clause 1 of the Constitution of the United States states that the <quote>House of Representatives shall be composed of Members chosen every second Year by the People of the several States</quote>. </text></paragraph> <paragraph id="H06AE3293FFE94B88BF57ADBF7F198848"><enum>(2)</enum><text>The Founding Fathers did not consider the proposed district that would become Washington, DC, a State under the Constitution, as evidenced when Alexander Hamilton offered an amendment to the Constitution during the New York ratification to provide full congressional representation to Washington, DC, which was rejected by the convention on July 22, 1788.</text></paragraph> 
<paragraph id="H3FE1DBC0FE0745CDA40F9F93EE82A810"><enum>(3)</enum><text>The Supreme Court of the United States held in Hepburn v. Ellzey, 6 U.S. 445 (1805), in an opinion authored by Chief Justice John Marshall, that the term <term>states</term> in article I, section 2, clause 1 of the Constitution does not include Washington, DC, for representation purposes.</text></paragraph> <paragraph id="HEA0D6D3A6C444F7AB3798D063644582B"><enum>(4)</enum><text>Seven Supreme Court Justices affirmed Chief Justice Marshall’s reasoning from Hepburn v. Ellzey in National Mutual Insurance Co. v. Tidewater Transfer Co., 337 U.S. 582 (1949).</text></paragraph> 
<paragraph id="H8513DBB3722648B186FA21BA8E298EE4"><enum>(5)</enum><text>In 1978, a Congress controlled by Democrats attempted to amend the Constitution to provide Washington, DC, with full congressional representation. The Committee on the Judiciary of the House of Representatives reported the joint resolution and stated that granting congressional representation to the District of Columbia as it is presently constituted would require a constitutional amendment, because <quote>statutory action alone will not suffice</quote>.</text></paragraph> <paragraph id="H1BE23EE1E7824C34B36FFA4C8458D3B0"><enum>(6)</enum><text display-inline="yes-display-inline">Amending the Constitution requires two-thirds approval by each house of Congress and ratification by three-fourths of the States. In 1978, two-thirds of both the House of Representatives and the Senate voted for the constitutional amendment to provide Washington, DC, with full congressional representation, but the amendment was not ratified by three-fourths of the States.</text></paragraph> 
<paragraph id="H087A45F8E9F14903A1A24B34F590BBFA"><enum>(7)</enum><text display-inline="yes-display-inline">An alternative to a potentially lengthy and difficult constitutional amendment process is ceding Washington, DC, back to Maryland, just as an area of 31 square miles that was originally ceded by Virginia was returned to that State by Federal legislation in 1847, thereby ensuring that the portion of Washington, DC, in Virginia would have representation in the Senate and the House of Representatives.</text></paragraph> <paragraph id="H648ECD009C404501BF78B473081D740A"><enum>(8)</enum><text display-inline="yes-display-inline"> In 1847, there was a desire to allow the District of Columbia land on the west side of the Potomac River that was not being used by the Federal Government to have its own proper representation in Congress.</text></paragraph> 
<paragraph id="H9CFBCE06A784477BB26FECE45997FA77"><enum>(9)</enum><text display-inline="yes-display-inline">Obtaining the desired representation for that portion of Washington, DC, would have required a constitutional amendment unless the land were given back to Virginia.</text></paragraph> <paragraph id="HD0EDADA713D8474096C0B9D6A34AAD32"><enum>(10)</enum><text display-inline="yes-display-inline">Instead of trying to pass a constitutional amendment, in 1847, Congress legislatively ceded back to Virginia from the District of Columbia the non-Federal land composed of 31 square miles on the west side of the Potomac River.</text></paragraph> 
<paragraph id="H8F1AAFCF385D423BB8A4B29E1F1815E4"><enum>(11)</enum><text>Accordingly, the District of Columbia would clearly and constitutionally have 2 Senators and a Representative with full voting rights by ceding the District of Columbia to Maryland after Maryland’s acceptance of such retrocession, while maintaining the exclusive legislative authority and control of Congress over the Federal District in the District of Columbia.</text></paragraph></section> <section id="HDEA16551BF55443AB3870AC877841ADC"><enum>3.</enum><header>Retrocession of District of Columbia to Maryland</header> <subsection id="H59A52A26198941E9891A35255728A477"><enum>(a)</enum><header>In general</header><text>Upon the issuance of a proclamation by the President under section 8 and except as provided in subsection (b) of this section, the territory ceded to Congress by the State of Maryland to serve as the District constituting the permanent seat of the Government of the United States is ceded and relinquished to the State of Maryland.</text></subsection> 
<subsection id="HAB720EF615704D30BAFA32BAEBFC0E55"><enum>(b)</enum><header>Continuation of Federal control over Federal District</header><text display-inline="yes-display-inline">Notwithstanding subsection (a), the Federal District described in section 5 shall not be ceded and relinquished to the State of Maryland and shall continue to serve as the permanent seat of the Government of the United States, and Congress shall continue to exercise exclusive legislative authority and control over such District.</text></subsection></section> <section id="H2E963A6D22CE411B8614C3B75288FB87"><enum>4.</enum><header>Effect on judicial proceedings in District of Columbia</header> <subsection id="H36C9978A6CD341FC8439EFA9A93881B1"><enum>(a)</enum><header>Continuation of suits</header><text>No writ, action, indictment, cause, or proceeding pending in any court of the District of Columbia on the effective date of this Act shall abate as a result of the enactment of this Act, but shall be transferred and shall proceed within such appropriate court of the State of Maryland as established under the laws or constitution of the State of Maryland.</text></subsection> 
<subsection id="HF8E3C4F08A134216AE55D098B51E3BA5"><enum>(b)</enum><header>Appeals</header><text>An order or decision of any court of the District of Columbia for which no appeal has been filed as of the effective date of this Act shall be considered an order or decision of a court of the State of Maryland for purposes of appeal from and appellate review of such order or decision in an appropriate court of the State of Maryland.</text></subsection></section> <section id="HCFA98B4C940E46AEAB87B9FB65B76AEF"><enum>5.</enum><header>Federal District described</header> <subsection id="HD3856F9EBA704F7A8A8A7D59963F1CFA"><enum>(a)</enum><header>In general</header><text>Subject to subsections (c), (d), and (e), upon the retrocession under section 3(a), the Federal District referred to in section 3(b)—</text> 
<paragraph id="idF8BF03BB27C0406E8A66048E6EBCBA7E"><enum>(1)</enum><text>shall consist of the territory located within the boundaries described in subsection (b) of this section;</text></paragraph> <paragraph id="id1DA055F1CCD341F094545F2316FDF426"><enum>(2)</enum><text>shall include the principal Federal monuments, the White House, the United States Capitol, the United States Supreme Court Building, and the Federal executive, legislative, and judicial office buildings located adjacent to the Mall and the United States Capitol; and</text></paragraph> 
<paragraph id="id517AE06B462A4047A3024AE6B3187CFF"><enum>(3)</enum><text>shall not include the building known as the <quote>John A. Wilson Building</quote>, as described and designated under section 601(a) of the Omnibus Spending Reduction Act of 1993 (sec. 10–1301(a), D.C. Official Code).</text></paragraph></subsection> <subsection id="HD97E29D5AD364BC58AADC2F8FD7BBC31"><enum>(b)</enum><header>General description</header><text>The boundaries of the Federal District shall be as follows: Beginning at the intersection of the southern right-of-way of F Street NE and the eastern right-of-way of 2nd Street NE;</text> 
<paragraph id="H676F75D8038E4DA7BB0C87A3072DC179"><enum>(1)</enum><text>thence south along said eastern right-of-way of 2nd Street NE to its intersection with the northeastern right-of-way of Maryland Avenue NE;</text></paragraph> <paragraph id="H5EC81784C77F49B5B1A85E790F89EC8C"><enum>(2)</enum><text>thence southwest along said northeastern right-of-way of Maryland Avenue NE to its intersection with the northern right-of-way of Constitution Avenue NE;</text></paragraph> 
<paragraph id="H2FADA8509B744E8AA6E021FFBABAFA27"><enum>(3)</enum><text>thence west along said northern right-of-way of Constitution Avenue NE to its intersection with the eastern right-of-way of 1st Street NE;</text></paragraph> <paragraph id="H7C678A77FCEE437D971B5454FEE3A19B"><enum>(4)</enum><text>thence south along said eastern right-of-way of 1st Street NE to its intersection with the southeastern right-of-way of Maryland Avenue NE;</text></paragraph>

<subsection id="HFCEF9A97AEB34989BECEBFA4CC0FD388"><enum>(d)</enum><header>Metes and bounds survey</header><text>Not later than 180 days after the date of the enactment of this Act, the President (in consultation with the Chair of the National Capital Planning Commission) shall conduct a metes and bounds survey of the Federal District, as described in subsection (b).</text></subsection> <subsection id="HFFFF804E08854C90B35D51BA06B1ACC1"><enum>(e)</enum><header>Clarification of treatment of Frances Perkins Building</header><text display-inline="yes-display-inline">The entirety of the Frances Perkins Building, including any portion of the Building which is north of D Street Northwest, shall be included in the Federal District.</text></subsection></section> 
<section id="H1DC13033BDDB4B18B526E6FE7EC0E8F9"><enum>6.</enum><header>Transition provisions relating to House of Representatives</header> 
<subsection id="H11E438A004A246DCA975AEDBC7AFA31A"><enum>(a)</enum><header>Temporary increase in apportionment</header> 
<paragraph id="H2E74A37D56F44AA3917CE0ADD7A1F5DC"><enum>(1)</enum><header>In general</header><text>Until the taking effect of the first reapportionment occurring after the effective date of this Act—</text> <subparagraph id="HAD9DA3FDC2254A118B39659DE522CF5B"><enum>(A)</enum><text>the State of Maryland shall be entitled to 1 additional Representative, relative to the number of Representatives to which the State was entitled as of the day before that effective date;</text></subparagraph> 
<subparagraph id="H9E5CDB75CBE4469C845A09621CF99EB9"><enum>(B)</enum><text>the additional Representative described in subparagraph (A) shall replace the Delegate to the House of Representatives from the District of Columbia; and</text></subparagraph> <subparagraph id="H0832559A33CB4F9E8594516D6A04EB4F"><enum>(C)</enum><text>the additional Representative described in subparagraph (A) shall be in addition to the membership of the House of Representatives as prescribed by law as of the day before the date of enactment of this Act.</text></subparagraph></paragraph> 
<paragraph id="idB32335CBD2B7434EBE56186AB4B932F7"><enum>(2)</enum><header>Temporary appointment of DC Delegate as Representative of Maryland</header><text>During the period beginning on the effective date of this Act and ending when a new Congress convenes, the individual who was serving as the Delegate to the House of Representatives from the District of Columbia on the day before that effective date shall serve as the additional Representative from the State of Maryland described in paragraph (1)(A).</text></paragraph> <paragraph id="H2A33AD2828C24C859579952A44624DD2"><enum>(3)</enum><header>Increase not counted against total number of members</header><text>The temporary increase in the membership of the House of Representatives provided under paragraph (1) shall not—</text> 
<subparagraph id="id260AE870F07440858BB1C90C1221F27F"><enum>(A)</enum><text>operate to increase or decrease the permanent membership of the House of Representatives as prescribed in sections 1 and 2 of the Act entitled <quote>An Act for the apportionment of Representatives in Congress among the several States under the Thirteenth Census</quote>, approved August 8, 1911 (<external-xref legal-doc="usc" parsable-cite="usc/2/2">2 U.S.C. 2</external-xref>); or</text></subparagraph> <subparagraph id="id0C1EC2F9F36E46DB9C7E549695234931"><enum>(B)</enum><text>affect the basis of reapportionment established by section 22 of the Act entitled <quote>An Act to provide for the fifteenth and subsequent decennial censuses and to provide for apportionment of Representatives in Congress</quote>, approved June 18, 1929 (<external-xref legal-doc="usc" parsable-cite="usc/2/2a">2 U.S.C. 2a</external-xref>).</text></subparagraph></paragraph></subsection> 
<subsection id="HC61AA12459C846D394BABB2DC1470488"><enum>(b)</enum><header>Repeal of laws providing for delegate from the District of Columbia</header> 
<paragraph id="HA7FFBD0F50E8479E8BDAACB1A8B3BC5D"><enum>(1)</enum><header>In general</header><text>Sections 202 and 204 of the District of Columbia Delegate Act (<external-xref legal-doc="public-law" parsable-cite="pl/91/405">Public Law 91–405</external-xref>; sections 1–401 and 1–402, D.C. Official Code) are repealed, and the provisions of law amended or repealed by such sections are restored or revived as if such sections had not been enacted.</text></paragraph> <paragraph id="idC07610B3E19C43FEBE266FFE9BA92738"><enum>(2)</enum><header>Conforming amendments to Federal law</header> <subparagraph id="id70CCAD269AE74CCDA0660B9965971A94"><enum>(A)</enum><header>Congress</header> <clause id="id17D151B8E4194A04AB4694E80C04F4F8"><enum>(i)</enum><text>Section 26 of the Revised Statutes of the United States (<external-xref legal-doc="usc" parsable-cite="usc/2/8">2 U.S.C. 8</external-xref>) is amended—</text>

<paragraph id="H5D941CA31B1B42118D377F8D8A4FE850"><enum>(4)</enum><header>Effective date</header><text>The amendments made by this subsection shall take effect on the date on which the individual serving as the Delegate to the House of Representatives from the District of Columbia first serves as a member of the House of Representatives from the State of Maryland.</text></paragraph></subsection></section> <section id="H18568FB8FD054BD9AFA6C41A78CFAA45"><enum>7.</enum><header>Effect on other laws</header><text display-inline="no-display-inline">No law or regulation in effect on the effective date of this Act shall be deemed amended or repealed by this Act except to the extent specifically provided in this Act, or to the extent that such law or regulation is inconsistent with this Act.</text></section> 
<section id="HF2F3D5F68F0047E288B611EF67CF3F43"><enum>8.</enum><header>Proclamation regarding acceptance of retrocession by Maryland</header> 
<subsection id="H060012BE921B49648CA1886C5BC22BF2"><enum>(a)</enum><header>Proclamation by President</header><text display-inline="yes-display-inline">Not later than 30 days after the State of Maryland enacts legislation accepting the retrocession described in section 3(a), the President shall issue a proclamation announcing such acceptance and declaring that the territory ceded to Congress by the State of Maryland to serve as the District constituting the permanent seat of the Government of the United States has been ceded back to the State of Maryland.</text></subsection> <subsection id="H81A2A16699394BF9A478C0105151F7CE"><enum>(b)</enum><header>Report by Congressional Budget Office on Economic Impact</header> <paragraph id="HFB95146A6A024FB4A5AC88A4ED924582"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Congressional Budget Office shall prepare a report analyzing the anticipated economic impact on the State of Maryland of the State's acceptance of the retrocession described in section 3(a), including the anticipated effect on the budgets of the State government and local governments, and shall submit the report to Congress and the governor of Maryland.</text></paragraph> 
<paragraph id="H672A5F78DC804EAF90F99366CFBB6D24"><enum>(2)</enum><header>Delay in enactment of legislation</header><text>The State of Maryland may not enact legislation accepting the retrocession described in section 3(a) until the expiration of the 1-year period that begins on the date on which the Director of the Congressional Budget Office submits the report prepared under paragraph (1) to the governor of Maryland.</text></paragraph></subsection></section> <section id="HFD27A599A829441FAA068105769F8988"><enum>9.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on the earlier of—</text> 
<paragraph id="idA024C97889C54EC68435D6AD6238C267"><enum>(1)</enum><text>the date on which the President issues a proclamation under section 8; or</text></paragraph> <paragraph id="idD8EB7D365FCC4954B367129050FC681A" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the date of the ratification of an amendment to the Constitution of the United States repealing the twenty-third article of amendment to the Constitution.</text></paragraph></section>
