Amendments to disclosures of foreign gifts.</toc-entry></toc></subsection></section><section id="id0BBEBDF883A64BCF84F9264A59F2E9FB" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id01DDBC34ECA44989A5F8ABB57B03BA75"><enum>(1)</enum><header>Federal science agency</header><text display-inline="yes-display-inline">The term <term>Federal science agency</term> means any Federal department or agency to which more than $100,000,000 in research and development funds were appropriated for the previous fiscal year.</text></paragraph><paragraph id="id3626EFBC56D949E2AE40CB02707E5142"><enum>(2)</enum><header>Research and development</header><subparagraph id="idDC8C73AA32DE4D5E8FFA0139BD60A64F"><enum>(A)</enum><header>In general</header><text>The term <term>research and development</term> means all research activities, both basic and applied, and all development activities. </text></subparagraph><subparagraph id="id22499443FD0C463287266ED298D6DDC1"><enum>(B)</enum><header>Development</header><text>The term <term>development</term> means experimental development.</text></subparagraph><subparagraph id="id5859D968B9AC4C65B0CD6F7C3B6A9BDB"><enum>(C)</enum><header>Experimental development</header><text>The term <term>experimental development</term> means creative and systematic work, drawing upon knowledge gained from research and practical experience, which—</text><clause id="id49134F2C82F442D9B23B213C35110CA2"><enum>(i)</enum><text>is directed toward the production of new products or processes or improving existing products or processes; and</text></clause><clause id="id6D34015C7AC048438B5E6AD3F8FDEC5E"><enum>(ii)</enum><text>like research, will result in gaining additional knowledge.</text></clause></subparagraph><subparagraph id="idB22BB5655A514EFC8C4CCD5B4F3B3C87"><enum>(D)</enum><header>Research</header><text>The term <term>research</term>—</text><clause id="id6BF00890D114407895803DC1F617C756"><enum>(i)</enum><text>means a systematic study directed toward fuller scientific knowledge or understanding of the subject studied; and</text></clause><clause id="idB3465CE6ADD24E7BACA90045A950B9A5"><enum>(ii)</enum><text>includes activities involving the training of individuals in research techniques if such activities—</text><subclause id="id69CC5E82F78E4EC9B383F1C97025CDFA"><enum>(I)</enum><text>utilize the same facilities as other research and development activities; and </text></subclause><subclause id="id1FE060EF6E23468384E15AF68AA20768"><enum>(II)</enum><text>are not included in the instruction function. </text></subclause></clause></subparagraph></paragraph></section><section id="id54E1A3F9508641E79CC5AAD04231E362"><enum>3.</enum><header>Federal Research Security Council</header><subsection id="idA285774F30B940E7944827C61B55412C"><enum>(a)</enum><header>In general</header><text>Subtitle V of title 31, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idA66C5F8BECDC447BBBFE31E820B13FD1"><chapter id="id1AC9408A335B4B4D926C38C00B8F9789" style="OLC"><enum>79</enum><header>Federal Research Security Council</header><toc><toc-entry level="section">Sec. </toc-entry><toc-entry level="section">7901. chapter:</text><paragraph id="idA5C8FD74557A4F188B58BF92279DDA9C"><enum>(1)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id970C220D16F2463BACEBC7E0191512B3"><enum>(A)</enum><text>the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the committee-id="">Permanent Select Committee on Intelligence of the House of Representatives</committee-name>;</text></subparagraph><subparagraph id="idB5CE43ADC3B540D1A69DB2F1196A4682"><enum>(K)</enum><text>the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name>;</text></subparagraph><subparagraph id="id546A310410BB45BBBEEAF2E67ADDF6B1"><enum>(L)</enum><text>the <committee-name committee-id="">Committee on Armed Services of the House of Representatives; and</committee-name></text></subparagraph><subparagraph id="id4148429276944E49BDFB8E1DBA1A023E"><enum>(M)</enum><text>the <committee-name committee-id="">Committee on Education and Labor of the House of Representatives</committee-name>.</text></subparagraph></paragraph><paragraph id="idD39F197565D74E50BE42092F083FC965"><enum>(2)</enum><header>Council</header><text>The term <term>Council</term> means the Federal Research Security Council established under section 7902(a).</text></paragraph><paragraph id="idB2689DBCA96D437C9C49D7A303C3CFED"><enum>(3)</enum><header>Executive agency</header><text>The term <term>Executive agency</term> has the meaning given that term in section 105 of title 5. </text></paragraph><paragraph id="id4D190CD4CE0A4A0FACCABB31EBE36FC0"><enum>(4)</enum><header>Federal research security risk</header><text>The term <term>Federal research security risk</term> means the risk posed by malign state actors and other persons to the security and integrity of research and development conducted using grants awarded by Executive agencies.</text></paragraph><paragraph id="id1fd8c3cb53e74867ad9a6493f7b67cb8"><enum>(5)</enum><header>Insider</header><text>The term <term>insider</term> means any person with authorized access to any United States Government resource, including personnel, facilities, information, research, equipment, networks, or systems. </text></paragraph><paragraph id="id7179320395f1406d93ac6847accefece"><enum>(6)</enum><header>Insider threat</header><text>The term <term>insider threat</term> means the threat that an insider will use his or her authorized access (wittingly or unwittingly) to harm the national and economic security of the United States or negatively affect the integrity of a Federal agency’s normal processes, including damaging the United States through espionage, sabotage, unauthorized disclosure of national security information or non-public information, or through the loss or degradation of departmental resources, capabilities, and functions. </text></paragraph><paragraph id="id0B9303F9BFAB4A44B0C0316F567CBAFB"><enum>(7)</enum><header>Research and development</header><subparagraph id="idF46472B94D9446EFA4277E94B2BD2ED1"><enum>(A)</enum><header>In general</header><text>The term <term>research and development</term> means all research activities, both basic and applied, and all development activities. </text></subparagraph><subparagraph id="idA939DF60CF45413587E16BAC4FBF4FE3"><enum>(B)</enum><header>Development</header><text>The term <term>development</term> means experimental development.</text></subparagraph><subparagraph id="id6879D3FA4BD242C7AAD6417660E29C55"><enum>(C)</enum><header>Experimental development</header><text>The term <term>experimental development</term> means creative and systematic work, drawing upon knowledge gained from research and practical experience, which—</text><clause id="id328C24E0390D46C28BD6142CD411D884"><enum>(i)</enum><text>is directed toward the production of new products or processes or improving existing products or processes; and</text></clause><clause id="id82941413C9F843E5816F6DD4F8AFA748" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>like research, will result in gaining additional knowledge. </text></clause></subparagraph><subparagraph id="id7478658F9FA043E0B9B1600F86D569BA"><enum>(D)</enum><header>Research</header><text>The term <term>research</term>—</text><clause id="idDFAF844DD2214865BE649D6C0F9B5213"><enum>(i)</enum><text>means a systematic study directed toward fuller scientific knowledge or understanding of the subject studied; and</text></clause><clause id="id2F6512EB26CB45E888E6C73F73DB0743"><enum>(ii)</enum><text>includes activities involving the training of individuals in research techniques if such activities—</text><subclause id="idCB78ED4CAFD440CDAE6929B134479E05"><enum>(I)</enum><text>utilize the same facilities as other research and development activities; and </text></subclause><subclause id="id6EC1DD3D64924BDA8BA30B7AC33A3DBC"><enum>(II)</enum><text>are not included in the instruction function. </text></subclause></clause></subparagraph></paragraph><paragraph id="idA8797B6F5E9F43FFAEECEC46ACB1F3AF"><enum>(8)</enum><header>United states research community</header><text>The term <term>United States research community</term> means—</text><subparagraph id="idEA82B16DE21F42E4ADE4EA61E551EDCD"><enum>(A)</enum><text>research and development centers of Executive agencies;</text></subparagraph><subparagraph id="idA51972F7A2D5403CBC0084A36ED83630"><enum>(B)</enum><text>private research and development centers in the United States, including for-profit and nonprofit research institutes;</text></subparagraph><subparagraph id="idFFBFCDBDD6334A709C8420D8BA397665"><enum>(C)</enum><text>research and development centers at institutions of higher education (as defined in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>));</text></subparagraph><subparagraph id="idDBAC9A35DB65499880F6953A985486A7"><enum>(D)</enum><text>research and development centers of States, United States territories, Indian tribes, and municipalities;</text></subparagraph><subparagraph id="idF555ED699DAA438E9B455CE855D29C8B"><enum>(E)</enum><text>government-owned, contractor-operated United States Government research and development centers; and</text></subparagraph><subparagraph id="id8A28DFF18E274EF9A543076E4CBBAB0E" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text>any person conducting federally funded research or receiving Federal research grant funding. </text></subparagraph></paragraph></section><section id="idF1CF5DB6B4F54135B0CC10DA11BBFED4"><enum>7902.</enum><header>Federal Research Security Council establishment and membership</header><subsection id="id998299E3EF3E4473936E2A090FF074AA"><enum>(a)</enum><header>Establishment</header><text>There is established, in the Office of Management and Budget, a Federal Research Security Council, which shall develop federally funded research and development grant making policy and management guidance to protect the national and economic security interests of the United States.</text></subsection><subsection id="id1C81E46D456846558ABD103B5261865B"><enum>(b)</enum><header>Membership</header><paragraph id="idA3D392B6553345FB8FEB5A9A3435A7B7"><enum>(1)</enum><header>In general</header><text>The following agencies shall be represented on the Council:</text><subparagraph id="idB4F38BBBF3A842EE84F7F0F447174542"><enum>(A)</enum><text>The Office of Management and Budget.</text></subparagraph><subparagraph id="idE1931C2BBEEB44B39352C15F09BB6605"><enum>(B)</enum><text>The Office of Science and Technology Policy.</text></subparagraph><subparagraph id="idF080470B687847ABB19C2E1E51A252E4"><enum>(C)</enum><text>The Department of Defense.</text></subparagraph><subparagraph id="id95CBE1273A8E42B4BAEAB15B7248AE62"><enum>(D)</enum><text>The Department of Homeland Security.</text></subparagraph><subparagraph id="idEF7E1EFB2955483881D36F2F6B126811"><enum>(E)</enum><text>The Office of the Director of National Intelligence, including the National Counterintelligence and Security Center.</text></subparagraph><subparagraph id="idB30F8710EBF04797B1EBB2608DF0BC96"><enum>(F)</enum><text>The Department of Justice, including the Federal Bureau of Investigation.</text></subparagraph><subparagraph id="id539CF48D02C0444E8D806B11F944FD84"><enum>(G)</enum><text>The Department of Energy.</text></subparagraph><subparagraph id="idEAD8AE594D5F457CB9C1EFE330392294"><enum>(H)</enum><text>The Department of Commerce, including the National Institute of Standards and Technology.</text></subparagraph><subparagraph id="id7BAFAB6B7FF24871A9BBAA7C4F5F91B3"><enum>(I)</enum><text>The Department of Health and Human Services, including the National Institutes of Health.</text></subparagraph><subparagraph id="idB5D613E8222D4E89833C8C9C70478D13"><enum>(J)</enum><text>The Department of State.</text></subparagraph><subparagraph id="idE53AC6D138AA4A65B6DD52BCC3F94F9E"><enum>(K)</enum><text>The Department of Transportation.</text></subparagraph><subparagraph id="idEA3685FA65604F0ABD50DD99BDB80B1A"><enum>(L)</enum><text>The National Aeronautics and Space Administration.</text></subparagraph><subparagraph id="id3AEC7F6A2264460AA306515F5670765C"><enum>(M)</enum><text>The National Science Foundation.</text></subparagraph><subparagraph id="id62F7F808114347F1B05018E97122595D"><enum>(N)</enum><text>The Department of Education.</text></subparagraph><subparagraph id="id35F7BDC6DC1F44698926DB94476983C2"><enum>(O)</enum><text>The Small Business Administration.</text></subparagraph><subparagraph id="id167E7BB01F944E62812A979E70DCFC70"><enum>(P)</enum><text>The Council of Inspectors General on Integrity and Efficiency.</text></subparagraph><subparagraph id="idAED61BA9DAC84719BEEAB43AE7C5ECF4"><enum>(Q)</enum><text>Other Executive agencies, as determined by the Chairperson of the Council.</text></subparagraph></paragraph><paragraph id="id0435D0DCAA4B45B0A1ECDC5FD8E8486A"><enum>(2)</enum><header>Lead representatives</header><subparagraph id="idD172E024884B45E78918802596FD1004"><enum>(A)</enum><header>Designation</header><text>Not later than 45 days after the date of the enactment of this chapter, the head of each agency represented on the Council shall designate a representative of that agency as the lead representative of the agency on the Council.</text></subparagraph><subparagraph id="idC458D2E246194E558A3DA68D3EBC9C1F"><enum>(B)</enum><header>Functions</header><text>The lead representative of an agency designated under subparagraph (A) shall ensure that appropriate personnel, including leadership and subject matter experts of the agency, are aware of the business of the Council.</text></subparagraph></paragraph></subsection><subsection id="id9BB16A0860DE4E8BB61D910CA71BF5FF"><enum>(c)</enum><header>Chairperson</header><paragraph id="idC0D1FB304B784193B1A5EE51FF41A5D7"><enum>(1)</enum><header>Designation</header><text>Not later than 45 days after the date of the enactment of this chapter, the Director of the Office of Management and Budget shall designate a senior-level official from the Office of Management and Budget to serve as the Chairperson of the Council.</text></paragraph><paragraph id="id189C293D1BF94DAE9AE8EF2B65DE4577"><enum>(2)</enum><header>Functions</header><text>The Chairperson shall perform functions that include—</text><subparagraph id="idA6A4098672484BB28A2CF95395098921"><enum>(A)</enum><text>subject to subsection (d), developing a schedule for meetings of the Council;</text></subparagraph><subparagraph id="idC08AB759DED94DDA8996E51929BCFFB2"><enum>(B)</enum><text>designating Executive agencies to be represented on the Council under subsection (b)(1)(Q);</text></subparagraph><subparagraph id="id00D72B43E5E6476A858C36A231DF14DC"><enum>(C)</enum><text>in consultation with the lead representative of each agency represented on the Council, developing a charter for the Council; and</text></subparagraph><subparagraph id="id63B289335D1D4F28B0409B76EDCA1853"><enum>(D)</enum><text>not later than 7 days after completion of the charter, submitting the charter to the appropriate congressional committees.</text></subparagraph></paragraph><paragraph id="id1A0FA9CC02C54038AF6A1CFD8571D727"><enum>(3)</enum><header>Lead science advisor</header><text>The Director of the Office of Science and Technology Policy shall be the lead science advisor to the Chairperson for purposes of this chapter.</text></paragraph><paragraph id="id235a5fdf91bd4499928756769b7e4179"><enum>(4)</enum><header>Lead security advisor</header><text>The Director of the National Counterintelligence and Security Center shall be the lead security advisor to the Chairperson for purposes of this chapter.</text></paragraph></subsection><subsection id="id70BA22E3735C4F53BAB7BA3ADD6017E3"><enum>(d)</enum><header>Meetings</header><text>The Council shall meet not later than 60 days after the date of the enactment of this chapter and not less frequently than quarterly thereafter.</text></subsection></section><section id="id24541873FC8D4593B4F381AA8BBFB27A"><enum>7903.</enum><header>Functions and authorities</header><subsection id="idEDC99A61CEC4417687CE4382EFC2EA5E"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id84c2df28afc44fe5bd0a269c5196741d"><enum>(1)</enum><header>Implementing</header><text>The term <term>implementing</term> means working with the relevant Federal agencies, through existing processes and procedures, to enable those agencies to put in place and enforce the measures described in this section. </text></paragraph><paragraph id="id27E7E64775844F5BA27E051A3B3CB0C3"><enum>(2)</enum><header>Uniform application process</header><text>The term <term>uniform application process</term> means a process employed by Federal science agencies to maximize the collection of information regarding applicants and applications, as determined by the Council.</text></paragraph></subsection><subsection id="id7292A5E4BFC8484890819007F2F1EB6B"><enum>(b)</enum><header>In general</header><text>The Chairperson of the Council shall consider the missions and responsibilities of Council members in determining the lead agencies for Council functions. The Council shall perform the following functions:</text><paragraph id="id3A95A2F89F4944DB80D0578B69DA09A7"><enum>(1)</enum><text>Developing and implementing, across all Executive agencies that award research and development grants, a uniform application process for grants in accordance with subsection (c).</text></paragraph><paragraph id="idF3AAF6E2F8CA4687AFF32C6342433FCF"><enum>(2)</enum><text>Developing and implementing a uniform and regular reporting process for identifying persons participating in federally funded research and development or that have access to nonpublic federally funded information, data, research findings, and research and development grant proposals.</text></paragraph><paragraph id="id90AB0439C9BE415FB614456EE5D56248"><enum>(3)</enum><text>Identifying or developing criteria, in accordance with subsection (d), for sharing and receiving information with respect to Federal research security risks in order to mitigate such risks with—</text><subparagraph id="idED5595A4A4BD44E884A2CE2616C52E25"><enum>(A)</enum><text>members of the United States research community; and</text></subparagraph><subparagraph id="id7D2E7486F29F441BA8D03B5C756538B4"><enum>(B)</enum><text>other persons participating in federally funded research and development.</text></subparagraph></paragraph><paragraph id="idEDDD0552C9B34F3A9F81DB7D02603D1F"><enum>(4)</enum><text>Identifying an appropriate Executive agency—</text><subparagraph id="idA57C957700F64EFAAFA632095CC26528"><enum>(A)</enum><text>to accept and protect information submitted by Executive agencies and non-Federal entities based on the processes established under paragraphs (1) and (2); and</text></subparagraph><subparagraph id="id8D1B75E8FC2C49669136CBBE73303EC7"><enum>(B)</enum><text>to facilitate the sharing of information received under subparagraph (A) to support, as necessary and appropriate—</text><clause id="idDE81DBCA43274C7A96E1192A2FC46907"><enum>(i)</enum><text>oversight of federally funded research and development;</text></clause><clause id="idCDAFECA61C06451EA87CE6170E6B9353"><enum>(ii)</enum><text>criminal and civil investigations of misappropriated Federal funds, resources, and information; and</text></clause><clause id="idE6A779E3E68F48869FAFC0B35AC68D56"><enum>(iii)</enum><text>counterintelligence investigations.</text></clause></subparagraph></paragraph><paragraph id="id7C4B94019D734535ABFEE6F9CF106904"><enum>(5)</enum><text>Identifying, as appropriate, Executive agencies to provide—</text><subparagraph id="idF6DEBBD03AD3415C8C531D9C29DFDF14"><enum>(A)</enum><text>shared services, such as support for conducting Federal research security risk assessments, activities to mitigate such risks, and oversight and investigations with respect to grants awarded by Executive agencies; and</text></subparagraph><subparagraph id="id42F646A739C64633B4401617491C6AAE"><enum>(B)</enum><text>common contract solutions to support enhanced information collection and sharing and the verification of the identities of persons participating in federally funded research and development.</text></subparagraph></paragraph><paragraph id="id7FF1DC06D019422BA063C717F8E6D1E4"><enum>(6)</enum><text>Identifying and issuing guidance, in accordance with subsection (e) and in coordination with the National Insider Threat Task Force established by Executive Order 13587 (<external-xref legal-doc="usc" parsable-cite="usc/50/3161">50 U.S.C. 3161</external-xref> note) for developing and implementing insider threat programs for Executive agencies to deter, detect, and mitigate insider threats, including the safeguarding of sensitive information from exploitation, compromise, or other unauthorized disclosure, taking into account risk levels and the distinct needs, missions, and systems of each such agency.</text></paragraph><paragraph id="idEC1467F229E54C138B63ADD8227AC784"><enum>(7)</enum><text>Identifying and issuing guidance for developing compliance and oversight programs for Executive agencies to ensure that research and development grant recipients accurately report conflicts of interest and conflicts of commitment in accordance with subsection (c)(1). Such programs shall include an assessment of—</text><subparagraph id="id1BB2DA9433CA4A1BBCE4E28872EACF34"><enum>(A)</enum><text>a grantee’s support from foreign sources and affiliations with foreign funding institutions or laboratories; and </text></subparagraph><subparagraph id="id8229579CB4F944A780E35364B0AE9DB8"><enum>(B)</enum><text>the impact of such support and affiliations on United States national security and economic interests.</text></subparagraph></paragraph><paragraph id="idB87F2CB4EF984412ADBA71AD75E209E1"><enum>(8)</enum><text>Assessing and making recommendations with respect to whether openly sharing certain types of federally funded research and development is in the economic and national security interests of the United States.</text></paragraph><paragraph id="id7A3E8AB0C1274113973FF48309BF56C6"><enum>(9)</enum><text>Identifying and issuing guidance to the United States research community, and other recipients of Federal research and development funding, to ensure that such institutions and recipients adopt existing best practices to reduce the risk of misappropriation of research data.</text></paragraph><paragraph id="idFF24C041CDDB4AB386D9EAD3A6648693"><enum>(10)</enum><text>Identifying and issuing guidance on additional steps that may be necessary to address Federal research security risks arising in the course of Executive agencies providing shared services and common contract solutions under paragraph (5)(B).</text></paragraph><paragraph id="id5957AC8047D847978C5CFAD059E03F66"><enum>(11)</enum><text>Engaging with the United States research community in performing the functions described in paragraphs (1), (2), and (3) and with respect to issues relating to Federal research security risks.</text></paragraph><paragraph id="idC3E48AFF6B9A45E1AED15A4BFE5AA01C"><enum>(12)</enum><text>Carrying out such other functions, as determined by the Council, that are necessary to reduce Federal research security risks.</text></paragraph></subsection><subsection id="id9DD6FA328D4E41E6AA7EFD46FD6744D0"><enum>(c)</enum><header>Requirements for uniform grant application process</header><text>In developing the uniform application process for Federal research and development grants required under subsection (b)(1), the Council shall—</text><paragraph id="id7E8D9247D3724BD9848B6EF17E545A41"><enum>(1)</enum><text>ensure that the process—</text><subparagraph id="idED47ECA68D5B469EAAA8083CF156F9C9"><enum>(A)</enum><text>requires principal investigators, co-principal investigators, and senior personnel associated with the proposed Federal research or development grant project—</text><clause id="id103435E342494EB9924AF5F00247E0C8"><enum>(i)</enum><text>to disclose biographical information, all affiliations, including any foreign military, foreign government-related organizations, and foreign-funded institutions, and all current and pending support, including from foreign institutions, foreign governments, or foreign laboratories, and all support received from foreign sources; and</text></clause><clause id="idD6C9E3E2CE664032824218BA21CEBE55"><enum>(ii)</enum><text>to certify the accuracy of the required disclosures under penalty of perjury; and </text></clause></subparagraph><subparagraph id="id7AFB70B69DA744D78028DD096D625DD9"><enum>(B)</enum><text>uses a machine-readable application form to assist in identifying fraud and ensuring the eligibility of applicants;</text></subparagraph></paragraph><paragraph id="id95194841DD084FB8A70CE0084551AEE5"><enum>(2)</enum><text>design the process—</text><subparagraph id="id8FF9A51C40B640F88C6C310ED4047294"><enum>(A)</enum><text>to reduce the administrative burden on persons applying for Federal research and development funding; and</text></subparagraph><subparagraph id="idC8096342F917481899B37B9EF351DD52"><enum>(B)</enum><text>to promote information sharing across the United States research community, while safeguarding sensitive information; and</text></subparagraph></paragraph><paragraph id="idAB8B0DDACF8949AF9882069246D7C422"><enum>(3)</enum><text>complete the process not later than 1 year after the date of the enactment of the <short-title>Safeguarding American Innovation Act</short-title>.</text></paragraph></subsection><subsection id="idB549F5CDFE764257BFD161EF28527F4A"><enum>(d)</enum><header>Requirements for information sharing criteria</header><text>In identifying or developing criteria and procedures for sharing information with respect to Federal research security risks under subsection (b)(3), the Council shall ensure that such criteria address, at a minimum—</text><paragraph id="idEDE39FEC8C7F452BAD3615EC9722A141"><enum>(1)</enum><text>the information to be shared;</text></paragraph><paragraph id="id971DCF42EE494BA7B824AFF8A5391DBF"><enum>(2)</enum><text>the circumstances under which sharing is mandated or voluntary;</text></paragraph><paragraph id="id8D2FBA5249FA4C2395954792FA6A83FB"><enum>(3)</enum><text>the circumstances under which it is appropriate for an Executive agency to rely on information made available through such sharing in exercising the responsibilities and authorities of the agency under applicable laws relating to the award of grants;</text></paragraph><paragraph id="id0052B9AEF6504A318F38B19966FB772A"><enum>(4)</enum><text>the procedures for protecting intellectual capital that may be present in such information; and</text></paragraph><paragraph id="id40BCA16E694F45E7AFE32C69A89012F9"><enum>(5)</enum><text>appropriate privacy protections for persons involved in Federal research and development.</text></paragraph></subsection><subsection id="id979e62d854634a6ea4ebd001a76a5b94"><enum>(e)</enum><header>Requirements for insider threat program guidance</header><text>In identifying or developing guidance with respect to insider threat programs under subsection (b)(6), the Council shall ensure that such guidance provides for, at a minimum—</text><paragraph id="idbdd04271d1ec40e59b75ab86db1823bb"><enum>(1)</enum><text>such programs—</text><subparagraph id="idDDE653B1DD5B49B18D9A335FA4D77689"><enum>(A)</enum><text>to deter, detect, and mitigate insider threats; and</text></subparagraph><subparagraph id="id72C7D59861D3483F8E7A154F22726D49"><enum>(B)</enum><text>to leverage counterintelligence, security, information assurance, and other relevant functions and resources to identify and counter insider threats;</text></subparagraph></paragraph><paragraph id="id7a135ba179b24316983d7737f0956772"><enum>(2)</enum><text>the development of an integrated capability to monitor and audit information for the detection and mitigation of insider threats, including through—</text><subparagraph id="idd665bae107cf43829b243a268c9d4658"><enum>(A)</enum><text>monitoring user activity on computer networks controlled by Executive agencies;</text></subparagraph><subparagraph id="id00ff617f2b5743e78ac669c3cdd6e7bd"><enum>(B)</enum><text>providing employees of Executive agencies with awareness training with respect to insider threats and the responsibilities of employees to report such threats;</text></subparagraph><subparagraph id="id699f63a060de4674a686a25921fbe70b"><enum>(C)</enum><text>gathering information for a centralized analysis, reporting, and response capability; and</text></subparagraph><subparagraph id="id85E900D2A8F24AEB9237869143CCAB56"><enum>(D)</enum><text>information sharing to aid in tracking the risk individuals may pose while moving across programs and affiliations;</text></subparagraph></paragraph><paragraph id="idce9e261cfe824552bdaed2ff1fd9b221"><enum>(3)</enum><text>the development and implementation of policies and procedures under which the insider threat program of an Executive agency accesses, shares, and integrates information and data derived from offices within the agency;</text></paragraph><paragraph id="id9e3fc4c3b9f64e199edd82326e6709f2"><enum>(4)</enum><text>the designation of senior officials with authority to provide management, accountability, and oversight of the insider threat program of an Executive agency and to make resource recommendations to the appropriate officials; and</text></paragraph><paragraph id="id585bc6bc630b452783d1af1efa750ada"><enum>(5)</enum><text>such additional guidance as is necessary to reflect the distinct needs, missions, and systems of each Executive agency.</text></paragraph></subsection><subsection id="id3c79aeca076b4475a276340689946807"><enum>(f)</enum><header>Issuance of warnings relating to risks and vulnerabilities in international scientific cooperation</header><paragraph id="id29CEF9E13E964877B908D863FBC39DAA"><enum>(1)</enum><header>In general</header><text>The Council, in conjunction with the lead security advisor under section 7902(c)(4), shall establish a process for informing members of the United States research community and the public, through the issuance of warnings described in paragraph (2), of potential risks and vulnerabilities in international scientific cooperation that may undermine the integrity and security of the United States research community or place at risk any federally funded research and development.</text></paragraph><paragraph id="id5d451b0dca03494992dffa77e279b33c"><enum>(2)</enum><header>Content</header><text>A warning described in this paragraph shall include, to the extent the Council considers appropriate, a description of—</text><subparagraph id="id3ba44bbca30e4f89871f264a9e3ab83c"><enum>(A)</enum><text>activities by the national government, local governments, research institutions, or universities of a foreign country—</text><clause id="id0f31206ac2e84a8a8e5967c4c21af1c4"><enum>(i)</enum><text>to exploit, interfere, or undermine research and development by the United States research community; or</text></clause><clause id="id2c7c0363254545daace1d827e2cd36ec"><enum>(ii)</enum><text>to misappropriate scientific knowledge resulting from federally funded research and development;</text></clause></subparagraph><subparagraph id="id25f2e33b0da2400897e9bbe714fac549"><enum>(B)</enum><text>efforts by strategic competitors to exploit the research enterprise of a foreign country that may place at risk—</text><clause id="idd2b4798f11934b26852c995b36ac3730"><enum>(i)</enum><text>the science and technology of that foreign country; or</text></clause><clause id="id13d4c691346c45dfbb5529da579b6059"><enum>(ii)</enum><text>federally funded research and development; and</text></clause></subparagraph><subparagraph id="id2b398db4e446492fb96a42a6ae0c882c"><enum>(C)</enum><text>practices within the research enterprise of a foreign country that do not adhere to the United States scientific values of openness, transparency, reciprocity, integrity, and merit-based competition. </text></subparagraph></paragraph></subsection><subsection id="id2940BF1DED1347F58797AAEA4291B97E"><enum>(g)</enum><header>Program office and committees</header><text>The interagency working group established under section 1746 of the National Defense Authorization Act for Fiscal Year 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>) shall be a working group under the Council performing duties authorized under such section and as directed by the Council. The Council shall use any findings or work product, existing or forthcoming, by such working group. The Council may also establish a program office and any committees, working groups, or other constituent bodies the Council deems appropriate, in its sole and unreviewable discretion, to carry out its functions. </text></subsection><subsection id="id195C460BD187498C915D23BF0B191BB4"><enum>(h)</enum><header>Exclusion orders</header><text>To reduce Federal research security risk, the Interagency Suspension and Debarment Committee shall provide quarterly reports to the Council that detail—</text><paragraph id="id016d58cc7f5145d9afeae4df9dbe011d"><enum>(1)</enum><text>the number of ongoing investigations by Council Members related to Federal research security that may result, or have resulted, in agency pre-notice letters, suspensions, proposed debarments, and debarments;</text></paragraph><paragraph id="id53ac9357031148819c9ff202dfd098bb"><enum>(2)</enum><text>Federal agencies’ performance and compliance with interagency suspensions and debarments;</text></paragraph><paragraph id="ide9e47511ca584a8787fa3930e015bb51"><enum>(3)</enum><text>efforts by the Interagency Suspension and Debarment Committee to mitigate Federal research security risk;</text></paragraph><paragraph id="id81b2c615c27949ba802194d09ecd32b9"><enum>(4)</enum><text>proposals for developing a unified Federal policy on suspensions and debarments; and</text></paragraph><paragraph id="id4ae990d684464d119ae630e4f1f0ec1a"><enum>(5)</enum><text>other current suspension and debarment related issues.</text></paragraph></subsection><subsection id="idA462AB05023C4EFD83C57C926B268A7F"><enum>(i)</enum><header>Savings provision</header><text>Nothing in this section may be construed to alter or diminish the authority of any Federal agency or to alter any procedural requirements or remedies that were in place before the date of the enactment of this chapter. </text></subsection></section><section id="id58377A5DDDAD4FAA8DCEF928791B259B"><enum>7904.</enum><header>Strategic plan</header><subsection id="id98A318C20BE842539024285D62CE7AAD"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this chapter, the Council shall develop a strategic plan for addressing Federal research security risks and for managing such risks, that includes—</text><paragraph id="id6259E7DBE18F492B9FBD75FD9EAEF3D4"><enum>(1)</enum><text>the criteria and processes required under section 7903(b), including a threshold and requirements for sharing relevant information about such risks with all Executive agencies and, as appropriate, with other Federal entities, foreign governments, and non-Federal entities;</text></paragraph><paragraph id="id5DEB8814749E40C689D335CECC84A674"><enum>(2)</enum><text>an identification of existing authorities for addressing such risks;</text></paragraph><paragraph id="id0630A5631B5346CEB328A4DDF150D064"><enum>(3)</enum><text>an identification and promulgation of best practices and procedures, and an identification of available resources, for Executive agencies to assess and mitigate such risks;</text></paragraph><paragraph id="idAC808A1E1EDF4040844882DE78C71D88"><enum>(4)</enum><text>recommendations for any legislative, regulatory, or other policy changes to improve efforts to address such risks;</text></paragraph><paragraph id="id6177581E03E14092AB8CCF4FA569BD69"><enum>(5)</enum><text>recommendations for any legislative, regulatory, or other policy changes to incentivize the adoption of best practices for avoiding and mitigating Federal research security risks by the United States research community and key United States foreign research partners;</text></paragraph><paragraph id="idB7B1B5670FB0421AB95CCAC0E2C1E5EA"><enum>(6)</enum><text>an evaluation of the effect of implementing new policies or procedures on existing Federal grant processes, regulations, and disclosures of conflicts of interest and conflicts of commitment;</text></paragraph><paragraph id="id0314DDFACF8C4AC280E37B09B3C5EB76"><enum>(7)</enum><text>a plan for engaging with Executive agencies, the private sector, and other nongovernmental stakeholders to address such risks and share information between Executive agencies, the private sector, and nongovernmental stakeholders; and</text></paragraph><paragraph id="id8EF8A11F5FB441199CCC29F0C199E984"><enum>(8)</enum><text>a plan for identification, assessment, mitigation, and vetting of Federal research security risks.</text></paragraph></subsection><subsection id="idDD4C9A287631442988C08619BE464BAB"><enum>(b)</enum><header>Submission to Congress</header><text>Not later than 7 calendar days after completion of the strategic plan required by subsection (a), the Chairperson of the Council shall submit the plan to the appropriate congressional committees.</text></subsection></section><section id="id9EF4249811D54757A04A85910C948AA3"><enum>7905.</enum><header>Annual report</header><text display-inline="no-display-inline">Not later than December 15 of each year, the Chairperson of the Council shall submit a report to the appropriate congressional committees that describes—</text><paragraph id="id1F619B013E4740258A319972708377FB"><enum>(1)</enum><text display-inline="yes-display-inline">the activities of the Council during the preceding fiscal year; and</text></paragraph><paragraph id="id84F8ABF7B2464B18AF50C98954A1F38D"><enum>(2)</enum><text display-inline="yes-display-inline">the progress made toward implementing the strategic plan required under section 7904 after such plan has been submitted to Congress.</text></paragraph></section><section id="id360D1B89F59240F1BD538D823A469758"><enum>7906.</enum><header>Requirements for Executive agencies</header><subsection id="id9098DFA4C5A947DBABEE35A42F9BE9A7"><enum>(a)</enum><header>In general</header><text>The head of each Executive agency on the Council shall be responsible for—</text><paragraph id="id7B804B6562B045739D292E3BB1225A2B"><enum>(1)</enum><text>assessing Federal research security risks posed by persons participating in federally funded research and development;</text></paragraph><paragraph id="id83BC4D22291144609A8840535E061DE2"><enum>(2)</enum><text>avoiding or mitigating such risks, as appropriate and consistent with the standards, guidelines, requirements, and practices identified by the Council under section 7903(b);</text></paragraph><paragraph id="id172167D43E504CB2B8DDA1572B8CBF6B"><enum>(3)</enum><text>prioritizing Federal research security risk assessments conducted under paragraph (1) based on the applicability and relevance of the research and development to the national security and economic competitiveness of the United States; and</text></paragraph><paragraph id="id6BC6FD352B024A94AED98E3E9F820B7E"><enum>(4)</enum><text>ensuring that all agency initiatives impacting federally funded research grant making policy and management to protect the national and economic security interests of the United States are integrated with the activities of the Council. </text></paragraph></subsection><subsection id="idA53F037C5A2D4A86AA9BC3464A3E6041"><enum>(b)</enum><header>Inclusions</header><text>The responsibility of the head of an Executive agency for assessing Federal research security risk described in subsection (a) includes—</text><paragraph id="id17371F73968F49CDB384EA00D6AE88A2"><enum>(1)</enum><text>developing an overall Federal research security risk management strategy and implementation plan and policies and processes to guide and govern Federal research security risk management activities by the Executive agency;</text></paragraph><paragraph id="id1647200650014201A92F68BEA189B62D"><enum>(2)</enum><text>integrating Federal research security risk management practices throughout the lifecycle of the grant programs of the Executive agency;</text></paragraph><paragraph id="id4E9CBF023A42425F9C75CEEE6C21FE5E"><enum>(3)</enum><text>sharing relevant information with other Executive agencies, as determined appropriate by the Council in a manner consistent with section 7903; and</text></paragraph><paragraph id="id142BBA93970B4EFC9FA633F3AEC8008F"><enum>(4)</enum><text>reporting on the effectiveness of the Federal research security risk management strategy of the Executive agency consistent with guidance issued by the Office of Management and Budget and the Council.</text></paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id458AE065DAA34FC88D7C3918356CF981" commented="no"><enum>(b)</enum><header>Clerical amendment</header><text>The table of chapters at the beginning of title 31, United States Code, is amended by inserting after the item relating to chapter 77 the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id90CE58ECF08349B3B93C9FE521ABBA1E"><toc><multi-column-toc-entry bold="on" level="section"><toc-enum>79.</toc-enum><level-header level="section"> Federal Research Security Council</level-header><target>7901.</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id06D047375DAF42A485E87E2F49F2F013"><enum>4.</enum><header>Federal grant application fraud</header><subsection id="id93A7CC5020BB4CCEB63E3C3E44E94887"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">Chapter 47</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block id="idFA8A6A923D414283B89CF323FC30E10B" display-inline="no-display-inline" style="USC"><section id="id71412D86939141618F51286927A606DA"><enum>1041.</enum><header>Federal grant application fraud</header><subsection id="id78C5004164DC4464BA6331818B184D87"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id0F8F71A70B6442F39D28CA5989867D75"><enum>(1)</enum><header>Federal agency</header><text>The term <term>Federal agency</term> has the meaning given the term <quote>agency</quote> in section 551 of title 5, United States Code.</text></paragraph><paragraph id="idF5A75581A7024CB38AB2469C1321D64A"><enum>(2)</enum><header>Federal grant</header><text>The term <term>Federal grant</term>—</text><subparagraph id="id82E950AF90504F82806624DC6BE49380"><enum>(A)</enum><text>means a grant awarded by a Federal agency;</text></subparagraph><subparagraph id="id93EB7DE0F6C746A1AA338D6105F125D8"><enum>(B)</enum><text>includes a subgrant awarded by a non-Federal entity to carry out a Federal grant program; or</text></clause><clause id="id820CED049D934E85811D1BFFCC107240"><enum>(v)</enum><text>insurance.</text></clause></subparagraph></paragraph><paragraph id="id9BD668071CF54C34A81D45A79BDBA4F2"><enum>(3)</enum><header>Federal grant application</header><text>The term <term>Federal grant application</term> means an application for a Federal grant.</text></paragraph><paragraph id="id36589F95641B4343B9B69B0A7C38E24D"><enum>(4)</enum><header>Foreign compensation</header><text>The term <term>foreign compensation</term> means a title, monetary compensation, access to a laboratory or other resource, or other benefit received from—</text><subparagraph id="id75E1649320344FD9A13F782C2D433B16"><enum>(A)</enum><text>a foreign government;</text></subparagraph><subparagraph id="id70078F2521D44D98893A51F6C93FC76F"><enum>(B)</enum><text>a foreign government institution; or</text></subparagraph><subparagraph id="id3269B25903E94BFE8AAF61C13834EF2C"><enum>(C)</enum><text>a foreign public enterprise.</text></subparagraph></paragraph><paragraph id="id72C592F1EEFF46EFB0C06E037802EAB9"><enum>(5)</enum><header>Foreign government</header><text>The term <term>foreign government</term> includes a person acting or purporting to act on behalf of—</text><subparagraph id="id5D758A4A23424A7F89133DB7D706730A"><enum>(A)</enum><text>a faction, party, department, agency, bureau, subnational administrative entity, or military of a foreign country; or</text></subparagraph><subparagraph id="id6A1A4F9C9E314DC98720947F1ACCFCA3"><enum>(B)</enum><text>a foreign government or a person purporting to act as a foreign government, regardless of whether the United States recognizes the government.</text></subparagraph></paragraph><paragraph id="id44E20448AC4C47298E807428B385B945"><enum>(6)</enum><header>Foreign government institution</header><text>The term <term>foreign government institution</term> means a foreign entity owned by, subject to the control of, or subject to regulation by a foreign government.</text></paragraph><paragraph id="id8C44AD03D60E4DD7B0A56CB170ACDE21"><enum>(7)</enum><header>Foreign public enterprise</header><text>The term <term>foreign public enterprise</term> means an enterprise over which a foreign government directly or indirectly exercises a dominant influence.</text></paragraph><paragraph id="id58EDA42149CB4AC8814A5C943F9CE398"><enum>(8)</enum><header>Law enforcement agency</header><text>The term <term>law enforcement agency</term>—</text><subparagraph id="id344BF5938CB94C958550CEFAD8629E43"><enum>(A)</enum><text>means a Federal, State, local, or Tribal law enforcement agency; and</text></subparagraph><subparagraph id="idB356D0E8459C49F5A6615ADAC64756E8"><enum>(B)</enum><text>includes—</text><clause id="id141A72DD62004BFA8D89D895B62D9B3B"><enum>(i)</enum><text>the Office of Inspector General of an establishment (as defined in <external-xref legal-doc="usc-act" parsable-cite="usc-act/Inspector General Act of 1978 /12">section 12</external-xref> of the Inspector General Act of 1978 (5 U.S.C. App.)) or a designated Federal entity (as defined in <external-xref legal-doc="usc-act" parsable-cite="usc-act/Inspector General Act of 1978 /8G">section 8G(a)</external-xref> of the Inspector General Act of 1978 (5 U.S.C. App.)); and</text></clause><clause id="id7E80C0E4002C4ECFBA4C5A2F9150FF1A"><enum>(ii)</enum><text>the Office of Inspector General, or similar office, of a State or unit of local government.</text></clause></subparagraph></paragraph><paragraph id="id148AA8CED94849A3B655BAF5FF2FB4BE"><enum>(9)</enum><header>Outside compensation</header><text>The term <term>outside compensation</term> means any compensation, resource, or support regardless of monetary value made available to the applicant in support of or related to any research endeavor, including, but not limited to, a title, research grant, cooperative agreement, contract, institutional award, access to a laboratory, or other resource, including, but not limited to, materials, travel compensation, or work incentives. </text></paragraph></subsection><subsection id="id418AB068599B4F469BCE937F1830BC83"><enum>(b)</enum><header>Prohibition</header><text>It shall be unlawful for any individual to knowingly—</text><paragraph id="id5B7B69EC8A6F492E84C0D2319F24C2FD"><enum>(1)</enum><text>prepare or submit a Federal grant application that fails to disclose the receipt of any outside compensation, including foreign compensation, by the individual;</text></paragraph><paragraph id="id4C5C16A56CCC4B179697D52660C4DFA5"><enum>(2)</enum><text>forge, counterfeit, or otherwise falsify a document for the purpose of obtaining a Federal grant; or</text></paragraph><paragraph id="id71CC08D912CA4BAEB323803AA908D9DB"><enum>(3)</enum><text>prepare, submit, or assist in the preparation or submission of a Federal grant application or document in connection with a Federal grant application that—</text><subparagraph id="id3D1326C7780E4937811F021D2712C78B"><enum>(A)</enum><text>contains a false statement;</text></subparagraph><subparagraph id="id9099FA8D21304804994DA69E9781F3A0"><enum>(B)</enum><text>contains a material misrepresentation;</text></subparagraph><subparagraph id="idF5F1E6893E784B70A6D819B7A6BDCCE4"><enum>(C)</enum><text>has no basis in law or fact; or</text></subparagraph><subparagraph id="id234A3F80E2F447B69C9D4C522D193B85"><enum>(D)</enum><text>fails to disclose a material fact.</text></subparagraph></paragraph></subsection><subsection id="idA151273D754048BABEA42A56F19EAEF8"><enum>(c)</enum><header>Exception</header><text>Subsection (b) does not apply to an activity—</text><paragraph id="idAF379C18E7D543B1A71BA7C04B06E6AB"><enum>(1)</enum><text>carried out in connection with a lawfully authorized investigative, protective, or intelligence activity of—</text><subparagraph id="id0DD8E4DD48C84AB7A6BF9F4ECB12F92D"><enum>(A)</enum><text>a law enforcement agency; or</text></subparagraph><subparagraph id="id59C96524DFD44A09850385AA3553978F"><enum>(B)</enum><text>a Federal intelligence agency; or</text></subparagraph></paragraph><paragraph id="idC25B749CA1E74AE4B6DF803CAAFA142A"><enum>(2)</enum><text>authorized under chapter 224.</text></paragraph></subsection><subsection id="idC776B98472A2455E99F0F7D41F7BD7C2"><enum>(d)</enum><header>Penalty</header><text>Any individual who violates subsection (b)—</text><paragraph id="idF439DD1345064E56B2711B0FDD7A2692"><enum>(1)</enum><text>shall be fined in accordance with this title, imprisoned for not more than 5 years, or both; and</text></paragraph><paragraph id="idF0A7AA2DBA394843A546D618BB3F5D31" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>shall be prohibited from receiving a Federal grant during the 5-year period beginning on the date on which a sentence is imposed on the individual under paragraph (1).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idE88DC08CFBC542C6A4C9C96CC752EBC3"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">chapter 47</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id8F4F992F618749379DDC9023CB656D7E"><toc><toc-entry level="section" bold="off">1041. Federal grant application fraud.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section section-type="subsequent-section" id="idD10F6B4A4CBE43EFB46AFE54BDDD4D09"><enum>5.</enum><header>Restricting the acquisition of goods, technologies, and sensitive information to certain aliens</header><subsection id="id8782E28875F24A91B618C4F2A38ADE18"><enum>(a)</enum><header>Grounds of inadmissibility</header><text display-inline="yes-display-inline">Section 212(a)(3)(A)(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(A)(i)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id70C23320981D447282B3BBE354B9C884"><clause id="id9B83970714D1473F97E7EE48BF4CCD5E"><enum>(i)</enum><text>any activity—</text><subclause id="idBBF9B2CEAF034AFFBB9E10B628FB7096"><enum>(I)</enum><text>to violate any law of the United States relating to espionage or sabotage;</text></subclause><subclause id="idCE82325BA189487D9FF34705F2C3578C"><enum>(II)</enum><text>to violate or evade any law prohibiting the export from the United States of goods, technologies, or sensitive information; or</text></subclause><subclause id="id694BD2AAA3164033861B5F9400210BE0"><enum>(III)</enum><text>to acquire export-controlled goods, technologies, or sensitive information through any exclusions for items normally subject to export controls if the Secretary of State has determined that the acquisition of those goods, technologies, or sensitive information by that alien would be contrary to an articulable national security (including economic security) interest of the United States;</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id1C6927CA48944BF2BDEEC4F6E9A7FAE1"><enum>(b)</enum><header>Determining factors</header><paragraph id="id9E6F125D10B94B78B338DFE34A7F8B0B"><enum>(1)</enum><header>In general</header><text>To determine whether an alien is inadmissible under section 212(a)(3)(A)(i)(III) of the Immigration and Nationality Act, as amended by subsection (a), officials of the Department of State shall—</text><subparagraph id="id5DB1E7BB226D4F9CB4E2EEFE64E962A7"><enum>(A)</enum><text>seek advice and assistance from officials at the Office of the Director of National Intelligence, the Office of Science and Technology Policy, the Department of Health and Human Services, the Department of Defense, the Department of Homeland Security, the Department of Energy, the Department of Commerce, and other appropriate Federal agencies;</text></subparagraph><subparagraph id="idB890CF8080104B0EA8655E8CD4CBC92E"><enum>(B)</enum><text>make a determination of the alien’s past, current, or intended employment or cooperation with—</text><clause id="id6C33C4F23C454347B38923203642BFCB"><enum>(i)</enum><text>foreign military and security related organizations that are adversarial to the United States;</text></clause><clause id="id9D7651D570C546EBBDC8293277F7F872"><enum>(ii)</enum><text>foreign institutions involved in the theft of United States research;</text></clause><clause id="id62E0C9F29A9B4B81A103A59355A7E6BD"><enum>(iii)</enum><text>entities involved in export control violations or the theft of intellectual property;</text></clause><clause id="id0A28A44E3CB84DE98A9C7F67A345F00C"><enum>(iv)</enum><text>a government that seeks to undermine the integrity and security of the United States research community; or</text></clause><clause id="id518E08D899E9449CAB56DFBC86469EEA"><enum>(v)</enum><text>other associations or collaborations that pose a national or economic security threat based on intelligence assessments; and</text></clause></subparagraph><subparagraph id="id5CB69E6E7551443CA45014BDFECC923D"><enum>(C)</enum><text>weigh the proportionality of risk for the factors listed in subparagraph (B).</text></subparagraph></paragraph><paragraph id="idF75E2BB2F3394F69AB614A19705CDCCC"><enum>(2)</enum><header>Machine-readable documents</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary of State shall—</text><subparagraph id="idB135616736A842E08AB59F7F20B7317D"><enum>(A)</enum><text>use a machine-readable visa application form; and </text></subparagraph><subparagraph id="id608DA45B7F434906A5185FCD286E46D3"><enum>(B)</enum><text>make available documents submitted in support of a visa application in a machine readable format to assist in—</text><clause id="idE3D16FC9F082453EBA09CC506BB6D9DF"><enum>(i)</enum><text>identifying fraud;</text></clause><clause id="id772AB85B24D6489B9603AFE459004DFE"><enum>(ii)</enum><text>conducting lawful law enforcement activities; and </text></clause><clause id="idD6407F4772D5462699EA14A5182313A7"><enum>(iii)</enum><text>determining the eligibility of applicants for a visa under the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> et seq.). </text></clause></subparagraph></paragraph></subsection><subsection id="id85AD1F7BD5564746ABC9F14DA78C6E50"><enum>(c)</enum><header>Reporting requirement</header><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Secretary of State, in coordination with the Director of National Intelligence, the Director of the Office of Science and Technology Policy, the Secretary of Homeland Security, the Secretary of Defense, the Secretary of Energy, the Secretary of Commerce, and the heads of other appropriate Federal agencies, shall submit a report to Congress that identifies—</text><paragraph id="idABEF07BC2F6344EF9A5F4703779B0274"><enum>(1)</enum><text>any criteria used to describe the aliens to which such section 212(a)(3)(A)(i)(III) may apply; and</text></paragraph><paragraph id="id13C408D91FC24FDE96AEE494EE5D04A9"><enum>(2)</enum><text>the number of individuals determined to be inadmissible under such section 212(a)(3)(A)(i)(III), including the nationality of each such individual.</text></paragraph></subsection><subsection id="id69cac8d9fe4048c7a5b21cc77f201278"><enum>(d)</enum><header>Classification of annual report</header><text>Each annual report required under subsection (c) shall be submitted, to the extent practicable, in an unclassified form, but may be accompanied by a classified appendix detailing the criteria used to describe the aliens to which such section 212(a)(3)(A)(i)(III) applies if the Secretary of State determines that such action—</text><paragraph id="idb22853ab5e9c4b4eaee250e33ab9ed77"><enum>(1)</enum><text>is in the national security and economic security interests of the United States; or</text></paragraph><paragraph id="id23cdcec9f1444b3b97a66fb1b7950949"><enum>(2)</enum><text>is necessary to further the purposes of this Act. </text></paragraph></subsection><subsection id="id52324e972f024dd48ac872edd24de107"><enum>(e)</enum><header>Report</header><text>Not later than 45 days after the date of the enactment of this Act, the Secretary of State shall submit a report to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name>, the <committee-name committee-id="SLIN00">Select Committee on Intelligence of the Senate</committee-name>, the <committee-name committee-id="SSFR00">Committee on Foreign Relations of the Senate</committee-name>, the <committee-name committee-id="">Committee on Oversight and Reform of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name>, the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name>, the <committee-name committee-id="">Permanent Select Committee on Intelligence of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on Foreign Affairs of the House of Representatives</committee-name> that— </text><paragraph id="id506082e58e5e4c8aa90b6b062aef3165"><enum>(1)</enum><text>describes how supplementary documents provided by a visa applicant in support of a visa application are stored and shared by the Department of State with authorized Federal agencies;</text></paragraph><paragraph id="id744249655a474f7a862ee7eec2273465"><enum>(2)</enum><text>identifies the sections of a visa application that are machine-readable and the sections that are not machine-readable;</text></paragraph><paragraph id="id894f72f198cf465ab56763bbc3312122"><enum>(3)</enum><text>provides cost estimates, including personnel costs and a cost-benefit analysis for adopting different technologies, including optical character recognition, for—</text><subparagraph id="id2B28EA0B821F428E89F86FD823F6793D"><enum>(A)</enum><text>making every element of a visa application, and documents submitted in support of a visa application, machine-readable; and</text></subparagraph><subparagraph id="id6D4E0397D0B64AFFA7BBF939910A19F9"><enum>(B)</enum><text>ensuring that such system—</text><clause id="id842283B3832A496CB043F90083B7646F"><enum>(i)</enum><text>protects personally identifiable information; and </text></clause><clause id="id457F30DC5B4A46C188F21E7C930FE504"><enum>(ii)</enum><text>permits the sharing of visa information with Federal agencies in accordance with existing law; and</text></clause></subparagraph></paragraph><paragraph id="id4D7C6FBCA5944EBD80B32A32E2014244"><enum>(4)</enum><text>includes an estimated timeline for completing the implementation of subsection (b)(2).</text></paragraph></subsection></section><section id="idAE9B127BC2D34B6FBF7201C1DEB99CD3"><enum>6.</enum><header>Limitations on educational and cultural exchange programs</header><text display-inline="no-display-inline">Section 102(b)(5) of the Mutual Educational and Cultural Exchange Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2452">22 U.S.C. 2452(b)(5)</external-xref>) is amended by striking the semicolon at the end and inserting the following: “by developing exchange programs for foreign researchers and scientists, while protecting technologies regulated by export control laws important to the national security and economic interests of the United States, including requiring sponsors—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC157D205568342D78772B71B815836B2"><subparagraph id="id1123BAD931DB4006A769C4C9CC1EB916"><enum>(A)</enum><text>to disclose to the Department of State whether an exchange visitor, as a primary part of his or her exchange program, will have released to them controlled technology or technical data regulated by export control laws at sponsor organizations through research activities, lectures, course work, sponsor employees, officers, agents, third parties at which the sponsor places the exchange visitor, volunteers, or other individuals or entities associated with a sponsor’s administration of the exchange visitor program;</text></subparagraph><subparagraph id="idA1E3432B4A4C4BC797D2F7C5D2DF9A61" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>to provide a plan to the Department of State that establishes appropriate program safeguards to prevent the unauthorized release of controlled technology or technical data regulated by export control laws at sponsor organizations or through their employees, officers, agents, third parties, volunteers, or other individuals or entities associated with a sponsor’s administration of the exchange visitor program; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id08D886B06CAA4D30AED09ECFF19EA983"><enum>(C)</enum><text>to demonstrate, to the satisfaction of the Secretary of State, that programs that will release controlled technology or technical data to an exchange visitor at the sponsor organization through exchange visitor programs have received appropriate authorization from the Department of State, the Department of Commerce, other cognizant Federal agency before the sponsor releases controlled technology or technical data;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id768d13a0cea84942b9e1b23ff9ab03db"><enum>7.</enum><header>Amendments to disclosures of foreign gifts</header><text display-inline="no-display-inline">Section 117 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1011f">20 U.S.C. 1011f</external-xref>) is amended—</text><paragraph id="id92e3ab125e0a42b58947fc137a459dfb"><enum>(1)</enum><text>by amending subsection (a) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="iddb49231a3fa84fcea6591cf42deee02b"><subsection id="idd54eec3ba9584eea8432224102d383e9"><enum>(a)</enum><header>Disclosure report</header><paragraph id="id9BA76AAB18FF460FA00C0CB217200C5A"><enum>(1)</enum><header>In general</header><text>An institution shall file a disclosure report with the Secretary not later than March 31 occurring after—</text><subparagraph id="id496d2213cb99425a9980b7f2c86c1f25"><enum>(A)</enum><text>the calendar year in which a foreign source gains ownership of, or control over, the institution; or</text></subparagraph><subparagraph id="idcf9e7c5f87824cbcb1be8d3a566cfd2f"><enum>(B)</enum><text>the calendar year in which the institution receives a gift from, or enters into a contract with, a foreign source, the value of which is $50,000 or more, considered alone or in combination with all other gifts from or contracts with that foreign source within a calendar year.</text></subparagraph></paragraph><paragraph id="id2524A27CDC0E4BB3A853D8032EA6E4FC"><enum>(2)</enum><header>Revisions; updates</header><text>The Secretary shall permit institutions to revise and update disclosure reports previously filed to ensure accuracy, compliance, and the ability to cure.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idc789987a56a348e292356877e1217cc0"><enum>(2)</enum><text>by amending subsection (b) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id865196BF728C440CA0C3CA42E26A60A6"><subsection id="id56A40F06CA0C4A7EACD8516404BA567E"><enum>(b)</enum><header>Contents of report</header><text>Each report to the Secretary required by this section shall contain the following: </text><paragraph id="id22ef3f3fffdd4aca9191d6a9727b9e2b"><enum>(1)</enum><text>For gifts received from or contracts entered into with a foreign source other than a foreign government, the aggregate dollar amount of such gifts and contracts attributable to a particular country and the legal or formal name of the foreign source. The country to which a gift is attributable is the country of citizenship, or if unknown, the principal residence for a foreign source who is a natural person, and the country of incorporation, or if unknown, the principal place of business, for a foreign source which is a legal entity.</text></paragraph><paragraph id="id761edb57b94347828c9e051ecced46da"><enum>(2)</enum><text>For gifts received from or contracts entered into with a foreign government, the aggregate amount of such gifts and contracts received from each foreign government.</text></paragraph><paragraph id="idbc7fb33bc5ba4a9cb4e35ecb7a22f036"><enum>(3)</enum><text>In the case of an institution which is owned or controlled by a foreign source, the identity of the foreign source, the date on which the foreign source assumed ownership or control, and any changes in program or structure resulting from the change in ownership or control.</text></paragraph><paragraph id="idafad6db4e78a459196767a4cf16fa7f6"><enum>(4)</enum><text>An assurance that the institution will maintain true copies of gift and contract agreements subject to the disclosure requirements under this section for at least the duration of the agreement.</text></paragraph><paragraph id="id158afd4db3b24a8ab5ec7f2f92ed6407"><enum>(5)</enum><text>An assurance that the institution will produce true copies of gift and contract agreements subject to the disclosure requirements under this section upon request of the Secretary during a compliance audit or other institutional investigation.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id8A0D5FAD39044E2BA5D9D65F69050729"><enum>(3)</enum><text>by amending subsection (e) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id68D5DEC043DA479C9768E4911257B623"><subsection id="id900BEE7D0DA94A599F6939F64525100A"><enum>(e)</enum><header>Public inspection</header><text>Not later than 30 days after receiving a disclosure report under this section, the Secretary shall make such report electronically available to the public for downloading on a searchable database under which institutions can be individually identified and compared.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idA96E83483C80481A903DDC72C267FA72"><enum>(4)</enum><text>in subsection (f), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id8F21B24FEFBC405BB113805EBC64BF97" style="OLC"><paragraph id="id2640416F167D40C4BF9547995C848B16"><enum>(3)</enum><header>Fines</header><subparagraph id="id8DD2E4F10B8F4C1B86ED54122363FD5F"><enum>(A)</enum><header>In general</header><text>The Secretary may impose a fine on any institution that repeatedly fails to file a disclosure report for a receipt of a gift from or contract with a foreign source in accordance with subsection (a) in an amount that is not more than 3 times the amount of the gift or contract with the foreign source.</text></subparagraph><subparagraph id="id4B3C34F1ABB242BDA338257090224EEF"><enum>(B)</enum><header>Definition of repeatedly fails</header><text>In this paragraph, the term <term>repeatedly fails</term> means that the institution failed to file a disclosure report for a receipt of a gift from or contract with a foreign source in 3 consecutive years.</text></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="id7ea4deaf84f14cef98cf008d3885fae7"><enum>(5)</enum><text>by amending subsection (g) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id779c6541b91b41eab8ed177c8fa418b6"><subsection id="id6fbe639da7f9430e8c5bdb28ad0eecc8"><enum>(g)</enum><header>Rulemaking</header><paragraph id="idf62e4493d1564a508230fe04584973cd"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Safeguarding American Innovation Act</short-title>, the Secretary shall issue regulations to carry out this section using the negotiated rulemaking procedure set forth in section 492(b).</text></paragraph><paragraph id="id9f8f9fb2505b4c65b1fc8c0e848779af"><enum>(2)</enum><header>Elements</header><text>Regulations issued pursuant to paragraph (1) shall—</text><subparagraph id="id16C5D3423F334EFAB7E60D87F16C4E29"><enum>(A)</enum><text>incorporate instructions for—</text><clause id="id2A3A5B5ABE254682838ED8ED833F0208"><enum>(i)</enum><text>reporting structured gifts and contracts; and</text></clause><clause id="id8E5A3BC0975F4835A95488F96FAB8606"><enum>(ii)</enum><text>reporting contracts that balances the need for transparency, while protecting the proprietary information of institutes of higher education; and </text></clause></subparagraph><subparagraph id="idedb2876205b2415caf8cdf3e295ab5d6"><enum>(B)</enum><text>clarify the definition of <term>subunit</term>, for purposes of subsection (i)(4)(C).</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id9982724891ff4282a182871a3c368ba4"><enum>(6)</enum><text>by redesignating subsection (h) as subsection (i);</text></paragraph><paragraph id="id902e550119ce4893993cb2db352b365b"><enum>(7)</enum><text>by inserting after subsection (g) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6e66d3f0d2bf40f8bf732a9c96cace99"><subsection id="idd418d7a980a54ee99da122292a893b1d"><enum>(h)</enum><header>Treatment of tuition payment</header><text>A tuition and related fees and expenses payment to an institution by, or a scholarship from, a foreign source made on behalf of a student enrolled at such institution shall not be considered a gift from or contract with a foreign source under this section.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id68FA4BCE426E4325916B3E6FDD066845"><enum>(8)</enum><text>in subsection (i), as redesignated—</text><subparagraph id="idbeb68d8f45f843f7a9ce69bb5eb6b315"><enum>(A)</enum><text>in paragraph (3), by striking <quote>or property</quote> and inserting <quote>, property, resources, or staff, including any funds provided to the institution and used to pay, or designated for the payment of, staff</quote>; and</text></subparagraph><subparagraph id="id76339b84eeb6482980778b8eee06330d" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>in paragraph (5)(B), by inserting <quote>institutes, instructional programs,</quote> after <quote>centers,</quote>.</text></subparagraph></paragraph></section></legis-body></bill>
