which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Veterans Affairs to carry out a retraining assistance program for unemployed veterans, and for other purposes. </official-title></form><legis-body><section id="H6BF5B424F12E4A73B23057FBB54A0CAA" section-type="section-one"><enum>1.</enum><header>COVID–19 veteran rapid retraining assistance program</header><subsection id="HD317B0374CAE473393BAB1B215144586"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall carry out a program under which the Secretary shall provide up to 12 months of retraining assistance to an eligible veteran for the pursuit of a covered program of education. </text></subsection><subsection id="H1F4BB00BDBB64025850350FF94B36A8A"><enum>(b)</enum><header>Eligible veterans</header><paragraph id="H1E788EED8D5841AF85E85D37A2A6644F"><enum>(1)</enum><header>In general</header><text>For purposes of this section, an eligible veteran is a veteran who—</text><subparagraph id="H9910CEE0746E4D65BAAE99E413054370"><enum>(A)</enum><text>as of the date of the receipt by the Department of Veterans Affairs of the application for assistance under this section, is at least 22 years of age but not more than 66 years of age;</text></subparagraph><subparagraph id="H2D587EBC0803445A8433C689D05685ED"><enum>(B)</enum><text>as of such date, is unemployed by reason of a covered public health emergency, as certified by the veteran;</text></subparagraph><subparagraph id="HF2ED897BD2F04276AC73337B8D013E07"><enum>(C)</enum><text>as of such date, is not eligible to receive educational assistance under chapter 30, 31, 32, 33, or 35 of title 38, United States Code, or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/1606">chapter 1606</external-xref> of title 10, United States Code;</text></subparagraph><subparagraph id="HE21A925903954ACDA73D4E5863F65FE4"><enum>(D)</enum><text display-inline="yes-display-inline">is not enrolled in any Federal or State jobs program;</text></subparagraph><subparagraph id="H313A3D1B42984C29B3BD4D77FBD080CE"><enum>(E)</enum><text>is not in receipt of compensation for a service-connected disability rated totally disabling by reason of unemployability; and</text></subparagraph><subparagraph id="H57FB62FFE256495EA49C94BCAC9C865F" commented="no"><enum>(F)</enum><text display-inline="yes-display-inline">will not be in receipt of unemployment compensation (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/85">section 85(b)</external-xref> of the Internal Revenue Code of 1986), including any cash benefit received pursuant to subtitle A of title II of division A of the CARES Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>), as of the first day on which the veteran would receive a housing stipend payment under this section.</text></subparagraph></paragraph><paragraph id="H6C81B3C71F2145AC9C7D6839836AB8FB"><enum>(2)</enum><header>Treatment of veterans who transfer entitlement</header><text>For purposes of paragraph (1)(C), a veteran who has transferred all of the veteran’s entitlement to educational assistance under section 3319 of title 38, United States Code, shall be considered to be a veteran who is not eligible to receive educational assistance under chapter 33 of such title.</text></paragraph><paragraph id="H4EF91BEEF06244039A29DD4FBAAC85E6"><enum>(3)</enum><header>Failure to complete</header><text>Any veteran who receives retraining assistance under this section to pursue a covered program of education and who fails to complete the program of education shall not be eligible to receive additional assistance under this section.</text></paragraph></subsection><subsection id="H65AB7257256B43A680080CE35F3F3ADA"><enum>(c)</enum><header>Covered programs of education</header><paragraph id="H720A5BE67F78446DAFD5BB721B68931F"><enum>(1)</enum><header>In general</header><text>For purposes of this section, a covered program of education is a program of education (as such term is defined in section 3452(b) of title 38, United States Code) for training, pursued on a full-time or part-time basis—</text><subparagraph id="H4CA4DFEC21514951B9C53609B9A95FDB"><enum>(A)</enum><text>that—</text><clause id="H9C694C0FFDBC422196E6889BCE73DFDC"><enum>(i)</enum><text>is approved under chapter 36 of such title;</text></clause><clause id="HC895CD988F334BAAA0D708E81C8ADC68"><enum>(ii)</enum><text>does not lead to a bachelors or graduate degree; and</text></clause><clause id="HC01C208429D94954AE0B039BC0B6549E"><enum>(iii)</enum><text>is designed to provide training for a high-demand occupation, as determined under paragraph (3); or</text></clause></subparagraph><subparagraph id="HDE6AF70D52B84B6A9A249E59A28168B5"><enum>(B)</enum><text display-inline="yes-display-inline">that is a high technology program of education offered by a qualified provider, under the meaning given such terms in section 116 of the Harry W. Colmery Veterans Educational Assistance Act of 2017 (<external-xref legal-doc="public-law" parsable-cite="pl/115/48">Public Law 115–48</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/3001">38 U.S.C. 3001</external-xref> note).</text></subparagraph></paragraph><paragraph id="HEBFE6CD967434EB990F28EF16D72A40B"><enum>(2)</enum><header>Accredited programs</header><text>In the case of an accredited program of education, the program of education shall not be considered a covered program of education under this section if the program has received a show cause order from the accreditor of the program during the five-year period preceding the date of the enactment of this Act.</text></paragraph><paragraph id="H6A9FF62F9CA645AA99914D24507601B4"><enum>(3)</enum><header>Determination of high-demand occupations</header><subparagraph id="H88C0CC2808F14E20A64589E6285E51B8"><enum>(A)</enum><header>Initial implementation</header><text display-inline="yes-display-inline">In carrying out this section, to determine whether a program of education is designed to provide training for high-demand occupations, the Secretary of Veterans Affairs shall use the list of high-demand occupations compiled by the Commissioner of Labor Statistics until the final list is issued under subparagraph (C).</text></subparagraph><subparagraph id="H5D8E1D21863946B4841CBB9AD9E75408"><enum>(B)</enum><header>Study required</header><clause id="idB6C6DD9FF496401F90F7EB3814372F31"><enum>(i)</enum><header>In general</header><text>The Secretary shall enter into an agreement with a federally funded research and development corporation or another appropriate non-Department of Veterans Affairs entity for the conduct of a study to determine which occupations are high-demand occupations. </text></clause><clause id="idD92453CF548C46D9B2C2C3953A25F2C3"><enum>(ii)</enum><header>Deadline</header><text>The study described in clause (i) shall be completed not later than 90 days after the date of the enactment of this Act.</text></clause></subparagraph><subparagraph id="H32A820FFB0EA4376A4500B834831CD7B"><enum>(C)</enum><header>Final list</header><text>The Secretary—</text><clause id="H1F891C7B667743A6ACD7725DF6BD9F7E"><enum>(i)</enum><text>may add or remove an occupation from the list in use pursuant to subparagraph (A) during the 90-day period following the completion of the study required by subparagraph (B);</text></clause><clause id="H03856CA2F4094081A98C818B2A146594"><enum>(ii)</enum><text>shall issue a final list of high-demand occupations for use under this section by not later than 90 days after the date of the completion of the study; and</text></clause><clause id="HA33152C18E224FE5A6A351A1426FF4FA"><enum>(iii)</enum><text>shall make such final list publicly available on a website of the Department.</text></clause></subparagraph><subparagraph id="H41A387F662264E6381CE778D3A54A3D4"><enum>(D)</enum><header>Use of list</header><text>The Secretary shall use the final list issued under subparagraph (C) to determine whether a program of education is designed to provide training for high-demand occupations. </text></subparagraph><subparagraph id="id5FBF485C96C44B12ACFBC8657E652D31"><enum>(E)</enum><header>Removal of occupations</header><text>The Secretary may remove occupations from the final list issued under subparagraph (C) as the Secretary determines appropriate. </text></subparagraph></paragraph><paragraph id="HB15F68694DE340FD9AF3AB8673A90AAF"><enum>(4)</enum><header>Full-time defined</header><text>In this subsection, the term <term>full-time</term> has the meaning given such term under section 3688 of title 38, United States Code.</text></paragraph></subsection><subsection id="HA67A4F11FEFB4EC3B4C5A4062773EC37"><enum>(d)</enum><header>Amount of assistance</header><paragraph id="H0AEE88D23E3941F395D9EC2054EE1583"><enum>(1)</enum><header>Retraining assistance</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall provide to an eligible veteran pursuing a covered program of education under the retraining assistance program under this section an amount equal to the amount of educational assistance payable under section 3313(c)(1)(A) of title 38, United States Code. </text></paragraph><paragraph id="id0A42A839E5724A5A9E052BDDF18A233E"><enum>(2)</enum><header>Payments</header><text display-inline="yes-display-inline">Amounts described in paragraph (1) shall be payable directly to the educational institution offering the covered program of education pursued by the veteran as follows:</text><subparagraph id="H2AB830F065244ECE84EE8FAB1DF92009"><enum>(A)</enum><text display-inline="yes-display-inline">50 percent of the total amount payable shall be paid on the date on which the eligible veteran begins the covered program of education.</text></subparagraph><subparagraph id="H0D3D2EA2119440C1AFF16824B5BD97E8"><enum>(B)</enum><text>25 percent of the total amount payable shall be paid on the date on which the eligible veteran completes the covered program of education.</text></subparagraph><subparagraph id="HBF7C8BAC086344CD8511E81D46143783"><enum>(C)</enum><text>25 percent of the total amount payable shall be paid on the date on which the eligible veteran finds employment in a field related to the covered program of education.</text></subparagraph></paragraph><paragraph id="H60E504EA1F8949759A325F48F968A30A"><enum>(3)</enum><header>Failure to complete</header><subparagraph id="HFB2B6FF706BC45048DEE5A2CFA8480C5"><enum>(A)</enum><header>Pro-rated payments</header><text>In the case of an eligible veteran who pursues a covered program of education under the retraining assistance program under this section, but who does not complete the program of education, the Secretary shall pay to the educational institution offering such program of education a pro-rated amount based on the number of months the veteran pursued the program of education in accordance with this paragraph.</text></subparagraph><subparagraph id="H0F027841732C4E1D8F5421D33ACEB168"><enum>(B)</enum><header>Payment otherwise due upon completion of program</header><text>The Secretary shall pay to the educational institution a pro-rated amount under paragraph (2)(B) when the veteran provides notice to the educational institution that the veteran no longer intends to pursue the program of education.</text></subparagraph><subparagraph id="HF343B97FB1384430B27DE359AAB826DB"><enum>(C)</enum><header>Nonrecovery from veteran</header><text>In the case of a veteran referred to in subparagraph (A), the educational institution may not seek payment from the veteran for any amount that would have been payable under paragraph (2)(B) had the veteran completed the program of education.</text></subparagraph><subparagraph id="HB8E4FEB22CD44F15AC05A114D40BE969"><enum>(D)</enum><header>Payment due upon employment</header><clause id="H069D495C39A3480C9E1D0577C0A7526F"><enum>(i)</enum><header>Veterans who find employment</header><text display-inline="yes-display-inline">In the case of a veteran referred to in subparagraph (A) who finds employment in a field related to the program of education during the 180-day period beginning on the date on which the veteran withdraws from the program of education, the Secretary shall pay to the educational institution a pro-rated amount under paragraph (2)(C) when the veteran finds such employment.</text></clause><clause id="H83EE75F8607C40C2BAD77B9AC49DDC19"><enum>(ii)</enum><header>Veterans who do not find employment</header><text display-inline="yes-display-inline">In the case of a veteran referred to in subparagraph (A) who does not find employment in a field related to the program of education during the 180-day period beginning on the date on which the veteran withdraws from the program of education—</text><subclause id="H2999E55133C04BAA8B2B8B04CBBA9FAB"><enum>(I)</enum><text>the Secretary shall not make a payment to the educational institution under paragraph (2)(C); and</text></subclause><subclause id="H86A3032307A44DEFAFF0AB72C09FE0AB"><enum>(II)</enum><text>the educational institution may not seek payment from the veteran for any amount that would have been payable under paragraph (2)(C) had the veteran found employment during such 180-day period.</text></subclause></clause></subparagraph></paragraph><paragraph id="HD6108F5E403548DC96FF50340C7EEE05"><enum>(4)</enum><header>Housing stipend</header><text>For each month that an eligible veteran pursues a covered program of education under the retraining assistance program under this section, the Secretary shall pay to the veteran a monthly housing stipend in an amount equal to—</text><subparagraph id="HF4D978635E764A3FB1FBFA2C3460232C"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of a covered program of education at an institution of higher learning (as that term is defined in section 3452(f) of title 38, United States Code) pursued on more than a half-time basis, the amount specified under subsection (c)(1)(B) of section 3313 of title 38, United States Code;</text></subparagraph><subparagraph id="H8D0B5D68AD254C87A37DB89687C6B0F4"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a covered program of education at an institution other than an institution of higher learning pursued on more than a half-time basis, the amount specified under subsection (g)(3)(A)(ii) of such section; or</text></subparagraph><subparagraph id="HC259A1FF83D24C0D87D57D9939E13D60"><enum>(C)</enum><text display-inline="yes-display-inline">in the case of a covered program of education pursued on less than a half-time basis, or a covered program of education pursued solely through distance learning on more than a half-time basis, the amount specified under subsection (c)(1)(B)(iii) of such section.</text></subparagraph></paragraph><paragraph id="H6ADD1388AC824CA1B7F1F7349D5DEE6E"><enum>(5)</enum><header>Failure to find employment</header><text>The Secretary shall not make a payment under paragraph (2)(C) with respect to an eligible veteran who completes or fails to complete a covered program of education under the retraining assistance program under this section if the veteran fails to find employment in a field related to the program of education within the 180-period beginning on the date on which the veteran withdraws from or completes the program.</text></paragraph></subsection><subsection id="id233425E2BAB84F6BA7D8340863035055"><enum>(e)</enum><header>Relation to other educational assistance and benefits</header><text>Retraining assistance provided under this section shall be in addition to any other entitlement to educational assistance or benefits for which an eligible veteran is, or has been, eligible. </text></subsection><subsection id="H03F9487A5DB74C32A439ED4C9B541C43"><enum>(f)</enum><header>No transferability</header><text>Retraining assistance provided under this section may not be transferred to another individual.</text></subsection><subsection id="H503D3B9CAFA84A5B9E02D6B9BF65C9D4" commented="no"><enum>(g)</enum><header>Employment assistance</header><paragraph id="H1B6ADCE309F94731AE01AB5CD2E7D1BD"><enum>(1)</enum><header>In general</header><text>The Secretary of Labor shall contact each eligible veteran who pursues a covered program of education under this section—</text><subparagraph id="H261B49B2146D460FA72ED8B5EA84B3EB" commented="no"><enum>(A)</enum><text>not later than 30 days after the date on which the veteran begins the program of education to notify the veteran of the availability of employment placement services upon completion of the program; and</text></subparagraph><subparagraph id="H397D2B6DB189435E949E3CDD2EF026A9" commented="no"><enum>(B)</enum><text>not later than 14 days after the date on which the veteran completes, or terminates participation in, such program to facilitate the provision of employment placement services to such veteran.</text></subparagraph></paragraph><paragraph id="HE3B54536DCC945A2B8030E83436132A3"><enum>(2)</enum><header>Provision of information</header><text>The Secretary of Veterans Affairs shall provide to the Secretary of Labor such information as may be necessary to carry out paragraph (1).</text></paragraph></subsection><subsection id="H968F641687644760BDE8AC31EC12EDD2"><enum>(h)</enum><header>Nonprofit organization</header><paragraph id="H224991D6BEC84DA89DC6DE7616C04C93"><enum>(1)</enum><header>In general</header><text>The Secretary of Veterans Affairs shall seek to enter into a memorandum of understanding with one or more qualified nonprofit organizations for the purpose of facilitating the employment of eligible veterans who participate in the retraining assistance program under this section.</text></paragraph><paragraph id="H11889615E8D541B0B701EFB926642D83"><enum>(2)</enum><header>Qualified nonprofit organization</header><text>For purposes of this subsection, a qualified nonprofit organization is a nonprofit organization that—</text><subparagraph id="HCF8B7644594148999576FC7A9F866748"><enum>(A)</enum><text>is an association of businesses; and</text></subparagraph><subparagraph id="H92E0D7012FCB4D528C2EE9D62C7F4101"><enum>(B)</enum><text>has at least two years of experience providing job placement services for veterans.</text></subparagraph></paragraph></subsection><subsection id="HE5CB619376C146D38F6C867F4CA174F7"><enum>(i)</enum><header>Follow up outreach</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs, in coordination with the Secretary of Labor, shall contact each veteran who completes a covered program of education under the retraining assistance program under this section 30 days, 60 days, 90 days, and 180 days after the veteran completes such program of education to ask the veteran about— </text><paragraph id="id57C88DC7BD044586BC545D7C6060D8D9"><enum>(1)</enum><text display-inline="yes-display-inline">the experience of the veteran in the retraining assistance program; and </text></paragraph><paragraph id="idAEF34B3305454790B402F258EB088309"><enum>(2)</enum><text display-inline="yes-display-inline">the veteran’s employment status.</text></paragraph></subsection><subsection id="H765A55F1C0A74772BA38556992403898"><enum>(j)</enum><header>Quarterly reports</header><text>Not later than one year after the date of the enactment of this Act, and quarterly thereafter, the Secretary of Labor shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report containing the following information about veterans who participate in the retraining assistance program under this section:</text><paragraph id="H99B02B7B06EF41898E1CF3750653542F"><enum>(1)</enum><text display-inline="yes-display-inline">The percentage of such veterans who found employment before the end of the second calendar quarter after exiting the program.</text></paragraph><paragraph id="H2F6EE5F24E98496193B35E2534A8F254"><enum>(2)</enum><text>The percentage of such veterans who found employment before the end of the fourth calendar quarter after exiting the program.</text></paragraph><paragraph id="HCD6A525266DA4D0C91268DC35491D006"><enum>(3)</enum><text>The median earnings of all such veterans for the second quarter after exiting the program.</text></paragraph><paragraph id="HA1EB369F09AD42E195BC03DE9B9451BD"><enum>(4)</enum><text>The percentage of such veterans who attain a recognized postsecondary credential during the 12-month period after exiting the program.</text></paragraph></subsection><subsection id="HE6C16F611EC14FA18504478B0E3D25A4"><enum>(k)</enum><header>Limitation</header><text>Not more than 35,000 eligible veterans may receive retraining assistance under this section.</text></subsection><subsection id="H01E9D8DEB09C4CB2BC5B00D3FF4B91DA"><enum>(l)</enum><header>Termination</header><text>No retraining assistance may be paid under this section after the date that is 21 months after the date of the enactment of this Act.</text></subsection><subsection id="H5B3B1929B53E48A3A4DD71FC9B609ADC"><enum>(m)</enum><header>GAO report</header><text>Not later than 180 days after the termination of the retraining assistance program under subsection (l), the Comptroller General of the United States shall submit to the Committee on Veterans’ Affairs of the Senate and the Committee on Veterans’ Affairs of the House of Representatives a report on the outcomes and effectiveness of the program.</text></subsection><subsection id="HD3ED6B04BF394B8AB29CD77BC12CA6E1"><enum>(n)</enum><header>Funding</header><paragraph id="idC3F69C58C66F41489B39464DBE7755FC"><enum>(1)</enum><header>In general</header><text>For each fiscal year for which the Secretary of Veterans Affairs provides retraining assistance under this section, such sums as may be necessary shall be made available for such assistance from funds appropriated to, or otherwise made available to, the Department of Veterans Affairs for the payment of readjustment benefits. </text></paragraph><paragraph id="id99BCEF3C6DD04F1F942E7D5967FA4673"><enum>(2)</enum><header>Administrative costs</header><text>There is authorized to be appropriated $15,000,000 for administrative costs associated with carrying out this section for each fiscal year for which the Secretary provides retraining assistance under this section. </text></paragraph></subsection><subsection id="H2849AF12990349B8B1765236A1D5A08C" commented="no" display-inline="no-display-inline"><enum>(o)</enum><header>Initiation of payments</header><text>The Secretary of Veterans Affairs may begin providing retraining assistance under this section on the date that is 180 days after the date of the enactment of this Act. </text></subsection><subsection id="H5722A5DFF29241A88309E1C71BAE4368"><enum>(p)</enum><header>Definitions</header><text>In this section: </text><paragraph id="id000D4EB136934DD88FCBAAA1FCAEE6F9"><enum>(1)</enum><header>Active military, naval, or air service; discharge or release</header><text>The terms <term>active military, naval, or air service</term> and <term>discharge or release</term> have the meanings given those terms in section 101 of title 38, United States Code.</text></paragraph><paragraph id="id306CDEBDEE1C44A8ADAE6287822D8EE1"><enum>(2)</enum><header>Active service</header><text>The term <term>active service</term> has the meaning given such term in section 101 of title 10, United States Code. </text></paragraph><paragraph id="H302741B1DA724ACD85A72AC7C7F3A0E8"><enum>(3)</enum><header>Covered public health emergency</header><text>The term <term>covered public health emergency</term> means—</text><subparagraph id="HF85E9BD895A9474E8FB8E18E0E711D4A"><enum>(A)</enum><text>the public health emergency declared by the Secretary of Health and Human Services under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) on January 31, 2020, with respect to Coronavirus Disease 2019 (COVID–19); or </text></subparagraph><subparagraph id="H3DE4B464633F4E139BA31386F4D9B0B5"><enum>(B)</enum><text>a domestic emergency declared, based on an outbreak of Coronavirus Disease 2019 (COVID–19), by the President, the Secretary of Homeland Security, or a State or local authority.</text></subparagraph></paragraph><paragraph id="HB2DE8A3B58D84B8CAD068165479E121E"><enum>(4)</enum><header>Veteran</header><text display-inline="yes-display-inline">The term <term>veteran</term> means—</text><subparagraph id="H3221EFF35F074758AF77525582CE90E1"><enum>(A)</enum><text>a person who served in the active military, naval, or air service, and who was discharged or released therefrom under conditions other than dishonorable; or</text></subparagraph><subparagraph id="H7774A1F278DC48FE99C6B59C1051C426"><enum>(B)</enum><text>a member of a reserve component of the Armed Forces who performs active service for a period of 30 days or longer by reason of a covered public health emergency.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
