which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Administrator of the Environmental Protection Agency to continue to carry out certain programs relating to environmental justice, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HBFCD19284AC74B128A1833B52476BCD6"><section section-type="section-one" id="H66A7A70393924F38A6651DD57F934FF1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Environmental Justice for Communities Act of 2021</short-title></quote>. </text></section><section section-type="subsequent-section" id="H4FB06072E020410196CD989FA76A61D8"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="HDAE080A961544723936A32C56F7F41F4"><enum>(1)</enum><text> communities of color, low-income communities, Tribal and indigenous communities, fossil fuel-dependent communities, and other vulnerable populations, such as persons with disabilities, children, and the elderly, are disproportionately burdened by environmental hazards that include exposure to polluted air, waterways, and landscapes;</text></paragraph><paragraph id="H7CF63D4FFB2B4557AB87C99F3D249515"><enum>(2)</enum><text>environmental justice disparities are also exhibited through a lack of equitable access to information and data on potential exposure to environmental hazards;</text></paragraph><paragraph id="HC51ABB4CDDC949AF966057BEF8AF1CE7"><enum>(3)</enum><text>communities experiencing environmental injustice have been subjected to systemic racial, social, and economic injustices and face—</text><subparagraph id="idF7CA85769DE04CA994F99A800E521D04"><enum>(A)</enum><text>a disproportionate burden of adverse human health or environmental effects;</text></subparagraph><subparagraph id="id638B465AF1A045CCA553344774FADD3E"><enum>(B)</enum><text>a higher risk of intentional and structural discrimination; and </text></subparagraph><subparagraph id="id5FDEFD421995492988CFF6F457220DD2"><enum>(C)</enum><text>disproportionate pollution burdens;</text></subparagraph></paragraph><paragraph id="H9D4E76F3815146EEA1775F6DD6C50059"><enum>(4)</enum><text>the disproportionate burdens described in paragraph (3)—</text><subparagraph id="idE32CCAAF02BD439C9CDF60E5B999ED02"><enum>(A)</enum><text>are being exacerbated by the COVID–19 pandemic; and</text></subparagraph><subparagraph id="idB6E1D4EEE6C94C1799BE9A10607CBE0A"><enum>(B)</enum><text>will be addressed with resources provided to environmental justice communities in the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>); and</text></subparagraph></paragraph><paragraph id="H9A9AEBF4277044978F2214FD110EB344"><enum>(5)</enum><text>citizen involvement and empowerment will be essential for environmental justice communities to protect themselves during the COVID–19 pandemic.</text></paragraph></section><section id="HF6CC3C3192C644D082C3F9894FE6193C"><enum>3.</enum><header>Environmental justice grant programs</header><subsection id="H2F14F97121724AC6A7D2F716DF8CFCD0"><enum>(a)</enum><header>Environmental justice grants</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency shall continue to carry out—</text><paragraph id="H3FB0169FD95546A3A6986534CDB66062"><enum>(1)</enum><text>the Environmental Justice Small Grants Program and the Environmental Justice Collaborative Problem-Solving Cooperative Agreement Program, as those programs are in existence on the date of enactment of this Act; and</text></paragraph><paragraph id="HE482A586FFD24E12A7FEA8C136354A8C"><enum>(2)</enum><text>the Community Action for a Renewed Environment grant programs I and II, as in existence on January 1, 2012.</text></paragraph></subsection><subsection commented="no" id="H109DF06D175845ED8549C85A47610CC3"><enum>(b)</enum><header>Distribution</header><text display-inline="yes-display-inline">Not later than 30 days after amounts are made available pursuant to subsection (c), the Administrator of the Environmental Protection Agency shall make awards of grants under each of the programs described in subsection (a).</text></subsection><subsection id="idC828165AF87040F0A88DCD53470BF021"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out the programs described in subsection (a) $50,000,000 for each of fiscal years 2022 through 2027.</text></subsection></section></legis-body></bill>
