<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1343</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210422">April 22, 2021</action-date><action-desc><sponsor name-id="S259">Mr. Reed</sponsor> (for himself and <cosponsor name-id="S390">Mr. Van Hollen</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Fair Credit Reporting Act to require that a consumer authorize the release of certain information.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Consumer Credit Control Act of 2021</short-title></quote>.</text></section><section id="id29AFFB47CC7642EBBB2BE53E43B51EBD"><enum>2.</enum><header>Permissible purposes of reports</header><subsection id="idD8285F45EEB2441A92344246390FCB43"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681</external-xref> et seq.) is amended—</text><paragraph id="idDEDB0BE36BF047FF980B7862427C70CD"><enum>(1)</enum><text>in section 604 (<external-xref legal-doc="usc" parsable-cite="usc/15/1681b">15 U.S.C. 1681b</external-xref>)—</text><subparagraph id="id4A33544802BD4CCDABFC95AACD3127CE"><enum>(A)</enum><text>by striking subsections (c) through (e) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5407b79eb7e147dcabf9e37a9bf72395"><subsection id="id8be951e76acc4fc6961316215b2391d8"><enum>(c)</enum><header>Conditions for furnishing certain consumer reports</header><paragraph id="id6507ae7aae874ef1bb365a23fead756d"><enum>(1)</enum><header>In general</header><text>A consumer reporting agency may furnish a consumer report for the following purposes only if the consumer reporting agency obtains affirmative informed consent of the consumer to furnish the consumer report and the consumer reporting agency verifies the identity of the consumer by reviewing the proper identification required under section 610:</text><subparagraph id="idd932d509383a488ba912940a6cc9e010"><enum>(A)</enum><text>An extension of credit pursuant to subsection (a)(3)(A).</text></subparagraph><subparagraph id="idff93d2b79ad24130b43c2fab071dac07"><enum>(B)</enum><text>The underwriting of insurance pursuant to subsection (a)(3)(C).</text></subparagraph></paragraph><paragraph id="id59b7a8e10ef7432ba9ca0e5dc9ca1646"><enum>(2)</enum><header>Additional reports; election</header><text>After the consumer reporting agency obtains affirmative informed consent of the consumer and verifies the identity of the consumer under paragraph (1), the consumer reporting agency may continue to furnish consumer reports solely for the purposes of reviewing or collecting on an account described in subparagraphs (A) and (C) of subsection (a)(3).</text></paragraph><paragraph id="id0f57cc78318a43b5a1cb90f9032d3ae5"><enum>(3)</enum><header>Furnishing reports in connection with credit or insurance transactions that are not initiated by
 consumer</header><subparagraph id="idD64651CE9C7C44ABB391754710773621"><enum>(A)</enum><header>In general</header><text>A consumer reporting agency may furnish a consumer report to a person in connection with any credit or insurance transaction under subparagraph (A) or (C) of subsection (a)(3) that is not initiated by the consumer only if—</text><clause id="idbbbebc827b2e45a09b618849436b0286"><enum>(i)</enum><text>the consumer reporting agency obtains affirmative informed consent of the consumer to furnish the consumer report and the consumer reporting agency verifies the identity of the consumer by reviewing the proper identification required under section 610; and</text></clause><clause id="id7e896646d559499f8cfbc45b94575752"><enum>(ii)</enum><text>the transaction consists of a firm offer of credit or insurance.</text></clause></subparagraph><subparagraph id="id446F617FF1FC4AE9960B9609DE0AD7F9"><enum>(B)</enum><header>Election</header><text>The consumer may elect to—</text><clause id="ida8f8b074b81b43a5aca728e568ab287e"><enum>(i)</enum><text>have the consumer’s name and addresses included in lists of names and addresses provided by the consumer reporting agency pursuant to subparagraphs (A) and (C) of subsection (a)(3) in connection with any credit or insurance transaction that is not initiated by the consumer only if—</text><subclause id="id31B0F6147D174060A982EA9A23758C2A"><enum>(I)</enum><text>the consumer reporting agency obtains affirmative informed consent of the consumer to furnish the consumer report and the consumer reporting agency verifies the identity of the consumer by reviewing the proper identification required under section 610; and</text></subclause><subclause id="idDB736A6746464FC3B37F29532D75FE7A"><enum>(II)</enum><text>the transaction consists of a firm offer of credit or insurance; and</text></subclause></clause><clause id="id4b7583486a4a43c7813ee1168563f68c"><enum>(ii)</enum><text>revoke at any time the election pursuant to clause (i) to have the consumer's name and address included in lists provided by a consumer reporting agency.</text></clause></subparagraph><subparagraph id="id96ec4806bbdc458d9f270db56c3bed39"><enum>(C)</enum><header>Information regarding inquiries</header><text>Except as provided in section 609(a)(5), a consumer reporting agency shall not furnish to any person a record of inquiries in connection with a credit or insurance transaction that is not initiated by a consumer.</text></subparagraph></paragraph><paragraph id="idA4AA71FDC513474A8AC7E57EBBF177DE"><enum>(4)</enum><header>Disclosures</header><subparagraph id="idE4CD5BDC436B4D3F9BA0D0ACED99460D"><enum>(A)</enum><header>In general</header><text>A person may not procure a consumer report for any purpose pursuant to subparagraphs (D), (F), and (G) of subsection (a)(3) unless—</text><clause id="idc0a4421f1fb844139bfaba68f42977fd"><enum>(i)</enum><text>a simple and easy to understand, as defined in section 1022.54(b) of title 12, Code of Federal Regulations, as in effect on the date of enactment of the <short-title>Consumer Credit Control Act of 2021</short-title>, disclosure has been made to the consumer at any time before the report is procured or caused to be procured, that consists solely of the disclosure and the opportunity to provide the consent described in clause (ii), that a consumer report may be obtained for such purposes; and</text></clause><clause id="id8c5347cd86f8443795f8059c7baaf2fb"><enum>(ii)</enum><text>the person has obtained affirmative informed consent of the consumer for the procurement of the consumer report by that person.</text></clause></subparagraph><subparagraph id="id959C5D963E4046C09EEA0D43D121CECD"><enum>(B)</enum><header>Authorizations</header><text>The consent described in subparagraph (A)(ii) shall be provided on the disclosure described under subparagraph (A)(i).</text></subparagraph></paragraph><paragraph id="id82A6F70BC297422B9E4FF4BA123DD813"><enum>(5)</enum><header>Rule making</header><text>Not later than 270 days after the date of enactment of the <short-title>Consumer Credit Control Act of 2021</short-title>, the Director of the Bureau shall promulgate regulations that—</text><subparagraph id="idd092d362fcce483cb8ad3c1e45b59f46"><enum>(A)</enum><text>implement this subsection;</text></subparagraph><subparagraph id="id7b07655d3b924e4c8000633123782d31"><enum>(B)</enum><text>establish a model form for the disclosure document pursuant to paragraph (4);</text></subparagraph><subparagraph id="id636d78b7d8c64c58aa899655824f2b84"><enum>(C)</enum><text>permit consumers to provide affirmative informed consent required by paragraph (1) for a specific time period for multiple users for the specified purpose during that time period;</text></subparagraph><subparagraph id="id981e023a98de474095efd33f6b194087"><enum>(D)</enum><text>require a consumer reporting agency—</text><clause id="id67DD3CA1D4404E30B48532DB16895F9F"><enum>(i)</enum><text>to provide to each consumer a secure, convenient, accessible, and cost-free method, including by toll-free telephone or secure electronic means, by which a consumer may—</text><subclause id="id1338081724A5490684F2B39E32B1072F"><enum>(I)</enum><text>provide or revoke any affirmative informed consent pursuant to this subsection; and</text></subclause><subclause id="id7085F71A83404BA5AA2E622E1BA8CFEA"><enum>(II)</enum><text>make or revoke any election pursuant to paragraph (3)(B);</text></subclause></clause><clause id="ida416c1b792db4ae996726cf572ae8433"><enum>(ii)</enum><text>to implement any provision or revocation of affirmative informed consent pursuant to this subsection not later than 1 business day after the date on which a consumer provides or revokes affirmative informed consent; and</text></clause><clause id="id33957974f53b4531ad2e596193a8b9f9"><enum>(iii)</enum><text>to implement any election or revocation of any election pursuant to paragraph (3)(B) not later than 1 business day after the date on which a consumer makes or revokes an election; and</text></clause></subparagraph><subparagraph id="id6FAF65C1D4A747199D6D95F8A5CEFCB1"><enum>(E)</enum><text>define what constitutes affirmed informative consent in the manner that provides the greatest protection to consumers.</text></subparagraph></paragraph><paragraph id="idAAB7FBEC93214E8E97B3DC86113D63ED"><enum>(6)</enum><header>Prohibitions</header><subparagraph id="idD4203667083042ED974B4CBEDEACC9E5"><enum>(A)</enum><header>In general</header><text>The method described in paragraph (5)(D) shall not be used to—</text><clause id="id5144BCA6366747EEA3EE4F434196B927"><enum>(i)</enum><text>collect any information on a consumer that is not necessary for the purpose of the consumer to allow or disallow the furnishing of consumer reports; or</text></clause><clause id="idF8705A5199304559A817C2D2F94BC01A"><enum>(ii)</enum><text>advertise any product or service.</text></clause></subparagraph><subparagraph id="idE8A0B79D7DDB47EDA66460E2C3D47196"><enum>(B)</enum><header>No waiver</header><text>In the offering of a method described in paragraph (5)(D), a consumer reporting agency shall not require a consumer to waive any rights nor indemnify the consumer reporting agency from any liabilities arising from the offering of such method.</text></subparagraph></paragraph><paragraph id="idA3259948CFD94DA6BC30EC7CE4B04F24"><enum>(7)</enum><header>Reports</header><subparagraph id="id902CE5E8AE04462995823795938B8D52"><enum>(A)</enum><header>CFPB</header><clause id="id16519ec6ca674657806e7e6dd4672ae0"><enum>(i)</enum><header>Recommendation</header><text>Not later than 270 days after the date of enactment of the <short-title>Consumer Credit Control Act of 2021</short-title>, the Director of the Bureau shall, after consultation with the Federal Deposit Insurance Corporation, the National Credit Union Administration, the Consumer Advisory Board, and other Federal and State regulators as the Director of the Bureau determines are appropriate, submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives recommendations on how to provide consumers greater transparency and personal control over their consumer reports furnished for permissible purposes under subsections (a)(3)(E) and (a)(6).</text></clause><clause id="id384e74aa358c4713a87f97dad6e92e95"><enum>(ii)</enum><header>Report</header><text>The Director of the Bureau shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives an annual report that includes—</text><subclause id="idB4DEB05D791A4FA1A72419D2A83ADB1B"><enum>(I)</enum><text>recommendations on how this subsection may be improved;</text></subclause><subclause id="id71B40B6532D749CCA87C69B30C61A9E0"><enum>(II)</enum><text>a description of efforts to educate consumers of their rights under this subsection;</text></subclause><subclause id="id5DEEEA9CD73242239031951A47EC0EF8"><enum>(III)</enum><text>a description of enforcement actions taken to demonstrate compliance with this subsection;</text></subclause><subclause id="id284C6AB172CF440495787263EBB7BE64"><enum>(IV)</enum><text>recommendations on how to improve oversight of consumer reporting agencies and users of consumer reports; and</text></subclause><subclause id="id1D41B585EC77453F86408A83B39F37AB"><enum>(V)</enum><text>any other recommendations concerning how consumers may be provided greater transparency and control over their personal information.</text></subclause></clause></subparagraph><subparagraph id="id93015290413C421AB886C1E5CA463027"><enum>(B)</enum><header>GAO</header><clause id="idFCDC4411D0494FFEAB1CECF8AE9B3549"><enum>(i)</enum><header>Study</header><text>The Comptroller General of the United States shall conduct a study on what additional protections or restrictions may be needed to ensure that the information collected in consumer files is secure and does not adversely impact consumers.</text></clause><clause id="id1E5E5444BDF847DFA2A7B076724BFD8F"><enum>(ii)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of the <short-title>Consumer Credit Control Act of 2021</short-title>, the Comptroller General of the United States shall submit to the Committee on Banking, Housing, and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives a report on the results of the study under clause (i), which shall include—</text><subclause id="id83788022615E415D9401C405F1801FDD"><enum>(I)</enum><text>to the greatest extent possible, the presentation of unambiguous conclusions and specific recommendations for further legislative changes needed to ensure that the information collected in consumer files is secure and does not adversely impact consumers; and</text></subclause><subclause id="idE2B6483E5EEC42F280095C73436FA3C1"><enum>(II)</enum><text>if no recommendations for further legislative changes are presented, a detailed explanation of why no such changes are recommended.</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id707127BE34DD4E8DA5F32244D5627E6C"><enum>(B)</enum><text>by redesignating subsections (f) and (g) as subsections (d) and (e), respectively; and</text></subparagraph><subparagraph id="id132485C22C3C439CBD53D4352D293D6F"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id1074A52CD48843AFB3FC10E4FED15488"><subsection commented="no" display-inline="no-display-inline" id="id867FE44AA27D4E64BB582AEAF30D9FA2"><enum>(f)</enum><header display-inline="yes-display-inline">No fees</header><text display-inline="yes-display-inline">No consumer reporting agency may charge a consumer any fee for any activity pursuant to or as a result of this section.</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id705F898BC56D4623A8D33250B9CC9607"><enum>(2)</enum><text>in section 607(a) (<external-xref legal-doc="usc" parsable-cite="usc/15/1681e">15 U.S.C. 1681e(a)</external-xref>)—</text><subparagraph id="id0D7FC8C53E6043B880B0DC292475D6AA"><enum>(A)</enum><text>in the third sentence, by striking <quote>make a reasonable effort</quote> and inserting <quote>use commercially reasonable efforts</quote>; and</text></subparagraph><subparagraph id="id1AB4709F01B842ACB68BD29C056F7C9E"><enum>(B)</enum><text>by inserting <quote>Every consumer reporting agency shall use commercially reasonable efforts to avoid unauthorized access to consumer reports and information in the file of a consumer maintained by the consumer reporting agency, including complying with any appropriate standards established under section 501(b) of the Gramm-Leach-Bliley Act (<external-xref legal-doc="usc" parsable-cite="usc/15/6801">15 U.S.C. 6801(b)</external-xref>).</quote> after the end of the third sentence;</text></subparagraph></paragraph><paragraph id="id9A67D8CA421B42299364E7843077C062"><enum>(3)</enum><text>in section 609 (<external-xref legal-doc="usc" parsable-cite="usc/15/1681g">15 U.S.C. 1681g</external-xref>), by striking subsection (b) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id53BCBED31EA8426EB95DD36CD1C9F979"><subsection id="idED8EB1C405044772A9107B15671084FC"><enum>(b)</enum><header>Scope of disclosure</header><text>The Director of the Bureau shall promulgate regulations to clarify that any disclosure required by subsection (a) shall be made to the consumer when a consumer makes a request, irrespective of whether the information required to be disclosed is held by the parent, subsidiary, or affiliate of a consumer reporting agency.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id17b7ec3c41a2410d95de18e51cac3c22"><enum>(4)</enum><text>in section 610(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/15/1681h">15 U.S.C. 1681h(a)(1)</external-xref>)—</text><subparagraph id="id570d59e35e914a2b9687742bd967b61f"><enum>(A)</enum><text>by inserting <quote>, implementing the provision or revocation of any affirmative informed consent, or implementing any election or revocation of any election</quote> after <quote>disclosures</quote>; and</text></subparagraph><subparagraph id="idEC86236CA1C748D7AFE98D608C126350"><enum>(B)</enum><text>by striking <quote>section 609</quote> and inserting <quote>sections 604 and 609</quote>.</text></subparagraph></paragraph></subsection><subsection id="id6DDE310569E04FE6B69DCEDB730E5567"><enum>(b)</enum><header>Technical and conforming amendments</header><text>The Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681">15 U.S.C. 1681</external-xref> et seq.) is amended—</text><paragraph id="id6AF162F4F3964A8C89C17BB11087D44F"><enum>(1)</enum><text>in section 603(d)(3) (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a(d)(3)</external-xref>), in the matter preceding subparagraph (A), by striking <quote>604(g)(3)</quote> and inserting <quote>604(e)(3)</quote>;</text></paragraph><paragraph id="id78AD384D503B449D94E5737FEECE83BF"><enum>(2)</enum><text display-inline="yes-display-inline">in section 605A (<external-xref legal-doc="usc" parsable-cite="usc/15/1681c-1">15 U.S.C. 1681c–1</external-xref>)—</text><subparagraph id="id59D8E3D499114C689C7214B6B4A90C5F"><enum>(A)</enum><text>by striking subsections (i) and (j); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAB7A1555774F4B1FB598680A248B72B1"><enum>(B)</enum><text>by redesignating subsection (k) as subsection (i);</text></subparagraph></paragraph><paragraph id="id62FB1ACC7F9B46D1AB3CB2E481F7A7E6"><enum>(3)</enum><text>in section 615(d) (<external-xref legal-doc="usc" parsable-cite="usc/15/1681m">15 U.S.C. 1681m(d)</external-xref>)—</text><subparagraph id="idB6B59B9CCDDD43E9ADD91E8C47846649"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id15BB1BB1373241778E2DA56DEAEE33AA"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>604(c)(1)(B)</quote> and inserting <quote>604(c)(3)(A)(ii)</quote>; and</text></clause><clause id="idEB58BF958B0A4CF6A1C254C76CF470F3"><enum>(ii)</enum><text>in subparagraph (E), by striking <quote>604(e)</quote> and inserting <quote>604(c)(5)(D)</quote>; and</text></clause></subparagraph><subparagraph id="id167DEBF10E844AF1838952C8B75CCE50"><enum>(B)</enum><text>in paragraph (2)(A), by striking <quote>604(e)</quote> and inserting <quote>604(c)(5)(D)</quote>; and</text></subparagraph></paragraph><paragraph id="id41A4D93173A8453485F4A67C41D7DBC7"><enum>(4)</enum><text>in section 625(b)(1) (<external-xref legal-doc="usc" parsable-cite="usc/15/1681t">15 U.S.C. 1681t(b)(1)</external-xref>)—</text><subparagraph id="idF35722A2A87C4B539F7A617344006D2C"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>subsection (c) or (e) of section 604</quote> and inserting <quote>604(c)(3)</quote>;</text></subparagraph><subparagraph id="idE87DD19154A3465C9F57D1A5C5CA0A23"><enum>(B)</enum><text>in subparagraph (I), by adding <quote>or</quote> at the end;</text></subparagraph><subparagraph id="id3FFD566D2F984231AFC79148A062D014"><enum>(C)</enum><text>by striking subparagraph (J); and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3C93D01D1AAA47F9848EBD16AFD4516E"><enum>(D)</enum><text>by redesignating subparagraph (K) as subparagraph (J).</text></subparagraph></paragraph></subsection><subsection id="id759340bad03e4d64851ce01127f727e2"><enum>(c)</enum><header>Applicability</header><text>The amendments made by subsections (a) and (b) shall apply to a consumer report, as defined in section 603 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a</external-xref>), furnished after the earlier of—</text><paragraph id="id0334bca611244b7285a6aa317db80d5c"><enum>(1)</enum><text>the date on which the rules issued by the Bureau of Consumer Financial Protection under subsection (c)(5) of section 604 of the Fair Credit Reporting Act, as amended by subsection (a) of this section, require compliance; and</text></paragraph><paragraph id="id63ee54371c70403da98d973562bc834c"><enum>(2)</enum><text>the date that is 18 months after the date of enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
