<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1339</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210422">April 22, 2021</action-date><action-desc><sponsor name-id="S385">Ms. Cortez Masto</sponsor> (for herself and <cosponsor name-id="S351">Mr. Toomey</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Victims of Crime Act of 1984 to ensure crime victims are not denied compensation because of rape kit backlogs, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fairness for Rape Kit Backlog Survivors Act of 2021</short-title></quote>.</text></section><section id="id1DF9FB9F0D59405C893606141EF2A9D9"><enum>2.</enum><header>Crime victim compensation</header><text display-inline="no-display-inline">Section 1403(b) of the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/34/20102">34 U.S.C. 20102(b)</external-xref>) is amended—</text><paragraph id="id8F6604035E48485E8E48CCC4D5933051"><enum>(1)</enum><text>in paragraph (8), by striking <quote>and</quote> at the end; </text></paragraph><paragraph id="idFE7328B0D0FE450A8D34E3CA17423787"><enum>(2)</enum><text>by redesignating paragraph (9) as paragraph (10); and </text></paragraph><paragraph id="idDCCD8AEB4A114720B94EBB50632DE074"><enum>(3)</enum><text>by inserting after paragraph (8) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCEC80CAD699746849E6EF90E032BD6BE"><paragraph id="idEEFA3FBA63B44FB7A88046507546FDC8"><enum>(9)</enum><text>beginning not later than 3 years after the date of enactment of this paragraph, such program—</text><subparagraph id="id33E7C42F598048A5BF87679ECA0062EC"><enum>(A)</enum><text>provides a waiver for any application filing deadline imposed by the program for a crime victim if—</text><clause id="id5ACF262FB4404C578CC6A1456B2347F7"><enum>(i)</enum><text>the crime victim is otherwise eligible for compensation; and</text></clause><clause id="id260CD237A5014F19B5F6A9F9CBDFA25E"><enum>(ii)</enum><text>the delay in filing the application was a result of a delay in the testing of, or a delay in the DNA profile matching from, a sexual assault forensic examination kit or biological material collected as evidence related to a sexual offense; and</text></clause></subparagraph><subparagraph id="idAB4D58C319C846A99BF3AC369DFE44E2"><enum>(B)</enum><text>does not require the crime victim to undergo an appeals process to have the application of the crime victim considered for a filing deadline waiver under subparagraph (A); and</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
