<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1336</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210422">April 22, 2021</action-date><action-desc><sponsor name-id="S370">Mr. Booker</sponsor> (for himself, <cosponsor name-id="S353">Mr. Schatz</cosponsor>, <cosponsor name-id="S322">Mr. Merkley</cosponsor>, <cosponsor name-id="S313">Mr. Sanders</cosponsor>, and <cosponsor name-id="S253">Mr. Durbin</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To discontinue a Federal program that authorizes State and local law enforcement officers to investigate, apprehend, and detain aliens in accordance with a written agreement with the Director of U.S. Immigration and Customs Enforcement and to clarify that immigration enforcement is solely a function of the Federal Government.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id07E40815E73F4A4DAD20BA7017BD634B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting the Rights Of Towns against federal Enforcement contrary to Constitutional Tenets for Immigration Act</short-title></quote> or the <quote><short-title>PROTECT Immigration Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id99352D9AAB4942DF87151E065008D768"><enum>2.</enum><header>Rescission of State and local immigration enforcement authority</header><text display-inline="no-display-inline">Section 287(g) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1357">8 U.S.C. 1357(g)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4038F8780A8740B3AA314EA894F1E513"><subsection id="idFE90F7F2757648CC84ABB5F602C47B26"><enum>(g)</enum><text display-inline="yes-display-inline">Except as provided in sections 103(a)(10) and 274(c) of this Act and in section 439 of the Antiterrorism and Effective Death Penalty Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1252c">8 U.S.C. 1252c</external-xref>), the authority to inquire about or verify immigration or citizenship status and to investigate, apprehend, arrest, or detain an individual for a violation of this Act or any regulation authorized by this Act—</text><paragraph id="id8C15DC7D5F0A49828DD685DFFF2001D9"><enum>(1)</enum><text display-inline="yes-display-inline">is restricted to immigration officers and authorized employees of the Department of Homeland Security; and </text></paragraph><paragraph id="idAA9C7D651EE7479B8D8C3857BBD4DEBA"><enum>(2)</enum><text display-inline="yes-display-inline">is subject to limits set forth in other provisions of law.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
