Russell National School Lunch Act to reauthorize the farm to school program, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Farm to School Act of 2021</short-title></quote>.</text></section><section id="ID3a7daa835f774cd0b5da5e9b68655314"><enum>2.</enum><header>Access to local foods: farm to school program</header><text display-inline="no-display-inline">Section 18(g) of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1769">42 U.S.C. 1769(g)</external-xref>) is amended—</text><paragraph id="IDcd189a19df0c4310975f4c11d3a24873"><enum>(1)</enum><text>in paragraph (1)—</text><subparagraph id="IDde35d5e0a51f420888e72cb471779811"><enum>(A)</enum><text>by striking the paragraph designation and heading and all that follows through <quote>means</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF0AF6A5B66254759B624744FA22676DD"><paragraph id="IDe4d04e74c2494436822a4e996231bde1"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="IDa7fa5a1cb1d84e0e804ecc5ddd5ca7f2"><enum>(A)</enum><header>Agricultural producer</header><text>The term <term>agricultural producer</term> means a farmer, rancher, or fisher (including of farm-raised fish).</text></subparagraph><subparagraph id="id1FB79BF60E2D4AB89DD0E1787F473F99"><enum>(B)</enum><header>Eligible institution</header><text>The term <quote>eligible institution</quote> means</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id158F1A554D9D4C7AB9B364C02F788D0A"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBF8B25609B4E466DA970BD8BF493E4F9"><subparagraph id="idD8E6CEC700D34EB8B67C98278522CDC9"><enum>(C)</enum><header>Farm to school program</header><text>The term <quote>farm to school program</quote> means a program that—</text><clause id="idB19DA714A6804BD5BC58FBDE0D0D4995"><enum>(i)</enum><text>benefits an eligible institution, as determined by the Secretary; and</text></clause><clause id="idCB46C14AA0EC419A87AB7B954B578488"><enum>(ii)</enum><text>carries out—</text><subclause id="id26BB93078CFF48E6B6FEA0950B28E241"><enum>(I)</enum><text>planting and maintenance of farms or gardens;</text></subclause><subclause id="idB8464A2A199F4D74B1F2D3F5BA3CD409"><enum>(II)</enum><text>procurement from local agricultural producers; or</text></subclause><subclause id="idB6D7E67E95854C7C8B249299CC660DC2"><enum>(III)</enum><text>educational activities relating to agriculture, nutrition, or food.</text></subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="ID95fa8f213ed848de885726f90fbdc849"><enum>(2)</enum><text>in paragraph (2)—</text><subparagraph id="id1DBD406928C745AA921AD1ABCE8C0979"><enum>(A)</enum><text>by striking <quote>schools</quote> each place it appears and inserting <quote>institutions</quote>;</text></subparagraph><subparagraph id="id6CD448CE799C44E286671A65DCC06C99"><enum>(B)</enum><text>by inserting <quote>land-grant colleges and universities,</quote> before <quote>and nonprofit</quote>; and</text></subparagraph><subparagraph id="id81980238F5C04F12BB86ACF3227BFED1"><enum>(C)</enum><text>by striking <quote>grants and technical assistance</quote> and inserting <quote>grants, technical assistance, research, and evaluation</quote>;</text></subparagraph></paragraph><paragraph id="ID708f769aca3e4236a0ad190a3291c39f"><enum>(3)</enum><text>in paragraph (3)—</text><subparagraph id="IDbc22b86608094687a8a51fc380d753e5"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="IDaaa2dd29919e42b18743b8f4ddfa1dcf"><enum>(i)</enum><text>in clause (i), by inserting <quote>and technical assistance</quote> after <quote>training</quote>;</text></clause><clause id="ID75fa902de9e548fd9aa613c3b6b4e00b"><enum>(ii)</enum><text>by redesignating clauses (vi) and (vii) as clauses (vii) and (viii), respectively; and</text></clause><clause id="IDfc39f620bf2c4a9eaedd053b264ba8a2"><enum>(iii)</enum><text>by inserting after clause (v) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC3198FAAC3C9482BAE0510B0DCC41834"><clause id="IDcd9e724e9f29414eacde753c64f7ee98"><enum>(vi)</enum><text>implementing educational activities relating to agriculture, nutrition, or food;</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="ID089d15f669d64012a7b6b0c021e55c73"><enum>(B)</enum><text>by striking subparagraph (C) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB34BEE81137E4F4D82930CC6F1CF95EB"><subparagraph id="ID24ed16d0cd8e45278056e054a2632f03"><enum>(C)</enum><header>Improved procurement and distribution</header><clause id="ID45a602d7281449269aa93df2d800f795"><enum>(i)</enum><header>In general</header><text>In awarding grants under this subsection, the Secretary shall seek to improve local food procurement and distribution options for agricultural producers and eligible institutions.</text></clause><clause id="ID59e26887f2c8408c8642403a0b4eabd3"><enum>(ii)</enum><header>Aggregation, processing, transportation, and distribution</header><text>In advancing local food procurement options and other farm to school program objectives, the Secretary may provide funding for projects that include innovative approaches to aggregation, processing, transportation, and distribution.</text></clause></subparagraph><subparagraph id="ID79da507a06074662a89b17155de5ef4e"><enum>(D)</enum><header>Awards</header><clause id="ID9ede227bb53d41d49277ca4a7b873f48"><enum>(i)</enum><header>Maximum amount</header><text>The total amount provided to a grant recipient under this subsection shall not exceed $500,000.</text></clause><clause id="ID792b98b8a79d45a98878478ac61551b4"><enum>(ii)</enum><header>Term</header><text>The term of an award shall not exceed 3 years.</text></clause><clause id="ID503cffa8e46848fca94d122aa84d08a8"><enum>(iii)</enum><header>Purpose and scope</header><text>In making awards under this subsection, the Secretary shall seek to make awards of diverse amounts and duration in order to best match the award to the purpose and scope of the project to be funded.</text></clause></subparagraph><subparagraph id="IDbc1b56500d8846149ac801990fb30412"><enum>(E)</enum><header>Limitation</header><text>The Secretary may not award a grant under this subsection if the grant funds would be used solely for the purpose of carrying out a conference.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="ID52ad3b030860443db7952492645139af"><enum>(4)</enum><text>in paragraph (4)—</text><subparagraph id="IDf31539df123044c78ba9a10cbbc4e204"><enum>(A)</enum><text>in subparagraph (B), by inserting <quote>, Tribal,</quote> after <quote>State</quote>; and</text></subparagraph><subparagraph id="IDd534fa95da84473494093b92b23a9dc2"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5530837B0FB54D0687FC83CC1B23D68C"><subparagraph id="IDc82262863374433b86734b25febc0858"><enum>(C)</enum><header>Tribal agencies</header><text>The Secretary may allow a Tribal agency to use funds provided to the Indian Tribe of the Tribal agency through a Federal agency (including the Indian Health Service) or any other Federal benefit to satisfy all or part of the non-Federal share described in subparagraph (A) if that use is consistent with the purpose of the funds or other Federal benefit provided.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="ID138b8fd79de642a2bdc1428f120741f2"><enum>(5)</enum><text>in paragraph (5)—</text><subparagraph id="IDca392acff3dc43fbae68658006c6102b"><enum>(A)</enum><text>by redesignating subparagraphs (A) through (F) and (G) as clauses (i) through (vi) and (ix), respectively, and indenting the clauses appropriately;</text></subparagraph><subparagraph id="IDa368141a12d14e318547474c45f8f8bf"><enum>(B)</enum><text>in the matter preceding clause (i) (as so redesignated), by striking <quote>To the maximum extent practicable</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id47AC370B99C3401BB5E8F4EF924BD0CC"><subparagraph commented="no" display-inline="no-display-inline" id="ID4e9992c87513424597e4bad85ee559e3"><enum>(A)</enum><header>In general</header><text>To the maximum extent practicable</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="IDe3d7ccf2e5624b24afcb2d696c116154"><enum>(C)</enum><text>in clause (i) (as so redesignated), by striking <quote>school</quote> and inserting <quote>institution</quote>;</text></subparagraph><subparagraph id="ID1f064727f47f4c8abeb76abfd2b414d2"><enum>(D)</enum><text>in clause (ii) (as so redesignated), by striking <quote>lunches</quote> and inserting <quote>meals</quote>;</text></subparagraph><subparagraph id="IDa9c9ab849d7c4be2b77d936fc4788206"><enum>(E)</enum><text>by striking clause (iii) (as so redesignated) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id78318858B28C4D639BEB1675C6A6C32A"><clause id="idC84F4196FF0B4FC593099BEC366DAF08"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id63E62DC8F6CB40869E25FE9B971A318E"><enum>(I)</enum><text>incorporate experiential and traditional and culturally appropriate food, nutrition, or agricultural education activities in curriculum planning; and</text></subclause><subclause id="id242109A74BC74CF3AAB9D19135E986A7" indent="up1"><enum>(II)</enum><text>serve a high proportion of children from socially disadvantaged backgrounds;</text></subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="ID4641911dc10c493baee6c3f178aeef1b"><enum>(F)</enum><text>in clause (iv) (as so redesignated), by striking <quote>eligible schools</quote> and all that follows through <quote>partners</quote> and inserting <quote>eligible institutions, State and local agencies, Tribal organizations and agencies, agricultural producers or groups of agricultural producers, land-grant colleges and universities, and nonprofit entities</quote>;</text></subparagraph><subparagraph id="IDd533ca776d7b4cafb59f40e711a9a4c2"><enum>(G)</enum><text>in clause (vi) (as so redesignated), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="IDe74aeadeaec14ed99bd210853c12cacf"><enum>(H)</enum><text>by inserting after clause (vi) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id08D3B0A4B8074D1DAA6DF3A70BB74D5C"><clause id="ID5f0aa236b402422189d72fdef823ea91"><enum>(vii)</enum><text>expand the selection of local commodities for eligible institutions;</text></clause><clause id="id3B8BE2BA3E894632BB87149D056BD322"><enum>(viii)</enum><text>identify and address chronic diet-related health issues of the children served by eligible institutions; and</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="ID2d0d102805a54a04bcd7e467d008dda2"><enum>(I)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4CDA1AFA421E486B904B7F81C48536F2"><subparagraph id="IDc9f96d6f800b4f64997f2a876b181b82"><enum>(B)</enum><header>Tribal community projects</header><text>In the case of projects serving Tribal communities, the Secretary shall, to the maximum extent practicable, give highest priority to projects that best utilize products, including traditional foods, from Tribal agricultural producers, as determined by the Secretary.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="IDb8f13c5ce15e4bc389102b7bea5f39c9"><enum>(6)</enum><text>in paragraph (7)—</text><subparagraph id="IDe59a643d1c6944fba5eaf181975fabf6"><enum>(A)</enum><text>by redesignating subparagraphs (A) through (C) as clauses (i) through (iii), respectively, and indenting appropriately;</text></subparagraph><subparagraph id="ID17340421cde84e119f05c2cdf63e3b0d"><enum>(B)</enum><text>by striking the paragraph designation and heading and all that follows through <quote>nonprofit entities—</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD79D91A273164493BE366DBE12A01659"><paragraph id="ID3aed69616f9f420e935ca6e81d3b1dac"><enum>(7)</enum><header>Technical assistance and research</header><subparagraph id="ID004d11f5532a42c2910b2b48b767e5fd"><enum>(A)</enum><header>In general</header><text>The Secretary shall provide technical assistance, research, and information to assist eligible institutions, State and local agencies, Indian Tribal organizations, agricultural producers or agricultural producer groups, and nonprofit entities—</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="IDd3b4d51f1f184511bcf3b93a373e119e"><enum>(C)</enum><text>in subparagraph (A) (as so designated)—</text><clause id="ID026ff9b110374cbb80f2293f609e0cef"><enum>(i)</enum><text>in clause (ii) (as so redesignated), by striking <quote>and</quote> at the end;</text></clause><clause id="IDc67d7f3187c74cc29c4145eab2ee535f"><enum>(ii)</enum><text>in clause (iii) (as so redesignated), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="ID18de98be4d5345369b4041b1d168bcee"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBC60627B3FF1418387ED26F772476865"><clause id="ID93996a2bd3284454bc0f9898964c1ba8"><enum>(iv)</enum><text>to increase awareness of, and participation in, farm to school programs among agricultural and aquaculture producers or agricultural producer groups, including beginning farmers and ranchers, veteran farmers and ranchers, and socially disadvantaged farmers and ranchers (as those terms are defined in section 2501(a) of the Food, Agriculture, Conservation, and Trade Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/7/2279">7 U.S.C. 2279(a)</external-xref>)).</text></clause><after-quoted-block>; and </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="ID70473d6e2c874b30ab5b8f74875ffaa0"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id64E8696B713E4E3E8C14E7642437AAF1"><subparagraph id="IDf33d6b94601c46629cbed00e6d55f256"><enum>(B)</enum><header>Review</header><clause id="ID45a15d977e384911af0bcc684a9d8c32"><enum>(i)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Farm to School Act of 2021</short-title> and every 3 years thereafter, the Secretary shall review and submit to the Committees on Agriculture and Education and Labor of the House of Representatives and the Committee on Agriculture, Nutrition, and Forestry of the Senate a report that describes the progress that has been made in identifying and eliminating regulatory and other barriers related to developing farm to school programs.</text></clause><clause id="IDb8b4f7781ba14b3cb481f4dcb370a29d"><enum>(ii)</enum><header>Requirements</header><text>In preparing the report, the Secretary shall examine—</text><subclause id="IDbbd7bb40b55d459092b4ef0bd05967e4"><enum>(I)</enum><text>the direct and indirect regulatory compliance costs affecting the production and marketing of locally or regionally produced agricultural food products to school and early childhood food programs;</text></subclause><subclause id="IDe6a23260e2234dfc8246d106e70a449e"><enum>(II)</enum><text>barriers to local and regional market access for small-scale production;</text></subclause><subclause id="IDe258762fb808477999a4ace607c9b307"><enum>(III)</enum><text>barriers to funding projects that meet the criteria described in paragraph (5)(A);</text></subclause><subclause id="IDf189b8d42d274c5785d5f5b92cb4eae0"><enum>(IV)</enum><text>barriers to local and regional market access for Tribal farmers and ranchers; and</text></subclause><subclause id="id393C2CD8A84E4ED99C5EB987B35E7A4D"><enum>(V)</enum><text>barriers to funding Tribal projects under farm to school programs.</text></subclause></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="ID62156ec12bc646d49e97d20e265aa45f"><enum>(7)</enum><text>in paragraph (8)—</text><subparagraph id="ID2f07ef3772ed4e1c8fc3580441617fad"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>$5,000,000</quote> and inserting <quote>$15,000,000</quote>; and</text></subparagraph><subparagraph id="ID390415f19ff44ad49b76b75a957a3519"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4A5151199A82473ABB2E627B46778125"><subparagraph id="IDf938c7607b9b4f52bbf6f3f2b24afb67"><enum>(C)</enum><header>Administration</header><text>Of the funds provided to the Secretary under subparagraph (A), not more than 5 percent may be used to pay administrative costs incurred by the Secretary in carrying out this subsection.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="ID9d8d623466b64914a84c77c7ad65f62f"><enum>(8)</enum><text>in paragraph (9), by striking <quote>2011 through 2015</quote> and inserting <quote>2022 through 2027</quote>.</text></paragraph></section></legis-body></bill>
