which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To modify the boundary of the Casa Grande Ruins National Monument, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HB16CEABF25D242D584739145B85D49EE"><section section-type="section-one" id="HE6090584686546D1854E80DB36AD79F1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Casa Grande Ruins National Monument Boundary Modification Act of 2021</short-title></quote>.</text></section><section id="H24F40BF579A3420599B8E59741B59218"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="HE1D3A02CA80A414B9BF3E908F7BF856A"><enum>(1)</enum><text>Casa Grande Ruin Reservation was—</text><subparagraph id="idF142F91CD41247FFBE137C16BB36288C"><enum>(A)</enum><text>set aside on March 2, 1889;</text></subparagraph><subparagraph id="id9034303D3AA04BDAAFA03FA25C1FE287"><enum>(B)</enum><text>proclaimed as the first archaeological preserve in the United States on June 22, 1892; and</text></subparagraph><subparagraph id="id35516FDCB3FA46A5B725E16E5C641F65"><enum>(C)</enum><text>redesignated as the <quote>Casa Grande Ruins National Monument</quote> on August 3, 1918;</text></subparagraph></paragraph><paragraph id="H8945542FE33E4E14A619DE206CA2B64A"><enum>(2)</enum><text>the Casa Grande Ruins National Monument protects 1 of the finest architectural examples of 14th century Hohokam culture in the Southwest, which was known to early Spanish explorers as the <quote>Great House</quote>;</text></paragraph><paragraph id="HFECE2ED634264DE081F62A3499E84A66"><enum>(3)</enum><text>Casa Grande is only part of the story of an ancient town that may have covered 2 square miles; and</text></paragraph><paragraph id="H69A890F0E2374DFDB5F1CADCFF461213"><enum>(4)</enum><text>recent surveys and research have determined that the area of the Great House and the village surrounding the Great House extends beyond the existing boundary of the Casa Grande Ruins National Monument.</text></paragraph></section><section id="id04b6c06ad6eb403896d4c1ed60d97893"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id2c57091d55764cb9994cce4ad8e2bd20"><enum>(1)</enum><header>BIA land</header><text>The term <term>BIA land</term> means the approximately 7.41 acres of Federal land administered by the Bureau of Indian Affairs, as generally depicted on the map as <quote>BIA land to NPS</quote>.</text></paragraph><paragraph id="idfebd7e60379a43a8b1cee2ade42096e1"><enum>(2)</enum><header>BLM land parcel A</header><text>The term <term>BLM land parcel A</term> means the approximately 3.8 acres of Federal land administered by the Bureau of Land Management, as generally depicted on the map as <quote>BLM land parcel A to NPS</quote>.</text></paragraph><paragraph id="id566a0db27ac841238ec9e58f4ea401fe"><enum>(3)</enum><header>BLM land parcel b</header><text>The term <term>BLM land parcel B</term> means the approximately 3.7 acres of Federal land administered by the Bureau of Land Management, as generally depicted on the map as <quote>BLM land parcel B to BIA</quote>.</text></paragraph><paragraph id="ideb88cad799c64ca48754f693e2da85bd"><enum>(4)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Casa Grande Ruins National Monument Proposed Boundary Adjustment</quote>, numbered 303/120,734B, and dated February 2021.</text></paragraph><paragraph id="id0a4637aac3c94cfeb10395a3dd30c773"><enum>(5)</enum><header>Monument</header><text>The term <term>Monument</term> means the Casa Grande Ruins National Monument in the State.</text></paragraph><paragraph id="idc4ceb1ca6223471db7e677ab826e3bb7"><enum>(6)</enum><header>NPS land</header><text>The term <term>NPS land</term> means the approximately 3.5 acres of Federal land administered by the National Park Service, as generally depicted on the map as <quote>NPS land to BIA</quote>.</text></paragraph><paragraph id="id502be0727520480db85406950e408a0d"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph id="id6819701D97614A69862ACF2C56FA0FD3" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header>State</header><text>The term <term>State</term> means the State of Arizona.</text></paragraph></section><section id="id81d98ee3ca3d4f25aa8987e4c0d23569"><enum>4.</enum><header>Acquisition and transfer of administrative jurisdiction over certain land</header><subsection id="id2105c92f0572451b8549732f7680760d"><enum>(a)</enum><header>Acquisition of land</header><text>The Secretary may acquire by donation, exchange, or purchase with donated or appropriated funds, from willing sellers only, land or an interest in land generally depicted on the map as <quote>State land of Arizona</quote> or <quote>Private land</quote>, to be administered as part of the Monument.</text></subsection><subsection id="id91707892a8ea4aca836f36d6c934bf66"><enum>(b)</enum><header>Transfer of administrative jurisdiction</header><paragraph id="id0f92944cef9146d9b095cbdda88fb652"><enum>(1)</enum><header>Withdrawal</header><text>The BIA land, BLM land parcel A, and BLM land parcel B are withdrawn from—</text><subparagraph id="id1a8474e2f08a46b6bbf5866ab0620db2"><enum>(A)</enum><text>all forms of entry, appropriation, and disposal under the public land laws;</text></subparagraph><subparagraph id="id563470fa8d1e4655abccd03473dedd92"><enum>(B)</enum><text>location, entry, and patent under the mining laws; and</text></subparagraph><subparagraph id="ide3a5ea0e12ff440f94e64abb0afac2bc"><enum>(C)</enum><text>operation of the mineral leasing and geothermal leasing laws and mineral materials laws.</text></subparagraph></paragraph><paragraph id="id57c53585d55047efbf6d4f342a7c9ffc"><enum>(2)</enum><header>Transfer of administrative jurisdiction</header><subparagraph id="iddb943a7a072747a0b56fdf38756af3a3"><enum>(A)</enum><header>BLM land parcel a</header><text>Administrative jurisdiction over BLM land parcel A is transferred from the Bureau of Land Management to the National Park Service.</text></subparagraph><subparagraph id="id31e4600a92124d4da16872687cf98785"><enum>(B)</enum><header>BLM land parcel b</header><text>Administrative jurisdiction over BLM land parcel B is transferred from the Bureau of Land Management to the Bureau of Indian Affairs.</text></subparagraph><subparagraph id="idf6b78aea2f554387bf1a531a4a817a70"><enum>(C)</enum><header>BIA land</header><text>Administrative jurisdiction over the BIA land is transferred from the Bureau of Indian Affairs to the National Park Service.</text></subparagraph><subparagraph id="id8ba77c54b7504a87ab66cd9a8edea081"><enum>(D)</enum><header>NPS land</header><text>Administrative jurisdiction over the NPS land is transferred from the National Park Service to the Bureau of Indian Affairs.</text></subparagraph></paragraph></subsection><subsection id="id34a962da34584cd3a94313e5625322dd"><enum>(c)</enum><header>Administration; boundary modification</header><text>On the acquisition of land or an interest in land under subsection (a), and with respect to any land transferred by subsection (b), the Secretary shall—</text><paragraph id="ide4c890e71f8749aa8339f77f12b95e44"><enum>(1)</enum><text>administer the land or interest in land acquired under subsection (a) or the land transferred to the administrative jurisdiction of the National Park Service under subparagraph (A) or (C) of subsection (b)(2), as applicable, as part of the Monument, in accordance with the laws generally applicable to units of the National Park System, including applicable provisions of division A of subtitle I of title 54, United States Code; and</text></paragraph><paragraph id="ide48d6ea8024b4475b0fea43d2cfaecc1"><enum>(2)</enum><text>modify the boundary of the Monument to reflect, as applicable—</text><subparagraph id="id65A27FF0E49644D9A58E1063E0A02671"><enum>(A)</enum><text>the acquisition of land or interest in land under subsection (a); and</text></subparagraph><subparagraph id="id9553128F3924494D86C0CB7C85819366"><enum>(B)</enum><text>the transfer of administrative jurisdiction under subsection (b).</text></subparagraph></paragraph></subsection><subsection id="id480ed640031849bf9b37ebf4b3d6b519"><enum>(d)</enum><header>Availability of map</header><text>The map shall be on file and available for inspection in the appropriate offices of the National Park Service.</text></subsection><subsection id="id31d4c85247b344e0912194de1f573116"><enum>(e)</enum><header>Compensation</header><text>Except in a case in which land or an interest in land is acquired by donation under subsection (a), as consideration for the acquisition of land or an interest in land under that subsection, the Secretary shall—</text><paragraph id="idc78e0e1e710f4213af3f90429a1b91c1"><enum>(1)</enum><text>pay fair market value for the land or interest in land; or</text></paragraph><paragraph id="id453b7805cfac4a1c9c3638e31c35433a"><enum>(2)</enum><text>convey to the State or private landowner, as applicable, Federal land or an interest in Federal land of equal value located in the State.</text></paragraph></subsection></section><section id="id598b3baa11fe4fa2a2e3b7c42a0d98ca"><enum>5.</enum><header>Administration of State land</header><text display-inline="no-display-inline"> The Secretary may enter into an agreement with the State to provide for the cooperative management by the Secretary and the State of the approximately 200 acres of State land, as generally depicted on the map as <quote>State land of Arizona</quote>. </text></section></legis-body></bill>
