which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Veterans Affairs to make certain information publicly available on one internet website of the Department of Veterans Affairs.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HE9E99784065F402CA9DA22FAB258216E"><section section-type="section-one" id="H9869431AE9DD4C758FB49CAA9B515329"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VA Quality Health Care Accountability and Transparency Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="H32369D9F71834EB7BB3C83BE15288800"><enum>2.</enum><header>Improved transparency by Department of Veterans Affairs</header><subsection id="HBD9C72B344574360ACC8957F294832AA"><enum>(a)</enum><header>Publication of staffing and quality of care data</header><text display-inline="yes-display-inline">Not later than one year after the date of the enactment of this Act, the Secretary of Veterans Affairs shall make publicly available on the Access to Care internet website of the Department of Veterans Affairs (or a successor website) the information under subsection (b).</text></subsection><subsection id="H66C59ACAF1574DE8BBC84D059733E284"><enum>(b)</enum><header>Information included</header><paragraph id="HE3B7E7EF6F3946CCAC3ACB0ACD64FF00"><enum>(1)</enum><header>In general</header><text>The information published on the internet website under subsection (a) shall include—</text><subparagraph commented="no" id="H9E319986988F4ECD8054B921A4CE72E3"><enum>(A)</enum><text display-inline="yes-display-inline">any numeric indicators relating to timely care, effective care, safety, and veteran-centered care that the Secretary collects at medical facilities of the Department pursuant to section 1703C of title 38, United States Code;</text></subparagraph><subparagraph id="H3E6C6F8915254D6299CDF7280307BC37"><enum>(B)</enum><text>the staffing and vacancy information required by subparagraphs (A) through (D) of section 505(a)(1) of the VA MISSION Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/182">Public Law 115–182</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/38/301">38 U.S.C. 301</external-xref> note);</text></subparagraph><subparagraph id="H0ADB793D063B4A34A33ACCF5C713604D"><enum>(C)</enum><text display-inline="yes-display-inline">the patient wait times information required by subsection (a) of section 206 of the Veterans Access, Choice, and Accountability Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/146">Public Law 113–146</external-xref>; 128 Stat. 1780); and</text></subparagraph><subparagraph id="H59F8D87D6E1B471D9A9BE0276DB0A248"><enum>(D)</enum><text display-inline="yes-display-inline">the patient safety, quality of care, and outcome measures required by subsection (b) of such section.</text></subparagraph></paragraph><paragraph commented="no" id="H0BEF9175A71A4F0189475D50DACBA801"><enum>(2)</enum><header>Updates</header><text display-inline="yes-display-inline">The Secretary shall regularly update the internet website under subsection (a) to ensure that the information under paragraph (1) is the most current information required by the provisions of law specified in such paragraph.</text></paragraph></subsection><subsection id="H9FD1C2C1099842878671A478A8F2BA18"><enum>(c)</enum><header>Requirements of internet website</header><text display-inline="yes-display-inline">In addition to the requirements of section 206(b)(4) of the Veterans Access, Choice, and Accountability Act of 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/146">Public Law 113–146</external-xref>; 128 Stat. 1781), the Secretary shall ensure that the internet website under subsection (a) meets the following requirements:</text><paragraph id="HC7285BEA81AC448D82675070E7425785"><enum>(1)</enum><text>The internet website is directly accessible from—</text><subparagraph id="HE37CE5CFDBE9413889CEC5728F174974"><enum>(A)</enum><text display-inline="yes-display-inline">the main homepage of the publicly accessible internet website of the Department; and</text></subparagraph><subparagraph id="HD2B23FB32CBA4A3083E3A9FC813745A0"><enum>(B)</enum><text display-inline="yes-display-inline">the main homepage of the publicly accessible internet website of each medical center of the Department.</text></subparagraph></paragraph><paragraph id="HC4E3DD5B89914E30890777137E661FE0"><enum>(2)</enum><text>Where practicable, the internet website is organized and searchable by each medical center of the Department.</text></paragraph><paragraph id="H43B33C9B688C4604816F59B0E3819B0D"><enum>(3)</enum><text>The internet website is easily understandable and usable by the general public.</text></paragraph></subsection><subsection id="H81437D78973543309194CE2056471BAE"><enum>(d)</enum><header>Consultation and contract authority</header><text>In carrying out subsection (c)(3), the Secretary—</text><paragraph id="HB75D60D4966D44A08EE04FCB7091EE5E"><enum>(1)</enum><text>shall consult with veterans service organizations; and</text></paragraph><paragraph id="H893F1FD1B7D84C59A38FDD60E0AB0815"><enum>(2)</enum><text>may enter into a contract to design the internet website under subsection (a) with a company, non-profit entity, or other entity specializing in website design that has substantial experience in presenting health care data and information in a easily understandable and usable manner to patients and consumers.</text></paragraph></subsection><subsection id="H4C6B4B9DCD4A4E979651AF9FA1A1DC2E"><enum>(e)</enum><header>Accuracy of data</header><paragraph id="H55DACA3C6A434C4EA2E9BFA8EEFF14D0"><enum>(1)</enum><header>Annual process</header><text>Not later than 18 months after the date of the enactment of this Act, the Secretary shall develop and implement an annual process to audit a generalizable subset of the data contained in the internet website under subsection (a) to assess the accuracy and completeness of the data.</text></paragraph><paragraph id="H612EE82798A74D79A5D2537750637CEF"><enum>(2)</enum><header>Criteria</header><text>The Secretary shall ensure that each audit under paragraph (1)—</text><subparagraph id="H8A794327C75841C4B982C0547CF65589"><enum>(A)</enum><text display-inline="yes-display-inline">determines the extent that the medical record information, clinical information, data, and documentation provided by each medical facility of the Department that is used to calculate the information under subsection (b) is accurate and complete;</text></subparagraph><subparagraph id="H41591A2F811C4C0DAF625D2334240F11"><enum>(B)</enum><text display-inline="yes-display-inline">identifies any deficiencies in the recording of medical record information, clinical information, or data by medical facilities of the Department that affects the accuracy and completeness of the information under subsection (b); and</text></subparagraph><subparagraph id="HA115E9F75B724C548E085F30FE38F2AD"><enum>(C)</enum><text display-inline="yes-display-inline">provides recommendations to medical facilities of the Department on how to—</text><clause id="HF24EB29FBCAD45DDAA1CE9A0CBAEAA1D"><enum>(i)</enum><text>improve the accuracy and completeness of the medical record information, clinical information, data, and documentation that is used to calculate the information under subsection (b); and</text></clause><clause id="HACD6812F6BF7488B8E0D529328735036"><enum>(ii)</enum><text display-inline="yes-display-inline">ensure that each medical facility of the Department provides such information in a uniform manner.</text></clause></subparagraph></paragraph><paragraph id="HCAE7BF0E49614003AC65BE15794F3797"><enum>(3)</enum><header>Annual reports</header><text>Not later than two years after the date of the enactment of this Act, and annually thereafter, the Secretary shall submit to Congress a report on the findings of each audit under paragraph (1).</text></paragraph></subsection></section></legis-body></bill>
