which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To permit disabled law enforcement officers, customs and border protection officers, firefighters, air traffic controllers, nuclear materials couriers, members of the Capitol Police, members of the Supreme Court Police, employees of the Central Intelligence Agency performing intelligence activities abroad or having specialized security requirements, and diplomatic security special agents of the Department of State to receive retirement benefits in the same manner as if they had not been disabled.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H803B589053F34EB5A7796A242E1941C0"><section section-type="section-one" id="HF49257BE1B7444E2802F311A40F322D6"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>First Responder Fair Return for Employees on Their Initial Retirement Earned Act of 2021</short-title></quote> or the <quote><short-title>First Responder Fair RETIRE Act</short-title></quote>.</text></section><section id="HE8168926CF7847399A407E10BE53DA05"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="H7349B526C13E4F7AB93F1EB39AB4DE1B"><enum>(1)</enum><text display-inline="yes-display-inline">it is in the best national and homeland security interests of the United States for Federal agencies to retain the specialized knowledge and experience of individuals who suffer an injury or illness while serving in a covered position (as defined under the amendments made by this Act); and</text></paragraph><paragraph id="HAC044C80B6894CADBA78DBDE0C3C7E00"><enum>(2)</enum><text display-inline="yes-display-inline">Federal agencies should ensure, to the greatest extent possible, that an individual who can no longer carry out the duties of a covered position, and is reappointed to a position in the civil service that is not a covered position, is reappointed within the same Federal agency, in the same geographic location, and at a level of pay commensurate to the position which the individual held immediately prior to such injury or illness.</text></paragraph></section><section section-type="subsequent-section" id="HBABA70D717054C2EB3454004CAD269E7"><enum>3.</enum><header>Retirement for certain employees</header><subsection id="H6F599866A8774FE6B06ADC732CF4BCF8"><enum>(a)</enum><header>CSRS</header><text display-inline="yes-display-inline">Section 8336(c) of title 5, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H6B9D8F2B13BB48BCA17EC1A17AE33D61"><paragraph id="HE1E5939F1B9041F6BE6019A3235BC4FD" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H36A0DF5224CA431AAB0DA8BC79CFCE6E"><enum>(A)</enum><text>In this paragraph—</text><clause id="HE46F95A916E74626A45AC6FCA78E5AB0" indent="up1"><enum>(i)</enum><text>the term <term>affected individual</term> means an individual covered under this subchapter who—</text><subclause id="H67F8CD90DB4C4CAC846606AF17952972"><enum>(I)</enum><text>is performing service in a covered position;</text></subclause><subclause id="H2B11F7EB8AC349C9B014D4FE0DE36781"><enum>(II)</enum><text>while performing official duties, becomes ill or is injured as a direct result of the performance of such duties before the date on which the individual becomes entitled to an annuity under paragraph (1) of this subsection or subsection (e), (m), or (n), as applicable;</text></subclause><subclause id="H70E1E118E5824B29A429D1844ED5E2A3"><enum>(III)</enum><text display-inline="yes-display-inline">because of the illness or injury described in subclause (II), is permanently unable to render useful and efficient service in the covered position held by the employee, as determined by the agency in which the individual was serving when such individual incurred the illness or injury; and</text></subclause><subclause id="H3180A9D97DA14EF5A069C2A3C033ABD8"><enum>(IV)</enum><text display-inline="yes-display-inline">is appointed to a position in the civil service that—</text><item id="H0E3CF8A2440B4EB282C6030A98FB7F67"><enum>(aa)</enum><text>is not a covered position; and</text></item><item id="H9C61C75F8A7C433EB0EBACCC39D0B1AB"><enum>(bb)</enum><text>is within an agency that regularly appoints individuals to supervisory or administrative positions related to the activities of the former covered position of the individual; and</text></item></subclause></clause><clause id="H9CB07BE9C8CE4D70A1A693AB1353AC13" indent="up1"><enum>(ii)</enum><text>the term <term>covered position</term> means a position as a law enforcement officer, customs and border protection officer, firefighter, air traffic controller, nuclear materials courier, member of the Capitol Police, or member of the Supreme Court Police.</text></clause></subparagraph><subparagraph id="HF2219A6B63494ACB931CF7D9BA3BC2E4" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Creditable service by an affected individual in a position described in subparagraph (A)(i)(IV) shall be treated as creditable service in a covered position for purposes of this chapter and determining the amount to be deducted and withheld from the pay of the affected individual under section 8334, unless—</text><clause id="idB86CA7265C3441DAB5F2DEB3DF304F69"><enum>(i)</enum><text display-inline="yes-display-inline">the affected individual files an election described in subparagraph (C);</text></clause><clause id="id0B7E15EC237E4376B0D38A43131E5F78"><enum>(ii)</enum><text>there is a break in service exceeding 3 days before the affected individual transitions to the position described in subparagraph (A)(i)(IV); or</text></clause><clause id="HC012191A9B4A462F916EEF40C5FDF905"><enum>(iii)</enum><text display-inline="yes-display-inline">the service occurs after the affected individual—</text><subclause id="H46DF6C10EE3C4A2086B2166A72ACCF67"><enum>(I)</enum><text>is transferred to a supervisory or administrative position related to the activities of the former covered position of the affected individual; or</text></subclause><subclause id="HC4D6CA4337974F8BAE837878E774D199"><enum>(II)</enum><text display-inline="yes-display-inline">meets the age and service requirements that would subject the individual to mandatory separation under section 8335 if the affected individual had remained in the former covered position.</text></subclause></clause></subparagraph><subparagraph id="H676CB00245CF4EEDA524FEB715BCE1E0" indent="up1"><enum>(C)</enum><text>In accordance with procedures established by the Director of the Office of Personnel Management, an affected individual may file an election to have any creditable service performed by the affected individual treated in accordance with this chapter without regard to subparagraph (B).</text></subparagraph><subparagraph id="HA9AF403687DE4767B277D33953D36AEE" indent="up1"><enum>(D)</enum><text>Nothing in this paragraph shall be construed to apply to an affected individual any other pay-related laws or regulations applicable to a covered position.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF8768ABB0C0D4CF4AD8BE464E61F246A"><enum>(b)</enum><header>FERS</header><paragraph id="H384C804D525A4ABA8361E88A93645545"><enum>(1)</enum><header>In general</header><text>Section 8412(d) of title 5, United States Code, is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="HE208403E1ABF4336BD8E7ECA906C20FE"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as subparagraphs (A) and (B), respectively;</text></subparagraph><subparagraph id="H3824FA5AE4A746B4B22CDF20AB7571C7"><enum>(B)</enum><text>by inserting <quote>(1)</quote> before <quote>An employee</quote>; and</text></subparagraph><subparagraph id="HF025DDFBE56148858C53C0E669986E5D"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HBF892FB40E34409A8443CF5F2CDE92F5"><paragraph id="H29D8B03A66BA4D2CA2A9B1612110F104" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HA58CF6D27F5A42669A4481DB0EF83E74"><enum>(A)</enum><text>In this paragraph—</text><clause id="H7E9E019D17074D928891EF3F614C4E7A" indent="up1"><enum>(i)</enum><text>the term <term>affected individual</term> means an individual covered under this chapter who—</text><subclause id="H4E8DA78E523140AFAF587264D15A1E13"><enum>(I)</enum><text>is performing service in a covered position;</text></subclause><subclause id="H4E62EC701F1248FD8C0C0691941F47C4"><enum>(II)</enum><text display-inline="yes-display-inline">while performing official duties, becomes ill or is injured as a direct result of the performance of such duties before the date on which the individual becomes entitled to an annuity under paragraph (1) of this subsection or subsection (e), as applicable;</text></subclause><subclause id="HB66F1E27C48342988BDEE9AA15F7B130"><enum>(III)</enum><text display-inline="yes-display-inline">because of the illness or injury described in subclause (II), is permanently unable to render useful and efficient service in the covered position held by the employee, as determined by the agency in which the individual was serving when such individual incurred the illness or injury; and</text></subclause><subclause id="HA389F5A2AC7B470290B7AF5FDC2C8EA6"><enum>(IV)</enum><text display-inline="yes-display-inline">is appointed to a position in the civil service that—</text><item id="H4F29E982C46C46FFAD47140064891ACB"><enum>(aa)</enum><text>is not a covered position; and</text></item><item id="H94D874E91F6E41E6B0C9B8BD34BA1E70"><enum>(bb)</enum><text>is within an agency that regularly appoints individuals to supervisory or administrative positions related to the activities of the former covered position of the individual;</text></item></subclause></clause><clause id="H38E0703B098445749A8623055FC5487D" indent="up1"><enum>(ii)</enum><text>the term <term>covered position</term> means a position as a law enforcement officer, customs and border protection officer, firefighter, air traffic controller, nuclear materials courier, member of the Capitol Police, or member of the Supreme Court Police.</text></clause></subparagraph><subparagraph id="H2CFC1CAD8DA446B193A534C165273C86" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">Creditable service by an affected individual in a position described in subparagraph (A)(i)(IV) shall be treated as creditable service in a covered position for purposes of this chapter and determining the amount to be deducted and withheld from the pay of the affected individual under section 8422, unless—</text><clause id="idFBC7FC3FE15D433D9E812F9E762AB38D"><enum>(i)</enum><text display-inline="yes-display-inline">the affected individual files an election described in subparagraph (C);</text></clause><clause id="id0718F6A54A7B494285445EFAA058E26B"><enum>(ii)</enum><text>there is a break in service exceeding 3 days before the affected individual transitions to the position described in subparagraph (A)(i)(IV); or</text></clause><clause id="HEC197AF52A3A4BCC878BD261C24992E2"><enum>(iii)</enum><text display-inline="yes-display-inline">the service occurs after the affected individual—</text><subclause id="H24ED929FF62740058DD3C8C18F909048"><enum>(I)</enum><text>is transferred to a supervisory or administrative position related to the activities of the former covered position of the affected individual; or</text></subclause><subclause id="H4731FEBD4AAC45ADB3DDE2CF1FE84057"><enum>(II)</enum><text display-inline="yes-display-inline">meets the age and service requirements that would subject the affected individual to mandatory separation under section 8425 if the affected individual had remained in the former covered position.</text></subclause></clause></subparagraph><subparagraph id="HD0C11F900A8F40D2BC0912172ED5CD04" indent="up1"><enum>(C)</enum><text>In accordance with procedures established by the Director of the Office of Personnel Management, an affected individual may file an election to have any creditable service performed by the affected individual treated in accordance with this chapter without regard to subparagraph (B).</text></subparagraph><subparagraph id="HA358E8A77F294F8799C8B89CA5FF6F83" indent="up1"><enum>(D)</enum><text>Nothing in this paragraph shall be construed to apply to an affected individual any other pay-related laws or regulations applicable to a covered position.</text></subparagraph></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HCCEEE5FAF7914C29912E401F4C3DD782"><enum>(2)</enum><header>Technical and conforming amendments</header><subparagraph id="HCBE563FFF6A44DEEB072BBAA3A8EFD84"><enum>(A)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">Chapter 84</external-xref> of title 5, United States Code, is amended—</text><clause id="H3CE9817A1EC9436E9903F0144A393B47"><enum>(i)</enum><text>in section 8414(b)(3), by inserting <quote>(1)</quote> after <quote>subsection (d)</quote>;</text></clause><clause id="H2F540C646A6541C7916514D9283514F1"><enum>(ii)</enum><text>in section 8415—</text><subclause id="H02B6065B304A4C51B49A9B055C974E19"><enum>(I)</enum><text>in subsection (e), in the matter preceding paragraph (1), by inserting <quote>(1)</quote> after <quote>subsection (d)</quote>; and</text></subclause><subclause id="H4ED922E755B64181A6658C2F78C665E4"><enum>(II)</enum><text>in subsection (h)(2)(A), by striking <quote>(d)(2)</quote> and inserting <quote>(d)(1)(B)</quote>;</text></subclause></clause><clause id="H93FFD7A54BFE47F48A659BBAEA948015"><enum>(iii)</enum><text>in section 8421(a)(1), by inserting <quote>(1)</quote> after <quote>(d)</quote>;</text></clause><clause id="H6D6D912DA1B54461A799C84C31509E7C"><enum>(iv)</enum><text>in section 8421a(b)(4)(B)(ii), by inserting <quote>(1)</quote> after <quote>section 8412(d)</quote>;</text></clause><clause id="H8D3A5F2E57DE4C7E9E14618BB06AC2D0"><enum>(v)</enum><text>in section 8425, by inserting <quote>(1)</quote> after <quote>section 8412(d)</quote> each place it appears; and</text></clause><clause id="H729275C71F814203BB2AC9B23237290D"><enum>(vi)</enum><text>in section 8462(c)(3)(B)(ii), by inserting <quote>(1)</quote> after <quote>subsection (d)</quote>.</text></clause></subparagraph><subparagraph id="H2489CD168D5F4740B73D31E46E3B1E2C"><enum>(B)</enum><text>Title VIII of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4041">22 U.S.C. 4041</external-xref> et seq.) is amended—</text><clause id="H3ABDF13EA1D44A35A3D5BC6A32F9E9D8"><enum>(i)</enum><text>in section 805(d)(5) (<external-xref legal-doc="usc" parsable-cite="usc/22/4045">22 U.S.C. 4045(d)(5)</external-xref>), by inserting <quote>(1)</quote> after <quote>or 8412(d)</quote>; and</text></clause><clause id="H9D9BD0F3EA85427ABE4D7605004A773E"><enum>(ii)</enum><text>in section 812(a)(2)(B) (<external-xref legal-doc="usc" parsable-cite="usc/22/4052">22 U.S.C. 4052(a)(2)(B)</external-xref>), by inserting <quote>(1)</quote> after <quote>or 8412(d)</quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="HC78B740DF02A40E9BB096D726FE34D2D"><enum>(c)</enum><header>CIA employees</header><text>Section 302 of the Central Intelligence Agency Retirement Act (<external-xref legal-doc="usc" parsable-cite="usc/50/2152">50 U.S.C. 2152</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HB2315BB9E5A24530857CDF9D293F9F86"><subsection id="H3CF28ACF0CC34683A0262E2244B097DF"><enum>(d)</enum><header>Employees disabled on duty</header><paragraph id="HB99D8BE8DE1949A3956917E1B92FA559"><enum>(1)</enum><header>Definitions</header><text>In this subsection—</text><subparagraph id="HBE7C1B994C484B83AE03F6D8595A09FF"><enum>(A)</enum><text>the term <term>affected employee</term> means an employee of the Agency covered under subchapter II of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, who—</text><clause id="H8B62D6B7E7B34F248F1CFF8372F2FE71"><enum>(i)</enum><text>is performing service in a position designated under subsection (a);</text></clause><clause id="H2BE41C2AFFAC4D178EF3AFD30CFE226F"><enum>(ii)</enum><text display-inline="yes-display-inline">while performing official duties in the position designated under subsection (a), becomes ill or is injured as a direct result of the performance of such duties before the date on which the employee becomes entitled to an annuity under section 233 of this Act or section 8412(d)(1) of title 5, United States Code;</text></clause><clause id="HBB60D6466ED94E4DBFFD471EEEF30AB0"><enum>(iii)</enum><text display-inline="yes-display-inline">because of the illness or injury described in clause (ii), is permanently unable to render useful and efficient service in the covered position held by the employee, as determined by the Director; and</text></clause><clause id="HE50EA56343D041F2A3B4A7D591A92E80"><enum>(iv)</enum><text>is appointed to a position in the civil service within the Agency that is not a covered position; and</text></clause></subparagraph><subparagraph id="H171CAA99060E4ECA85ED83B8E75A8282"><enum>(B)</enum><text>the term <term>covered position</term> means a position as—</text><clause id="H6E37DC87ACEF4395B292B325E3AB93B7"><enum>(i)</enum><text>a law enforcement officer described in section 8331(20) or 8401(17) of title 5, United States Code;</text></clause><clause id="HAB7EE9F82EF5404D8987B14F9EFDF26B"><enum>(ii)</enum><text>a customs and border protection officer described in section 8331(31) or 8401(36) of title 5, United States Code;</text></clause><clause id="H07E85997F5C44A80A1F9D4E79C4F6574"><enum>(iii)</enum><text>a firefighter described in section 8331(21) or 8401(14) of title 5, United States Code;</text></clause><clause id="H5878CA7FF861414A97A0542D4E28AF56"><enum>(iv)</enum><text>an air traffic controller described in section 8331(30) or 8401(35) of title 5, United States Code;</text></clause><clause id="H7671D14FA2044158843594B3EAE6756A"><enum>(v)</enum><text>a nuclear materials courier described in section 8331(27) or 8401(33) of title 5, United States Code;</text></clause><clause id="H019C4ADDE8E2448DBB67871A768B1F5B"><enum>(vi)</enum><text>a member of the United States Capitol Police;</text></clause><clause id="HCBC7062404E74571A3C0C028AC51E3AD"><enum>(vii)</enum><text>a member of the Supreme Court Police;</text></clause><clause id="H6801E840D689404084AF3A5684AA60EB"><enum>(viii)</enum><text>an affected employee; or</text></clause><clause id="H1D04075C91AC475A88FB69899D92968A"><enum>(ix)</enum><text>a special agent described in section 804(15) of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4044">22 U.S.C. 4044(15)</external-xref>).</text></clause></subparagraph></paragraph><paragraph id="H6AB56657EA8F4CD8BA06203B238A51E5"><enum>(2)</enum><header>Treatment of service after disability</header><text display-inline="yes-display-inline">Creditable service by an affected employee in a position described in paragraph (1)(A)(iv) shall be treated as creditable service in a covered position for purposes of this Act and <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, including eligibility for an annuity under section 233 of this Act or 8412(d)(1) of title 5, United States Code, and determining the amount to be deducted and withheld from the pay of the affected employee under section 8422 of title 5, United States Code, unless—</text><subparagraph id="id2C706FC5CC8B45A18280639B84ADC79D"><enum>(A)</enum><text>the affected employee files an election described in paragraph (3);</text></subparagraph><subparagraph id="HC5875F350DD645C0A424970E5871B45F"><enum>(B)</enum><text>there is a break in service exceeding 3 days before the affected employee transitions to the position described in paragraph (1)(A)(iv); or</text></subparagraph><subparagraph id="H1C48F619ED1945AD8E0F0D470AFBCA84"><enum>(C)</enum><text display-inline="yes-display-inline">the service occurs after the affected employee is transferred to a supervisory or administrative position related to the activities of the former covered position of the affected employee.</text></subparagraph></paragraph><paragraph id="H9378DB953FF6408E97C16656EFD38A7E"><enum>(3)</enum><header>Opt out</header><text>An affected employee may file an election to have any creditable service performed by the affected employee treated in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/84">chapter 84</external-xref> of title 5, United States Code, without regard to paragraph (2).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H9A65054042064590AD1387BF0F9194F3"><enum>(d)</enum><header>Foreign Service Retirement and Disability System</header><text>Section 806(a)(6) of the Foreign Service Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/22/4046">22 U.S.C. 4046(a)(6)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H5A68713B52EC422FB3893FE2FBA79F2D"><subparagraph id="H193CE9FCA1024F5B81ADF9870D3DEE20" indent="up2"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="HC291429CCEAD453AA6C28A4A4F9FA842"><enum>(i)</enum><text>In this subparagraph—</text><subclause id="HF93663DC946D408E8972A0E23A837CBA" indent="up1"><enum>(I)</enum><text>the term <term>affected special agent</term> means an individual covered under this subchapter who—</text><item id="H6A6DC0AE3C604214ABD5CD14FEB34B1E"><enum>(aa)</enum><text>is performing service as a special agent;</text></item><item id="HD880470D68E8450F9DB9AF2CD9C22840"><enum>(bb)</enum><text display-inline="yes-display-inline">while performing official duties as a special agent, becomes ill or is injured as a direct result of the performance of such duties before the date on which the individual becomes entitled to an annuity under section 811;</text></item><item id="H796F31F17E1D4738AB6CB7E601349273"><enum>(cc)</enum><text display-inline="yes-display-inline">because of the illness or injury described in item (bb), is permanently unable to render useful and efficient service as a special agent, as determined by the Secretary; and</text></item><item id="H45176F31F7A940BDA660B41FB0E9DB83"><enum>(dd)</enum><text>is appointed to a position in the Foreign Service that is not a covered position; and</text></item></subclause><subclause id="HF2B1C6ACD6FE4D0D8D107D5B4381B4D4" indent="up1"><enum>(II)</enum><text>the term <term>covered position</term> means a position as—</text><item id="H679813BE29B648049A84A91A6145942C"><enum>(aa)</enum><text>a law enforcement officer described in section 8331(20) or 8401(17) of title 5, United States Code;</text></item><item id="H55642F15F7B34A04806D14481EC608FE"><enum>(bb)</enum><text>a customs and border protection officer described in section 8331(31) or 8401(36) of title 5, United States Code;</text></item><item id="H90D4A3A452314AA49218C6AAF6ABC688"><enum>(cc)</enum><text>a firefighter described in section 8331(21) or 8401(14) of title 5, United States Code;</text></item><item id="HB0509E4E14BA4EF9B515B43367E4DBE4"><enum>(dd)</enum><text>an air traffic controller described in section 8331(30) or 8401(35) of title 5, United States Code;</text></item><item id="HD60740210C6C4F27B4F13661789B3D11"><enum>(ee)</enum><text>a nuclear materials courier described in section 8331(27) or 8401(33) of title 5, United States Code;</text></item><item id="H2CA4352CAF654DFD8C9FDF67BF00CA85"><enum>(ff)</enum><text>a member of the United States Capitol Police;</text></item><item id="H853C8ABF949C42B0B7BB5C12CCF1FC2A"><enum>(gg)</enum><text>a member of the Supreme Court Police;</text></item><item id="H8E6CB1AACB514E00AE330D98C8653AD9"><enum>(hh)</enum><text>an employee of the Agency designated under section 302(a) of the Central Intelligence Agency Retirement Act (<external-xref legal-doc="usc" parsable-cite="usc/50/2152">50 U.S.C. 2152(a)</external-xref>); or</text></item><item id="H1F5F15EB005F4705836994224FBF0E51"><enum>(ii)</enum><text>a special agent.</text></item></subclause></clause><clause id="H3167A5E1CB814948A491604F71032910" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">Creditable service by an affected special agent in a position described in clause (i)(I)(dd) shall be treated as creditable service as a special agent for purposes of this subchapter, including determining the amount to be deducted and withheld from the pay of the individual under section 805, unless—</text><subclause id="idE2DF39992F2045FA84BA5D2186221700"><enum>(I)</enum><text display-inline="yes-display-inline">the affected special agent files an election described in clause (iii);</text></subclause><subclause id="H847CE0F6D883467EA72277706BDD1ED4"><enum>(II)</enum><text>there is a break in service exceeding 3 days before the special agent transitions to a position described in clause (i)(I)(dd); or</text></subclause><subclause id="HCC77DC70E63A486C8A94CCA3E7B11FAA"><enum>(III)</enum><text>the service occurs after the affected special agent is transferred to a supervisory or administrative position related to the activities of the former covered position of the affected special agent.</text></subclause></clause><clause id="H6F53331DE8B446BB896C3BD077540328" indent="up1"><enum>(iii)</enum><text>In accordance with procedures established by the Secretary, an affected special agent may file an election to have any creditable service performed by the affected special agent treated in accordance with this subchapter, without regard to clause (ii).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HC0A61B1F59E64C26BBB7AF3C17A161CE"><enum>(e)</enum><header>Implementation</header><paragraph id="HD2E0DB15C3BE4D0F8A9DC120CEC5D184"><enum>(1)</enum><header>Office of Personnel Management</header><text>Not later than 1 year after the date of enactment of this Act, the Director of the Office of Personnel Management shall promulgate regulations to carry out the amendments made by subsections (a) and (b).</text></paragraph><paragraph id="HCB91F14CF30848B6B50A9DBC8B94EFDD"><enum>(2)</enum><header>CIA employees</header><text display-inline="yes-display-inline">The Director of the Central Intelligence Agency shall promulgate regulations to carry out the amendment made by subsection (c).</text></paragraph><paragraph id="H43294BAD79A04AF68E080DA795BB2EB9"><enum>(3)</enum><header>Foreign Service Retirement and Disability System</header><text>The Secretary of State shall promulgate regulations to carry out the amendment made by subsection (d).</text></paragraph><paragraph id="H65832F2C111C4CDFA63DE125D8682542"><enum>(4)</enum><header>Agency certification</header><text display-inline="yes-display-inline">The regulations promulgated to carry out the amendments made by this Act shall include a requirement that the head of the agency at which an affected individual, affected employee, or affected special agent (as the case may be) incurred the applicable illness or injury certifies that such illness or injury—</text><subparagraph id="HCB957D4CE7864D178A7181F4B1BFDD34"><enum>(A)</enum><text>was incurred in the course of performing official duties; and</text></subparagraph><subparagraph id="HB5947CE3CDCE4EEF9CA54A89963581BC"><enum>(B)</enum><text>permanently precludes the affected individual, affected employee, or affected special agent from rendering useful and efficient service in the covered position but would not preclude the affected individual, affected employee, or affected special agent from continuing to serve in the Federal service.</text></subparagraph></paragraph><paragraph id="HDCE69E27477A4BA9BEC15C913DE4AAED"><enum>(5)</enum><header>Agency reappointment</header><text display-inline="yes-display-inline">The regulations promulgated to carry out the amendments made by this Act shall ensure that, to the greatest extent possible, the head of each agency appoints an affected individual, affected employee, or affected special agent to a supervisory or administrative position related to the activities of the former covered position of the affected individual, affected employee, or affected special agent.</text></paragraph><paragraph id="HB2CF282CEB8F49D6A2331F54C3A03606"><enum>(6)</enum><header>Treatment of service</header><text display-inline="yes-display-inline">The regulations promulgated to carry out the amendments made by this Act shall ensure that the creditable service of an affected individual, affected employee, or affected special agent (as the case may be) that is not in a covered position pursuant to an election made under such amendments shall be treated as the same type of service as the covered position in which the affected individual, affected employee, or affected special agent suffered the qualifying illness or injury.</text></paragraph></subsection><subsection id="H55B9A77F701E477CAE03756AE1BF98C7"><enum>(f)</enum><header>Effective date; applicability</header><text>The amendments made by this Act—</text><paragraph id="H3B79A45CDC1146A3B6A0B7B8D14C7CA0"><enum>(1)</enum><text>shall take effect on the date of enactment of this Act; and</text></paragraph><paragraph id="HF66A6F8CD03840D492D57DC594759213"><enum>(2)</enum><text>shall apply to an individual who suffers an illness or injury described in section 8336(c)(3)(A)(i)(II) or section 8412(d)(2)(A)(i)(II) of title 5, United States Code, as amended by this section, section 302(d)(1)(A)(ii) of the Central Intelligence Agency Retirement Act, as amended by this section, or section 806(a)(6)(D)(i)(I)(bb) of the Foreign Service Act of 1980, as amended by this section, on or after the date that is 2 years after the date of enactment of this Act.</text></paragraph></subsection></section></legis-body></bill>
