which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To assist communities affected by stranded nuclear waste, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sensible, Timely Relief for America's Nuclear Districts' Economic Development Act of 2021</short-title></quote> or the <quote><short-title>STRANDED Act of 2021</short-title></quote>.</text></section><section id="id7869F2253B18400A8057A445F7EE5CEC"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text><paragraph id="idD715FCDDD6CF450C804BB1D9030B7013"><enum>(1)</enum><text display-inline="yes-display-inline">in 1982, Congress authorized the Secretary of Energy and the Chairman of the Nuclear Regulatory Commission to safely manage and dispose of the most highly radioactive nuclear waste of the United States, a responsibility that includes—</text><subparagraph id="id5E1723A1886C4791AAFEEA69EA8DC30B"><enum>(A)</enum><text display-inline="yes-display-inline">removing spent nuclear fuel from commercial nuclear power plants for a fee; and</text></subparagraph><subparagraph id="id65A1B3E610BB4EA8BC1AF1992BA8594B"><enum>(B)</enum><text display-inline="yes-display-inline">transporting the spent fuel to—</text><clause id="id4A35F03E0BC145A59191F335A6A06002"><enum>(i)</enum><text display-inline="yes-display-inline">a permanent geological repository; or</text></clause><clause id="id3BCC76AFE4AD423D92CB929F96C9DC42"><enum>(ii)</enum><text display-inline="yes-display-inline">an interim storage facility before permanent disposal;</text></clause></subparagraph></paragraph><paragraph id="id10442B2C24D74BBFA145425D87B2E4ED"><enum>(2)</enum><text>for more than 30 years, nuclear power plants have operated in good faith that the Federal Government would establish a permanent geological repository;</text></paragraph><paragraph id="id59B0788372B343D28292467BDFF56999"><enum>(3)</enum><text>communities affected by stranded nuclear waste are in fact interim nuclear waste storage sites;</text></paragraph><paragraph id="id40F6F16FF0A1404E804241C7F87FD345"><enum>(4)</enum><text display-inline="yes-display-inline">the <act-name parsable-cite="NWPA">Nuclear Waste Policy Act of 1982</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref> et seq.)—</text><subparagraph id="idDCA08CA0741745AAB19B662C6D9D0537"><enum>(A)</enum><text display-inline="yes-display-inline">directed the Secretary to make annual impact assistance payments to States or appropriate units of local government to mitigate the social and economic impacts of the establishment and operation of interim nuclear waste storage capacity within the jurisdictional boundaries of an affected community; and</text></subparagraph><subparagraph id="idF49E20F498ED4B23B3C09A46BF0F0E1C"><enum>(B)</enum><text display-inline="yes-display-inline">established the rate for impact assistance payments at $15 per kilogram of spent nuclear fuel;</text></subparagraph></paragraph><paragraph id="id71600A568E1F4EFF8F689D2608726341"><enum>(5)</enum><text>decommissioning a commercial nuclear power plant is often catastrophic for the host community because nuclear power plants are major employers and the primary source of local tax revenue;</text></paragraph><paragraph id="id17469322B29549B18730271016C5C56E"><enum>(6)</enum><text>stranded nuclear waste is a profound obstacle to future economic growth, deterring potential employers and residents from considering the host community;</text></paragraph><paragraph id="id13E759A09EE549789E776BA9F2B12EB3"><enum>(7)</enum><text>stranded nuclear waste prevents economic development in communities in which the stranded nuclear waste is located; and</text></paragraph><paragraph id="id92CA4FBDD6F6442D95C1BA25FE5017A1"><enum>(8)</enum><text>it is critical to provide resources to communities that—</text><subparagraph id="id69CA7ACAFFC4473B8856A904EB781C75"><enum>(A)</enum><text>are challenged by stranded nuclear waste; or</text></subparagraph><subparagraph id="id55C63E365631488BA690F57B91BD4026"><enum>(B)</enum><text>will be challenged by stranded nuclear waste during the 10-year period beginning on the date of enactment of this Act.</text></subparagraph></paragraph></section><section id="idCAAF3DDCD5ED4B72B13F015C7ADCAF3D"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id9D42AA8099AD4C318A452CB00FCBE648"><enum>(1)</enum><header>Academy</header><text>The term <term>Academy</term> means the National Academy of Sciences.</text></paragraph><paragraph commented="no" id="idC507F1AFEC784510955C2B2B1AF6344D"><enum>(2)</enum><header>Affected community</header><text>The term <term>affected community</term> means a unit of local government, including a county, city, town, village, school district, or special district, that contains stranded nuclear waste within the boundaries of the unit of local government, as determined by the Secretary.</text></paragraph><paragraph commented="no" id="id8E9B3E2E15604F70BE41867D2266C45A"><enum>(3)</enum><header>Eligible civilian nuclear power plant</header><text>The term <term>eligible civilian nuclear power plant</term> means a nuclear power plant that—</text><subparagraph commented="no" id="idD0277DE34F9A44B389796901A8843D4B"><enum>(A)</enum><text>has been decommissioned; or</text></subparagraph><subparagraph commented="no" id="id7361DF1D86F84E0A81485783FE691F71"><enum>(B)</enum><text>is in the process of being decommissioned.</text></subparagraph></paragraph><paragraph id="id24F60EC0BB1F4D85A04C1490D4ADA966"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph commented="no" id="id840EAFB6C6814CE788CFE7B5C5BEF2B7"><enum>(5)</enum><header>Stranded nuclear waste</header><text>The term <term>stranded nuclear waste</term> means nuclear waste or spent nuclear fuel stored in dry casks or spent fuel pools at a decommissioned or decommissioning nuclear facility.</text></paragraph></section><section id="id3FBFF7FF9A6F4D1DAF834B7796255619"><enum>4.</enum><header>Innovative solutions prize competition</header><subsection id="id72E04508F9B448028AB6607CED82DA42"><enum>(a)</enum><header>Establishment</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall establish under section 24 of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3719">15 U.S.C. 3719</external-xref>) a competitive prize competition (referred to in this section as the <quote>prize competition</quote>) to award prizes for proposals for affected communities to carry out alternatives to nuclear facilities, generating sites, and waste sites.</text></subsection><subsection id="id24D4424EBA49463DB380FC213E552971"><enum>(b)</enum><header>Prize board</header><paragraph id="id581CCF784E5E4625B1844BB30141D061"><enum>(1)</enum><header>Establishment</header><text>There is established an advisory board (referred to in this section as the <quote>Board</quote>) to advise the Secretary on—</text><subparagraph id="idBA2DE00E95294EAA8A25DE8933F0F993"><enum>(A)</enum><text>the design and implementation of the prize competition; and</text></subparagraph><subparagraph id="id247ABDDA4112470584D0BE526862C12B"><enum>(B)</enum><text>the development of each pilot project under subsection (d).</text></subparagraph></paragraph><paragraph id="idFA1DB6AE563E4BC29A11A9713A04B68B"><enum>(2)</enum><header>Composition</header><text>The Board shall be composed of not fewer than 9 members appointed by the Secretary—</text><subparagraph id="id73F1618EFF79488C8D3D0DCF8DAEDBB5"><enum>(A)</enum><text>who shall provide expertise in—</text><clause id="id06EC6212FCA541C483193FB0CD745AFE"><enum>(i)</enum><text>nuclear waste;</text></clause><clause id="id99528945B60344B58DAC40F17FBC9614"><enum>(ii)</enum><text>workforce issues;</text></clause><clause id="id7D4B4A6F12B7441CB5AF78A07C80F0B7"><enum>(iii)</enum><text>technology development; and</text></clause><clause id="id365620DB1C724F00A0B247272BFCFB57"><enum>(iv)</enum><text>economic development; and</text></clause></subparagraph><subparagraph id="id26E0C06F0F894C9D9585E593C505175B"><enum>(B)</enum><text>who may include representatives from—</text><clause id="id2AFBF5AE0F674C7AB101129C6F87295C"><enum>(i)</enum><text>the National Laboratories;</text></clause><clause id="idB8F5A1DD4BA44CCA83BB90DF3E9D45EE"><enum>(ii)</enum><text>nonprofit organizations; and</text></clause><clause id="id0A3F67D1D80E4D83A07A2B1FB0877582"><enum>(iii)</enum><text>institutions of higher education.</text></clause></subparagraph></paragraph></subsection><subsection id="id841B7EA9A2AF4324A6DA4521899F2BC9"><enum>(c)</enum><header>Award amount</header><text>An award under the prize competition shall be in the amount of $500,000.</text></subsection><subsection id="id75B01B138C6249E7ACB5DC1DAACC2111"><enum>(d)</enum><header>Pilot project</header><paragraph id="idD782622100214AB18D72641C25218975"><enum>(1)</enum><header>In general</header><text>The Secretary, in consultation with the Board, shall develop a pilot project based on each proposal for which a prize is awarded under the prize competition.</text></paragraph><paragraph id="id09CEA5B19A554A008193474D355BDC91"><enum>(2)</enum><header>Funding</header><text>Of the amounts made available under section 8, the Secretary may use $500,000 to carry out each pilot project under paragraph (1).</text></paragraph></subsection><subsection id="id3CF28C1C6431454B9C5491D0AA90ECC3"><enum>(e)</enum><header>Report</header><text>Not later than 60 days after the date on which a prize is awarded under the prize competition, the Secretary shall submit to the relevant committees of Congress a report that describes the proposal for which the prize was awarded.</text></subsection></section><section id="id380768E959F94691804C8A49CBFF9077"><enum>5.</enum><header>Stranded Nuclear Waste Task Force</header><subsection id="idCCBB66DF35F147D791385F88B57942B5"><enum>(a)</enum><header>Establishment</header><text>The Secretary shall establish a task force, to be known as the <quote>Stranded Nuclear Waste Task Force</quote>—</text><paragraph id="idA056AE59246C49DCACCA9536D66C8F2B"><enum>(1)</enum><text>to conduct a study on existing public and private resources and funding for which affected communities may be eligible; and</text></paragraph><paragraph id="idF6AF8F82DC0C4162B49960345C3EB8E8"><enum>(2)</enum><text>to develop immediate and long-term economic adjustment plans tailored to the needs of each affected community.</text></paragraph></subsection><subsection id="id866C1985821446128739A14EA359E82D"><enum>(b)</enum><header>Study</header><text>Not later than 180 days after the date of enactment of this Act, the Stranded Nuclear Waste Task Force shall complete and submit to Congress the study described in subsection (a).</text></subsection></section><section id="id8F4A093A488D470F9ABA608C6A2B262D"><enum>6.</enum><header>Economic impact grants</header><subsection id="idB04AC4868B29467A8DEF703819DC5E32"><enum>(a)</enum><header>Establishment</header><text>Not later than 60 days after the date of enactment of this Act, the Secretary shall establish and carry out a noncompetitive grant program to provide financial assistance to units of local government within the jurisdictional boundary of which an eligible civilian nuclear power plant is located to offset the economic and social impacts of stranded nuclear waste in affected communities.</text></subsection><subsection id="id7155F887DE7944B4A0DC993AD4708F47"><enum>(b)</enum><header>Eligibility</header><text>A unit of local government that is an affected community shall be eligible to receive a grant under this section for a fiscal year.</text></subsection><subsection id="id61B0ADEC9D064F7A8995BB4758B23D4F"><enum>(c)</enum><header>Awards</header><paragraph id="id278C8E94D2B94371AD9F34748F3201BC"><enum>(1)</enum><header>Amount</header><text>The amount of a grant awarded under subsection (a) shall be equal to $15 for each kilogram of spent nuclear fuel stored at the eligible civilian nuclear power plant in the affected community.</text></paragraph><paragraph id="idC367760D8A6F4DECA2ECE080E6DBD953"><enum>(2)</enum><header>Number and frequency</header><text>With respect to each eligible civilian nuclear power plant, the Secretary may only award 1 grant under subsection (a) to each eligible unit of local government for each fiscal year.</text></paragraph></subsection></section><section id="id6AC274FEA58F43BBA42E94C22FF461D4" commented="no"><enum>7.</enum><header>Annual report</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter through fiscal year 2026, the Secretary shall submit to Congress a report that—</text><paragraph id="id3D5DEC8C2B464BFCACA2308DF50FEA39" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">describes and evaluates the progress and effectiveness of—</text><subparagraph id="id1CE6620F7ED3420BB6E3FAFE962BB3F5" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">the prize competition established under section 4(a);</text></subparagraph><subparagraph commented="no" id="idD9445D78D4C94125829E3FECEB90B4B1"><enum>(B)</enum><text display-inline="yes-display-inline">each pilot project established under section 4(d); and</text></subparagraph><subparagraph id="id05E3D17AF25E4F30BD346E038A1FC83E" commented="no"><enum>(C)</enum><text>the grant program established under section 6(a); and</text></subparagraph></paragraph><paragraph id="idCB41104FFE2F46DF982C5AE7C77E1233" commented="no"><enum>(2)</enum><text>provides recommendations for legislative, regulatory, or other changes to improve the prize competition, pilot projects, or grant program described in paragraph (1), as applicable.</text></paragraph></section><section id="idF15D57C0F9F446CD98F62CFDF89A5199"><enum>8.</enum><header>Authorization of appropriations</header><subsection id="id4B7DB0BD563D47D1AB0FB8847AD7E2E2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to the Secretary to carry out this Act $175,000,000 for each of fiscal years 2022 through 2026.</text></subsection><subsection id="id138AC071B80D4B40881FE386A1A09547"><enum>(b)</enum><header>No offset</header><text>None of the funds made available under this section may be used to offset the funding for any other Federal program.</text></subsection></section></legis-body></bill>
