<section id="id7b985632-7b7a-40cb-8f85-d13e6b4c9a6d" changed="not-changed" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Marine Mammal Research and Response Act of 2021</short-title></quote>.</text></section> <section id="idb51b5582-3c57-493f-81e7-50057c0cd52b" changed="not-changed"><enum>2.</enum><header>Data collection and dissemination</header><text display-inline="no-display-inline">Section 402 of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1421a">16 U.S.C. 1421a</external-xref>) is amended—</text>
<paragraph id="id6b7162d8-0840-4f43-8af6-67ed9d8ea2c1" changed="not-changed"><enum>(1)</enum><text>in subsection (b)—</text> <subparagraph id="idee9bed01-e628-472c-ab91-b68d5a29dd53" changed="not-changed"><enum>(A)</enum><text>in paragraph (1)(A), by inserting <quote>or entangled</quote> after <quote>stranded</quote>;</text></subparagraph>
<subparagraph id="id09bba9fc-27ac-4720-9e51-40c8a2b1dda6" changed="not-changed"><enum>(B)</enum><text>in paragraph (3)—</text> <clause id="id9d9969f4-5cc5-44f4-bab2-2bc626454be1" changed="not-changed"><enum>(i)</enum><text>by striking <quote>strandings,</quote> and inserting <quote>strandings and entanglements, including unusual mortality events,</quote>;</text></clause>
<clause commented="no" id="idaae31ecc-41df-48d5-97d4-0fd5c4a18be3" changed="not-changed"><enum>(ii)</enum><text>by inserting <quote>stranding</quote> before <quote>region</quote>; and</text></clause> <clause commented="no" id="idacf76bd7-e359-45f2-8e69-a0128cf9d417" changed="not-changed"><enum>(iii)</enum><text>by striking <quote>marine mammals; and</quote> and inserting <quote>marine mammals and entangled marine mammals to allow comparison of the causes of illness and deaths in stranded marine mammals and entangled marine mammals with physical, chemical, and biological environmental parameters; and</quote>; and</text></clause></subparagraph>
<subparagraph commented="no" id="id05d0812a-7b86-49ac-82dd-220de4e4bb31" changed="not-changed"><enum>(C)</enum><text>in paragraph (4), by striking <quote>analyses, that would allow comparison of the causes of illness and deaths in stranded marine mammals with physical, chemical, and biological environmental parameters.</quote> and inserting <quote>analyses.</quote>; and</text></subparagraph></paragraph> <paragraph commented="no" id="id82e0be85-e3b9-4a03-9d60-42d3240e3ce7" changed="not-changed"><enum>(2)</enum><text>by striking subsection (c) and inserting the following:</text>

<subsection id="id26AA8D89A46447F99F831135E17EF360" changed="not-changed"><enum>(c)</enum><header>Information required To be submitted and collected</header>
<paragraph id="idCEFB479BD6E84DC4A5386A78D7916E59" changed="not-changed"><enum>(1)</enum><header>In General</header><text>After each response to a stranding or entanglement event, the Secretary shall collect (including from any staff of the National Oceanic and Atmospheric Administration that respond directly to such an event), and shall require each stranding network participant who responds to that stranding or entanglement to submit to the Administrator of the National Oceanic and Atmospheric Administration—</text> <subparagraph id="idBFB3FC72FB8940A5A2DD35EA20880B18" changed="not-changed"><enum>(A)</enum><text>data on the stranding event, including NOAA Form 89–864 (OMB #0648–0178), NOAA Form 89–878 (OMB #0648–0178), similar successor forms, or similar information in an appropriate format required by the United States Fish and Wildlife Service for species under its management authority;</text></subparagraph>
<subparagraph commented="no" id="idB81B13DFAB7A48A0909AAAF91D1A301E" changed="not-changed"><enum>(B)</enum><text>supplemental data to the data described in subparagraph (A), which may include, as available, relevant information about—</text> <clause id="idD5774563C4CA49E983CA0EF906E15B0D" changed="not-changed"><enum>(i)</enum><text>weather and tide conditions;</text></clause>
<clause id="id4EA85D2377084825A7751D0397F19473" changed="not-changed"><enum>(ii)</enum><text>offshore human, predator, or prey activity;</text></clause> <clause id="id1424983CA76F435E8BC3ECBCE469E53F" changed="not-changed"><enum>(iii)</enum><text>morphometrics;</text></clause>
<clause id="id0AA71AC3671C4E2F8EBC3A8F5F60767F" changed="not-changed"><enum>(iv)</enum><text>behavior;</text></clause> <clause id="idB0AF4E37C5214DEC84F6965B102F6E4B" changed="not-changed"><enum>(v)</enum><text>health assessments;</text></clause>
<clause id="idD7D6B3B989F14ADF80E90BD7BE361DFD" changed="not-changed"><enum>(vi)</enum><text>life history samples; or</text></clause> <clause id="id09C2E57AA8834C05AEB6EA2267554D68" changed="not-changed"><enum>(vii)</enum><text>stomach and intestinal contents; and</text></clause></subparagraph>
<subparagraph commented="no" id="id7895A6DB1EE04C5FBD0C52C983BD4A1B" changed="not-changed"><enum>(C)</enum><text>data and results from laboratory analysis of tissues, which may include, as appropriate and available—</text> <clause commented="no" id="id324365BE5CC849CCB3E70901F357FDAC" changed="not-changed"><enum>(i)</enum><text>histopathology;</text></clause>
<clause commented="no" id="id436F7D5EFE1C4C059E15326F505011C5" changed="not-changed"><enum>(ii)</enum><text>toxicology;</text></clause> <clause commented="no" id="idE88D89CE6F1F460A830EF3B2641017EC" changed="not-changed"><enum>(iii)</enum><text>microbiology</text></clause>
<clause commented="no" id="idB1154AA71E104950B28DD57DEC2F0E44" changed="not-changed"><enum>(iv)</enum><text>virology; or</text></clause> <clause commented="no" id="id144FA1AC765246FC81E1D8ADE5E1BBB4" changed="not-changed"><enum>(v)</enum><text>parasitology. </text></clause></subparagraph></paragraph>
<paragraph id="ida2a673b871c64fc1b4baec2317dd6de7" changed="not-changed"><enum>(2)</enum><header>Timeline</header><text>A stranding network participant shall submit—</text> <subparagraph id="id5c062c5f7da642ccba5a8cd427cee2b3" changed="not-changed"><enum>(A)</enum><text>the data described in paragraph (1)(A) not later than 30 days after the date of a response to a stranding or entanglement event;</text></subparagraph>
<subparagraph id="idef4a513fe856465389bb656e33649c22" changed="not-changed"><enum>(B)</enum><text>the compiled data described in paragraph (1)(B) not later than 30 days after the date on which the data is available to the stranding network participant; and</text></subparagraph> <subparagraph id="id6baa2a9fac264ba08e5bab0acc73531a" changed="not-changed"><enum>(C)</enum><text>the compiled data described in paragraph (1)(C) not later than 30 days after the date on which the laboratory analysis has been reported to the stranding network participant.</text></subparagraph></paragraph></subsection>
<subsection id="id1f83f2c0-0d96-4894-b162-1aafca5fb110" changed="not-changed"><enum>(d)</enum><header>Availability of data</header>
<paragraph id="id24475e04-436b-47c2-afb2-9322bfc3e826" changed="not-changed"><enum>(1)</enum><header>In general</header><text>The Secretary shall develop a program to make information, including any data and metadata collected under paragraphs (3) or (4) of subsection (b) or subsection (c), available to researchers, stranding network participants, and the public—</text> <subparagraph id="id3d7f6dcf-2bc2-4549-88a4-2699014c1391" changed="not-changed"><enum>(A)</enum><text>to improve real-time coordination of response to stranding and entanglement events across geographic areas and between stranding coordinators;</text></subparagraph>
<subparagraph id="idcc0c1c1a-73f8-4130-bfc4-1ebf60f212b3" changed="not-changed"><enum>(B)</enum><text>to identify and quickly disseminate information on potential public health risks;</text></subparagraph> <subparagraph id="idc8bae738-b7bc-4e8c-949c-95e1caa186dd" changed="not-changed"><enum>(C)</enum><text>to facilitate integrated interdisciplinary research;</text></subparagraph>
<subparagraph id="idb7d9af9a-a525-449e-b5e0-3e689c46542d" changed="not-changed"><enum>(D)</enum><text>to facilitate peer-reviewed publications;</text></subparagraph> <subparagraph id="id64a6a375-0f25-4177-abd5-00592e14f8f8" changed="not-changed"><enum>(E)</enum><text>to archive regional data into 1 national database for future analyses; and</text></subparagraph>
<subparagraph id="id7e067312-e4cb-4eb5-b067-88f8c5ca7967" changed="not-changed"><enum>(F)</enum><text>for education and outreach activities.</text></subparagraph></paragraph> <paragraph id="id02de12ca494d4878b9a589fec931e7d4" changed="not-changed"><enum>(2)</enum><header>Access to data</header><text>The Secretary shall ensure that any data or metadata collected under subsection (c)—</text>
<subparagraph id="ide77c74b81e9843f8b715921cf877643a" changed="not-changed"><enum>(A)</enum><text>by staff of the National Oceanic and Atmospheric Administration that responded directly to a stranding or entanglement event is available to the public through the Health MAP and the Observation System not later than 30 days after that data or metadata is collected by, available to, or reported to the Secretary; and</text></subparagraph> <subparagraph id="id06e88e92e9504d17a1ca37ae1313c150" changed="not-changed"><enum>(B)</enum><text>by a stranding network participant that responded directly to a stranding or entanglement event is made available to the public through the Health MAP and the Observation System 2 years after the date on which that data is submitted to the Secretary under subsection (c).</text></subparagraph></paragraph>
<paragraph id="id9C2AF55D910E413C9698C3D6DAD5CEFF" changed="not-changed"><enum>(3)</enum><header>Exceptions</header>
<subparagraph id="idC61BD754EE8D425D9788016E81F256C0" changed="not-changed"><enum>(A)</enum><header>Written release</header><text>Not­with­stand­ing paragraph (2)(B), the Secretary may make data described in paragraph (2)(B) publicly available earlier than 2 years after the date on which that data is submitted to the Secretary under subsection (c), if the stranding network participant has completed a written release stating that such data may be made publicly available.</text></subparagraph> <subparagraph commented="no" id="id172115FA0C3D4C6D8602E299901F9798" changed="not-changed"><enum>(B)</enum><header>Law enforcement</header><text>Not­with­stand­ing paragraph (2), the Secretary may withhold data for a longer period than the period of time described in paragraph (2) in the event of a law enforcement action or legal action that may be related to that data.</text></subparagraph></paragraph></subsection>
<subsection id="idB9434DCBA44D4B50987CC86B8029B56C" changed="not-changed"><enum>(e)</enum><header>Standards</header><text>The Secretary, in consultation with the marine mammal stranding community, shall—</text> <paragraph id="idBB5677DC6C05406FA80187294260B589" changed="not-changed"><enum>(1)</enum><text>make publicly available guidance about uniform data and metadata standards to ensure that data collected in accordance with this section can be archived in a form that is readily accessible and understandable to the public through the Health MAP and the Observation System; and</text></paragraph>
<paragraph id="idCB23C3E715394A77BDA04833598E8130" changed="not-changed"><enum>(2)</enum><text>periodically update such guidance.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="idFA1B737C3F0C49B6B044FD27003F8289" changed="not-changed"><enum>(f)</enum><header>Management policy</header><text>In collaboration with the regional stranding networks, the Secretary shall develop, and periodically update, a data management and public outreach collaboration policy for stranding or entanglement events.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="id3de9e9eb-866b-4a9f-a03f-b51c8e2ae97e" changed="not-changed"><enum>3.</enum><header>Stranding or entanglement response agreements</header>
<subsection id="id6B850BAA2A4D490982EBA316BF109580" changed="not-changed"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 403 of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1421b">16 U.S.C. 1421b</external-xref>) is amended—</text> <paragraph id="idd9a8a470-693a-4f25-a0b3-d37fde172eb0" changed="not-changed"><enum>(1)</enum><text>in the section heading by inserting <quote><header-in-text level="section" style="OLC">or entanglement</header-in-text></quote> before <quote><header-in-text level="section" style="OLC">response</header-in-text></quote>; </text></paragraph>
<paragraph id="id946dec8b-8a3d-4942-b2df-f80bdfb8ea89" changed="not-changed"><enum>(2)</enum><text>in subsection (a), by striking the period at the end and inserting <quote>or entanglement.</quote>; and</text></paragraph> <paragraph id="idD7C817875251413083D3C198F660E788" changed="not-changed"><enum>(3)</enum><text>in subsection (b)—</text>
<subparagraph id="id77E140DBEB8749D0AA4C11CA31D18EF3" changed="not-changed"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and</quote> after the semicolon;</text></subparagraph> <subparagraph id="id220390F6AE684A7C8323B85315B756C5" changed="not-changed"><enum>(B)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph>
<subparagraph id="idE3E14480FA474300862F16024963460F" changed="not-changed"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idDE258DD210064AFFA0738EAF5A9EA3CF" changed="not-changed"> <paragraph id="id8DE32B7F1B1045BFB8041D8604C7448F" changed="not-changed"><enum>(3)</enum><text>include a description of the data management and public outreach policy established under section 402(f).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection>
<subsection id="idCC1F5664E512401F90E113192B225EE3" changed="not-changed"><enum>(b)</enum><header>Table of contents amendment</header><text>The table of contents in the first section of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="public-law" parsable-cite="pl/92/522">Public Law 92–522</external-xref>; 86 Stat. 1027) is amended by striking the item related to section 403 and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id8B55C7D3A75D4479A0A2247736914125" changed="not-changed"> <toc changed="not-changed"> <toc-entry bold="off" level="section" changed="not-changed">Sec. 403. Stranding or entanglement response agreements.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="ida7c8b1ff-aeba-425a-92d1-d3bf0b180c03" changed="not-changed"><enum>4.</enum><header>Unusual mortality event activity funding</header><text display-inline="no-display-inline">Section 405 the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1421d">16 U.S.C. 1421d</external-xref>) is amended—</text>
<paragraph id="id4D80B1039C024489B11910C0541B857A" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="id80f6854b-6a66-4eb4-97d9-a7dcfc4c0a93" changed="not-changed"> <subsection commented="no" id="ide1510b77-959f-4ecf-b3ec-6871d4c988af" changed="not-changed"><enum>(b)</enum><header>Uses</header><text>Amounts in the Fund—</text>
<paragraph commented="no" display-inline="no-display-inline" id="id02dd1ef1-b572-459b-9c1c-e1f872319192" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">shall be available only for use by the Secretary, in consultation with the Secretary of the Interior, and dispersed among claimants based on budgets approved by the Secretary prior to expenditure—</text> <subparagraph commented="no" display-inline="no-display-inline" id="ideed0edda-8b75-4174-82cd-591ad15acc1e" changed="not-changed"><enum>(A)</enum><text>to make advance, partial, or progress payments under contracts or other funding mechanisms for property, supplies, salaries, services, and travel costs incurred in acting in accordance with the contingency plan issued under section 404(b) or under the direction of an Onsite Coordinator for an unusual mortality event designated under section 404(a)(2)(B)(iii);</text></subparagraph>
<subparagraph id="id41277a60bb054b3a857694410214c2d6" changed="not-changed"><enum>(B)</enum><text>for reimbursing any stranding network participant for costs incurred in the collection, preparation, analysis, and transportation of marine mammal tissues and samples collected with respect to an unusual mortality event for the Tissue Bank; and</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idbfc5b2a5-fbf9-4e26-b4bd-730bef915b33" changed="not-changed"><enum>(C)</enum><text>for the care and maintenance of a marine mammal seized under section 104(c)(2)(D); and</text></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id0befeb33-6df5-47e4-805c-1422913077fa" changed="not-changed"><enum>(2)</enum><text>shall remain available until expended.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> <paragraph id="idCD9113B4732A41F7A2BBD47A909F1BC4" changed="not-changed"><enum>(2)</enum><text>in subsection (c)—</text>
<subparagraph id="id36747a6f-c11e-4d4c-942c-9d5915117e5e" changed="not-changed"><enum>(A)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end;</text></subparagraph> <subparagraph id="ide1a6f3a6-3cee-47d6-a400-6625633c6283" changed="not-changed"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting a semicolon; and</text></subparagraph>
<subparagraph id="idadc9fa75-53eb-4f6c-befe-7ba97a37efa8" changed="not-changed"><enum>(C)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="idd84413f5af814609bdfb10881a27e544" changed="not-changed"> <paragraph id="id05ea82b1baad436686e94e804c816f54" changed="not-changed"><enum>(4)</enum><text>not more than $250,000 per year, as determined by the Secretary of Commerce, from sums collected as fines, penalties, or forfeitures of property by the Secretary of Commerce for violations of any provision of this Act; and</text></paragraph>
<paragraph id="id68E84F80454B49DFB254046F044E5066" changed="not-changed"><enum>(5)</enum><text>sums received from emergency declaration grants for marine mammal conservation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section> <section id="ide27e1373-b069-4fdf-acdf-a0fe9fa679b8" changed="not-changed"><enum>5.</enum><header>Liability</header><text display-inline="no-display-inline">Section 406(a) of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1421e">16 U.S.C. 1421e(a)</external-xref>) is amended, in the matter preceding paragraph (1)—</text>
<paragraph id="id8C56F49CAE2745E2971CF58DAA39FFB0" changed="not-changed"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>or entanglement</quote> after <quote>to a stranding</quote>; and</text></paragraph> <paragraph id="id9DAFE9FFDFA74821BB7104299B1E800C" changed="not-changed"><enum>(2)</enum><text>by striking <quote>government</quote> and inserting <quote>Government</quote>.</text></paragraph></section>
<section id="id7e7a3524-3e48-4362-94be-a344d8fae1c7" changed="not-changed"><enum>6.</enum><header>National Marine Mammal Tissue Bank and tissue analysis</header><text display-inline="no-display-inline">Section 407 of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1421f">16 U.S.C. 1421f</external-xref>) is amended—</text> <paragraph id="id85bbc164-4287-45d3-ab1c-6bd7c0ab3f95" changed="not-changed"><enum>(1)</enum><text>in subsection (c)(2)(A), by striking <quote>the health of marine mammals and</quote> and inserting <quote>marine mammal health and mortality and the health of</quote>; and</text></paragraph>
<paragraph id="id8dc7b6cd-b15e-4f1f-a7d6-8351a5c46d7f" changed="not-changed"><enum>(2)</enum><text>in subsection (d), in the matter preceding paragraph (1), by inserting <quote>public</quote> before <quote>access</quote>.</text></paragraph></section> <section id="idcc994066-415a-4215-a844-ee7d8036b696" changed="not-changed"><enum>7.</enum><header>Marine Mammal Rescue and Response Grant Program and Rapid Response Fund</header> <subsection id="id4bbd2717-2e26-45a7-8fec-1d63aff219f3" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Section 408 of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1421f-1">16 U.S.C. 1421f–1</external-xref>) is amended—</text>
<paragraph id="id182FC86F062647C6B7ADA8DFD2038AF8" changed="not-changed"><enum>(1)</enum><text>by striking the section heading and inserting <quote><header-in-text level="section" style="OLC">Marine Mammal Rescue and Response Grant Program and Rapid Response Fund</header-in-text></quote>;</text></paragraph> <paragraph id="id08EC305420394582A59159884E4DBAAE" changed="not-changed"><enum>(2)</enum><text>by striking subsections (a) through (d) and subsections (f) through (h);</text></paragraph>
<paragraph id="id42DD18702C2243E898F2925B71224F51" changed="not-changed"><enum>(3)</enum><text>by redesignating subsection (e) as subsection (f); and</text></paragraph> <paragraph id="idFCF3E2506350488794BF9039933A2716" changed="not-changed"><enum>(4)</enum><text>by inserting before subsection (f), as redesignated by paragraph (3), the following: </text>

<subsection id="idabb1051d-a5d4-4bb5-a2d0-5436e6c87c37" changed="not-changed"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> <paragraph id="id8ec0fd18-1630-495a-99d1-ebf044152371" changed="not-changed"><enum>(1)</enum><header>Emergency assistance</header> <subparagraph id="idE178C93EF3D249DFB3BF43598CBEFE2A" changed="not-changed"><enum>(A)</enum><header>In General</header><text>The term <term>emergency assistance</term> means—</text>
<clause id="id27bcdd95-1524-42fd-a624-45f620bb4154" changed="not-changed"><enum>(i)</enum><text>financial assistance provided to respond to, or that results from, a stranding event or entanglement event that—</text> <subclause id="id5b5c3944-0f15-4a7e-8a66-c38bd88f590d" changed="not-changed"><enum>(I)</enum><text>causes an immediate increase in the cost of a response, recovery, or rehabilitation that is greater than the usual cost of a response, recovery, or rehabilitation;</text></subclause>
<subclause id="idedbc90a3-4361-4ca1-ae31-ab490391e406" changed="not-changed"><enum>(II)</enum><text>is cyclical or endemic; or</text></subclause> <subclause id="id4c32da1e-e81c-42e4-afb5-d28d81578add" changed="not-changed"><enum>(III)</enum><text>involves a marine mammal that is out of the normal range for that marine mammal; or</text></subclause></clause>
<clause id="id911cabab-629f-479e-9841-38ba5575ff03" changed="not-changed"><enum>(ii)</enum><text>financial assistance provided to respond to, or that results from, a stranding event or an entanglement event that the appropriate Secretary or State or Tribal government considers to be an emergency.</text></clause></subparagraph> <subparagraph commented="no" id="id6da04eea-a4aa-41c2-b527-a1576338eaee" changed="not-changed"><enum>(B)</enum><header>Exclusions</header><text>The term <term>emergency assistance</term> does not include financial assistance to respond to an unusual mortality event.</text></subparagraph></paragraph>
<paragraph commented="no" id="idE0D7205A9B60468DB94F6C4BCC746A21" changed="not-changed"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> has the meaning given that term in section 3(12)(A).</text></paragraph> <paragraph id="ID9127308F2E3946B1A688EF43ABA0938D" changed="not-changed"><enum>(3)</enum><header>Stranding region</header><text>The term <term>stranding region</term> means a geographic region designated by the applicable Secretary for purposes of administration of this title.</text></paragraph></subsection>
<subsection commented="no" id="idC0B318DECD2E49EFB4C22833D8F0A351" changed="not-changed"><enum>(b)</enum><header>John H. Prescott Marine Mammal Rescue and Response Grant Program</header>
<paragraph id="idda8b5d3d-de2f-4cbf-a2d2-87504560669f" changed="not-changed"><enum>(1)</enum><header>In general</header><text>Subject to the availability of appropriations or other funding, the applicable Secretary shall carry out a grant program, to be known as the <quote>John H. Prescott Marine Mammal Rescue and Response Grant Program</quote> (referred to in this section as the <quote>grant program</quote>), to award grants to eligible stranding network participants or stranding network collaborators, as described in this subsection.</text></paragraph> <paragraph id="id3f94f9a4-cc5d-4963-8171-36c0575f8fd9" changed="not-changed"><enum>(2)</enum><header>Purposes</header><text>The purposes of the grant program are to provide for—</text>
<subparagraph id="id2caa13f1-9164-47a8-8b53-2e983bc54f12" changed="not-changed"><enum>(A)</enum><text>the recovery, care, or treatment of sick, injured, or entangled marine mammals;</text></subparagraph> <subparagraph id="idba144c51-b275-4053-aecf-aafe557d360b" changed="not-changed"><enum>(B)</enum><text>responses to marine mammal stranding events that require emergency assistance;</text></subparagraph>
<subparagraph id="id3d42fb34-874a-4c10-92ae-82060a8a4167" changed="not-changed"><enum>(C)</enum><text>the collection of data and samples from living or dead stranded marine mammals for scientific research or assessments regarding marine mammal health;</text></subparagraph> <subparagraph id="id530ae297-d724-488b-87d7-b172cd66244b" changed="not-changed"><enum>(D)</enum><text>facility operating costs that are directly related to activities described in subparagraph (A), (B), or (C); and</text></subparagraph>
<subparagraph id="ideed7a9bf-584d-4fc1-8e6c-24e07094d2c9" changed="not-changed"><enum>(E)</enum><text>development of stranding network capacity, including training for emergency response, where facilities do not exist or are sparse.</text></subparagraph></paragraph> <paragraph commented="no" id="idf8b7c467-dc75-4407-bb3f-98c3cd97f95c" changed="not-changed"><enum>(3)</enum><header>Contract, grant, and cooperative agreement authority</header> <subparagraph commented="no" id="id85F4149D17044B9AAE21A33833387E05" changed="not-changed"><enum>(A)</enum><header>In general</header><text>The applicable Secretary may enter into a contract, grant, or cooperative agreement with any eligible stranding network participant or stranding network collaborator, as the Secretary determines to be appropriate, for the purposes described in paragraph (2).</text></subparagraph>
<subparagraph commented="no" id="id3CEB1C30B51A49A9B9A6ACA3866352BA" changed="not-changed"><enum>(B)</enum><header>Emergency award flexibility</header><text>Following a request for emergency award flexibility and analysis of the merits of and necessity for such a request, the applicable Secretary may—</text> <clause commented="no" id="id3CC212C102A243DAA4B48E7FC96306CE" changed="not-changed"><enum>(i)</enum><text>amend any contract, grant, or cooperative agreement entered into under this paragraph, including provisions concerning the period of performance; or</text></clause>
<clause commented="no" id="id9696367B71A44BABA4A7304D2DC0DA42" changed="not-changed"><enum>(ii)</enum><text>waive the requirements under subsection (f) for grant applications submitted during the provision of emergency assistance.</text></clause></subparagraph></paragraph> <paragraph id="idec3d0f74-a9dc-4234-b881-929a41e1e961" changed="not-changed"><enum>(4)</enum><header>Equitable distribution of funds</header> <subparagraph id="idfc6da21f-4518-4f2f-944b-35831420bda2" changed="not-changed"><enum>(A)</enum><header>In general</header><text>The Secretary shall ensure, to the extent practicable, that funds awarded under the grant program are distributed equitably among the stranding regions.</text></subparagraph>
<subparagraph id="id6dbb7d8c-008d-4bbc-b281-28ab80df2a40" changed="not-changed"><enum>(B)</enum><header>Considerations</header><text>In determining priorities among the stranding regions under this paragraph, the Secretary may consider—</text> <clause commented="no" id="id75ed7e1c-f134-4b59-b4f4-2315b016a913" changed="not-changed"><enum>(i)</enum><text>equitable distribution within the stranding regions, including the sub regions (including, but not limited to, the Gulf of Mexico);</text></clause>
<clause id="idF92993E91FA04C17BD60CE966E52B3BD" changed="not-changed"><enum>(ii)</enum><text>any episodic stranding, entanglement, or mortality events, except for unusual mortality events, that occurred in any stranding region in the preceding year;</text></clause> <clause id="id987b64df-f0d5-4c89-b114-0414c03d1b01" changed="not-changed"><enum>(iii)</enum><text>any data with respect to average annual stranding, entanglements, and mortality events per stranding region;</text></clause>
<clause id="id3b44b7d3-db47-42d1-ae3f-c844a40d84c9" changed="not-changed"><enum>(iv)</enum><text>the size of the marine mammal populations inhabiting a stranding region; </text></clause> <clause id="id147efff698d349ca8b64e13ce5ae2ff6" changed="not-changed"><enum>(v)</enum><text>the importance of the region’s marine mammal populations to the well-being of indigenous communities; and </text></clause>
<clause id="idb8400b17-6602-4437-8e36-968d69ebc417" changed="not-changed"><enum>(vi)</enum><text>the conservation of protected, depleted, threatened, or endangered marine mammal species.</text></clause></subparagraph> <subparagraph commented="no" id="idE706936ABC50489B9B6818881F3DB25E" changed="not-changed"><enum>(C)</enum><header>Strandings</header><text>For the purposes of this program, priority is to be given to applications focusing on marine mammal strandings. </text></subparagraph></paragraph>
<paragraph id="idc7d121ae-83be-4909-aeac-69e3280ad934" changed="not-changed"><enum>(5)</enum><header>Application</header><text>To be eligible for a grant under the grant program, a stranding network participant shall—</text> <subparagraph id="ida9c79fe9-bea8-430e-a28f-5db310704ad0" changed="not-changed"><enum>(A)</enum><text>submit an application in such form and manner as the applicable Secretary prescribes; and</text></subparagraph>
<subparagraph id="idd9e78bb5-5516-4013-b38b-859ae1d7f516" changed="not-changed"><enum>(B)</enum><text>be in compliance with the data reporting requirements under section 402(d) and any applicable reporting requirements of the United States Fish and Wildlife Service for species under its management jurisdiction.</text></subparagraph></paragraph> <paragraph commented="no" id="id6b88b37d8f254e02a380b38f58ba80fa" changed="not-changed"><enum>(6)</enum><header>Grant criteria</header><text>The Secretary shall, in consultation with the Marine Mammal Commission, a representative from each of the stranding regions, and other individuals who represent public and private organizations that are actively involved in rescue, rehabilitation, release, scientific research, marine conservation, and forensic science with respect to stranded marine mammals under that Department's jurisdiction, develop criteria for awarding grants under their respective grant programs.</text></paragraph>
<paragraph id="id12ccf531-af62-4ffc-90d2-3b2c65adaeda" changed="not-changed"><enum>(7)</enum><header>Limitations</header>
<subparagraph id="id10054c33-c505-45a5-a872-da9adac686db" changed="not-changed"><enum>(A)</enum><header>Maximum grant amount</header><text>No grant made under the grant program for a single award may exceed $150,000 in any 12-month period.</text></subparagraph> <subparagraph id="id5013a254d7fe4a8fade4f2211a4ceb6d" changed="not-changed"><enum>(B)</enum><header>Unexpended funds</header><text>Any funds that have been awarded under the grant program but that are unexpended at the end of the 12-month period described in subparagraph (A) shall remain available until expended.</text></subparagraph></paragraph>
<paragraph id="id94B6CDA86B1E496BA1FC1382893A5B25" changed="not-changed"><enum>(8)</enum><header>Administrative costs and expenses</header><text>The Secretary's administrative costs and expenses related to reviewing and awarding grants under the grant program, in any fiscal year may not exceed the greater of—</text> <subparagraph id="idFC0B34EFD0844FC19BF6CCBDB865FEA9" changed="not-changed"><enum>(A)</enum><text>6 percent of the amounts made available each fiscal year to carry out the grant program; or</text></subparagraph>
<subparagraph id="idD5BB63F89C564A55893AFF1177BDDFED" changed="not-changed"><enum>(B)</enum><text>$80,000.</text></subparagraph></paragraph> <paragraph changed="not-changed" id="idB53462E7BAB347979306D995C1BA8B01"><enum>(9)</enum><header>Transparency</header><text>The Secretary shall make publicly available a list of grant proposals for the upcoming fiscal year, funded grants, and requests for grant flexibility under this subsection.</text></paragraph></subsection>
<subsection id="idcbe3725d-c53e-4c08-8bf5-693bda12837e" changed="not-changed"><enum>(c)</enum><header>Joseph R. Geraci Marine Mammal Rescue and Rapid Response Fund</header>
<paragraph id="id7e61151a-3bf3-4e80-8872-4c66077592a9" changed="not-changed"><enum>(1)</enum><header>In general</header><text>There is established in the Treasury of the United States an interest-bearing fund, to be known as the <quote>Joseph R. Geraci Marine Mammal Rescue and Rapid Response Fund</quote> (referred to in this section as the <quote>Rapid Response Fund</quote>).</text></paragraph> <paragraph id="idd72dbb8e-1dab-4b61-b415-da807db6fa26" changed="not-changed"><enum>(2)</enum><header>Use of Funds</header><text>Amounts in the Rapid Response Fund shall be available only for use by the Secretary to provide emergency assistance.</text></paragraph></subsection>
<subsection id="ida7aee9e7-0140-4dd1-8f54-4130557a48da" changed="not-changed"><enum>(d)</enum><header>Authorization of appropriations</header>
<paragraph id="idaf2bc9ef-1149-41fe-b433-2e0030587449" changed="not-changed"><enum>(1)</enum><header>In general</header>
<subparagraph changed="not-changed" id="id23D260C55924401BB205A0867E0331C5"><enum>(A)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out the grant program $7,000,000 for each of fiscal years 2021 through 2026, to remain available until expended, of which for each fiscal year—</text> <clause id="id63c69afc-6d29-41c0-8f1b-e50999eb3750" changed="not-changed"><enum>(i)</enum><text>$6,000,000 shall be made available to the Secretary of Commerce; and</text></clause>
<clause id="id5afb43f6-f033-44a4-9c0b-4f89948705eb" changed="not-changed"><enum>(ii)</enum><text>$1,000,000 shall be made available to the Secretary of the Interior.</text></clause></subparagraph> <subparagraph changed="not-changed" id="id3BD9804B7D1549BE83E035F8FC59FA85"><enum>(B)</enum><header>Derivation of funds</header><text>Funds to carry out the activities under this section shall be derived from amounts authorized to be appropriated pursuant to subparagraph (A) that are enacted after the date of enactment of the <short-title>Marine Mammal Research and Response Act of 2021</short-title>.</text></subparagraph></paragraph>
<paragraph id="id46d42966-13b8-4f9a-9848-8816d38ba748" changed="not-changed"><enum>(2)</enum><header>Joseph R. Geraci Marine Mammal Rescue and Rapid Response Fund</header><text>There is authorized to be appropriated to the Rapid Response Fund $500,000 for each of fiscal years 2021 through 2026.</text></paragraph></subsection> <subsection id="id4ceed9db-f06a-4ec6-bf9a-b944829f122d" changed="not-changed"><enum>(e)</enum><header>Acceptance of donations</header><text>For the purposes of carrying out this section, the Secretary may solicit, accept, receive, hold, administer, and use gifts, devises, and bequests without any further approval or administrative action.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="id16b2dad6-8fb1-421a-975e-24d959576e2c" changed="not-changed"><enum>(b)</enum><header>Table of contents amendment</header><text>The table of contents in the first section of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="public-law" parsable-cite="pl/92/522">Public Law 92–522</external-xref>; 86 Stat. 1027) (as amended by section 3(b)) is amended by striking the item related to section 408 and inserting the following:</text> <quoted-block style="OLC" id="id9d5683d6-d22d-45a4-8695-9cdc2d6ee6af" changed="not-changed"> <toc changed="not-changed"> <toc-entry level="section" changed="not-changed">Sec. 408. <section id="id7a9dc68e-b162-4336-b529-9ca952f3c310" changed="not-changed"><enum>408A.</enum><header>Marine Mammal Health Monitoring and Analysis Platform (Health MAP)</header>
<subsection id="iddab549f8-b405-4d7a-b948-2a2e66424d82" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>Marine Mammal Research and Response Act of 2021</short-title>, the Secretary, acting through the Administrator of the National Oceanic and Atmospheric Administration, in consultation with the Secretary of the Interior and the Marine Mammal Commission, shall—</text> <paragraph id="id5f72d7ec-e0b4-4611-83c8-c3eeefedefed" changed="not-changed"><enum>(1)</enum><text>establish a marine mammal health monitoring and analysis platform (referred to in this Act as the <quote>Health MAP</quote>);</text></paragraph>
<paragraph id="id2e2bab49-4242-4a3e-a8ed-f42bbed36c70" changed="not-changed"><enum>(2)</enum><text>incorporate the Health MAP into the Observation System; and</text></paragraph> <paragraph id="idf1edd03d-e511-45c1-a628-44eb0395d668" changed="not-changed"><enum>(3)</enum><text>make the Health MAP—</text>
<subparagraph id="iddcb11ec5-5d08-4243-be84-22843848f41a" changed="not-changed"><enum>(A)</enum><text>publicly accessible through the web portal of the Observation System; and</text></subparagraph> <subparagraph id="idc1926bde-ffde-4660-8326-e2d71d86a566" changed="not-changed"><enum>(B)</enum><text>interoperable with other national data systems or other data systems for management or research purposes, as practicable.</text></subparagraph></paragraph></subsection>
<subsection id="id45079dcc-233d-4901-8658-0830fc5ebc6c" changed="not-changed"><enum>(b)</enum><header>Purposes</header><text>The purposes of the Health MAP are—</text> <paragraph id="id98E2D017772A4ED482192776596D0D57" changed="not-changed"><enum>(1)</enum><text>to promote—</text>
<subparagraph id="id64bbb857-271c-42b9-93bc-014d8cc02587" changed="not-changed"><enum>(A)</enum><text>interdisciplinary research among individuals with knowledge and experience in marine mammal science, marine mammal veterinary and husbandry practices, medical science, and oceanography, and with other marine scientists;</text></subparagraph> <subparagraph id="ida7a25615-da07-4622-8cd6-23b239e70d2c" changed="not-changed"><enum>(B)</enum><text>timely and sustained dissemination and availability of marine mammal health, stranding, entanglement, and mortality data;</text></subparagraph>
<subparagraph id="id38cf6260-716d-4621-b308-a3c48caec8e1" changed="not-changed"><enum>(C)</enum><text>identification of spatial and temporal patterns of marine mammal mortality, disease, and stranding;</text></subparagraph> <subparagraph id="idc538be7e-c4b0-451c-a3d4-5860da994082" changed="not-changed"><enum>(D)</enum><text>evaluation of marine mammal health in terms of mortality, as well as sublethal marine mammal health impacts;</text></subparagraph>
<subparagraph id="id2d3d01b5-05bb-4efd-8246-0823ac66c966" changed="not-changed"><enum>(E)</enum><text>improved collaboration and forecasting of marine mammal and larger ecosystem health events;</text></subparagraph> <subparagraph id="idbde05f8b-3b9f-4501-b34c-bcd42b1ac599" changed="not-changed"><enum>(F)</enum><text>rapid communication and dissemination of information regarding marine mammal strandings that may have implications for human health, such as those caused by harmful algal blooms; and</text></subparagraph>
<subparagraph id="id3e6c2c52-eb0a-43f1-a814-4ae4718aa63e" changed="not-changed"><enum>(G)</enum><text>increased accessibility of data in a user friendly visual interface for public education and outreach; and</text></subparagraph></paragraph> <paragraph id="id50f8cf52-0be5-4901-a858-d201a6fbe2c1" changed="not-changed"><enum>(2)</enum><text>to contribute to an ocean health index that incorporates marine mammal health data.</text></paragraph></subsection>
<subsection id="iddf5f63a8-24d7-4ec9-86e6-27f0147775e1" changed="not-changed"><enum>(c)</enum><header>Requirements</header><text>The Health MAP shall—</text> <paragraph id="idabe0fcee22924448a8f5b1550f8ca8c0" changed="not-changed"><enum>(1)</enum><text>integrate in situ, remote, and other marine mammal health, stranding, and mortality data, including visualizations and metadata, collected by marine mammal stranding networks, Federal, State, local, and Tribal governments, private partners, and academia; and</text></paragraph>
<paragraph id="iddecabd78-45a8-4b42-a59f-cc91f7929f8d" changed="not-changed"><enum>(2)</enum><text>be designed—</text> <subparagraph id="id7C0D27AB57EE4E81B863127F47723FE6" changed="not-changed"><enum>(A)</enum><text>to enhance data and information availability, including data sharing among stranding network participants, scientists, and the public within and across stranding network regions;</text></subparagraph>
<subparagraph id="id47d4b1c4-66f7-41ea-83c8-830eeb879e6e" changed="not-changed"><enum>(B)</enum><text>to facilitate data and information access across scientific disciplines, scientists, and managers;</text></subparagraph> <subparagraph id="ida05f6882-2f7d-4e0f-8bdf-52ec8e118920" changed="not-changed"><enum>(C)</enum><text>to facilitate public access to national and regional marine mammal health, stranding, entanglement, and mortality data, including visualizations and metadata, through the national and regional data portals of the Observation System; and</text></subparagraph>
<subparagraph id="id41F3FF8BACA54EE1AD803F967FC2E2F0" changed="not-changed"><enum>(D)</enum><text>in collaboration with, and with input from, States and stranding network participants.</text></subparagraph></paragraph></subsection> <subsection id="id1e320339-532a-4075-9069-e146066adb0b" changed="not-changed"><enum>(d)</enum><header>Procedures and guidelines</header><text>The Secretary shall establish and implement policies, protocols, and standards for—</text>
<paragraph id="id1793226e-f9c0-4376-9f60-9c35ac283dc4" changed="not-changed"><enum>(1)</enum><text>reporting marine mammal health data collected by stranding networks consistent with subsections (c) and (d) of section 402;</text></paragraph> <paragraph id="idfba226b2-8bc4-4eb0-b129-d879b046213f" changed="not-changed"><enum>(2)</enum><text>promptly transmitting health data from the stranding networks and other appropriate data providers to the Health MAP;</text></paragraph>
<paragraph id="id16aa03b45a9a49c49dc165b84ed7e457" changed="not-changed"><enum>(3)</enum><text>disseminating and making publicly available data on marine mammal health, stranding, entanglement, and mortality data in a timely and sustained manner; and</text></paragraph> <paragraph id="idb09aa9288d604a5bbd7a45eaddfb9086" changed="not-changed"><enum>(4)</enum><text>integrating additional marine mammal health, stranding, or other relevant data as the Secretary determines appropriate.</text></paragraph></subsection>
<subsection id="id739a07971590483eb91c6f92969baef0" changed="not-changed"><enum>(e)</enum><header>Consultation</header><text>The Administrator of the National Oceanic and Atmospheric Administration shall maintain and update the Health MAP in consultation with the Secretary of the Interior and the Marine Mammal Commission.</text></subsection> <subsection id="id79db725b-d12c-47e3-8a1b-b64261b2f4df" changed="not-changed"><enum>(f)</enum><header>Contributions</header><text>For purposes of carrying out this section, the Secretary may solicit, accept, receive, hold, administer, and use gifts, devises, and bequests without any further approval or administrative action.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

Marine Mammal Health Monitoring and Analysis Platform (Health MAP).</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="id21359347-1712-40e1-828f-c49231263baa" changed="not-changed"><enum>9.</enum><header>Reports to Congress</header> <subsection id="ida54668d1-567f-4e44-943a-239bd3e54dd3" changed="not-changed"><enum>(a)</enum><header>In general</header><text>Title IV of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="usc" parsable-cite="usc/16/1421">16 U.S.C. 1421</external-xref> et seq.) (as amended by section 8(a)) is amended by inserting after section 408A the following:</text>

<section id="idef6f3661-3964-4f49-8d83-b7f544b622d8" changed="not-changed"><enum>408B.</enum><header>Reports to Congress</header>
<subsection id="id34a80c0a-e510-46a0-96d6-14f2880c2306" changed="not-changed"><enum>(a)</enum><header>Definition of appropriate committees of Congress</header><text>In this section, the term <term>appropriate committees of Congress</term> means—</text> <paragraph id="id1D1A071DC2D4400FAB0884B4172E2E3A" changed="not-changed"><enum>(1)</enum><text>the Committee on Commerce, Science, and Transportation of the Senate; </text></paragraph>
<paragraph id="idA27D78C583114C7BB9E290BD4C9F035D" changed="not-changed"><enum>(2)</enum><text>the Committee on Natural Resources of the House of Representatives; and</text></paragraph> <paragraph id="idE5259F52CB1B4098B13E7921F29036A2" changed="not-changed"><enum>(3)</enum><text>the Committee on Science, Space, and Technology of the House of Representatives.</text></paragraph></subsection>
<subsection id="id5049bdae-c051-4d42-9223-4927260b0c98" changed="not-changed"><enum>(b)</enum><header>Health MAP status report</header>
<paragraph id="id8CF6E714BC3E4F39BF45B358E090A31B" changed="not-changed"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 2 year after the date of enactment of the <short-title>Marine Mammal Research and Response Act of 2021</short-title>, the Administrator of the National Oceanic and Atmospheric Administration, in consultation with the Marine Mammal Commission, the Secretary of the Interior, and the National Ocean Research Leadership Council, shall submit to the appropriate committees of Congress a report describing the status of the Health MAP.</text></paragraph> <paragraph id="id22758F53B4584EE8B7B5F5FB24847889" changed="not-changed"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The report under paragraph (1) shall include—</text>
<subparagraph id="ide8bdcac7-d9c6-46a2-aca3-57d2c303ecf1" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">a detailed evaluation of the data made publicly available through the Health MAP;</text></subparagraph> <subparagraph id="id85a8854c-1d47-46b8-af26-a9cbaa491c6c" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">a detailed list of any gaps in data collected pursuant to the Health MAP, a description of the reasons for those gaps, and recommended actions to close those gaps;</text></subparagraph>
<subparagraph id="idfc480112-0c18-4a10-b508-d2152a7760d3" changed="not-changed"><enum>(C)</enum><text>an analysis of the effectiveness of using the website of the Observation System as the platform to collect, organize, visualize, archive, and disseminate marine mammal stranding and health data;</text></subparagraph> <subparagraph id="idf4571e86-1756-4d05-91c9-4aee767477fe" changed="not-changed"><enum>(D)</enum><text display-inline="yes-display-inline">a list of publications, presentations, or other relevant work product resulting from, or produced in collaboration with, the Health MAP;</text></subparagraph>
<subparagraph id="idfb0c317c-b884-4ecd-b9f4-64c62421b687" changed="not-changed"><enum>(E)</enum><text>a description of emerging marine mammal health concerns and the applicability of those concerns to human health;</text></subparagraph> <subparagraph id="iddead6c69-2891-4a19-b0e2-604cf6d4e629" changed="not-changed"><enum>(F)</enum><text>an analysis of the feasibility of the Observation System being used as an alert system during stranding events, entanglement events, and unusual mortality events for the stranding network, Observation System partners, Health MAP partners, Federal and State agencies, and local and Tribal governments;</text></subparagraph>
<subparagraph id="id74edde73-c3df-4ff9-970d-47222b51529c" changed="not-changed"><enum>(G)</enum><text>an evaluation of the use of Health MAP data to predict broader ecosystem events and changes that may impact marine mammal or human health and specific examples of proven or potential uses of Observation System data for those purposes; and</text></subparagraph> <subparagraph id="id35280e09-7c09-4a00-a7ac-6fa8ce5322a0" changed="not-changed"><enum>(H)</enum><text>recommendations for the Health MAP with respect to—</text>
<clause id="ide8e1142b-b88e-4b8f-a5c8-e3f831d4c856" changed="not-changed"><enum>(i)</enum><text>filling any identified data gaps;</text></clause> <clause id="id46fbdf52-1286-4a2e-a82f-3f8155ebf303" changed="not-changed"><enum>(ii)</enum><text>standards that could be used to improve data quality, accessibility, transmission, interoperability, and sharing;</text></clause>
<clause id="id15c6d5b8-9804-4ab1-a3f2-216587788e04" changed="not-changed"><enum>(iii)</enum><text>any other strategies that would contribute to the effectiveness and usefulness of the Health MAP; and</text></clause> <clause id="id883f3429-7725-4883-8259-6967165befa6" changed="not-changed"><enum>(iv)</enum><text>the funding levels needed to maintain and improve the Health MAP.</text></clause></subparagraph></paragraph></subsection>
<subsection id="idca70cd93-4eb1-4ef3-816e-70145c36c828" changed="not-changed"><enum>(c)</enum><header>Data gap analysis</header>
<paragraph id="idFAA07B05E57E499EAD6B8281502D3A86" changed="not-changed"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 5 years after the date on which the report required under subsection (b)(1) is submitted, and every 10 years thereafter, the Administrator of the National Oceanic and Atmospheric Administration, in consultation with the Marine Mammal Commission and the Secretary of Commerce, shall—</text> <subparagraph id="id5A9CCBB379E44736B2317C523A05F669" changed="not-changed"><enum>(A)</enum><text>make publicly available a report on the data gap analysis described in paragraph (2); and</text></subparagraph>
<subparagraph id="idB7E56E6BBCD442E4BF655FAF1B4482E6" changed="not-changed"><enum>(B)</enum><text>provide a briefing to the appropriate committees of Congress concerning that data gap analysis.</text></subparagraph></paragraph> <paragraph id="id1C6CE070527B4DA19BD0B9FF13E90354" changed="not-changed"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The data gap analysis under paragraph (1) shall include—</text>
<subparagraph id="id3a117fbf9c664d4f811c99b77267dff2" changed="not-changed"><enum>(A)</enum><text>an overview of existing participants within a marine mammal stranding network;</text></subparagraph> <subparagraph id="id6e63470690ad4623a93630eb162c2d96" changed="not-changed"><enum>(B)</enum><text>an identification of coverage needs and participant gaps within a network;</text></subparagraph>
<subparagraph id="idd285c588304a4738a5cd2b33286817b4" changed="not-changed"><enum>(C)</enum><text>an identification of data and reporting gaps from members of a network; and</text></subparagraph> <subparagraph id="idbd33947ec28e485a8808f3987c1948bd" changed="not-changed"><enum>(D)</enum><text>an analysis of how stranding and health data are shared and made available to scientists, academics, State, local, and Tribal governments, and the public.</text></subparagraph></paragraph></subsection>
<subsection id="ida779705b-bd40-40a1-a785-99a75ef1c87d" changed="not-changed"><enum>(d)</enum><header>Marine mammal response capabilities in the Arctic</header>
<paragraph id="idB661E3B9CC9D440FBEF1D9A5E72592B9" changed="not-changed"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of the <short-title>Marine Mammal Research and Response Act of 2021</short-title>, the Administrator of the National Oceanic and Atmospheric Administration, the Director of the United States Fish and Wildlife Service, and the Director of the United States Geologic Survey, in consultation with the Marine Mammal Commission and the Secretary of the Interior, shall—</text> <subparagraph id="id207A7DF1227441F080174ECDAF8D4F87" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">make publicly available a report describing the response capabilities for sick and injured marine mammals in the Arctic regions of the United States; and</text></subparagraph>
<subparagraph id="id8A73DC236BB846AE9A81A0D93FB3C211" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">provide a briefing to the appropriate committees of Congress on that report. </text></subparagraph></paragraph> <paragraph id="id4894E983F4C44BEBB1A4BE2E7BACF341" changed="not-changed"><enum>(2)</enum><header>Arctic</header><text display-inline="yes-display-inline">The term <term>Arctic</term> has the meaning given the term in section 112 of the Arctic Research and Policy Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/15/4111">15 U.S.C. 4111</external-xref>).</text></paragraph>
<paragraph id="idA7C956EB14BE48E2ADA110962C582668" changed="not-changed"><enum>(3)</enum><header>Requirements</header><text display-inline="yes-display-inline">The report under paragraph (1) shall include—</text> <subparagraph id="id4fb1b7d8-6053-48a1-9d63-dab5640c79d6" changed="not-changed"><enum>(A)</enum><text display-inline="yes-display-inline">a description, developed in consultation with the Fish and Wildlife Service of the Department of the Interior, of all marine mammal stranding agreements in place for the Arctic region of the United States, including species covered, response capabilities, facilities and equipment, and data collection and analysis capabilities;</text></subparagraph>
<subparagraph id="idc44f18e3-bdb1-41b9-b337-f528e5bb13be" changed="not-changed"><enum>(B)</enum><text display-inline="yes-display-inline">a list of State and local government agencies that have personnel trained to respond to marine mammal strandings in the Arctic region of the United States;</text></subparagraph> <subparagraph id="idedd729ac-9100-4009-813b-c07772ca97ca" changed="not-changed"><enum>(C)</enum><text display-inline="yes-display-inline">an assessment of potential response and data collection partners and sources of local information and knowledge, including Alaska Native people and villages;</text></subparagraph>
<subparagraph id="idc37e92ca-bf8d-4467-a745-037794b5732b" changed="not-changed"><enum>(D)</enum><text display-inline="yes-display-inline">an analysis of spatial and temporal trends in marine mammal strandings and unusual mortality events that are correlated with changing environmental conditions in the Arctic region of the United States;</text></subparagraph> <subparagraph id="id3e85d1a4-cff6-4d24-bc67-429f4449ae4a" changed="not-changed"><enum>(E)</enum><text display-inline="yes-display-inline">a description of training and other resource needs to meet emerging response requirements in the Arctic region of the United States;</text></subparagraph>
<subparagraph id="id2f18ccc1-0be1-4c38-9fad-77250bb3be5a" changed="not-changed"><enum>(F)</enum><text display-inline="yes-display-inline">an analysis of oiled marine mammal response and rehabilitation capabilities in the Arctic region of the United States, including personnel, equipment, facilities, training, and husbandry capabilities, and an assessment of factors that affect response and rehabilitation success rates; and</text></subparagraph> <subparagraph id="id08492269-2ed4-4dda-93a3-27b5dc2d47e2" changed="not-changed"><enum>(G)</enum><text display-inline="yes-display-inline">recommendations to address future stranding response needs for marine mammals in the Arctic region of the United States.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="id0a6146dd-54a3-4e66-8733-dfd0a1e405b7" changed="not-changed"><enum>(b)</enum><header>Table of contents amendment</header><text>The table of contents in the first section of the Marine Mammal Protection Act of 1972 (<external-xref legal-doc="public-law" parsable-cite="pl/92/522">Public Law 92–522</external-xref>; 86 Stat. 1027) (as amended by section 8(b)) is amended by inserting after the item related to section 408A the following:</text> <quoted-block style="OLC" id="idce2d36e4-10dc-4f45-8d13-36912379ea95" changed="not-changed"> <toc changed="not-changed"> <toc-entry level="section" changed="not-changed">Sec. 408B. <paragraph commented="no" display-inline="no-display-inline" id="idF138991B63194E6A8730336F36BAF59C" changed="not-changed"><enum>(4)</enum><text>The term <term>Observation System</term> means the National Integrated Coastal and Ocean Observation System established under section 12304 of the Integrated Coastal and Ocean Observation System Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/33/3603">33 U.S.C. 3603</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="id9522E3D69110475F9436A8DD003CCCAD" changed="not-changed"><enum>12.</enum><header>Study on marine mammal mortality</header> <subsection id="id4BA4537F497C4F42A9CE1EE0C82BE1CD" changed="not-changed"><enum>(a)</enum><header>In General</header><text>Not later than 12 months after the date of enactment of this Act, the Undersecretary of Commerce for Oceans and Atmosphere shall, in consultation with the Secretary of the Interior and the Marine Mammal Commission, conduct a study evaluating the connections among marine heat waves, frequency and intensity of harmful algal blooms, prey availability, and habitat degradation, and the impacts of these conditions on marine mammal mortality. </text></subsection>
<subsection id="idA4B3DD25B9D54C389F088E09E651D1C6" changed="not-changed"><enum>(b)</enum><header>Report</header><text>The Undersecretary of Commerce for Oceans and Atmosphere, in consultation with the Secretary of the Interior and the Marine Mammal Commission, shall prepare, post to a publicly available website, and brief the appropriate committees of Congress on, a report containing the results of the study described in subsection (a). The report shall identify priority research activities, opportunities for collaboration, and current gaps in effort and resource limitations related to advancing scientific understanding of how ocean heat waves, harmful algae blooms, availability of prey, and habitat degradation impact marine mammal mortality. The report shall include recommendations for policies needed to mitigate and respond to mortality events. </text></subsection></section> </legis-body> </bill>
