<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1286</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210421">April 21, 2021</action-date><action-desc><sponsor name-id="S287">Mr. Cornyn</sponsor> (for himself and <cosponsor name-id="S221">Mrs. Feinstein</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Controlled Substances Act to provide for the modification, transfer, and termination of a registration to manufacture, distribute, or dispense controlled substances or list I chemicals, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HF8B117850DDD41CCA52B3C7570C0D7CE"><section section-type="section-one" id="H4F042BDB297E4E7DAACC3DF48DE0B46B"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ensuring Compliance Against Drug Diversion Act of 2021</short-title></quote>.</text></section><section id="H77FBC429EE3D4DD09B2F66221ECC1ADE"><enum>2.</enum><header>Modification, transfer, and termination of registration To manufacture, distribute, or dispense controlled substances</header><text display-inline="no-display-inline">Subsection (a) of section 302 of the Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/822">21 U.S.C. 822</external-xref>) is amended by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H86C12E5FE0B24F899F7A3832904D6CE8"><paragraph id="HC53B86F6F05B4A4D9F4EA46187C6583A" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H8116905E73B546CBB127F6847D9728C1"><enum>(A)</enum><text display-inline="yes-display-inline">Except as provided in subparagraph (C), the registration of any registrant under this title to manufacture, distribute, or dispense controlled substances or list I chemicals terminates if and when such registrant—</text><clause id="H529531B733574F99A3D86BCE3B90F3EB" indent="up1"><enum>(i)</enum><text>dies;</text></clause><clause id="H8F945B147E474F3EBFEE444B9A51555F" indent="up1"><enum>(ii)</enum><text>ceases legal existence;</text></clause><clause id="H758CD3DFD95D49A492D6EC9EA6A514DB" indent="up1"><enum>(iii)</enum><text>discontinues business or professional practice; or</text></clause><clause id="HE18FF114AF24412A93477B3E97AE046A" indent="up1"><enum>(iv)</enum><text>surrenders such registration.</text></clause></subparagraph><subparagraph id="HE7CC478437874561B00A0F71351CC3AB" indent="up1"><enum>(B)</enum><text>In the case of such a registrant who ceases legal existence or discontinues business or professional practice, such registrant shall promptly notify the Attorney General in writing of such fact.</text></subparagraph><subparagraph id="H7DC68F85C1F64BF2BC9BC662CB43AE22" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">No registration under this title to manufacture, distribute, or dispense controlled substances or list I chemicals, and no authority conferred thereby, may be assigned or otherwise transferred except upon such conditions as the Attorney General may specify and then only pursuant to written consent. A registrant to whom a registration is assigned or transferred pursuant to the preceding sentence may not manufacture, distribute, or dispense controlled substances or list I chemicals pursuant to such registration until the Attorney General receives such written consent.</text></subparagraph><subparagraph id="HAF4A076D47284D88BC5FA12688601F2F" indent="up1"><enum>(D)</enum><text>In the case of a registrant under this title to manufacture, distribute, or dispense controlled substances or list I chemicals desiring to discontinue business or professional practice altogether or with respect to controlled substances and list I chemicals (without assigning or transferring such business or professional practice to another entity), such registrant shall return to the Attorney General for cancellation—</text><clause id="H9BEF874B54574CCC8CE1D52CBAF93CB4"><enum>(i)</enum><text>the registrant’s certificate of registration;</text></clause><clause id="H734CAA24ACE84ED3AF9A9066C00022FF"><enum>(ii)</enum><text>any unexecuted order forms in the registrant’s possession; and</text></clause><clause id="HCADCC2F3ECAF4D639A68A29A5065F30C"><enum>(iii)</enum><text>any other documentation that the Attorney General may require.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H871879B8BAAB44ABB53FE0E0928FD233"><enum>3.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></legis-body></bill>
