<section section-type="section-one" id="HEDE7D04648B64D17AF513D01E6355608"><enum>1.</enum><header>Short title; references in Act</header>
<subsection id="H3511EF7CCE694E579C19E8934BF67EAA"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Family Violence Prevention and Services Improvement Act of 2021</short-title></quote>.</text></subsection> <subsection id="H07466974F07B4235A75898FBC1C78873"><enum>(b)</enum><header>References</header><text>Except as otherwise specified, amendments made by this Act to a section or other provision of law are amendments to such section or other provision of the Family Violence Prevention and Services Act (<external-xref legal-doc="usc" parsable-cite="usc/42/10401">42 U.S.C. 10401</external-xref> et seq.).</text></subsection></section>
<section id="H11D8B3DEC0CA467BAE3E58449AFDE350"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">Subsection (b) of section 301 (<external-xref legal-doc="usc" parsable-cite="usc/42/10401">42 U.S.C. 10401</external-xref>) is amended to read as follows:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HE7314197B4784774875DE211FCA4BE14"> <subsection id="H16B366E22E194442B5678007BF3338EF"><enum>(b)</enum><header>Purpose</header><text>It is the purpose of this title to improve services and interventions and advance primary and secondary prevention of family violence, domestic violence, and dating violence by—</text>
<paragraph id="HAB1F7B82512E4AFFA69899B6EE8B7D97"><enum>(1)</enum><text>assisting States and territories in supporting local family violence programs to provide accessible, trauma-informed, culturally relevant residential and non-residential services to domestic violence victims and their children and dependents;</text></paragraph> <paragraph id="H73F25812F4244A15B14B61AA46E0AFDA"><enum>(2)</enum><text>strengthening the capacity of Indian Tribes to exercise their sovereign authority to respond to family violence committed against Indians;</text></paragraph>
<paragraph id="H358C062963EF4794866B23A3AF60882B"><enum>(3)</enum><text>providing for a network of technical assistance and training centers to support effective policy, practice, research, and cross-system collaboration to improve intervention and prevention efforts throughout the country;</text></paragraph> <paragraph id="H520187B28ED043648E4C91EDEDAEAAB2"><enum>(4)</enum><text>supporting the efforts of State, territorial, and Tribal coalitions to document and address the needs of victims and their children and dependents, including victims and their children and dependents who are underserved, implement effective coordinated community and systems responses, and promote ongoing public education and community engagement;</text></paragraph>
<paragraph id="H9A66E9966BD94C44836E66CE1B4B1BF4"><enum>(5)</enum><text>maintaining national domestic violence hotlines, including a national Indian domestic violence hotline; and</text></paragraph> <paragraph id="H5A2DDCE10F864065A864D595DF13D516"><enum>(6)</enum><text>supporting the development and implementation of evidence-informed, coalition-led, and community-based primary prevention approaches and programs.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H35070A0DE0BD49F8BAE574CFB99B5D2F"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 302 (<external-xref legal-doc="usc" parsable-cite="usc/42/10402">42 U.S.C. 10402</external-xref>) is amended—</text> <paragraph id="H3FA7F6B9015540B98EDD5E84D9294277"><enum>(1)</enum><text>by amending paragraph (2) to read as follows:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H134694ED03444C41A743F9D56E9CBB0A">
<paragraph id="H0DA24F44C0494054A6B037F6F496E823"><enum>(2)</enum><header>Dating partner</header><text>The term <term>dating partner</term> means any person who is or has been in a social relationship of a romantic or intimate nature with a victim, and where the existence of such a relationship shall be determined based on a consideration of—</text> <subparagraph id="H4ABBAEF6EBE846119B1C3294385A9D9E"><enum>(A)</enum><text>the length of the relationship;</text></subparagraph>
<subparagraph id="H98034DC3702443EFA6F791A5D212AE9A"><enum>(B)</enum><text>the type of the relationship; and</text></subparagraph> <subparagraph id="HCAD4E91FA49C48E8B33780B5151561CB"><enum>(C)</enum><text>the frequency of interaction between the persons involved in the relationship.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>
<paragraph id="H9E976DAF472943CC8F2D5C63636FB8DE"><enum>(2)</enum><text>by striking paragraphs (3) and (4);</text></paragraph> <paragraph id="H36750C546B154842B53B45B097A6FCFC"><enum>(3)</enum><text>by inserting after paragraph (2) the following:</text>

<paragraph id="H17D593779DF14498AA148634AA93A6BE"><enum>(3)</enum><header>Digital services</header><text>The term <term>digital services</term> means services, resources, information, support, or referrals provided through electronic communications platforms and media, which may include mobile phone technology, video technology, computer technology (including use of the internet), and any other emerging communications technologies that are appropriate for the purposes of providing services, resources, information, support, or referrals for the benefit of victims of domestic violence, dating violence, or family violence.</text></paragraph> <paragraph id="H8BEFF6F24F1648E48579FCE87BE93659"><enum>(4)</enum><header>Domestic violence, dating violence, family violence</header><text>The terms <term>domestic violence</term>, <term>dating violence</term>, and <term>family violence</term> mean any act, threatened act, or pattern of acts of physical or sexual violence, stalking, harassment, psychological abuse, economic abuse, technological abuse, or any other form of abuse, including threatening to commit harm against children or dependents or other members of the household of the recipient of the threat for the purpose of coercion, threatening, or causing harm, directed against—</text>
<subparagraph id="HC2D3F5876FE44E03BC4A5078F4DF4049"><enum>(A)</enum><text>a dating partner or other person similarly situated to a dating partner under the laws of the jurisdiction;</text></subparagraph> <subparagraph id="H84CEE42463E045619BF995E47DBED36E"><enum>(B)</enum><text>a person who is cohabitating with or has cohabitated with the person committing such an act;</text></subparagraph>
<subparagraph id="HE257BB7860594547977EF7A4117BC1B8"><enum>(C)</enum><text>a current or former spouse or other person similarly situated to a spouse under the laws of the jurisdiction;</text></subparagraph> <subparagraph id="H78148E02DCF346E19B8CAB13F2CE2BE0"><enum>(D)</enum><text>a person who shares a child or dependent in common with the person committing such an act; or</text></subparagraph>
<subparagraph id="HFD17CFF9E89449A790CD27E525EE937E"><enum>(E)</enum><text>any other person who is protected from any such act under the domestic or family violence laws, policies, or regulations of the jurisdiction.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph commented="no" id="H11853A54C99D48848B48314F2D2BE773"><enum>(4)</enum><text>by amending paragraph (5) to read as follows:</text>

<paragraph commented="no" id="HC9C6DA089A3F400C96435A298B44FE31"><enum>(5)</enum><header>Indian; Indian Tribe; Tribal organization</header><text>The terms <term>Indian</term>, <term>Indian Tribe</term>, and <term>Tribal organization</term> have the meanings given the terms <term>Indian</term>, <term>Indian tribe</term>, and <term>tribal organization</term>, respectively, in section 4 of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304</external-xref>).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H81D8D6528DD64CA6AB4AEA034D797969"><enum>(5)</enum><text>by—</text>
<subparagraph id="H012FE8CEBEB647D58DDA402607A429A8"><enum>(A)</enum><text>redesignating paragraphs (13) and (14) as paragraphs (17) and (18), respectively;</text></subparagraph> <subparagraph id="HAD612ABE543D4D64ABB58ABD434E1BFA"><enum>(B)</enum><text>redesignating paragraphs (8) through (12) as paragraphs (11) through (15), respectively; and</text></subparagraph>

<paragraph id="H7A97CD1879514F698A75D9FD0E67EF27"><enum>(6)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H525BC5CD7E944866B3B9F24E9A854DEF"><enum>(7)</enum><text>in paragraph (8), as so redesignated, by striking <quote>42 U.S.C. 13925(a)</quote> and inserting <quote>34 U.S.C. 12291(a)</quote>;</text></paragraph>

<paragraph id="H465C818A78FB4CF3868B4F100BE5BB19"><enum>(10)</enum><header>Racial and ethnic minority group</header><text display-inline="yes-display-inline">The term <quote>racial and ethnic minority group</quote> includes each group listed in the definition of such term in section 1707(g) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300u-6">42 U.S.C. 300u–6(g)</external-xref>).</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph commented="no" id="HF1109FCAE5F44DB3B0A870952F6C4CA0"><enum>(9)</enum><text>by amending paragraph (12), as so redesignated, to read as follows:</text>

<paragraph commented="no" id="HE1165B53AEF94A1E9E9787F8B9E2F1D8"><enum>(12)</enum><header>Shelter</header><text>The term <term>shelter</term> means the provision of temporary refuge and basic necessities, in conjunction with supportive services, provided on a regular basis, in compliance with applicable State, Tribal, territorial, or local law to victims of family violence, domestic violence, or dating violence, and their children and dependents. Such law includes regulations governing the provision of safe homes and other forms of secure temporary lodging, meals, or supportive services (including providing basic necessities) to victims of family violence, domestic violence, or dating violence, and their children and dependents.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> <paragraph id="H2FEB5221925D48099295FD15F997C129"><enum>(10)</enum><text>in paragraph (14), as so redesignated—</text>
<subparagraph id="H595293DE32DC4E7DBBB0466A26B20691"><enum>(A)</enum><text>in the matter preceding subparagraph (C), by inserting <quote>, designated by the Secretary,</quote> after <quote>organization</quote>; and</text></subparagraph> <subparagraph id="HC0506820611640E0A8F78506E618552C"><enum>(B)</enum><text>in subparagraph (C), by striking <quote>dependents</quote> and inserting <quote>children and dependents</quote>;</text></subparagraph></paragraph>

<paragraph id="H0357C9FAAB744BE39DCE234E006E2110"><enum>(16)</enum><header>Tribal domestic violence coalition</header><text display-inline="yes-display-inline">The term <term>Tribal domestic violence coalition</term> means an established nonprofit, nongovernmental Indian organization recognized by the Office of Violence Against Women of the Department of Justice that—</text> <subparagraph id="H5277CE02D35D40CEB752A21E752A7005"><enum>(A)</enum><text>provides education, support, and technical assistance to member Indian service providers in a manner that enables the member providers to establish and maintain culturally appropriate services, including shelter (including supportive services) designed to assist Indian victims of family violence, domestic violence, or dating violence and the children and dependents of such victims; and</text></subparagraph>
<subparagraph id="H408940CC39D3479A80D9EA9D094E47FB"><enum>(B)</enum><text>is comprised of members that are representative of—</text> <clause id="H6659A8AC62424E329B5F40C9E7DF15D2"><enum>(i)</enum><text>the member service providers described in subparagraph (A); and</text></clause>
<clause id="H04C8450B221541F8B3B74426C1BFFC37"><enum>(ii)</enum><text>the Tribal communities in which the services are being provided.</text></clause></subparagraph></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph> <paragraph id="HA96DF1ED155949C0B17BAA4A82E95BCE"><enum>(13)</enum><text>in paragraph (17), as so redesignated—</text>
<subparagraph id="HF451F1CA700D43C7A2A26FBB48A62945"><enum>(A)</enum><text>by striking <quote>tribally</quote> and inserting <quote>Tribally</quote>;</text></subparagraph> <subparagraph id="H086F59AC0D814535B402F840ADAEB1C8"><enum>(B)</enum><text>by striking <quote>tribal</quote> and inserting <quote>Tribal</quote>; and</text></subparagraph>

<paragraph id="H05F9F11C21BD477A84AB068CA77A7122"><enum>(18)</enum><header>Underserved populations and underserved individuals</header><text>The terms <term>underserved populations</term> and <term>underserved individuals</term> mean victims of domestic violence, dating violence, or family violence, and their children and dependents who face obstacles in accessing and using State, Tribal, territorial, or local domestic violence, dating violence, or family violence services, and who may be overrepresented due to historical barriers. Populations may be underserved on the basis of, marginalized racial and ethnic minority populations, Indigenous status, cultural and language barriers, immigration status, physical, sensory, or cognitive disabilities, mental disabilities or other mental health needs, sexual orientation or gender identity, age (including both elders and minors), geographical location, faith or religious practice, or other bases, as determined by the Secretary, under the Family Violence Prevention and Services Act program carried out under this title.</text></paragraph> <paragraph id="H39DCE8893BBC4C9BAFD508DBD6BA23C0"><enum>(19)</enum><header>Child</header><text>The term <term>child</term> means an individual who is—</text>
<subparagraph id="HB6C222C539CC4E41AA0D215BCD1840BE"><enum>(A)</enum><text>younger than age 18; and</text></subparagraph> <subparagraph id="H1595E6E260024BEEB35C3690BFECADF5"><enum>(B)</enum><text>not an emancipated minor.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="HC5D558A28AEF41379ACDE5F4C6F7B2C8"><enum>4.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">The Act is amended by repealing section 303 (<external-xref legal-doc="usc" parsable-cite="usc/42/10403">42 U.S.C. 10403</external-xref>) and inserting the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HDA33452DE6104312840FBB20392E4F13"> <section id="H2485C1D3B3234B50ACC36633BB2F538F"><enum>303.</enum><header>Authorization of appropriations</header> <subsection id="H1C29717944EA40E191E20837040B1231"><enum>(a)</enum><header>Application</header><text>This section shall apply for any fiscal year before the first fiscal year for which the amount appropriated to carry out the provisions specified in subsection (b) is not less than $185,000,000.</text></subsection>
<subsection id="H993487ED4F204B55B9061FD828C59CC3"><enum>(b)</enum><header>Authorizations</header>
<paragraph id="H94AC7712995447378B3C868223A3B050"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out sections 301 through 312, $253,300,000 for each of fiscal years 2022 through 2026.</text></paragraph> <paragraph id="H01CB7B217D01499BA339789D34CEC4AE"><enum>(2)</enum><header>Reservation for grants to tribes</header><text>Of the amounts appropriated under paragraph (1) for a fiscal year, 10 percent shall be reserved and used to carry out section 309.</text></paragraph>
<paragraph id="H521081F2B47540A6B15EC3C8636210D7"><enum>(3)</enum><header>Formula grants to states</header><text>Of the amounts appropriated under paragraph (1) for a fiscal year and not reserved under paragraph (2) (referred to in this subsection as the <quote>remainder</quote>), not less than 75 percent shall be used for making grants under section 306(a).</text></paragraph> <paragraph id="H7298319406FA4D5ABD09186B9849C97A"><enum>(4)</enum><header>Technical assistance and training centers</header><text>Of the remainder, not less than 6 percent shall be used to carry out section 310.</text></paragraph>
<paragraph id="H710DC0C6C6C94F0195A44782DB5F95C5"><enum>(5)</enum><header>Grants for state domestic violence coalitions</header><text>Of the remainder, not less than 10 percent shall be used to carry out section 311.</text></paragraph> <paragraph id="HA62AC694B43346129FBE74C53D130512"><enum>(6)</enum><header>Specialized services</header><text>Of the remainder, not less than 5 percent shall be used to carry out section 312.</text></paragraph>
<paragraph id="HCD892651527D4F16869378E92593148B"><enum>(7)</enum><header>Administration, evaluation, and monitoring</header><text>Of the remainder, not more than 4 percent shall be used by the Secretary for evaluation, monitoring, and other administrative costs under this title.</text></paragraph></subsection> <subsection id="H2E99266956AE43E6AD0F59D0E8379475"><enum>(c)</enum><header>Tribal domestic violence coalitions</header><text>There is authorized to be appropriated to carry out section 311A $7,500,000 for each of fiscal years 2022 through 2026.</text></subsection>
<subsection id="H04E14436E7054575AC7889D07E655C46"><enum>(d)</enum><header>National domestic violence hotline</header><text>There is authorized to be appropriated to carry out section 313 $14,000,000 for each of fiscal years 2022 through 2026.</text></subsection> <subsection id="H8507FF09D571414F8AFCA3937763429C"><enum>(e)</enum><header>National Indian Domestic Violence Hotline</header><text>There is authorized to be appropriated to carry out section 313A $4,000,000 for each of fiscal years 2022 through 2026.</text></subsection>
<subsection id="HEDE11528D8BA4E1DBB81D777720C1500"><enum>(f)</enum><header>Domestic violence prevention enhancement and leadership through alliances</header><text>There is authorized to be appropriated to carry out section 314 $26,000,000 for each of fiscal years 2022 through 2026.</text></subsection> <subsection id="HCCCD689381214DE4AAF2B814E045EDB8"><enum>(g)</enum><header>Grants for underserved populations</header><text>There is authorized to be appropriated to carry out section 315 $10,000,000 for each of fiscal years 2022 through 2026.</text></subsection>
<subsection id="H4F5544A2D38E4DE285F4146641D73307"><enum>(h)</enum><header>Grants for culturally specific services</header><text>There is authorized to be appropriated to carry out section 316 $6,250,000 for each of fiscal years 2022 through 2026.</text></subsection></section> <section id="H4FC9924128B14A7CA22E46EDF22D90F5"><enum>303A.</enum><header>Authorization of appropriations</header> <subsection id="H33723013D5A74D4EA321CB4211B62177"><enum>(a)</enum><header>Application</header><text>This section shall apply for—</text>
<paragraph id="H70D25E6EC1234682AED0DDF20828BAD3"><enum>(1)</enum><text>the first fiscal year for which the amount appropriated to carry out the provisions specified in subsection (b) is not less than $185,000,000; and</text></paragraph> <paragraph id="H2F8DC276783F4B11AE7F577F3F6A94B1"><enum>(2)</enum><text>each subsequent fiscal year.</text></paragraph></subsection>
<subsection id="H6EC0C95A6E834740A35361DFE17201A0"><enum>(b)</enum><header>Authorization</header>
<paragraph id="H86798A77F6314AE1B6250E74B20920EB"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to carry out sections 301 through 312 and 316, $251,000,000 for each of fiscal years 2022 through 2026.</text></paragraph> <paragraph id="H58C0B21627214452BA86E440FE54E930"><enum>(2)</enum><header>Reservations for grants to tribes</header><text>Of the amounts appropriated under paragraph (1) for a fiscal year, 12.5 percent shall be reserved and used to carry out section 309.</text></paragraph>

<subparagraph id="H9267444858584DBCB6459A5142FF39B0"><enum>(G)</enum><text>Strengthening the organizational capacity of State, territorial, and Tribal domestic violence coalitions and of State, territorial, and Tribal administrators who distribute funds under this title to community-based domestic violence programs, with the aim of better enabling such coalitions and administrators—</text> <clause id="HEC7B560BB37D44E2B8C988FDC08995B2"><enum>(i)</enum><text>to collaborate and respond effectively to domestic violence;</text></clause>
<clause id="HCFF9B544F455420C9319731E11B5C844"><enum>(ii)</enum><text>to meet the conditions and carry out the provisions of this title; and</text></clause> <clause id="HED8F53A6D81B480DA49CE5433AE75DE0"><enum>(iii)</enum><text>to implement best practices to meet the emerging needs of victims of domestic violence and their families, children, and dependents.</text></clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph>
<subparagraph id="HC3E3EB34699B40108D888BC244E7E7F3"><enum>(C)</enum><text>by redesignating paragraph (3) as paragraph (4);</text></subparagraph> <subparagraph id="H6068409458D445338D53194E9392E3EF"><enum>(D)</enum><text>by inserting after paragraph (2) the following:</text>

<subparagraph id="H6241877C7D614CFB9A99C76D781783D3"><enum>(B)</enum><text>coordinate all projects and activities with the national resource center described in paragraph (1)(B), including projects and activities that involve working with non-Tribal State and local governments to enhance their capacity to understand the unique needs of Alaska Natives;</text></subparagraph> <subparagraph id="H14D6BCADA84F4F06927EE72A2D7EAD5A"><enum>(C)</enum><text>provide comprehensive community education and domestic violence prevention initiatives in a culturally sensitive and relevant manner; and</text></subparagraph>
<subparagraph id="H9D0F69A026E442B6BF3B00D31B252761"><enum>(D)</enum><text>coordinate activities with other Federal agencies, offices, and grantees that address the needs of Alaska Natives that experience domestic violence, including the Office of Justice Services of the Bureau of Indian Affairs, the Indian Health Service, and the Office for Victims of Crime and the Office on Violence Against Women of the Department of Justice.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> <subparagraph id="H91EDA7D6AD5446A1824492236F42C872"><enum>(E)</enum><text>in paragraph (4), as so redesignated—</text>

<paragraph id="HB55928DDC2E64F3FA7C1B030E148A80C"><enum>(4)</enum><header>Alaska Native Tribal Resource Center on Domestic Violence</header><text>To be eligible to receive a grant under subsection (b)(3), an entity shall be a Tribal organization or a nonprofit private organization that focuses primarily on issues of domestic violence within Tribes in Alaska that submits information to the Secretary demonstrating—</text> <subparagraph id="HF89149E0134648F4AD9A0EF7A557AF1F"><enum>(A)</enum><text>experience working with Alaska Tribes and Tribal organizations to respond to domestic violence and the findings of section 901 of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/162">Public Law 109–162</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/34/10452">34 U.S.C. 10452</external-xref> note);</text></subparagraph>
<subparagraph id="HC575FCD09E2940EE90B49C7A32AFB764"><enum>(B)</enum><text>experience providing Alaska Tribes and Tribal organizations with assistance in developing Tribally based prevention and intervention services addressing domestic violence and safety for Indian women consistent with the purposes of section 902 of the Violence Against Women and Department of Justice Reauthorization Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/162">Public Law 109–162</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/34/10452">34 U.S.C. 10452</external-xref> note);</text></subparagraph> <subparagraph id="HB3E35476EA0B47EF932CF6CDFADF7A95"><enum>(C)</enum><text>strong support for the entity's designation as the Alaska Native Tribal resource center on domestic violence from advocates working with Alaska Tribes to address domestic violence and the safety of Alaska Native women;</text></subparagraph>
<subparagraph id="H90AD259AD3D541639FE3F120A4CAAB65"><enum>(D)</enum><text>a record of demonstrated effectiveness in assisting Alaska Tribes and Tribal organizations with prevention and intervention services addressing domestic violence; and</text></subparagraph> <subparagraph id="H5DC4E204A3F74F16949E84B4C8125888"><enum>(E)</enum><text>the capacity to serve Tribes across the State of Alaska.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph>
<subparagraph id="HD2A9ADC02FDB404997A933FB3D0C6A1C"><enum>(F)</enum><text>in paragraph (5), as so redesignated—</text> <clause id="H7C697006DED548D19D5A85E4125C857B"><enum>(i)</enum><text>by striking <quote>(including Alaska Natives)</quote>; and</text></clause>

<section id="H7663F4FB9B8D42C6B2D739AC8E17FE82"><enum>13.</enum><header>Grants to Tribal domestic violence coalitions</header><text display-inline="no-display-inline">The Family Violence Prevention and Services Act (<external-xref legal-doc="usc" parsable-cite="usc/42/10401">42 U.S.C. 10401</external-xref> et seq.) is amended by inserting after section 311 the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HCE7DEFF33D754649B9DDF772DD8B96C5"> <section id="H6333FF9F500243B88729A1B6D2038715"><enum>311A.</enum><header>Grants to Tribal domestic violence coalitions</header> <subsection id="H4205B955E7A34568AD4FA707CC840970"><enum>(a)</enum><header>Grants authorized</header><text>Beginning with fiscal year 2022, out of amounts appropriated under section 303 or 303A and made available to carry out this section for a fiscal year, the Secretary shall award grants to eligible entities in accordance with this section.</text></subsection>
<subsection id="H251D8A79EBAC4EAEA6EF04606CBE0A28"><enum>(b)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under this section, an entity shall be a Tribal domestic violence coalition that is recognized by the Office on Violence Against Women of the Department of Justice that provides services to Indian Tribes.</text></subsection> <subsection id="H9B3BD9F5B7074A2FA1878EF056400D12"><enum>(c)</enum><header>Application</header><text>Each Tribal domestic violence coalition desiring a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require. The application submitted by the coalition for the grant shall provide documentation of the coalition’s work, demonstrating that the coalition—</text>
<paragraph id="HEABF17D2485D4AA9B588D369C8B21E81"><enum>(1)</enum><text>meets all the applicable requirements set forth in this section; and</text></paragraph> <paragraph id="H4425F75DAE104A809D917048EFF58DA3"><enum>(2)</enum><text>has the ability to conduct all activities described in this section, as indicated by—</text>
<subparagraph id="H437D505FE7274F8F8579D0FC827667A4"><enum>(A)</enum><text>a documented experience in administering Federal grants to conduct the activities described in subsection (d); or</text></subparagraph> <subparagraph id="H20B4CA059DEE4475BA7E276332444164"><enum>(B)</enum><text>a documented history of activities to further the purposes of this section set forth in subsection (d).</text></subparagraph></paragraph></subsection>
<subsection id="HD18FB61196184BADAEF3D95DE70AF225"><enum>(d)</enum><header>Use of funds</header><text>A Tribal domestic violence coalition eligible under subsection (b) that receives a grant under this section may use the grant funds for administration and operation to further the purposes of family violence, domestic violence, and dating violence intervention and prevention activities, including—</text> <paragraph id="HA1864E34D9844524849322F12C1A2D7B"><enum>(1)</enum><text>working with local Tribal family violence, domestic violence, or dating violence service programs and providers of direct services to encourage appropriate and comprehensive responses to family violence, domestic violence, and dating violence against adults or youth within the Indian Tribes served, including providing training and technical assistance and conducting Tribal needs assessments;</text></paragraph>
<paragraph id="H0CA6D79986DA45018D38C9060FB904B4"><enum>(2)</enum><text>participating in planning and monitoring the distribution of subgrants and subgrant funds within the State under section 308(a);</text></paragraph> <paragraph id="H2B7072C0D4A242A28C59AED325126132"><enum>(3)</enum><text>working in collaboration with Tribal service providers and community-based organizations to address the needs of victims of family violence, domestic violence, and dating violence, and their children and dependents;</text></paragraph>
<paragraph id="H51BDC4917BBB4D89B04FA6B06DE6B688"><enum>(4)</enum><text>collaborating with, and providing information to, entities in such fields as housing, health care, mental health, social welfare, and law enforcement to support the development and implementation of effective policies;</text></paragraph> <paragraph id="HA2584E7C6EE04686A8EC7308785B9D14"><enum>(5)</enum><text>supporting the development and implementation of effective policies, protocols, legislation, codes, and programs that address the safety and support needs of adult and youth Tribal victims of family violence, domestic violence, or dating violence;</text></paragraph>
<paragraph id="H0F8556D316424737B6C55466309711A8"><enum>(6)</enum><text>encouraging appropriate responses to cases of family violence, domestic violence, or dating violence against adults or youth, by working with Tribal, State, and Federal judicial agencies and law enforcement agencies;</text></paragraph> <paragraph id="HC81B3E3FFDA440979FF55F0B12263BCB"><enum>(7)</enum><text>working with Tribal, State, and Federal judicial agencies, including family law judges, criminal court judges, child protective service agencies, and children's advocates to develop appropriate responses to child custody and visitation issues—</text>
<subparagraph id="H31E64AF770BD46868F41DC1A67E746D1"><enum>(A)</enum><text>in cases of child exposure to family violence, domestic violence, or dating violence; or</text></subparagraph> <subparagraph id="H3AA678E1F5CA4D73B65FFE006FA561D1"><enum>(B)</enum><text>in cases in which—</text>
<clause id="H125EFE5C4E554DC1B88F15A3E8DAD74A"><enum>(i)</enum><text>family violence, domestic violence, or dating violence is present; and</text></clause> <clause id="HEC039EE925B84383AE4032EEF07CE9F7"><enum>(ii)</enum><text>child abuse is present;</text></clause></subparagraph></paragraph>
<paragraph id="H5A59A8D122FE4455A75C44F272941E00"><enum>(8)</enum><text>providing information to the public about prevention of family violence, domestic violence, and dating violence within Indian Tribes; and</text></paragraph> <paragraph id="H2B83EE6E3FE840E4B95BA8B9D8A99E2C"><enum>(9)</enum><text>assisting Indian Tribes' participation in, and attendance of, Federal and State consultations on family violence, domestic violence, or dating violence, including consultations mandated by the Violence Against Women Act of 1994 (title IV of <external-xref legal-doc="public-law" parsable-cite="pl/103/322">Public Law 103–322</external-xref>), the Victims of Crime Act of 1984 (<external-xref legal-doc="usc" parsable-cite="usc/34/20101">34 U.S.C. 20101</external-xref> et seq.), or this title.</text></paragraph></subsection>
<subsection id="HF19D3FF9C4F848E9984FC20DBE0817D6"><enum>(e)</enum><header>Reallocation</header><text>If, at the end of the sixth month of any fiscal year for which sums are appropriated under section 303 or 303A and made available to carry out this section, a portion of the available amount has not been awarded to Tribal domestic violence coalitions for grants under this section because of the failure of such coalitions to meet the requirements for such grants, then the Secretary shall award such portion, in equal shares, to Tribal domestic violence coalitions that meet such requirements.</text></subsection></section><after-quoted-block>. </after-quoted-block></quoted-block></section> <section id="HE2EB4C7D77144724B995F8BB0A29136C"><enum>14.</enum><header>Specialized services for abused parents and their children</header><text display-inline="no-display-inline">Section 312 (<external-xref legal-doc="usc" parsable-cite="usc/42/10412">42 U.S.C. 10412</external-xref>) is amended—</text>
<paragraph id="H77879ABE103143878852B848AC95B353"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="HB839AD11743E42C9831DCD7CF2D4CD05"><enum>(A)</enum><text>in paragraph (1)—</text>
<clause id="H4B46C5EB9BB945BFAAE827980D717FF5"><enum>(i)</enum><text>by striking <quote>dating violence service programs and community-based programs to prevent future domestic violence by addressing, in an appropriate manner, the needs of children</quote> and inserting <quote>culturally specific community-based programs to serve children and youth</quote>; and</text></clause> <clause id="H8E2D0CC0E87C4007B2F27722F19CA3C5"><enum>(ii)</enum><text>by inserting <quote>, and to support the caregiving capacity of adult victims</quote> before the period; and</text></clause></subparagraph>
<subparagraph id="HD807D0384D1E45E0847F27D8059096CB"><enum>(B)</enum><text>in paragraph (2), by striking <quote>more than 2</quote> and inserting <quote>less than 3</quote>;</text></subparagraph></paragraph> <paragraph id="H9665C6E114EB4A5591A13B59F7CEA764"><enum>(2)</enum><text>in subsection (b)—</text>

<subparagraph id="H31E12331268F42849D51605AD5177627"><enum>(B)</enum><text>in paragraph (2), by striking <quote>developmentally appropriate and age-appropriate services, and culturally and linguistically appropriate services, to the victims and children; and</quote> and inserting <quote>trauma-informed, developmentally appropriate, age-appropriate, and culturally and linguistically appropriate services to children and youth and their adult caregivers;</quote>;</text></subparagraph> <subparagraph id="HE4305FCCF18146F98D8AFFE5BAA04B37"><enum>(C)</enum><text>in paragraph (3), by striking <quote>appropriate and relevant to the unique needs of children exposed to family violence, domestic violence, or dating violence.</quote> and inserting <quote>relevant to the unique needs of children and youth exposed to family violence, domestic violence, or dating violence, and address the parent's or caregiver's ongoing caregiving capacity; and</quote>; and</text></subparagraph>
<subparagraph id="H1F2E5342C7F34F2EAE0DC95F85AC5350"><enum>(D)</enum><text>by adding at the end the following:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HD9D3FB53F6BF4830A3FDEBBBBED9B695"> <paragraph id="H3269D94CF2F94B8DB4AF65C5B8C02485"><enum>(4)</enum><text>a description of prevention activities targeting child and youth victims of family violence, domestic violence, or dating violence.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph>

<paragraph id="H17144651231242578A942C34535FFB86"><enum>(1)</enum><text>84.3 percent of American Indian and Alaska Native women have experienced violence in their lifetime;</text></paragraph> <paragraph id="HBF92093A4069481CAEB83DE746643ABD"><enum>(2)</enum><text>81.6 percent of American Indian and Alaska Native men have experienced violence in their lifetime;</text></paragraph>
<paragraph id="H61C65CB5175B452B9923ADC0064269F5"><enum>(3)</enum><text>56.1 percent of American Indian and Alaska Native women will experience sexual violence in their lifetime;</text></paragraph> <paragraph id="H26F418EA1ADA46209A800BECD2C8ED67"><enum>(4)</enum><text>55.5 percent of American Indian and Alaska Native women will experience intimate partner violence in their lifetime;</text></paragraph>
<paragraph id="H020C42DE251047C0B05FD4E76E3DFEEF"><enum>(5)</enum><text>48.8 percent of American Indian and Alaska Native women will experience stalking;</text></paragraph> <paragraph id="HD2AB188C3988476F94668B8C9B63563F"><enum>(6)</enum><text>38 percent of American Indian and Alaska Natives female victims have been previously unable to access victim assistance services;</text></paragraph>
<paragraph id="H130A9C7096F74E1394B782792A96A033"><enum>(7)</enum><text>Indian Tribes require additional criminal justice and victim services resources to respond to violent assaults against women;</text></paragraph> <paragraph id="H15C5A43A4BCD4E19BBEFF25E5F9A38E4"><enum>(8)</enum><text>the unique legal relationship of the United States to Indian Tribes creates a Federal trust responsibility to assist Tribal governments in safeguarding the lives of Indian women; and</text></paragraph>
<paragraph id="H2C0E1A7121A44E42ABE5B3B9C6C491C4"><enum>(9)</enum><text>a national Indian domestic violence hotline is required to increase access of Indian adult and youth victims of family violence, domestic violence, and dating violence to Tribal victim services and resources.</text></paragraph></subsection> <subsection id="H8088CD4862A24BB491FD7FFA86B2B29F"><enum>(b)</enum><header>Purpose</header><text>The purpose of this section is to increase the availability of information and assistance to Indian adult or youth victims of family violence, domestic violence, or dating violence, family and household members of such victim, and individuals affected by such victimization by supporting a national, toll-free telephonic and digital hotline to provide services that are—</text>
<paragraph id="H3D6C362234F640B6A35CA9145FCB3343"><enum>(1)</enum><text>informed of Federal Indian law and Tribal laws impacting Indian victims of family violence, domestic violence, or dating violence;</text></paragraph> <paragraph id="H88287B6332484AE2A09CE85386E15980"><enum>(2)</enum><text>culturally appropriate to Indian adult and youth victims; and</text></paragraph>
<paragraph id="H092B7600007C4DEB9A42C5B20A962688"><enum>(3)</enum><text>developed in cooperation with victim services offered by Indian Tribes and Tribal organizations.</text></paragraph></subsection> <subsection id="H72842B9B869946A3B92004B432ABDF10"><enum>(c)</enum><header>Grant program</header><text display-inline="yes-display-inline">The Family Violence Prevention and Services Act (<external-xref legal-doc="usc" parsable-cite="usc/42/10401">42 U.S.C. 10401</external-xref> et seq.) is amended by inserting after section 313 the following:</text>

<section id="HAD7C46846FA6402F8B0BBBE8DE4D6F21"><enum>313A.</enum><header>National Indian domestic violence hotline grant</header>
<subsection id="H807F2F03C749496D98A8BC4C26A78CBF"><enum>(a)</enum><header>In general</header><text>The Secretary shall award a grant to a Tribal organization or private, non-profit entity to maintain the ongoing operation of a national, toll-free telephonic and digital hotline service to provide information and assistance to Indian adult and youth victims of family violence, domestic violence, or dating violence, family and household members of such victims, and other individuals affected by such victimization.</text></subsection> <subsection id="HC23CE4692196466DAC88BAF53E24EA1A"><enum>(b)</enum><header>Term</header><text>The Secretary shall award a grant under this section for a period of not more than 5 years.</text></subsection>
<subsection id="H9297AFDDA0FE4D5EB0877B2CC566EA0A"><enum>(c)</enum><header>Conditions on payment</header><text>The provision of payments under a grant awarded under this section shall be subject to annual approval by the Secretary and subject to the availability of appropriations for each fiscal year to make the payments.</text></subsection> <subsection id="H36E61851AF5A48179D035B638D07996D"><enum>(d)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this section, an entity shall be a Tribal organization or a nonprofit private organization that focuses primarily on issues of domestic violence as it relates to American Indians and Alaska Natives, and submit an application to the Secretary that shall—</text>
<paragraph id="H89A12FBE0C7D46718363705DF389D5A6"><enum>(1)</enum><text>contain such agreements, assurances, and information, be in such form, and be submitted in such manner, as the Secretary shall prescribe;</text></paragraph> <paragraph id="H9F4F7062F40644698AA00B825419DC94"><enum>(2)</enum><text>include a complete description of the applicant’s plan for the operation of a national Indian domestic violence hotline and digital services, including descriptions of—</text>
<subparagraph id="H6BFCC1076F954B21A0EBEEF9C4E2BDE0"><enum>(A)</enum><text>the training program for advocacy personnel relating to the provision of culturally appropriate and legally accurate services, information, resources and referrals for Indian victims of domestic, dating, and family violence;</text></subparagraph> <subparagraph id="HF463B8FD434940F9BAC73D2EB07B12C3"><enum>(B)</enum><text>the training program for advocacy personnel, relating to technology requirements to ensure that all persons affiliated with the hotline and digital services are able to effectively operate any technological systems required to provide the necessary services used by the hotline;</text></subparagraph>
<subparagraph id="H247A8FF79D00456A9E2CECA1940B35A0"><enum>(C)</enum><text display-inline="yes-display-inline">the qualifications of the applicant and the hiring criteria and qualifications for advocacy personnel, to ensure that hotline advocates and other personnel have demonstrated knowledge of Indian legal, social, and cultural issues, to ensure that the unique needs of Indian callers and users of digital services are met;</text></subparagraph> <subparagraph id="HD358E5B3E6EE40A5BE5AA3C65D431B9E"><enum>(D)</enum><text>the methods for the creation, maintenance, and updating of a resource database of culturally appropriate victim services and resources available from Indian Tribes and Tribal organizations;</text></subparagraph>
<subparagraph id="H3A41196C9F774A5A81AFAEE18E9F9379"><enum>(E)</enum><text>a plan for publicizing the availability of the services from the national Indian hotline to Indian victims of domestic violence and dating violence;</text></subparagraph> <subparagraph id="HFD58E98D154443C5BE9AF68BAC72D1ED"><enum>(F)</enum><text>a plan for providing service to non-English speaking callers, including service through hotline and digital services personnel who have non-English language capability;</text></subparagraph>
<subparagraph id="H727DD8FF44184D899965C357D22913F2"><enum>(G)</enum><text>a plan for facilitating access to hotline and digital services by individuals with hearing impairments; and</text></subparagraph> <subparagraph id="H49919EC3009B43959B20D5BDA542FD1D"><enum>(H)</enum><text>a plan for providing assistance and referrals to Indian youth victims of domestic violence and for victims of dating violence who are minors, which may be carried out through a national Indian youth dating violence hotline, digital services, or other resources;</text></subparagraph></paragraph>
<paragraph id="H54D167DF5C6D46A69C8FA500706B007D"><enum>(3)</enum><text>demonstrate recognized expertise providing services, including information on healthy relationships and referrals for Indian victims of family violence, domestic violence, or dating violence and coordinating services with Indian Tribes or Tribal organizations;</text></paragraph> <paragraph id="HE8FF27E436DB4ABCA88486625A7A99ED"><enum>(4)</enum><text>demonstrate support from Indian victim services programs, Tribal coalitions recognized by the Office on Violence Against Women and Tribal grantees under this title;</text></paragraph>
<paragraph id="H1476D021156C4F5483293EFDB1EF2229"><enum>(5)</enum><text>demonstrate capacity and the expertise to maintain a domestic violence hotline, digital services and a comprehensive database of service providers from Indian Tribes or Tribal organizations;</text></paragraph> <paragraph id="H3A0B25A0F0C449B5BF250971AB107806"><enum>(6)</enum><text>demonstrate compliance with nondisclosure requirements as described in section 306(c)(5) and following comprehensive quality assurance practices; and</text></paragraph>
<paragraph id="HF0447FBCB0C34785B9A5D8D032351006"><enum>(7)</enum><text>contain such other information as the Secretary may require.</text></paragraph></subsection> <subsection id="H5DCD5A45C4824F2B823020BFEEB12BF6"><enum>(e)</enum><header>Indian hotline activities</header> <paragraph id="H16203978F90344F7B14AB445F0336693"><enum>(1)</enum><header>In general</header><text>An entity that receives a grant under this section shall use funds made available through the grant for the purpose described in subsection (a), consistent with paragraph (2).</text></paragraph>
<paragraph id="H788BDB3DD952422C8438A0680377FF64"><enum>(2)</enum><header>Activities</header><text>In establishing and operating the hotline, the entity—</text> <subparagraph id="H56AEAEDF00764CBD9328006722A3AD73"><enum>(A)</enum><text>shall contract with a carrier for the use of a toll-free telephone line and an internet service provider for digital services;</text></subparagraph>
<subparagraph id="H7BB33220925F4B8DB71C7377167C1A2E"><enum>(B)</enum><text>shall employ, train (including providing technology training), and supervise personnel to answer incoming calls and digital services contacts, provide counseling, healthy relationship and referral services for Indian callers and digital services users, directly connect callers, and assist digital services users in connecting to service providers;</text></subparagraph> <subparagraph id="H724327CCEE2B4ED6A9563C3377C36B09"><enum>(C)</enum><text>shall assemble and maintain a database of information relating to services for Indian victims of family violence, domestic violence, or dating violence to which Indian callers or digital services users may be referred, including information on the availability of shelters and supportive services for victims of family violence, domestic violence, or dating violence;</text></subparagraph>
<subparagraph id="H76C20D1B8FD34394A822340360E6E30E"><enum>(D)</enum><text>shall widely publicize the hotline and digital services throughout Indian Tribes and communities, including—</text> <clause id="HBDFF98DD545849B989C9B0C1E7A72CF5"><enum>(i)</enum><text>national and regional member organizations of Indian Tribes;</text></clause>
<clause id="H479FCA5E4B6E42C091B377D75D5AFBB4"><enum>(ii)</enum><text>Tribal domestic violence services programs; and</text></clause> <clause id="HA629A0AC55434BC5930FF8E4E3551365"><enum>(iii)</enum><text>Tribal non-profit victim service providers;</text></clause></subparagraph>
<subparagraph id="HF2298B87DF7F42A58E2D242BF0DB9923"><enum>(E)</enum><text>at the discretion of the hotline operator, may provide appropriate assistance and referrals for family and household members of Indian victims of family violence, domestic violence, or dating violence, and Indians affected by the victimization described in subsection (a); and</text></subparagraph> <subparagraph id="H45BD923A886D4ABF91ACE00BD01CE9CC"><enum>(F)</enum><text>at the discretion of the hotline operator, may provide assistance, or referrals for counseling or intervention, for identified Indian perpetrators, including self-identified perpetrators, of family violence, domestic violence, or dating violence, but shall not be required to provide such assistance or referrals in any circumstance in which the hotline operator fears the safety of a victim may be impacted by an abuser or suspected abuser.</text></subparagraph></paragraph></subsection>
<subsection id="H1757DDEDDE8941AF95EA9801306149B8"><enum>(f)</enum><header>Reports and evaluation</header><text>The entity receiving a grant under this section shall submit a performance report to the Secretary at such time as shall be reasonably required by the Secretary. Such performance report shall describe the activities that have been carried out with such grant funds, contain an evaluation of the effectiveness of such activities, and provide such additional information as the Secretary may reasonably require.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="HBAEE066B2FC14801B8938F41CAE4FF9F"><enum>17.</enum><header>Domestic violence prevention enhancement and leadership</header><text display-inline="no-display-inline">Section 314 (<external-xref legal-doc="usc" parsable-cite="usc/42/10414">42 U.S.C. 10414</external-xref>) is amended to read as follows:</text>

<paragraph id="H4AC8D573B0A64F1399B72F8E327F7E0A"><enum>(1)</enum><header>Purpose</header><text>The purposes of this section are—</text> <subparagraph id="H5A5463B6B3FF4617AA6DBAA84B841A73"><enum>(A)</enum><text>to continue efforts to build evidence for effective primary prevention practices, programs, and policies that reduce and end family violence, domestic violence, and dating violence;</text></subparagraph>
<subparagraph id="H8C83B0C65D574D74929C1F6AED9B6E77"><enum>(B)</enum><text>to build capacity at the State, Tribal, territorial, and local levels to meet the objectives described in subparagraph (A); and</text></subparagraph> <subparagraph id="H13265C4E8DCA440DB284825A5BE437C2"><enum>(C)</enum><text>to advance primary prevention efforts related to family violence, domestic violence, and dating violence nationally.</text></subparagraph></paragraph>
<paragraph commented="no" id="H0758F9229BAC4A568417F0AA78141398"><enum>(2)</enum><header>Description of grants</header><text>From the amounts appropriated under this section, the Secretary shall—</text> <subparagraph commented="no" id="HC2A8EC4F15084BE8BFAEFCA1100E82AC"><enum>(A)</enum><text>acting through the Division of Violence Prevention of the Centers for Disease Control and Prevention, in consultation with the Director of the Division of Family Violence Prevention and Services of the Administration for Children and Families—</text>
<clause commented="no" id="H90CE5CF304BE4A7E87D5B0D3FAD2BB90"><enum>(i)</enum><text>provide core grants under subsection (b)(1) to support primary prevention of family violence, domestic violence and dating violence; and</text></clause> <clause commented="no" id="H408EA14C68D8482593848CF905F73C7B"><enum>(ii)</enum><text>enter into cooperative agreements under subsection (b)(2) with State, territorial, and Tribal domestic violence coalitions that are in partnerships with entities carrying out local and culturally specific programs, to test, evaluate, or scale up innovative family violence, domestic violence, or dating violence prevention models, particularly those programs serving culturally specific or traditionally underserved populations; and</text></clause></subparagraph>
<subparagraph commented="no" id="H887303083D254524B0BB302CF2E77B8C"><enum>(B)</enum><text>acting through the Family Violence Prevention and Services Program of the Administration for Children and Families, award grants under subsection (c) to enhance the capacity of communities and systems to engage in effective prevention efforts.</text></subparagraph></paragraph> <paragraph id="H61A219D950844AE68BF9D80B200C8C45"><enum>(3)</enum><header>Technical assistance, evaluation, and monitoring</header><text>Of the amounts appropriated under this section for a fiscal year the Secretary may use—</text>
<subparagraph id="H89626B083DFE462E946B2851865CF225"><enum>(A)</enum><text>not more than 5 percent of the amounts for evaluation, monitoring, and other administrative costs under this section; and</text></subparagraph> <subparagraph id="H145A7CB4CBD248F3A0D16C99DE15C2E2"><enum>(B)</enum><text>not more than 3 percent of the amounts for each fiscal year for technical assistance under this section.</text></subparagraph></paragraph></subsection>
<subsection id="H10BF7E39F89441A88906FA62C02C9803"><enum>(b)</enum><header>Grants to State, territorial, and Tribal coalitions</header>
<paragraph commented="no" id="H289B1E682B6143FDAF979194D81218C5"><enum>(1)</enum><header>Grants to build primary prevention capacity of domestic violence coalitions</header>
<subparagraph id="H1C8DDA1E96204883BC3075D34C4F571B"><enum>(A)</enum><header>Purpose</header><text>The Secretary shall provide a core grant for each eligible State, territorial, and Tribal coalition. The Secretary shall provide such a grant to build organizational capacity and leadership for primary prevention of family violence, domestic violence and dating violence, including work with other systems central to prevention at the local, State, territorial, and Tribal levels.</text></subparagraph> <subparagraph id="H6B3986E926FF4B24BADCB4BC9DAB3F55"><enum>(B)</enum><header>Eligibility</header><text>To be eligible to receive a grant under this paragraph, a State, territorial, or Tribal coalition shall be a State domestic violence coalition, territorial domestic violence coalition, or Tribal domestic violence coalition, respectively, that has not entered into a cooperative agreement under section 314 of this Act (as in effect on the day before the date of enactment of the Family Violence Prevention and Services Improvement Act of 2019) or under paragraph (2).</text></subparagraph>
<subparagraph id="H0B7FFEBAFF0148428678C817D0761371"><enum>(C)</enum><header>Allotment of funds</header><text>From the amount appropriated to carry out this section, and available for this subsection the Secretary shall allot an equal share to each qualified entity receiving funds under section 311 or section 311A to carry out evidence-informed prevention activities.</text></subparagraph> <subparagraph id="H63509EE132134DFD84B2F83EF9D1D227"><enum>(D)</enum><header>Application</header><text>Each coalition seeking a grant under this paragraph shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require. The application submitted by the coalition for the grant shall provide documentation of the coalition’s prevention work, satisfactory to the Secretary, demonstrating that the coalition—</text>
<clause id="H2774E1B204154932BC46352AE83D12B7"><enum>(i)</enum><text>meets all of the applicable requirements of this paragraph; and</text></clause> <clause id="H57E52540701A47C8BB5F67828D1E2712"><enum>(ii)</enum><text>demonstrates the ability to conduct appropriately the prevention activities described in this paragraph.</text></clause></subparagraph>
<subparagraph id="HFB712E0B2DD947369BEADBDDFFB00478"><enum>(E)</enum><header>Use of funds</header><text>A coalition that receives a grant under this paragraph—</text> <clause id="H6C4EF9C9CFD1415393F5FDAF9C14D162"><enum>(i)</enum><text>shall use the grant funds to—</text>
<subclause id="HCFDC14F254E84C899364407C3835A4A3"><enum>(I)</enum><text>build the coalition's organizational capacity and enhance its State or Tribal leadership to advance evidence-informed primary prevention of family violence, domestic violence, and dating violence;</text></subclause> <subclause id="H992C7AA85A4E468CA29FFAE94693911E"><enum>(II)</enum><text>provide prevention-focused training, technical assistance, peer learning opportunities, and other support to local domestic violence programs and other community-based and culturally specific programs working to address family violence, domestic violence, or dating violence;</text></subclause>
<subclause id="H9BA268B688C749CEB914D8EB99A2745C"><enum>(III)</enum><text>provide training and advocacy to other State, Tribal, and local public and private systems on how to prevent domestic violence, dating violence, and family violence, and help victims, including through health services, early childhood programs, economic support programs, schools, child welfare, workforce development, community-based programs primarily serving racial and ethnic minority groups, community-based programs primarily serving other underserved populations, faith-based programs, and youth programs; and</text></subclause> <subclause id="H1EBF202C1B0E465AB8E8BF1C1BB47688"><enum>(IV)</enum><text>support dissemination of prevention strategies and approaches throughout the State, territorial, or Tribal communities; and</text></subclause></clause>
<clause id="HA40BA203871F444D9F5BDC9EB0596CC5"><enum>(ii)</enum><text>may use the grant funds to provide subgrants to local programs to support the dissemination of primary prevention programs or initiatives.</text></clause></subparagraph> <subparagraph id="HB04D3D567C9441569E4A42CDB2645A38"><enum>(F)</enum><header>Reports</header><text>Each entity receiving a grant under this section shall submit a performance report to the Secretary at such time as the Secretary requires. Such performance report shall describe the activities that have been carried out with such grant funds and the effectiveness of such activities, and provide such additional information as the Secretary may require.</text></subparagraph>
<subparagraph id="H483FE564DDDE4E71BE900E5C47F8C912"><enum>(G)</enum><header>Federal activities</header><text>The Secretary may use a portion of the funds provided under this paragraph to provide prevention-focused training, technical assistance, and other support to coalitions described in subparagraph (B) or State or local entities that are in partnerships with such coalitions.</text></subparagraph></paragraph> <paragraph id="H080A533F099646E98036703CE070089A"><enum>(2)</enum><header>Cooperative agreement for implementation and evaluation of primary prevention strategies</header> <subparagraph id="H6F02E0A6044642D6843ABAB893CFBA6D"><enum>(A)</enum><header>Purpose</header><text>The Secretary shall enter into cooperative agreements with qualified State, territorial, and Tribal domestic violence coalitions that are in partnerships with entities carrying out local and culturally specific programs, to test, evaluate, or scale up innovative family violence, domestic violence, or dating violence prevention strategies and models, particularly those serving culturally specific or traditionally underserved populations.</text></subparagraph>
<subparagraph id="HD430F7816A2C4770AEF5D9622C1F4F80"><enum>(B)</enum><header>Qualification</header><text>To be qualified to enter into a cooperative agreement under subsection (a)(2)(A)(ii), an organization shall be a State, territorial, or Tribal domestic violence coalition and include representatives of pertinent sectors of the local community, which may include—</text> <clause id="H61369444133E41F3ACC99B2AB1F3638C"><enum>(i)</enum><text>health care providers and Tribal, State, or local health departments;</text></clause>
<clause id="H1E2D19800CA94278811350E979FE9932"><enum>(ii)</enum><text>the education community;</text></clause> <clause id="H53FD18FD7B1F4AA3B377A1FC9371D93C"><enum>(iii)</enum><text>a faith-based community;</text></clause>
<clause id="H3935B7D5C63546F0BBAEA41A8F0BAA45"><enum>(iv)</enum><text>the juvenile justice system;</text></clause> <clause id="HF42F00A5DC164510967F86AC1B43E21E"><enum>(v)</enum><text>family violence, domestic violence, and dating violence service program advocates;</text></clause>
<clause id="H0CD57DD1DABF456FBC6D438533DD06F0"><enum>(vi)</enum><text>public human service entities;</text></clause> <clause id="H80D4A8510D2F47D0A58123C81136006F"><enum>(vii)</enum><text>business and civic leaders;</text></clause>
<clause id="H9E0513E0037145C1A52753C83D2F5139"><enum>(viii)</enum><text>child and youth-serving organizations;</text></clause> <clause id="HF17AF9856CAD490988E95D21F57A6BBF"><enum>(ix)</enum><text>community-based organizations whose primary purpose is to provide culturally appropriate services to underserved populations, including racial and ethnic minority communities; and</text></clause>
<clause id="HB4512C2694054698A9958F2BAD2AEC4C"><enum>(x)</enum><text>other pertinent sectors.</text></clause></subparagraph> <subparagraph id="H0457BCF7132C401E947200DDBFE09BA8"><enum>(C)</enum><header>Term</header><text>The Secretary shall enter into a cooperative agreement under this section for a period of not more than 5 fiscal years.</text></subparagraph>
<subparagraph id="HB69421F3762D45078EC93ADAC052D630"><enum>(D)</enum><header>Conditions on payment</header><text>The provision of payments under a cooperative agreement under this section shall be subject to—</text> <clause id="HE1C3492305C54895B419575BFC61411C"><enum>(i)</enum><text>annual approval by the Secretary; and</text></clause>
<clause id="H79ED0F6E42764E7DB99DD49F55F842B6"><enum>(ii)</enum><text>the availability of appropriations for each fiscal year to make the payments.</text></clause></subparagraph> <subparagraph id="H94C4E0BC813D427C9CF2F365F2906761"><enum>(E)</enum><header>Applications</header><text>An organization that desires to enter into a cooperative agreement under this section shall submit to the Secretary an application, in such form and in such manner as the Secretary shall require, that—</text>
<clause id="H9AE731028A6E4111AA9E85F58216F443"><enum>(i)</enum><text>identifies models and strategies to be tested and partner organizations who will be implementing programs to prevent family violence, domestic violence, or dating violence;</text></clause> <clause id="H56B8B9210BBF43EAA63E44659B7DE08E"><enum>(ii)</enum><text>demonstrates that the applicant has developed effective and collaborative relationships with diverse communities, including with organizations primarily serving racial and ethnic minority populations or other underserved populations;</text></clause>
<clause id="H53547C53BA6C4B2495D42E05E753C92A"><enum>(iii)</enum><text>identifies other partners and sectors who will be engaged to meet the prevention goals;</text></clause> <clause id="H58D44AC1304A4FF8AA17761A168DFEE2"><enum>(iv)</enum><text>includes a description of the expected outcomes from the prevention activities and how the strategy is expected to achieve those outcomes;</text></clause>
<clause id="H0F3BE03EF4154A14A625C0F62185A1E2"><enum>(v)</enum><text>describes the method to be used for identification and selection of project staff and a project evaluator;</text></clause> <clause id="HC015024136EF447C8CF0675CD45265CD"><enum>(vi)</enum><text>describes the method to be used for identification and selection of a project council consisting of representatives of the community sectors listed in subparagraph (B);</text></clause>
<clause id="HDC633101119B4E37908D4275D23E9F7F"><enum>(vii)</enum><text>demonstrates that the applicant has the capacity to carry out collaborative community initiatives to prevent family violence, domestic violence, and dating violence; and</text></clause> <clause id="H84F379C2D9F94566BC891600746C55E8"><enum>(viii)</enum><text>contains such other information, agreements, and assurances as the Secretary may require.</text></clause></subparagraph>
<subparagraph id="H822A314BBB0A4154AAE2DD6AE2F43616"><enum>(F)</enum><header>Geographical dispersion</header><text>The Secretary shall enter into cooperative agreements under this section with organizations in States, territories, and Tribes geographically dispersed throughout the Nation.</text></subparagraph> <subparagraph id="H7D9FC57F46754B38933195787A4470EA"><enum>(G)</enum><header>Use of funds</header> <clause id="H34B4396C0BAA426ABF7BC7308A4835B2"><enum>(i)</enum><header>In general</header><text>An organization that enters into a cooperative agreement under this paragraph shall use the funds made available through the agreement to establish, operate, and maintain implementation and evaluation of coordinated community response to reduce risk factors for family violence, domestic violence and dating violence perpetration and enhance protective factors to promote positive development and healthy relationships and communities.</text></clause>
<clause commented="no" id="HF0219E27377640FF90FF59ABA29E916F"><enum>(ii)</enum><header>Technical assistance, evaluation, and monitoring</header><text>The Secretary may use a portion of the funds provided under this paragraph to provide for the evaluation, monitoring, administration, and technical assistance described in subsection (a)(3), with respect to the prevention projects.</text></clause></subparagraph> <subparagraph id="H546D07B89A0A46298BB4E1B23755B23E"><enum>(H)</enum><header>Requirements</header><text>In establishing and operating a project under this paragraph, an organization shall—</text>
<clause id="H57E4FC1860DA4CE091CB8A6E1D563D91"><enum>(i)</enum><text>utilize evidence-informed prevention project planning;</text></clause> <clause id="HDFC81C359C2D46DC85F3EC0AEDDCDBD7"><enum>(ii)</enum><text>recognize and address the needs of underserved populations, racial and ethnic minority groups, and individuals with disabilities;</text></clause>
<clause id="H2E70D9CEA45944468CF9D39DA19DE12D"><enum>(iii)</enum><text>use not less than 30 percent or more than 50 percent of awarded funds to subcontract with local domestic violence programs or other community-based programs to develop and implement such projects;</text></clause> <clause id="HA9987424AB6C4849B717D4CABC81D089"><enum>(iv)</enum><text>in the case of a new grantee, use the funds for up to 1 year for planning and capacity building without subcontracting as described in clause (iii); and</text></clause>
<clause id="H1189716AACBA4D488264C6B9E3BE18FC"><enum>(v)</enum><text>use up to 8 percent of the funds awarded under this paragraph to procure technical assistance from a list of providers approved by the Secretary and peer-to-peer technical assistance from other grantees under this paragraph.</text></clause></subparagraph> <subparagraph id="H1BBC93C5156140ABAD2BD154BD656F0B"><enum>(I)</enum><header>Reports</header><text>Each organization entering into a cooperative agreement under this section shall submit a performance report to the Secretary at such time as shall be reasonably required by the Secretary. Such performance report shall describe activities that have been carried out with the funds made available through the agreement and the effectiveness of such activities, and provide such additional information as the Secretary may reasonably require. The Secretary shall make the evaluations received under this subparagraph publicly available on the Department of Health and Human Services internet website, and shall submit such reports to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Education and Labor of the House of Representatives.</text></subparagraph></paragraph></subsection>
<subsection id="H1D28ECF280E548BEB4D4AD3F94C95F3D"><enum>(c)</enum><header>Grants to expand community-Based primary prevention</header>
<paragraph id="H13F8E0A828D64EC4842BC39E87B32008"><enum>(1)</enum><header>Program</header><text>The Secretary shall establish a grant program to expand the capacity of communities and systems to engage in effective prevention efforts.</text></paragraph> <paragraph id="H24A1F3CA22DA4F95A9739E9B7BE732DA"><enum>(2)</enum><header>Grants</header><text>The Secretary may award grants to eligible entities through the program established under paragraph (1) for periods of not more than 4 years. If the Secretary determines that an entity has received such a grant and been successful in meeting the objectives of the grant application so submitted, the Secretary may renew the grant for 1 additional period of not more than 4 years.</text></paragraph>
<paragraph id="H5B16ABA5D5A74E3F95A155CA04686645"><enum>(3)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under this section, an entity shall—</text> <subparagraph id="H8ED41B506E2B4DA896413DF204BC3A51"><enum>(A)</enum><text>be a private nonprofit, nongovernmental organization (which may include faith-based and charitable organizations) or a Tribal organization that is—</text>
<clause id="HE690DCB1845B4DCA8BFE90F29F829C7E"><enum>(i)</enum><text>a community-based organization whose primary purpose is providing culturally specific services to racial and ethnic minority groups or other underserved populations; or</text></clause> <clause id="HA56B91E96D554FB5A272FFB962DBF396"><enum>(ii)</enum><text>a community-based organization with a program focused on serving youth or serving children and their parents or caregivers; and</text></clause></subparagraph>
<subparagraph id="H10FCE9B3AF1B4702BB58E1707C553736"><enum>(B)</enum><text>have a demonstrated record of serving victims of family violence, domestic violence, or dating violence, or demonstrate a partnership with another organization that has such a record.</text></subparagraph></paragraph> <paragraph id="H150B402175594D4FAB98781B3F4E8C96"><enum>(4)</enum><header>Application</header><text>An entity seeking a grant under this subsection shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may reasonably require, including—</text>
<subparagraph id="H8A3FB1F7B3094BD587ED4901F5340F5B"><enum>(A)</enum><text>a description of how the entity will develop, expand, or replicate evidence-informed primary prevention strategies and approaches in their communities, including culturally appropriate prevention programming;</text></subparagraph> <subparagraph id="HFDF129173A4B4BDFA71CCEEBF2B3C605"><enum>(B)</enum><text>documents that the entity meets all of the applicable requirements set forth in this subsection; and</text></subparagraph>
<subparagraph id="HAB4BC50C6B664D1F948C4A49A96F96E1"><enum>(C)</enum><text>demonstrates the ability to conduct appropriately the prevention activities described in this section.</text></subparagraph></paragraph> <paragraph id="H98F05F3EB2384F948233DECD1E68C1C0"><enum>(5)</enum><header>Use of funds</header><text>An entity that receives a grant under this section shall use the grant funds to—</text>
<subparagraph id="H607B7FF562E348FA90FC0128D6FF59C8"><enum>(A)</enum><text>build their organizational capacity and enhance their leadership of the organization within the community to promote community engagement in and advancement of evidence-informed primary prevention of family violence, domestic violence, or dating violence;</text></subparagraph> <subparagraph id="H2403DF741F124631B914ED3658BF140F"><enum>(B)</enum><text>promote strategic prevention partnership development, including between any of domestic violence programs and health programs, early childhood programs, economic support programs, schools, child welfare programs, workforce development, culturally specific community-based organizations, faith-based programs, and youth programs;</text></subparagraph>
<subparagraph id="H2A59EAAD576C488593A7D6CCB9BA0E9D"><enum>(C)</enum><text>support dissemination of prevention strategies and approaches through States, territories, Tribes, and Tribal organizations; and</text></subparagraph> <subparagraph commented="no" id="H2EAF2BB84FF54EA080491331437EB00C"><enum>(D)</enum><text>use up to 5 percent of funds awarded under this section to procure technical assistance from a list of providers approved by the Secretary, from peer-to-peer technical assistance from other grantees under this section, or from both.</text></subparagraph></paragraph>
<paragraph id="H05369C56AF074FDE8E1011206ADC6D2A"><enum>(6)</enum><header>Reports and evaluation</header><text>Each entity receiving a grant under this section shall submit a performance report to the Secretary at such time as shall be reasonably required by the Secretary. Such performance report shall describe the activities that have been carried out with such grant funds, contain an evaluation of the effectiveness of such activities, and provide such additional information as the Secretary may reasonably require.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H9A053885196244EDB6A3966A89AFDF09"><enum>18.</enum><header>Additional grant programs</header><text display-inline="no-display-inline">The Family Violence Prevention and Services Act (<external-xref legal-doc="usc" parsable-cite="usc/42/10401">42 U.S.C. 10401</external-xref> et seq.) is amended by adding at the end the following:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H5A46279168CF4ECA8CFDB6A46E6641EA">
<section id="H38791D4EC26D415FAEF01E3CEE1C0372"><enum>315.</enum><header>Grants for underserved populations</header>
<subsection id="HC047156254C04317A2D6D1423D45BFA8"><enum>(a)</enum><header>Purpose</header><text>It is the purpose of this section to provide grants to assist communities in mobilizing and organizing resources in support of effective and sustainable programs that will prevent and address domestic violence experienced by underserved populations.</text></subsection> <subsection id="H64594C2EB276468F8FA67D38A091EF66"><enum>(b)</enum><header>Authority to award grants</header><text>The Secretary, acting through the Director of the Division of Family Violence Prevention and Services, shall award capacity building, implementation, and evaluation grants to eligible entities to assist in developing, implementing, and evaluating culturally and linguistically appropriate, community-driven strategies to prevent and address domestic violence in underserved populations.</text></subsection>
<subsection id="HE1EF408130BB48A783D4F8B97D644F02"><enum>(c)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under this section, an entity shall—</text> <paragraph id="HD543C44E01EC48E689D5C72EE72C7C27"><enum>(1)</enum><text>with respect to the programs under subsections (d) and (e), be—</text>
<subparagraph id="H4B78C8EA5FD64FDEBED82DFE15B35EBD"><enum>(A)</enum><text>a population specific organization that has demonstrated experience and expertise in providing population specific services in the relevant underserved communities, or a population specific organization working in partnership with a victim service provider or domestic violence or sexual assault coalition; or</text></subparagraph> <subparagraph id="H590D71D4CF91468FAA88C4864F3DBF03"><enum>(B)</enum><text>a victim service provider offering population-specific services for a specific underserved population; or</text></subparagraph></paragraph>
<paragraph id="H3B21D2458DBA47D3BD7CF0596D6045AF"><enum>(2)</enum><text>with respect to the program under subsection (f), be an eligible entity described in paragraph (1) that is working in collaboration with an entity specializing in evaluation with documented experience working with targeted underserved populations;</text></paragraph></subsection> <subsection id="H8C01069064F54BCBA8F3749274908B0B"><enum>(d)</enum><header>Capacity building grants</header> <paragraph id="HC370EDB12CD34B7FB8BC8DE47EB0F867"><enum>(1)</enum><header>In general</header><text>The Secretary shall award grants to eligible entities to support the capacity building, planning, and development of programs for underserved communities that utilize community-driven intervention and prevention strategies that address the barriers to domestic violence services, raise awareness of domestic violence, and promote community engagement in the prevention of domestic violence in targeted underserved populations. Such grants may be used to—</text>
<subparagraph id="HD23BE8E3E5724CE5BA042E928E660F9A"><enum>(A)</enum>
<clause commented="no" display-inline="yes-display-inline" id="H3F4F5B36E1F449C788244071C7CFF400"><enum>(i)</enum><text display-inline="yes-display-inline">expand the collaboration with community partners who can provide appropriate assistance to the targeted underserved populations; and</text></clause> <clause id="HBF49A5BC3775411C8DDDD6196626597D" indent="up1"><enum>(ii)</enum><text>establish linkages with national, State, Tribal, or local public and private partners, which may include community health workers, advocacy, and policy organizations;</text></clause></subparagraph>
<subparagraph id="H4535D4716E404B9DBA782E646CB6EDB6"><enum>(B)</enum><text>establish community working groups;</text></subparagraph> <subparagraph id="H533F91D1BFC648A1AC3A21025E75E876"><enum>(C)</enum><text>conduct a needs assessment of targeted underserved populations to determine the barriers to access and factors contributing to such barriers, using input from targeted underserved communities;</text></subparagraph>
<subparagraph id="H36C648DB98DF4FE5A98449BF08BD7BBE"><enum>(D)</enum><text>participate in training and technical assistance sponsored by the Family Violence Prevention and Services program for program development, implementation, evaluation, and other programmatic issues;</text></subparagraph> <subparagraph id="H1938B0198816444C93584C78AB343A27"><enum>(E)</enum><text>use up to 5 percent of funds awarded under this subsection to procure technical assistance from a list of providers approved by the Family Violence Prevention and Services program;</text></subparagraph>
<subparagraph id="HBECB583F78C1400BA2705955F5890762"><enum>(F)</enum><text>identify promising intervention and prevention strategies;</text></subparagraph> <subparagraph id="H91F56F7F796146288BD679C6D4310139"><enum>(G)</enum><text>develop a plan with the input of targeted underserved communities that includes strategies for—</text>
<clause id="H828A46FE0B674DDAA14AA7D1BE37D653"><enum>(i)</enum><text>implementing intervention and prevention strategies that have the greatest potential for addressing the barriers to accessing services, raising awareness of domestic violence, and promoting community engagement in the prevention of domestic violence within targeted underserved populations;</text></clause> <clause id="HEFBF107E75424A16BB6E4345371DD895"><enum>(ii)</enum><text>identifying other sources of revenue and integrating current and proposed funding sources to ensure long-term sustainability of the program; and</text></clause>
<clause id="HE9C048102D6F4148AA1BFF82D9264245"><enum>(iii)</enum><text>conducting evaluation, including collecting data and measuring progress toward addressing domestic violence or raising awareness of domestic violence in targeted underserved populations; and</text></clause></subparagraph> <subparagraph id="H017C25B259E64D8DAFAD97E16357DD37"><enum>(H)</enum><text>conduct an evaluation of the planning and development activities.</text></subparagraph></paragraph>
<paragraph id="H80E3DE767DF14025B42F99D09C817607"><enum>(2)</enum><header>Duration</header><text>The period during which payments may be made under a grant under paragraph (1) shall not exceed 2 years, except where the Secretary determines that extraordinary circumstances exist.</text></paragraph></subsection> <subsection id="H727BA2FA553340D5BBCA47D141D36BA7"><enum>(e)</enum><header>Implementation grants</header> <paragraph id="HDBC2617B6EC842C997AEF4D3F126CBF5"><enum>(1)</enum><header>In general</header><text>The Secretary shall award grants to eligible entities that have received a planning grant under subsection (d) or who already have demonstrated experience and expertise in providing population specific services in the relevant underserved communities to enable such entities to—</text>
<subparagraph id="H37654EB660D24F1D8A708591313C2CF8"><enum>(A)</enum><text>implement a plan including intervention services or prevention strategies to address the identified barrier or awareness issue or initiate the community engagement strategy for targeted underserved populations, in an effective and timely manner;</text></subparagraph> <subparagraph id="HF5CF339B1F5F441E8F5C540900FFEAA5"><enum>(B)</enum><text>collect data appropriate for monitoring and evaluating the program carried out under the grant;</text></subparagraph>
<subparagraph id="H8A76BF58B8DE410CB81DF2B5AAF7D73F"><enum>(C)</enum><text>analyze and interpret data, or collaborate with academic or other appropriate institutions, for such analysis and collection;</text></subparagraph> <subparagraph id="H6979F617495C4DEAB3C815DCBCE85AF0"><enum>(D)</enum><text>participate in training for the purpose of informing and educating other entities regarding the experiences and lessons learned from the project;</text></subparagraph>
<subparagraph id="H75C3DCB8CA9D40D59B81C211C025F21C"><enum>(E)</enum><text>collaborate with appropriate partners to disseminate information gained from the project for the benefit of other domestic violence programs;</text></subparagraph> <subparagraph id="HB6D4EE56046F4F3280EBCE2578181B8E"><enum>(F)</enum><text>establish mechanisms with other public or private groups to maintain financial support for the program after the grant terminates;</text></subparagraph>
<subparagraph id="HD0F33232115243719F8AD3FFE0957AA4"><enum>(G)</enum><text>develop policy initiatives for systems change to address the barriers or awareness issue;</text></subparagraph> <subparagraph id="H749AD5D67A3041F191847FD1F610417D"><enum>(H)</enum><text display-inline="yes-display-inline">develop and implement community engagement strategies;</text></subparagraph>
<subparagraph id="H9E36ED8BD1EB465DA805F884B0BBFE64"><enum>(I)</enum><text>maintain relationships with local partners and continue to develop new relationships with national and State partners;</text></subparagraph> <subparagraph id="H13DEDE78C9F24DB4B1553D3763713873"><enum>(J)</enum><text>evaluate the implementation of the activities described in this paragraph; and</text></subparagraph>
<subparagraph id="H2E44694C83AE4884B2E8759663B79877"><enum>(K)</enum><text>use up to 5 percent of funds awarded under this subsection to procure technical assistance from a list of providers approved by the Family Violence Prevention and Services program.</text></subparagraph></paragraph> <paragraph id="HA5EC05FA9E1A43DCA3D99B7AFDE99242"><enum>(2)</enum><header>Duration</header><text>The Secretary shall award grants under this subsection for 3-year periods.</text></paragraph></subsection>
<subsection id="H18CE0F5ECB6B4FEBBE5D03C6888802F3"><enum>(f)</enum><header>Evaluation grants</header>
<paragraph id="H6EB377EE75E14E018CA35282D03B531B"><enum>(1)</enum><header>In general</header><text>The Secretary may award grants to eligible entities that have received an implementation grant under subsection (e) and that require additional assistance for the purpose of rigorous data analysis, program evaluation (including process and outcome measures), or dissemination of findings.</text></paragraph> <paragraph id="HFFBB85EAB2CF488DAAB9F6006F00E7FD"><enum>(2)</enum><header>Priority</header><text>In awarding grants under this subsection, the Secretary shall give priority to—</text>
<subparagraph id="H96E14F4F7DBD4C0787683693E6D91D77"><enum>(A)</enum><text>entities that in previous funding cycles—</text> <clause commented="no" id="HEA2AE75F219043D295B0E30DA79509F8"><enum>(i)</enum><text>have received a grant under subsection (d); or</text></clause>
<clause id="H56043BA8B7F34ECB9D3473CD9F6A3E0B"><enum>(ii)</enum><text>established population specific organizations that have demonstrated experience and expertise in providing population-specific services in the relevant underserved communities programs; and</text></clause></subparagraph> <subparagraph id="HE8FA1CB9135C4CE087AFDBAA7417FADE"><enum>(B)</enum><text>entities that incorporate best practices or build on successful models in their action plan, including the use of community advocates.</text></subparagraph></paragraph>
<paragraph id="H3D35966C282C41BA92D2DEB38497F9B2"><enum>(3)</enum><header>Duration</header><text>The period during which payments may be made under a grant under paragraph (1) shall not exceed 2 years, except where the Secretary determines that extraordinary circumstances exist.</text></paragraph></subsection> <subsection id="HF2EBAC84C68E408FB8EA15061F1754D7"><enum>(g)</enum><header>Nonsupplantation</header><text>Funds provided under this section shall be used to supplement and not supplant other Federal, State, and local public funds expended to provide services and activities that promote the purposes of this title.</text></subsection>
<subsection id="HED3062EDBB6042AAB1C34EFB467B65C8"><enum>(h)</enum><header>Technical assistance, evaluation, and monitoring</header>
<paragraph id="HE476D1FBA1114EA89B31E674C3ECFDDF"><enum>(1)</enum><header>In general</header><text>Of the funds appropriated under this section for each fiscal year—</text> <subparagraph id="H2F96B37D51764383A3BAE8DA96DD47FE"><enum>(A)</enum><text>up to 5 percent may be used by the Secretary for evaluation, monitoring, and other administrative costs under this section; and</text></subparagraph>
<subparagraph id="HDD586EC9BF3E48299D6DE2FE28CCD3D2"><enum>(B)</enum><text>up to 3 percent may be used by the Secretary for technical assistance.</text></subparagraph></paragraph> <paragraph id="H0483743954D948ECB6CA29A7EDF3F6AF"><enum>(2)</enum><header>Technical assistance provided by grantees</header><text display-inline="yes-display-inline">The Secretary shall enable grantees to share best practices, evaluation results, and reports using the internet, conferences, and other pertinent information regarding the projects funded by this section, including the outreach efforts of the Family Violence Prevention and Services program to underserved programs.</text></paragraph>
<paragraph id="H8F09CBB1C48E4E7094E38609FD8C0D05"><enum>(3)</enum><header>Reports and evaluation</header><text>Each entity receiving funds under this section shall file a performance report at such times as requested by the Secretary describing the activities that have been carried out with such grant funds and providing such additional information as the Secretary may require.</text></paragraph></subsection> <subsection id="H660E67A846014B81906E1F64610AA22A"><enum>(i)</enum><header>Administrative burdens</header><text>The Secretary shall make every effort to minimize duplicative or unnecessary administrative burdens on the grantees.</text></subsection></section>
<section id="H20D3795FD83641518269639E170F68D1"><enum>316.</enum><header>Grants to enhance culturally specific services for racial and ethnic minority populations</header>
<subsection id="HA667459984F54B77A6083C07C645F3E2"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services, acting through the Director of the Division of Family Violence Prevention and Services in the Administration on Children, Youth, and Families (referred to in this section as the <quote>Director</quote>), shall establish a grant program to establish or enhance culturally specific services for victims of domestic violence, dating violence, and family violence from racial and ethnic minority populations.</text></subsection> <subsection id="H61C3B12FA331433CA51112E0F9EF9AF9"><enum>(b)</enum><header>Purposes</header> <paragraph id="H321A2A65ED284BB4AEA067C1FAB22A77"><enum>(1)</enum><header>In general</header><text>The purposes of the grant program under this section are to—</text>
<subparagraph id="HF7A85FFF6B0341D1B157EADE192258A4"><enum>(A)</enum><text>develop and support innovative culturally specific community-based programs to enhance access to shelter services or supportive services to further the purposes of family violence, domestic violence, and dating violence intervention and prevention for all victims of family violence, domestic violence, or dating violence from racial and ethnic minority populations who face obstacles to using more traditional services and resources;</text></subparagraph> <subparagraph id="H41B8F32DDC26400591FE758C20CCF64A"><enum>(B)</enum><text>strengthen the capacity and further the leadership development of individuals in racial and ethnic minority populations to address family violence, domestic violence, and dating violence in their communities; and</text></subparagraph>
<subparagraph id="H18CD5CC2B936446C9F230BE7FA0609AC"><enum>(C)</enum><text>promote strategic partnership development and collaboration, including with health, early childhood programs, economic support programs, schools, child welfare, workforce development, domestic violence programs, other community-based programs, faith-based programs, and youth programs, in order to further a public health approach to addressing domestic violence and dating violence.</text></subparagraph></paragraph> <paragraph id="H660E5B743AAD44D8B6BA0CCEB6AA205B"><enum>(2)</enum><header>Use of funds</header> <subparagraph commented="no" id="H5F00DBC664CF4D22BC382FE210E3183B"><enum>(A)</enum><header>In general</header><text>The Director shall award grants to programs based in the targeted community to establish or enhance domestic violence and dating violence intervention and prevention efforts that address distinctive culturally specific responses to domestic violence and dating violence in racial and ethnic minority populations.</text></subparagraph>
<subparagraph id="H05D346A0BBE5471B8690DA1FD4358A36"><enum>(B)</enum><header>New programs</header><text>In carrying out this section, the Secretary may award initial planning and capacity building grants to eligible entities that are establishing new programs in order to support the planning and development of culturally specific programs.</text></subparagraph> <subparagraph id="H5DFA2167D65E49F0A31CE81BC4ACB93D"><enum>(C)</enum><header>Competitive basis</header><text>The Secretary shall ensure that grants are awarded, to the extent practical, only on a competitive basis, and that a grant is awarded for a proposal only if the proposal has been recommended for such an award through a process of peer review.</text></subparagraph>
<subparagraph id="H82DD07E8429244079AA127A174BA0B47"><enum>(D)</enum><header>Technical assistance</header><text display-inline="yes-display-inline">Up to 5 percent of funds appropriated under this section for a fiscal year shall be available for technical assistance to be used by the grantees to access training and technical assistance from organizations that have entered into a cooperative agreement with the Director to provide training and technical assistance regarding the provision of effective culturally specific, community-based services for racial and ethnic minority populations.</text></subparagraph></paragraph> <paragraph id="H098B88709AC74AB6AEF056AF5ED44380"><enum>(3)</enum><header>Technical assistance and training</header><text display-inline="yes-display-inline">The Director shall enter into cooperative agreements or contracts with organizations having a demonstrated expertise in and whose primary purpose is addressing the development and provision of culturally specific community-based services to victims of domestic violence and dating violence from the targeted populations to provide training and technical assistance for grantees.</text></paragraph></subsection>
<subsection id="HB2FBA3F16CEA4430B09865F6CA2060A4"><enum>(c)</enum><header>Eligible entities</header><text>To be eligible for a grant under this section, an entity shall—</text> <paragraph id="HC39D6C7D1B394C8AA8D7C91334CB3030"><enum>(1)</enum><text>be a private nonprofit, nongovernmental organization that is—</text>
<subparagraph id="H2111BD699B5B457DA7EA905755ADF764"><enum>(A)</enum><text display-inline="yes-display-inline">a community-based organization whose primary purpose is providing culturally specific services to victims of domestic violence and dating violence from racial and ethnic minority populations; or</text></subparagraph> <subparagraph id="HA94A7138CADC4E42B244863C12BFB165"><enum>(B)</enum><text display-inline="yes-display-inline">a community-based organization whose primary purpose is providing culturally specific services to individuals from racial and ethnic minority populations that can partner with an organization having demonstrated expertise in serving victims of domestic violence and dating violence; and</text></subparagraph></paragraph>
<paragraph id="HE13A4317C63D473BAF1E0722266E3AAF"><enum>(2)</enum><text>have a board of directors and staffing which is reflective of the targeted minority group.</text></paragraph></subsection> <subsection id="H180ADA59F7504F29A1290CC638B5F397"><enum>(d)</enum><header>Cultural competency of services</header><text>The Secretary shall ensure that information and services provided pursuant to this section are provided in the language, educational, and cultural context that is most appropriate for the individuals for whom the information and services are intended.</text></subsection>
<subsection id="HA2606E5BA80C44CBA339F850A38AFC84"><enum>(e)</enum><header>Grant period</header><text>The Director shall award grants for a 3-year period, with a possible extension of another 2 years to further implementation of the projects under the grant.</text></subsection> <subsection id="H2AE75E01374D41BEBAFE46A999520E83"><enum>(f)</enum><header>Nonexclusivity</header><text>Nothing in this section shall be interpreted to exclude linguistic and culturally specific community-based entities from applying for other sources of funding available under this title.</text></subsection>
<subsection id="H95D9DD48862C4018A80C438D03091529"><enum>(g)</enum><header>Reports and evaluation</header><text>Each entity receiving funds under this section shall file a performance report at such times as requested by the Secretary describing the activities that have been carried out with such grant funds and providing such additional information as the Secretary may require.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> </legis-body> </bill>
