which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize the Clean School Bus Program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H1F51A67DF97349F384DAE1DBDF799835"><section section-type="section-one" id="HA2FE49F7125E4CC4967DA6359E1914C8"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Commute for Kids Act of 2021</short-title></quote>.</text></section><section id="HF8EE93A613EC40B3AC57F57CD5D0E274"><enum>2.</enum><header>Clean School Bus Program</header><subsection id="H44A010C0ABE1467C96F79E2D4B83EC00"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 741 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16091">42 U.S.C. 16091</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H65F1EB96C30D47AF80C2904406997F3B"><section id="H5B965212DF3242388BD893022E894805"><enum>741.</enum><header>Clean School Bus Program</header><subsection id="H07A0F3BD030F4E3D8FAF9798ABDF49B9"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H993A0480F6A94B499DBE2656AC0E9357"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="id2A720978050C4E668DBB16528A9F3FB2"><enum>(2)</enum><header>Clean school bus</header><text>The term <term>clean school bus</term> means a school bus with a drivetrain that produces, under any possible operational mode or condition, zero exhaust emissions of—</text><subparagraph id="id2E202F0FBCE04AD9BE492DE4583AB672"><enum>(A)</enum><text>any air pollutant that is listed pursuant to section 108(a) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7408">42 U.S.C. 7408(a)</external-xref>) (or any precursor to such an air pollutant); and</text></subparagraph><subparagraph id="id85CE7415755F457A880427E14CABA56B"><enum>(B)</enum><text>any greenhouse gas. </text></subparagraph></paragraph><paragraph id="HF55EA8C9913C456C8B50A866880F19C2"><enum>(3)</enum><header>Community of color</header><text>The term <term>community of color</term> means any geographically distinct area the population of color of which is higher than the average population of color of the State in which the community is located.</text></paragraph><paragraph commented="no" id="HB41367BC5A3A4D078BEE18D0B5204248"><enum>(4)</enum><header>Eligible contractor</header><text display-inline="yes-display-inline">The term <term>eligible contractor</term> means a contractor that is a for-profit, not-for-profit, or nonprofit entity that has the capacity—</text><subparagraph commented="no" id="H48C0C2504609465E988AB2B3AE2B0CFD"><enum>(A)</enum><text>to sell clean school buses, or charging or other equipment needed to charge or maintain clean school buses, to individuals or entities that own a school bus or fleet of school buses; or</text></subparagraph><subparagraph commented="no" id="HE1A99284A8714B24961DDD5BC8E88066"><enum>(B)</enum><text display-inline="yes-display-inline">to arrange financing for a sale described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="H293216681FDC4A69834863293F3E1087"><enum>(5)</enum><header>Eligible recipient</header><subparagraph id="H32CD1E8FC9E94DC185C5A4EC8FBB3DA2"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the term <term>eligible recipient</term> means—</text><clause id="HAB2D8F00C00C4FBAA4E9DAFBB4678BE4"><enum>(i)</enum><text>1 or more local or State governmental entities responsible for—</text><subclause id="H170B5722A15447369CD39DDB32B2C7AD"><enum>(I)</enum><text>providing school bus service to 1 or more public school systems; or</text></subclause><subclause id="H09F417B6521C4513B90E84D28529C029"><enum>(II)</enum><text>the purchase of school buses;</text></subclause></clause><clause id="H041495226C98405CBB5B36E6C568FFE3"><enum>(ii)</enum><text>a tribally controlled school (as defined in section 5212 of the Tribally Controlled Schools Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/25/2511">25 U.S.C. 2511</external-xref>));</text></clause><clause id="H7E0BEBE6E6024106BF3554A87CE4FA10"><enum>(iii)</enum><text>a nonprofit school transportation association; or</text></clause><clause id="HF5B6CA56A6654122B81C83BCE9D1CFCC"><enum>(iv)</enum><text>1 or more contracting entities that provide school bus service to 1 or more public school systems.</text></clause></subparagraph><subparagraph id="HAFADFC9250BE462CB63DB6DB7CCD41F8"><enum>(B)</enum><header>Special requirements</header><text>In the case of eligible recipients described in clauses (iii) and (iv) of subparagraph (A), the Administrator—</text><clause id="id68E4E07543434170BD4B09D3D67384DC"><enum>(i)</enum><text>shall establish timely and appropriate requirements for notice to the public school systems that would be served by school buses purchased using an award under subsection (b)(1); and</text></clause><clause id="idED727BA3B00649A88F523EBE9E6321D7"><enum>(ii)</enum><text>may establish timely and appropriate requirements for approval by the public school systems that would be served by school buses purchased using an award under subsection (b)(1).</text></clause></subparagraph></paragraph><paragraph id="HECE60BA855D149D0AB230EDC6C2818C5"><enum>(6)</enum><header>Indigenous community</header><text>The term <term>indigenous community</term> means—</text><subparagraph id="H17F4C603FF144AC1BF5AD9A5C1F8EECC"><enum>(A)</enum><text>a federally recognized Indian Tribe;</text></subparagraph><subparagraph id="H3241DCED4D984B7D97C5BC38FF1D0D0F"><enum>(B)</enum><text>a State-recognized Indian Tribe;</text></subparagraph><subparagraph id="HBF4C94905B5349AB8B1A0B18A63BA61E"><enum>(C)</enum><text>an Alaska Native or Native Hawaiian community or organization; or</text></subparagraph><subparagraph id="H11BAC31951474893BBAEDB67AEB8AF1F"><enum>(D)</enum><text>any other community of indigenous people, including communities in other countries.</text></subparagraph></paragraph><paragraph id="H1772FFBD81CD42D593BC69884CD06ED8"><enum>(7)</enum><header>Low income</header><text>The term <term>low income</term> means an annual household income equal to, or less than, the greater of—</text><subparagraph id="H4F9293FBCF8D44AF916B551EAD24E34B"><enum>(A)</enum><text>an amount equal to 80 percent of the median income of the area in which the household is located, as reported by the Department of Housing and Urban Development; and</text></subparagraph><subparagraph id="HC9E483D3BA0942C9A83F8D55AABBBD3F"><enum>(B)</enum><text>200 percent of the Federal poverty line.</text></subparagraph></paragraph><paragraph id="HEF6982650CA34F06AA3207BB4BE1681A"><enum>(8)</enum><header>Low-income community</header><text>The term <term>low-income community</term> means any census block group in which 30 percent or more of the population are individuals with low income.</text></paragraph><paragraph id="H474DA56A4AAA46E891B419E7EABE5D36"><enum>(9)</enum><header>School bus</header><text>The term <term>school bus</term> has the meaning given the term <term>schoolbus</term> in section 30125(a) of title 49, United States Code.</text></paragraph><paragraph id="H6F1C826C52054AC988E773188C2DDC55"><enum>(10)</enum><header>Scrap</header><subparagraph id="H9B0F48D100374A51B41184AADF3A25FB"><enum>(A)</enum><header>In general</header><text>The term <term>scrap</term>, with respect to a school bus engine replaced using an award under subsection (b)(1), means to recycle, crush, or shred the engine within such period and in such manner as determined by the Administrator.</text></subparagraph><subparagraph id="HFD7BF2343373490EA54184435FE8B6A3"><enum>(B)</enum><header>Exclusion</header><text>The term <term>scrap</term> does not include selling, leasing, exchanging, or otherwise disposing of an engine described in subparagraph (A) for use in another motor vehicle in any location.</text></subparagraph></paragraph></subsection><subsection id="H3BD42B73A5404DC8B899250963802790"><enum>(b)</enum><header>Program for replacement of existing school buses with clean school buses</header><paragraph id="H1A7955B7DD7349C4929701BF102E9E90"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Administrator, in consultation with the Secretary, shall establish a program for—</text><subparagraph id="H45A3B2E117094399ACB4573165D874B3"><enum>(A)</enum><text>making awards, on a competitive basis, of grants, rebates, and low-cost revolving loans to eligible recipients for the replacement of existing school buses that are not clean school buses with clean school buses; and </text></subparagraph><subparagraph id="HAB9D1193AB9C44499BB75AD3064BF9E7"><enum>(B)</enum><text>making awards of contracts to eligible contractors for providing rebates and low-cost revolving loans for the replacement of existing school buses that are not clean school buses with clean school buses.</text></subparagraph></paragraph><paragraph id="H4696CCC24B6043968F00A5A1DC6FFAA6"><enum>(2)</enum><header>Applications</header><subparagraph id="idD8EB7F373A0347E8AA215993D30E85C4"><enum>(A)</enum><header>In general</header><text>An applicant for an award under paragraph (1) shall submit to the Administrator an application at such time, in such manner, and containing such information as the Administrator may require, including—</text><clause id="H5295E2536B4045D3A857330EFA47463C"><enum>(i)</enum><text>a written assurance that—</text><subclause id="HD25C8A6E732442B49E192EDCD885DCFE"><enum>(I)</enum><text>all laborers and mechanics employed by contractors or subcontractors during construction, alteration, or repair, or at any manufacturing operation, that is financed, in whole or in part, by an award under paragraph (1), shall be paid wages at rates not less than those prevailing in a similar firm or on similar construction in the locality, as determined by the Secretary of Labor in accordance with subchapter IV of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/31">chapter 31</external-xref> of title 40, United States Code; and</text></subclause><subclause id="idAD5627AECD89419DBEC4FADE2C56F1B9"><enum>(II)</enum><text>the applicant agrees to the authority of the Secretary of Labor described in subparagraph (B);</text></subclause></clause><clause id="HA0F270B432C44687B0E1DD78053585E3"><enum>(ii)</enum><text>a certification that no public work or service normally performed by a public employee will be privatized or subcontracted in carrying out a project funded by the award;</text></clause><clause id="HF09A53346F644220A4699B491DB872CF"><enum>(iii)</enum><text>to ensure a fair assessment of workforce impact related to an award under paragraph (1), a detailed accounting with respect to relevant employees, including employees in each of management, administration, operations, and maintenance, of the eligible recipient at the time of the application, including—</text><subclause id="H963B20F199D64D4991D78A77D0ACC01A"><enum>(I)</enum><text>the number of employees, organized by salary;</text></subclause><subclause id="H4D19FAD0BC0D4F05BB700E75235DC6DE"><enum>(II)</enum><text>the bargaining unit status of each employee;</text></subclause><subclause id="H195AD95225BE4F38AC0CC27D57637B7F"><enum>(III)</enum><text>the full-time or part-time status of each employee; and</text></subclause><subclause id="HA0688522D9FD47898A016B7CE486F0D8"><enum>(IV)</enum><text>the job title of each employee; and</text></subclause></clause><clause id="H6B1E98E1C8014600A619626FC1A2B80A"><enum>(iv)</enum><text display-inline="yes-display-inline">a description of coordination and advance planning with the local electricity provider.</text></clause></subparagraph><subparagraph id="idB152EFB0EC114698ACB27DD99CB79A58"><enum>(B)</enum><header>Authority of Secretary of Labor</header><text>For any project or activity carried out by a recipient of an award under paragraph (1), the Secretary of Labor shall, with respect to the labor standards described in subparagraph (A)(i)(I), have the authority and functions set forth in Reorganization Plan Numbered 14 of 1950 (64 Stat. 1267; 5 U.S.C. App.) and section 3145 of title 40, United States Code.</text></subparagraph></paragraph><paragraph id="H7A3D334EEF2E47F999C6FD826291F726"><enum>(3)</enum><header>Eligible manufacturers</header><subparagraph id="H8661BA01A52B46C48D8873721C7FACA4"><enum>(A)</enum><header>In general</header><text>The Administrator shall maintain and make publicly available a list of manufacturers of clean school buses from whom recipients of awards under paragraph (1) may purchase clean school buses.</text></subparagraph><subparagraph id="H5A07FFF2C150462DA0B58C4A65502BD4"><enum>(B)</enum><header>Criteria</header><text>The Administrator shall establish a process by which manufacturers may seek inclusion on the list established under subparagraph (A), which shall include the submission of such information as the Administrator may require, including—</text><clause id="H3C53684E52D54F929EEFF3BB8A407245"><enum>(i)</enum><text>a disclosure of whether there has been any administrative merits determination, arbitral award or decision, or civil judgment, as defined in guidance issued by the Secretary of Labor, rendered against the manufacturer in the preceding 3 years for violations of applicable labor, employment, civil rights, or health and safety laws; and</text></clause><clause id="HB7E6FB4E8B3F496B88BCD20151C50E73"><enum>(ii)</enum><text>specific information regarding—</text><subclause id="idD1EA5A1F16CA40E4BB11D18A9A52AC27"><enum>(I)</enum><text>the actions the manufacturer will take to demonstrate compliance with and, where possible, exceedance of, requirements under applicable labor, employment, civil rights, and health and safety laws; and </text></subclause><subclause id="id894EDD03B60644CC853065DD31972364"><enum>(II)</enum><text>actions the manufacturer will take to ensure that the direct suppliers of the manufacturer demonstrate compliance with applicable labor, employment, civil rights, and health and safety laws.</text></subclause></clause></subparagraph></paragraph><paragraph id="H8C9840B6AA78475AA200A98C39AFBBCD"><enum>(4)</enum><header>Priority of applications</header><subparagraph id="HFEB66359C65C4FA28951B606545AB24A"><enum>(A)</enum><header>Highest priority</header><text display-inline="yes-display-inline">In making awards under paragraph (1), the Administrator shall give highest priority to applicants that propose to replace school buses that serve the highest number of students (measured in absolute numbers or in the percentage of student population) who are eligible for free or reduced price lunches under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751</external-xref> et seq.).</text></subparagraph><subparagraph id="H7B9E542FB4A84B3AA6B1A2964D232716"><enum>(B)</enum><header>Additional priority</header><text display-inline="yes-display-inline">In making awards under paragraph (1), after taking into account the priority described in subparagraph (A), the Administrator shall give priority to applicants that propose to complement the assistance received through the award by securing additional sources of funding for the activities supported through the award, such as through— </text><clause id="H5B59F4E928E74E4A8690FC0B058F5035"><enum>(i)</enum><text>public-private partnerships with electric companies; </text></clause><clause id="H86964E06E03343EBBBE39AAA52639DFB"><enum>(ii)</enum><text>grants from other entities; or </text></clause><clause id="H6EA99DC765324B18A69DF9CA9409A80A"><enum>(iii)</enum><text>the issuance of school bonds.</text></clause></subparagraph></paragraph><paragraph id="HF739349DF8E549FE8F4F34E07BF5C8DE"><enum>(5)</enum><header>Use of school bus fleet</header><text>All clean school buses purchased with an award under paragraph (1) shall—</text><subparagraph id="H63DA81D48A9449A8BE932D3B6C3F5DC4"><enum>(A)</enum><text>be operated as part of the school bus fleet for which the award was made for not less than 5 years;</text></subparagraph><subparagraph id="HA3D36345C00C4094BB2784CB0D022C64"><enum>(B)</enum><text>be maintained, operated, charged, and fueled according to manufacturer recommendations or State requirements; and</text></subparagraph><subparagraph id="H6FB75B2434B340B9B9F440C0580886D0"><enum>(C)</enum><text>not be manufactured or retrofitted with, or otherwise have installed, a power unit or other technology that creates air pollution within the school bus, such as an unvented diesel passenger heater.</text></subparagraph></paragraph><paragraph id="H65ED0A6209154C6783A4EDCAB9A78341"><enum>(6)</enum><header>Awards</header><subparagraph id="id0D0BC1C883B24349A4644FCBDCE5E941"><enum>(A)</enum><header>Award amount</header><clause id="idEBB71B62620447EA86B7DA785C0D9368"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii) and subparagraph (D), the Administrator may make an award under paragraph (1) in an amount not more than the amount that is 100 percent of the replacement costs for clean school buses.</text></clause><clause id="id2C9C4016DB334D288213C80335E0EEC4"><enum>(ii)</enum><header>Limitation</header><text>The replacement costs described in clause (i) shall not exceed an amount equal to 110 percent of the difference between—</text><subclause id="idAF720461F0A042B7807FB06A9D34A872"><enum>(I)</enum><text>the cost of a clean school bus; and</text></subclause><subclause id="idF10B63CBD7E04552829EBE7F8F1F85E2"><enum>(II)</enum><text>the cost of a diesel school bus.</text></subclause></clause></subparagraph><subparagraph id="HCD77D5F4355F4E1A80B4C82C3867BE66"><enum>(B)</enum><header>Structuring awards</header><text display-inline="yes-display-inline">In making an award under paragraph (1)(A), the Administrator shall decide whether to award a grant, rebate, or low-cost revolving loan, or a combination thereof, based primarily on—</text><clause id="H478663E7876747DE99CCB3C7F6229860"><enum>(i)</enum><text>how best to facilitate replacing existing school buses that are not clean school buses with clean school buses; and</text></clause><clause id="HA2B3DC22514D46AB908197318303D778"><enum>(ii)</enum><text>the preference of the eligible recipient.</text></clause></subparagraph><subparagraph id="HD4F46E46CC3444FF86112D8F91FEAE27"><enum>(C)</enum><header>Included costs</header><text>An award under paragraph (1) may be used to pay for—</text><clause id="HA2A2777FBFB049E9B54EFA2F77FEA357"><enum>(i)</enum><text>acquisition and labor costs for charging or other infrastructure needed to charge or maintain clean school buses;</text></clause><clause id="H84E3F4713AA441E1BA9D3CEE4DEBBE26"><enum>(ii)</enum><text>workforce development and training to support the maintenance, charging, and operations of electric school buses; and</text></clause><clause id="HC8E46A2A2D53413B8AFF5DC85EB1705E"><enum>(iii)</enum><text>planning and technical activities to support the adoption and deployment of clean school buses.</text></clause></subparagraph><subparagraph id="HE46AA70CC3BF44688AFD5FAAF0373B08"><enum>(D)</enum><header>Exception for contracting entities</header><clause id="id1AA4C73F9B6C43ABACAF1F2CADE7BC3E"><enum>(i)</enum><header>In general</header><text>Subject to clause (ii), in the case of an award under paragraph (1) to an eligible recipient described in subsection (a)(5)(A)(iv), the Administrator may make an award for up to 70 percent of the replacement costs for clean school buses.</text></clause><clause id="idE178DA63D74647E28B88F70EC79DD06A"><enum>(ii)</enum><header>Exception</header><text>If an eligible recipient described in subsection (a)(5)(A)(iv) demonstrates, to the satisfaction of the Administrator, that the labor standards of the eligible recipient are equal to or exceed those of the public school system that would be served by the clean school buses purchased with an award under paragraph (1), the Administrator may make an award to the eligible recipient for up to 90 percent of the replacement costs for clean school buses.</text></clause></subparagraph><subparagraph id="H7B6461E3ED4D4A7DA74F6B659C53E44B"><enum>(E)</enum><header>Requirements</header><text>The Administrator shall require, as a condition of receiving an award under paragraph (1), that an award recipient—</text><clause id="H00702C2E301E4DC695A41DE2920ACFF7"><enum>(i)</enum><text>does not, as a result of receiving the award—</text><subclause id="HCAD08EDA5AA947FD954C79C1118E42E8"><enum>(I)</enum><text>lay off, transfer, or demote any current employee; or</text></subclause><subclause id="H39AD8ED560F9423E842F5D717A081C66"><enum>(II)</enum><text>reduce the salary or benefits of any current employee or worsen the conditions of work of any current employee; and</text></subclause></clause><clause id="HFA2C374D0BF1467DA7075A590D31393E"><enum>(ii)</enum><text>provides current employees with training to effectively operate, maintain, or otherwise adapt to new technologies relating to clean school buses.</text></clause></subparagraph><subparagraph id="HD8D82D43BC5E451196A5E21A17590AFF"><enum>(F)</enum><header>Buy America</header><clause id="H6F08848DE7EE4F5BAFB0E319BC75C0CA"><enum>(i)</enum><header>In general</header><text>Except as provided in clause (ii), any clean school bus or electric vehicle supply equipment purchased using an award under paragraph (1) shall comply with section 5323(j) of title 49, United States Code.</text></clause><clause id="H6EC6264398A0446EB849FE705B99E591"><enum>(ii)</enum><header>Exceptions</header><subclause id="HB86CF88909FE48BFB9EDEB76949F8E24"><enum>(I)</enum><header>Waiver</header><text>Subject to subclause (II), the Administrator may provide a waiver to the requirements described in clause (i) in the same manner and to the same extent as the Secretary of Transportation may provide a waiver under section 5323(j)(2) of title 49, United States Code.</text></subclause><subclause id="H0A0208AA35B64D71A427D10EBB29CCA8"><enum>(II)</enum><header>Percentage of components and subcomponents</header><text>The Administrator may grant a waiver in accordance with section 5323(j)(2)(C) of title 49, United States Code, when an award recipient purchases a clean school bus or electric vehicle supply equipment using an award under paragraph (1) for which the cost of components and subcomponents produced in the United States—</text><item id="H3705D2E7D759400BBC22EEC143A9C446"><enum>(aa)</enum><text>for each of fiscal years 2021 through 2025, is more than 60 percent of the cost of all components of the clean school bus; and</text></item><item id="HB4D37BE651B84EE4A331E469126D9AA4"><enum>(bb)</enum><text>for fiscal year 2025 and each fiscal year thereafter, is more than 70 percent of the cost of all components of the clean school bus.</text></item></subclause></clause></subparagraph></paragraph><paragraph id="H25E9A93D64F549F4BB5785834C94A835"><enum>(7)</enum><header>Deployment and distribution</header><text>The Administrator shall—</text><subparagraph id="H5577F2595F994B0A850120611FAC9887"><enum>(A)</enum><text>to the maximum extent practicable, achieve nationwide deployment of clean school buses through the program under paragraph (1);</text></subparagraph><subparagraph id="HFF86FA1FF9364AF488B67A8A67961937"><enum>(B)</enum><text>ensure, as practicable, a broad geographic distribution of awards under paragraph (1) each fiscal year;</text></subparagraph><subparagraph id="HDE13E8270C8C476EA0D8BA5ECBA227F2"><enum>(C)</enum><text>solicit early applications for large-scale deployments and, as soon as reasonably practicable, make awards for at least 1 such large scale deployment in a rural location and another in an urban location, on the condition that each such award recipient—</text><clause id="H5019D5E4FD07409DA98B7356C56D474F"><enum>(i)</enum><text>participate in the development of best practices, lessons learned, and other information sharing to guide the implementation of the program under paragraph (1), including relating to building out associated infrastructure; and</text></clause><clause id="H3D2EF3F351F14E4B9388B908257E06A8"><enum>(ii)</enum><text> cooperate as specified in subparagraph (D); and</text></clause></subparagraph><subparagraph id="HC910F9C22D094CE196FD58AD157013D5"><enum>(D)</enum><text>develop, in cooperation with award recipients, resources for future recipients of awards under paragraph (1).</text></subparagraph></paragraph><paragraph id="H96B7E32A6FD240AFA0EF38DAF01C1742"><enum>(8)</enum><header>Scrappage</header><subparagraph id="H96D74D02D01046C79527D3E6E2BBF7C3"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Administrator shall require an award recipient to verify, not later than 1 year after receiving a clean school bus purchased using an award under paragraph (1), that the engine of the replaced school bus has been scrapped.</text></subparagraph><subparagraph id="H4F5D3C9C236842AD8D133A5788C75EFE"><enum>(B)</enum><header>Exception</header><text display-inline="yes-display-inline">Subject to such conditions that the Administrator determines appropriate and giving consideration to public health and the goal of reducing emissions of pollutants, the Administrator may waive the requirements of subparagraph (A) for school buses that meet—</text><clause id="HE2A1A0A1B2BA4A87B433E793D2D2E244"><enum>(i)</enum><text display-inline="yes-display-inline">the emission standards applicable to a new school bus as of the date of enactment of the <short-title>Clean Commute for Kids Act of 2021</short-title>; or</text></clause><clause id="H6F63B5514D864449A0C622CF5954E6FA"><enum>(ii)</enum><text>subsequent emission standards that are at least as stringent as the standards described in clause (i).</text></clause></subparagraph></paragraph></subsection><subsection id="H79998130BB834E3DB64D0637A4D76FD3"><enum>(c)</enum><header>Education and outreach</header><paragraph id="HDA90292A3A3F4140901E04C28EEF96ED"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of enactment of the <short-title>Clean Commute for Kids Act of 2021</short-title>, the Administrator shall develop an education and outreach program to promote and explain the award program under subsection (b)(1).</text></paragraph><paragraph id="HEE345ABF3AC74304974E519B1946BA1D"><enum>(2)</enum><header>Coordination with stakeholders</header><text display-inline="yes-display-inline">The education and outreach program under paragraph (1) shall be designed and conducted in conjunction with interested national school bus transportation associations, labor unions, electric utilities, manufacturers of clean school buses, manufacturers of components of clean school buses, clean transportation nonprofit organizations, and other stakeholders.</text></paragraph><paragraph id="H202CB4843EAA4275A39506613307B856"><enum>(3)</enum><header>Components</header><text>The education and outreach program under paragraph (1) shall—</text><subparagraph id="H299835C27CC4404782457504F563E0EC"><enum>(A)</enum><text>inform, encourage, and support potential award recipients on the process of applying for awards and fulfilling the requirements of awards;</text></subparagraph><subparagraph id="H7C7ED6C1F85646F5949346DEDE696BAA"><enum>(B)</enum><text>describe the available technologies and the benefits of the technologies;</text></subparagraph><subparagraph id="H17BAD7EA46B443868608894DCEB91A67"><enum>(C)</enum><text>explain the benefits of participating in the award program under subsection (b)(1);</text></subparagraph><subparagraph id="H4B560484D50F47D392CFA30D234D5DA7"><enum>(D)</enum><text>make available information regarding best practices, lessons learned, and technical and other information with respect to—</text><clause id="HD3D045BFC44843B1AA247798FDA8F478"><enum>(i)</enum><text>clean school bus acquisition and deployment;</text></clause><clause id="H0D6FDFEB8F78424497C458A927CA785D"><enum>(ii)</enum><text display-inline="yes-display-inline">the build-out of associated infrastructure and advance planning with the local electricity supplier;</text></clause><clause id="HBAA330ED29C64069ABB58E26AB25EB47"><enum>(iii)</enum><text>workforce development and training; and</text></clause><clause id="HEBB73296DF4D4A3D9134B5CDA32009F0"><enum>(iv)</enum><text>any other information that, in the judgment of the Administrator, is relevant to transitioning to and deploying clean school buses;</text></clause></subparagraph><subparagraph id="HE4A62F83222948E185AD9DD5DC055C19"><enum>(E)</enum><text display-inline="yes-display-inline">make available the information provided by the Secretary pursuant to subsection (d);</text></subparagraph><subparagraph id="H4AC135D1B0DD4AFC8AE1FF8D5BB035F4"><enum>(F)</enum><text>in consultation with the Secretary, make information available about how clean school buses can be part of building community resilience to the effects of climate change; and</text></subparagraph><subparagraph id="HB44C2E5E6F2F40F782A4007375EF6567"><enum>(G)</enum><text>include, as appropriate, information from the annual report required under subsection (e).</text></subparagraph></paragraph></subsection><subsection id="HDF286602F9C948C38E85CAFB0B4F1455"><enum>(d)</enum><header>DOE assistance</header><paragraph id="H5D0D8BB4EF084980A2677B19F3018560"><enum>(1)</enum><header>Information gathering</header><subparagraph id="id33CA1477FB694721BB3F71D3C13FFE28"><enum>(A)</enum><header>In general</header><text>The Secretary shall gather information with respect to—</text><clause id="H968CD8638DEF4525B735B8F166F393BA"><enum>(i)</enum><text>vehicle-to-grid technology, including best practices and use-case scenarios;</text></clause><clause id="H5AC1006FA20B4FF68BB638BAA67201A7"><enum>(ii)</enum><text>the use of clean school buses for community resilience; and</text></clause><clause id="H720563BD49D146EC953669C4CFD21A38"><enum>(iii)</enum><text>technical aspects of clean school bus management and deployment.</text></clause></subparagraph><subparagraph id="idC37EEA2D965043DA9C18E9095DCFB572"><enum>(B)</enum><header>Sharing with EPA</header><text>Not less frequently than annually, the Secretary shall share the information gathered under subparagraph (A) with the Administrator.</text></subparagraph></paragraph><paragraph id="HDAD98B40E17E464C85D62F652AE02C4D"><enum>(2)</enum><header>Technical assistance</header><text>The Secretary shall, in response to a request from the Administrator, or from an applicant for or recipient of an award under subsection (b)(1), provide technical assistance in the development of an application for or the use of an award under subsection (b)(1).</text></paragraph></subsection><subsection id="H4443EC0D43644243919A3BDC653AE51F"><enum>(e)</enum><header>Annual report</header><text display-inline="yes-display-inline">Not later than January 31 of each year after a year for which funds were appropriated to carry out this section, the Administrator shall submit to Congress a report that—</text><paragraph id="H63A68655854F4CD8A94465975D6FFDF1"><enum>(1)</enum><text>evaluates the implementation of this section;</text></paragraph><paragraph id="H89E26A5EE9E84367920F79D1E8647801"><enum>(2)</enum><text>describes—</text><subparagraph id="HE2623148AD1C43E5B62BBA5788915C7D"><enum>(A)</enum><text>the total number of applications received for awards under subsection (b)(1);</text></subparagraph><subparagraph id="HDBE3E279FE504FD582BB5599CD0B626A"><enum>(B)</enum><text>the number of clean school buses requested in the applications described in subparagraph (A);</text></subparagraph><subparagraph id="H9088ABA1390441C597580A24E208AD5C"><enum>(C)</enum><text>the awards made under subsection (b)(1) and the criteria used to select the award recipients;</text></subparagraph><subparagraph id="H294A245FDAAE41C09A995FD3743698B1"><enum>(D)</enum><text>the awards made under subsection (b)(1) for charging and fueling infrastructure;</text></subparagraph><subparagraph id="HE04C57E284CD4648A0A23EA482732953"><enum>(E)</enum><text>ongoing compliance with the commitments made by manufacturers on the list maintained by the Administrator under subsection (b)(3)(A);</text></subparagraph><subparagraph id="H9A080E80492547479009849985D74328"><enum>(F)</enum><text>the estimated effect of the awards under subsection (b)(1) on emission of air pollutants, including greenhouse gases; and</text></subparagraph><subparagraph id="H467B09BA304745FB9FF69769948E74D3"><enum>(G)</enum><text>any other information the Administrator considers appropriate; and</text></subparagraph></paragraph><paragraph id="HFFFF1CDE86F247309DC0C6BB87F16312"><enum>(3)</enum><text>describes any waiver granted under subsection (b)(6)(F)(ii) during the preceding year.</text></paragraph></subsection><subsection id="H150226D984844F708B56B690AAC8F2CB"><enum>(f)</enum><header>Authorization of appropriations</header><paragraph id="H421F126C2C534DA3A6211C65183F5F01"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Administrator to carry out this section, to remain available until expended, $2,500,000,000 for each of fiscal years 2022 through 2031.</text></paragraph><paragraph id="id9F5E1D7D32D14BB99F2927494A6D3697"><enum>(2)</enum><header>Use of fund requirements</header><subparagraph id="HFF2F222A4A3F445C8A9EF281F8AC13B0"><enum>(A)</enum><header>Allocation</header><text>Of the amount made available under paragraph (1) for a fiscal year, not less than $1,000,000,000 shall be used for awards under subsection (b)(1) to eligible recipients proposing to replace school buses that serve a community of color, an indigenous community, a low-income community, or a community located in an air quality area designated pursuant to section 107 of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7407">42 U.S.C. 7407</external-xref>) as nonattainment.</text></subparagraph><subparagraph id="idA5F6DB1D5A984F5D87D9E4992069A974"><enum>(B)</enum><header>Administrative costs</header><text>Of the amounts made available under paragraph (1) for a fiscal year, the Administrator may use not more than 2 percent for the administrative costs of carrying out this section.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id3675DD15A4674D8DA634FC5BF3E923D7"><enum>(b)</enum><header>Repeal of redundant authorization</header><paragraph id="id2C4EA4782F1049A0BD0C923D60A9F2ED"><enum>(1)</enum><header>In general</header><text>Section 6015 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (<external-xref legal-doc="usc" parsable-cite="usc/42/16091a">42 U.S.C. 16091a</external-xref>) is repealed.</text></paragraph><paragraph id="id07AA3A7FAABB4D52A0B561538A472A5D"><enum>(2)</enum><header>Conforming amendment</header><text>The table of contents in section 1(b) of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (<external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>; 119 Stat. 1144) is amended by striking the item relating to section 6015.</text></paragraph></subsection></section></legis-body></bill>
