<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 124</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210128">January 28, 2021</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> (for himself, <cosponsor name-id="S303">Mr. Thune</cosponsor>, <cosponsor name-id="S236">Mr. Inhofe</cosponsor>, <cosponsor name-id="S350">Mr. Rubio</cosponsor>, <cosponsor name-id="S375">Mr. Daines</cosponsor>, <cosponsor name-id="S396">Mrs. Blackburn</cosponsor>, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, <cosponsor name-id="S389">Mr. Kennedy</cosponsor>, <cosponsor name-id="S318">Mr. Wicker</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, <cosponsor name-id="S348">Mr. Paul</cosponsor>, <cosponsor name-id="S374">Mr. Cotton</cosponsor>, <cosponsor name-id="S407">Mr. Hagerty</cosponsor>, <cosponsor name-id="S355">Mr. Cruz</cosponsor>, <cosponsor name-id="S365">Mr. Scott of South Carolina</cosponsor>, <cosponsor name-id="S398">Mr. Cramer</cosponsor>, <cosponsor name-id="S382">Mr. Sasse</cosponsor>, and <cosponsor name-id="S347">Mr. Moran</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Internal Revenue Code of 1986 to provide that amounts paid for an abortion are not taken into account for purposes of the deduction for medical expenses.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H96BBF82B7E644414A6486D818C6B10F7"><section section-type="section-one" id="H60B45DD2B38F40B7B10F893680B6C2A5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Abortion Is Not Health Care Act of 2021</short-title></quote>.</text></section><section id="HF584CE19B38B4681A4BD32E93C15E95C"><enum>2.</enum><header>Amounts paid for abortion not taken into account in determining deduction for medical expenses</header><subsection id="H98C261991D354EAA99FEC00E2B71A198"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/213">Section 213</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE14CE05BF87C4EE19337E772DEDFE003"><subsection id="H560D87D29D0B4E878C89B8B7D41EB458"><enum>(g)</enum><header>Amounts paid for abortion not taken into account</header><paragraph id="id285AB55D872441A09E17DF7FFB75362A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An amount paid during the taxable year for an abortion shall not be taken into account under subsection (a).</text></paragraph><paragraph id="id79f297e4539a4d1ca6554c38502036ab"><enum>(2)</enum><header>Exceptions</header><text>Paragraph (1) shall not apply in the case of an abortion with respect to—</text><subparagraph id="id541CD17F934C4FAEA71C91166A49F2E8"><enum>(A)</enum><text>a woman suffering from a physical disorder, physical injury, or physical illness, including a life-endangering physical condition caused by or arising from the pregnancy itself, that would, as certified by a physician, place the woman in danger of death unless an abortion is performed, or</text></subparagraph><subparagraph id="id710A7F75ADEA46C4AF5D221C306A3450"><enum>(B)</enum><text>a pregnancy that is the result of an act of rape or incest.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H8E3C366AE9634BECA28960E25A630827"><enum>(b)</enum><header>Effective date</header><text>The amendment made by this section shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section></legis-body></bill>
