<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1241</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210420">April 20, 2021</action-date><action-desc><sponsor name-id="S349">Mr. Portman</sponsor> (for himself, <cosponsor name-id="S363">Mr. King</cosponsor>, <cosponsor name-id="S337">Mr. Coons</cosponsor>, <cosponsor name-id="S397">Mr. Braun</cosponsor>, and <cosponsor name-id="S388">Ms. Hassan</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the discharge of parent borrower liability if a student on whose behalf a parent has received certain student loans becomes disabled.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HA0F8A44D821E4423AEB08DC91A2CCB41"><section section-type="section-one" id="HFA99B6485E664EE09053617597A327D2"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Domenic and Ed’s Law</short-title></quote>.</text></section><section section-type="subsequent-section" id="HCD0441594A644053B2DA82B15D877D57"><enum>2.</enum><header>Repayment of loans to parents</header><subsection id="H1B443C0EFBD4485994611562FFD36C2F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 437(d) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087">20 U.S.C. 1087(d)</external-xref>) is amended by inserting <quote>or becomes permanently and totally disabled (as determined in accordance with regulations of the Secretary), or if the student is unable to engage in any substantial gainful activity by reason of any medically determinable physical or mental impairment that can be expected to result in death, has lasted for a continuous period of not less than 60 months, or can be expected to last for a continuous period of not less than 60 months,</quote> after <quote>dies,</quote>.</text></subsection><subsection id="HFA3D2C94E5D64C1FBBD533EC342CEFAF"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall apply to any outstanding loan that is received by a parent borrower before, on, or after the date of the enactment of this Act, and without regard to the onset date of the disability or impairment.</text></subsection></section></legis-body></bill>
