which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Transportation to develop best practices for incorporating resilience into emergency relief projects, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Rebuilding Stronger Infrastructure Act</short-title></quote>.</text></section><section id="idDADF2E6CED344EBC98872C08CD3E9BF2"><enum>2.</enum><header>Emergency relief program</header><subsection id="id6b8f2e9bbf944e3280991f67cbc9e81f"><enum>(a)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="idA68F93F0E06D4C35BBA35308A15147AB"><enum>(1)</enum><header>Emergency relief project</header><text>The term <term>emergency relief project</term> means a project carried out under the emergency relief program under section 125 of title 23, United States Code.</text></paragraph><paragraph id="id67373429BFD841789E0B5A0F8ADB4A30"><enum>(2)</enum><header>Resilience</header><subparagraph id="id2c760954398741a59b48b428e99ad668"><enum>(A)</enum><header>In general</header><text>The term <term>resilience</term> means, with respect to a facility, the ability—</text><clause id="idda7a1325bc3b44f489b98c55c7c365b4"><enum>(i)</enum><text>to anticipate, prepare for, or adapt to conditions; or</text></clause><clause id="idde0bc71d2a874a78ab25275e45a539c3"><enum>(ii)</enum><text>to withstand, respond to, or recover rapidly from disruptions.</text></clause></subparagraph><subparagraph id="id591665d71e6a49f7b1d94abe957989a7"><enum>(B)</enum><header>Inclusions</header><text>The term <term>resilience</term> includes, with respect to a facility, the ability—</text><clause id="idcadd3d0ef9814a8cb9025d76d88ac265"><enum>(i)</enum><text>to resist hazards or withstand impacts from disruptions;</text></clause><clause id="id7ddb3466d58a4d699e1719849b57a12e"><enum>(ii)</enum><text>to reduce the magnitude, duration, or impact of a disruption; or</text></clause><clause id="id3b9952f3b23c4f808c106c85dbc7b8d3"><enum>(iii)</enum><text>to have the absorptive capacity, adaptive capacity, and recoverability to decrease vulnerability to a disruption.</text></clause></subparagraph></paragraph><paragraph id="id9e279e517b274534a8f5cc68cb1e0f9a"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph></subsection><subsection id="idfbb78265503c4c9c9415e16c068bfb2c"><enum>(b)</enum><header>Improving the emergency relief program</header><text>Not later than 90 days after the date of enactment of this Act, the Secretary shall—</text><paragraph id="id7383e5a54c8c457995e328eacc60f707"><enum>(1)</enum><text>revise the emergency relief manual of the Federal Highway Administration—</text><subparagraph id="idd6ad0e4be0014c0ea2cf7690e8e4da66"><enum>(A)</enum><text>to include and reflect the definition of the term <term>resilience</term>; </text></subparagraph><subparagraph id="id4662c60ee2e143e0aa437967b878a2bf"><enum>(B)</enum><text>to identify procedures that States may use to incorporate resilience into emergency relief projects; and</text></subparagraph><subparagraph id="idc00566e4066a4786b1c4bc721fb5538c"><enum>(C)</enum><text>to encourage the use of Complete Streets design principles and consideration of access for moderate- and low-income families impacted by a declared disaster;</text></subparagraph></paragraph><paragraph id="id29cb1db28c3c4703a5478742f4c5217f"><enum>(2)</enum><text>develop best practices for improving the use of resilience in—</text><subparagraph id="id94f63bf167314c678178131eb016624f"><enum>(A)</enum><text>the emergency relief program under section 125 of title 23, United States Code; and</text></subparagraph><subparagraph id="id5a4f674ee68145cc88bc19fd836deced"><enum>(B)</enum><text>emergency relief efforts;</text></subparagraph></paragraph><paragraph id="idfe28622fd2a64abbb0010d4afb538543"><enum>(3)</enum><text>provide to division offices of the Federal Highway Administration and State departments of transportation information on the best practices developed under paragraph (2); and</text></paragraph><paragraph id="ida84e8966953842f38abc691ff7c199e9"><enum>(4)</enum><text>develop and implement a process to track—</text><subparagraph id="idac2689b47da04386a09d436d9c8b0911"><enum>(A)</enum><text>the consideration of resilience as part of the emergency relief program under section 125 of title 23, United States Code; and</text></subparagraph><subparagraph id="id26bea73446ef40ac8c8c38d260e832ec"><enum>(B)</enum><text>the costs of emergency relief projects.</text></subparagraph></paragraph></subsection><subsection id="id166E6AA3758A4FB58090B13A02AD8374"><enum>(c)</enum><header>Cost limitation</header><text>Section 125(d) of title 23, United States Code, is amended by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id984C2C64F0CB4D88AAD3A9C29170ED35"><paragraph id="idEE0F7CB93F07466C9E242612D0D519A4"><enum>(2)</enum><header>Cost limitation</header><text>The total cost of a project funded under this section may not exceed the cost of repair or reconstruction of a comparable facility unless the Secretary determines that the project incorporates economically justified betterments, including protective features to increase the resilience of the facility.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
