which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Bank Service Company Act to provide improvements with respect to State banking agencies, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2575E1910A9245C6BB54ED6CACD51A3B"><section section-type="section-one" id="H641B4971082E422286B3D0E450647EFE"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bank Service Company Examination Coordination Act of 2021</short-title></quote>.</text></section><section id="HACF74C8AC6304F24960E4D4D56F60848"><enum>2.</enum><header>Bank Service Company Act improvements</header><text display-inline="no-display-inline">The Bank Service Company Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1861">12 U.S.C. 1861</external-xref> et seq.) is amended—</text><paragraph id="HE7F0145CDE654F238D9E6BBDDAD9CB8A"><enum>(1)</enum><text>in section 1(b)—</text><subparagraph id="HAF2B267D959B42E58C43F4ACF958DDF8"><enum>(A)</enum><text>by redesignating paragraphs (2) through (9) as paragraphs (3) through (10), respectively; and</text></subparagraph><subparagraph id="HBA3FD4E159F14A44BFB41B58ADB52CC1"><enum>(B)</enum><text>by inserting after paragraph (1) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HAAF25578451548A7BBE7A44BB1A9D8BD"><paragraph commented="no" id="HF866961335964B78AB74003BDE379384"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>State banking agency</term> shall have the same meaning given the term <quote>State Bank Supervisor</quote> under section 3 of the Federal Deposit Insurance Act;</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H65AA210D0E3344B09A4B44DEAE262157"><enum>(2)</enum><text>in section 5(a), by inserting <quote>, in consultation with the State banking agency,</quote> after <quote>banking agency</quote>; and</text></paragraph><paragraph id="H1E77D34A8FDE46FE8C767568CFB158DF"><enum>(3)</enum><text>in section 7—</text><subparagraph id="H0D7E0833A47C462AA466868F49715CF8"><enum>(A)</enum><text>in subsection (a)—</text><clause id="HE526BED2D4DB4BE592FB267B3E15587F"><enum>(i)</enum><text>in the first sentence, by inserting <quote>or State banking agency</quote> after <quote>appropriate Federal banking agency</quote>; and</text></clause><clause id="HA9A8F0EDE20A4B899555B44E38C19004"><enum>(ii)</enum><text>in the second sentence, by striking <quote>Federal banking agency that supervises any other shareholder or member</quote> and inserting <quote>Federal or State banking agency that supervises any other shareholder or member</quote>;</text></clause></subparagraph><subparagraph id="H886103F2B33147E9975F43BAF32C6F7E"><enum>(B)</enum><text>in subsection (c)—</text><clause id="HA652F82AEC064CE2B8A5A9287A5926FC"><enum>(i)</enum><text>by inserting <quote>or a State banking agency</quote> after <quote>appropriate Federal banking agency</quote>; and</text></clause><clause id="HD59E2718DB624644B383E3B009ABD6D9"><enum>(ii)</enum><text>by striking <quote>such agency</quote> each place such term appears and inserting <quote>such Federal or State agency</quote>;</text></clause></subparagraph><subparagraph id="H2B8ECAD9660A4ADB856C098123BC3C8C"><enum>(C)</enum><text>by redesignating subsection (d) as subsection (f);</text></subparagraph><subparagraph id="H155FC5CB6C854DECA4E15354695EE6BB"><enum>(D)</enum><text>by inserting after subsection (c) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H915E113FA22C4ABE96C5377A17E8CD80"><subsection id="H52D55AD8BC97435C82A4EB1CE4814F80"><enum>(d)</enum><header>Availability of information</header><text display-inline="yes-display-inline">Information obtained pursuant to the regulation and examination of service providers under this section or applicable State law may be furnished by and accessible to Federal and State agencies to the same extent that supervisory information concerning depository institutions is authorized to be furnished to and required to be accessible by Federal and State agencies under section 7(a)(2) of the Federal Deposit Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1817">12 U.S.C. 1817(a)(2)</external-xref>) or State law, as applicable.</text></subsection><subsection id="H6E2E14FD85EB4D47A22AE865385A42B7"><enum>(e)</enum><header>Coordination with State Banking Agencies</header><text display-inline="yes-display-inline">Where a State bank is principal shareholder or principal member of a bank service company or where a State bank is any other shareholder or member of the bank service company, the appropriate Federal banking agency, in carrying out examinations authorized by this section, shall—</text><paragraph id="H4C3734D0B23044708C09DA96A0DCDA8F"><enum>(1)</enum><text display-inline="yes-display-inline">provide reasonable and timely notice to the State banking agency; and</text></paragraph><paragraph id="HC02CDCBEAD9D46868F045E1FFB36AAD9"><enum>(2)</enum><text display-inline="yes-display-inline">to the fullest extent possible, coordinate and avoid duplication of examination activities, reporting requirements, and requests for information.</text></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph><subparagraph id="H60E0C4EDDBBD4057B466155823F50BF7"><enum>(E)</enum><text>in subsection (f), as so redesignated, by inserting <quote>, in consultation with State banking agencies,</quote> after <quote>appropriate Federal banking agencies</quote>; and</text></subparagraph><subparagraph id="H9FC9AE32B62541EB8D867E42260C45D8"><enum>(F)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7EC9E2C0091A45A4AE2663230163D575"><subsection id="H6A9376CF6B6A4319BDA2B7BD3A72DE4A"><enum>(g)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed as granting authority for a State banking agency to examine a bank service company where no such authority exists in State law.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section><section id="H313B888E7CF94EE880E3710007DB3957"><enum>3.</enum><header>Determination of Budgetary Effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section></legis-body></bill>
