<subsection commented="no" id="H2853EFE0B04044F69B9897C438ADF812"><enum>(a)</enum><header>In general</header><text>Section 1108 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1308">42 U.S.C. 1308</external-xref>) is amended—</text> <paragraph commented="no" id="HD684EAFA4C95400F987F680E3874293C"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (f), in the matter preceding paragraph (1), by striking <quote>and (h)</quote> and inserting <quote>(h), and (i)</quote>;</text></paragraph>
<paragraph commented="no" id="H3ACFB9BE0E8041C3AA8205E20751710A"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (g)(2), in the matter preceding subparagraph (A), by inserting <quote>subsection (i),</quote> after <quote>subject to</quote>; and</text></paragraph> <paragraph commented="no" id="HB4F852DB7F454774897652ADB8E68A91"><enum>(3)</enum><text>by adding at the end the following new subsection:</text>

<subsection commented="no" id="H50624E97E5834E4EAF30DC01A1AF9D73"><enum>(i)</enum><header>Sunset of Medicaid funding limitations for Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa</header><text display-inline="yes-display-inline">Subsections (f) and (g) shall not apply to Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa beginning with fiscal year 2022.</text></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection> <subsection commented="no" id="H1E0A2310DA4843A1943C526A524AFCF3"><enum>(b)</enum><header>Conforming amendments</header> <paragraph id="H71210612BEF4479AA5A384BEBD06DBC8"><enum>(1)</enum><text display-inline="yes-display-inline">Section 1902(j) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(j)</external-xref>) is amended by striking <quote>, the limitation in section 1108(f),</quote>.</text></paragraph>
<paragraph id="H0934586DF4DF4B918DEA42AAEF19B677"><enum>(2)</enum><text>Section 1903(u) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(u)</external-xref>) is amended by striking paragraph (4).</text></paragraph></subsection> <subsection id="H07FAD0093DD445E8A044A606B08779AA"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply beginning with fiscal year 2022.</text></subsection></section>
<section id="H8B23B197B01C408687904FECC6FCE238"><enum>102.</enum><header>Elimination of specific Federal medical assistance percentage (FMAP) limitation for territories; temporary increase in FMAP for Puerto Rico and the Virgin Islands to 100 percent</header><text display-inline="no-display-inline">Section 1905(b) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(b)</external-xref>) is amended—</text> <paragraph id="id2C58C3777BE74ECFB33D4C6F2354D5A3"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (2), by inserting <quote>for fiscal years before fiscal year 2022</quote> after <quote>American Samoa</quote>; and</text></paragraph>
<paragraph id="idA49F895B288449A2B9732D59F89CF0F6"><enum>(2)</enum><text>by adding at the end the following new sentence: <quote>Notwithstanding the first sentence of this subsection, for each of fiscal years 2022 and 2023, the Federal medical assistance percentage for Puerto Rico and the Virgin Islands shall be 100 percent.</quote>.</text></paragraph></section> <section id="H70C530E55CD44D32A458C92273AEC1F9"><enum>103.</enum><header>Application of Medicaid waiver authority to all of the territories</header> <subsection id="H2D38DC1A81AD40E7AF332C4E1CAD72C4"><enum>(a)</enum><header>In general</header><text>Section 1902(j) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(j)</external-xref>) is amended—</text>
<paragraph id="H0E27B8562A3249C0929667252852ABD1"><enum>(1)</enum><text>by striking <quote>American Samoa and the Northern Mariana Islands</quote> and inserting <quote>Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa</quote>;</text></paragraph> <paragraph id="H45F0CBCEA4494CCC8FC6171197F594FB"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>American Samoa or the Northern Mariana Islands</quote> and inserting <quote>Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, or American Samoa</quote>;</text></paragraph>
<paragraph id="H3494FFB748224FA88B6D72D2856BBB3F"><enum>(3)</enum><text>by inserting <quote>(1)</quote> before <quote>Notwithstanding</quote>;</text></paragraph> <paragraph id="H7623124868A445D195F5B3ED2E0DC26B"><enum>(4)</enum><text>by inserting <quote>except as otherwise provided in this subsection,</quote> after <quote>Notwithstanding any other requirement of this title</quote>; and</text></paragraph>
<paragraph id="H1C23583A144543E0B96CA5E42F7632FB"><enum>(5)</enum><text>by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="H87D6E272F8114D1B8CB9F6D177C49B18" style="traditional"> <paragraph id="HED461D817B4A4BE68C9A3DCCADE69317" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary may not waive under this subsection—</text>
<subparagraph id="idAC8C613701B04E90871FEB93E36F695B"><enum>(A)</enum><text display-inline="yes-display-inline">the requirement of subsection (a)(10)(A)(i)(IX) (relating to coverage of adults formerly under foster care) with respect to any territory;</text></subparagraph> <subparagraph id="id050B1D469BAB42C7921EEDACD15A9D1E"><enum>(B)</enum><text>the requirement to provide medical assistance for early and periodic screening, diagnostic, and treatment services (as defined in section 1905(r)) for individuals who are eligible for assistance under the program and who under the age of 21; or</text></subparagraph>
<subparagraph id="id3EFAFF43361C4A6390B5A4B28DEB4114"><enum>(C)</enum><text>the requirement to provide for payment for services described in section 1905(a)(2)(C) furnished by a Federally-qualified health center and services described in section 1905(a)(2)(B) furnished by a rural health clinic in accordance with the provisions of subsection (bb).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HF63E7A30605C449C92608C6884F44823"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply beginning October 1, 2021.</text></subsection></section>
<section id="HCE83A601F8A14648B451A01EB58620E3"><enum>104.</enum><header>Permitting Medicaid DSH allotments for territories</header><text display-inline="no-display-inline">Section 1923(f) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-4">42 U.S.C. 1396r–4(f)</external-xref>) is amended—</text> <paragraph id="HAE74462C168E4AE4AEE2996F99099351"><enum>(1)</enum><text>in paragraph (6), by adding at the end the following new subparagraph:</text>
<quoted-block display-inline="no-display-inline" id="HC609F9CEC0DD44E6AB666010375D0FCE" style="OLC">
<subparagraph id="HCBC167EB899E4A56BA782AE91BAE4321"><enum>(C)</enum><header>Territories</header>
<clause id="H60599C271ED04AB5B06299EA98937FED"><enum>(i)</enum><header>Fiscal year 2021</header><text display-inline="yes-display-inline">For fiscal year 2022, the DSH allotment for Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa shall bear the same ratio to $300,000,000 as the ratio of the number of individuals who are low-income or uninsured and residing in such respective territory (as estimated from time to time by the Secretary) bears to the sums of the number of such individuals residing in all of the territories.</text></clause> <clause id="HB64312B9EE7F4ABBAFC0A0BFB5DAC3F2"><enum>(ii)</enum><header>Subsequent fiscal year</header><text>For each subsequent fiscal year, the DSH allotment for each such territory is subject to an increase in accordance with paragraph (3).</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="H0818842C098247D0BE6C6C556D2E8AF6" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>in paragraph (9), by inserting before the period at the end the following: <quote>, and includes, beginning with fiscal year 2022, Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa</quote>.</text></paragraph></section></subtitle> <subtitle id="id1E92E3DE8BAC4E73A04720FF52CD799F" style="OLC"><enum>B</enum><header>Medicare part A</header> <section id="H1C73495E04AE4AFDB9E6CABD0DBB59C3"><enum>111.</enum><header>Calculation of Medicare DSH payments for IPPS hospitals in Puerto Rico</header><text display-inline="no-display-inline">Section 1886(d)(9)(D)(iii) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(d)(9)(D)(iii)</external-xref>) is amended to read as follows:</text>
<quoted-block style="OLC" display-inline="no-display-inline" id="H931D1DC4B5ED49D8B9B22612CBD138F5">
<clause id="HDCEBA821082F4A2784F088B9C5516937" indent="up2"><enum>(iii)</enum><text display-inline="yes-display-inline">Subparagraph (F) (relating to disproportionate share payments), including application of subsection (r), except that for this purpose—</text> <subclause id="HC0A4CB325F78480F85068B967729562A"><enum>(I)</enum><text display-inline="yes-display-inline">the sum described in clause (ii) of this subparagraph shall be substituted for the sum referred to in paragraph (5)(F)(ii)(I); and</text></subclause>
<subclause id="HD1D4D7BE43244AD79DA2D80329124223"><enum>(II)</enum><text display-inline="yes-display-inline">for discharges occurring on or after October 1, 2021, subclause (I) of paragraph (5)(F)(vi) shall be applied by substituting for the numerator described in such subclause the number of subsection (d) Puerto Rico hospital’s patient days for the cost reporting period involved which were made up of patients who (for such days) were entitled to benefits under part A of this title and were—</text> <item id="H9513DDEC4A434458B32961FDE6B2B248"><enum>(aa)</enum><text>entitled to supplementary security income benefits (excluding any State supplementation) under title XVI of this Act;</text></item>
<item id="HA75AF616D79F4117A862758FB54EADF2"><enum>(bb)</enum><text>eligible for medical assistance under a State plan under title XIX; or</text></item> <item id="H1B16229DEA8E4A7CAF2F48115ACD2114"><enum>(cc)</enum><text display-inline="yes-display-inline">receiving aid or assistance under any plan of the State approved under title I, X, XIV, or XVI.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HD18E1411D7ED4E579A5AFEDBC999A42D"><enum>112.</enum><header>Rebasing target amount for hospitals in territories</header><text display-inline="no-display-inline">Section 1886(b)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(b)(3)</external-xref>) is amended by adding at the end the following new subparagraph:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HD0E1A935A5474D2EBA0BB5106E1FF9EA"> <subparagraph id="HF60F236DEC784725B5464A6E6F3B4870" indent="up2"><enum>(M)</enum> <clause commented="no" display-inline="yes-display-inline" id="H0E0D504FE0774466975E442927501FB8"><enum>(i)</enum><text display-inline="yes-display-inline">For each cost reporting period beginning on or after October 1, 2021, in the case of a hospital located in a territory of the United States, there shall be substituted for the target amount otherwise determined under subparagraph (A) the rebased target amount (as defined in clause (ii)), if such substitution results in an amount of payment under this section to the hospital for such period that is greater than the amount of payment that would be made under this section to the hospital for such period if this subparagraph were not to apply.</text></clause>
<clause id="H8485C237FB104F079A3ED4B85A27B420" indent="up1"><enum>(ii)</enum><text>For purposes of this subparagraph, the term <quote>rebased target amount</quote> has the meaning given the term <quote>target amount</quote> in subparagraph (A), except that—</text> <subclause id="H078D6A63097B4227BE31D1F1C3D49B86"><enum>(I)</enum><text display-inline="yes-display-inline">there shall be substituted for the preceding 12-month cost reporting period the 12-month cost reporting period beginning during fiscal year 2017 (or, at the option of the hospital, beginning during fiscal year 2019);</text></subclause>
<subclause id="H7E82DAEEBAF3417DA6ED0A8612B76711"><enum>(II)</enum><text>any reference in subparagraph (A)(i) to the <quote>first such cost reporting period</quote> is deemed a reference to the first cost reporting period following the 12-month cost reporting period beginning during fiscal year 2017 (or, at the option of the hospital, beginning during fiscal year 2019); and</text></subclause> <subclause id="H5DAF78E856854E4FABF97B80F5C48807"><enum>(III)</enum><text>the applicable percentage increase shall only be applied under subparagraph (B)(ii) for cost reporting periods beginning on or after October 1, 2021.</text></subclause></clause>
<clause commented="no" id="HE91A38F9A8EB4BD693A0C8B1969D550D" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">Nothing in this subparagraph shall affect any pending request by a hospital for a new target amount for any cost reporting period beginning during a fiscal year before fiscal year 2022.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="HD035C57F844B452DBB371CE384DF941B"><enum>113.</enum><header>Medicare DSH target adjustment for hospitals in territories</header><text display-inline="no-display-inline">Section 1886(b)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ww">42 U.S.C. 1395ww(b)(3)</external-xref>), as amended by section 112, is further amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H7AE80B99B3E24F9C977AA1A9FD887ABF" indent="up2"><enum>(N)</enum>
<clause commented="no" display-inline="yes-display-inline" id="H775FFDAB1C7A4C45B21ACAE969A784EB"><enum>(i)</enum><text display-inline="yes-display-inline">For each cost reporting period beginning on or after October 1, 2020, in the case of a hospital that is located in a territory of the United States other than Puerto Rico and that would be a subsection (d) hospital if it were located in one of the 50 States, the target amount shall be increased by—</text> <subclause id="H4FE0E89243C9476198C19EB701CBACFA" indent="up1"><enum>(I)</enum><text>in the case that such hospital has a disproportionate patient percentage of not less than 15 percent and not greater than 40 percent, 10 percent; and</text></subclause>
<subclause id="H89656374E8254D8FB4526C8A9D84B6EC" indent="up1"><enum>(II)</enum><text>in the case that such hospital has a disproportionate patient percentage of greater than 40 percent, 10 percent plus 60 percent of the number of percentage points by which such hospital’s disproportionate patient percentage exceeds 40 percent.</text></subclause></clause> <clause id="H56C7FF8BF8264A20AA36102AAAE85BC5" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">For purposes of this subparagraph, the term <quote>disproportionate patient percentage</quote> has the meaning given such term in subsection (d)(5)(F)(vi), except that in applying such meaning any reference under such subsection to individuals entitled to supplementary security income under title XVI shall be deemed for purposes of this subparagraph to include individuals—</text>
<subclause id="H10DF300B0371469C819686A57BDFC301"><enum>(I)</enum><text>eligible for medical assistance under a State plan under title XIX; or</text></subclause> <subclause id="H2B3CC9B3132641BAA2014A8D41AB7813"><enum>(II)</enum><text>receiving aid or assistance under any plan of the territory approved under title I, X, XIV, or XVI.</text></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section></subtitle>
<subtitle id="H9D5F167D866D43B69851B643C847E55C"><enum>C</enum><header>Medicare part B</header>
<section section-type="subsequent-section" id="HCDF265EC2E004423866BDC166CF9C860"><enum>121.</enum><header>Application of part B deemed enrollment process to residents of Puerto Rico; special enrollment period and limit on late enrollment penalties</header>
<subsection id="H6EF387E70600456FB54735F6F9511D7A"><enum>(a)</enum><header>Application of part B deemed enrollment process to residents of Puerto Rico</header><text display-inline="yes-display-inline">Section 1837(f)(3) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395p">42 U.S.C. 1395p(f)(3)</external-xref>) is amended by striking <quote>, exclusive of Puerto Rico</quote>.</text></subsection> <subsection id="H55B2CE726F72423EA917F836F3D53565"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply to individuals whose initial enrollment period under section 1837(d) of the Social Security Act begins on or after the first day of the effective month, specified by the Secretary of Health and Human Services under section 1839(k)(1)(C) of such Act, as added by subsection (c)(2).</text></subsection>
<subsection id="HDB462C8BDCB94B3DBD516B65AD3FF430"><enum>(c)</enum><header>Transition providing special enrollment period and limit on late enrollment penalties for certain Medicare beneficiaries</header><text display-inline="yes-display-inline">Section 1839 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395r">42 U.S.C. 1395r</external-xref>) is amended—</text> <paragraph id="H4861E4574B304FAE948910FEEA2A12DB"><enum>(1)</enum><text display-inline="yes-display-inline">in the first sentence of subsection (b), by inserting <quote>subject to subsection (k)(2) of this section,</quote> after <quote>subsection (i)(4), (l), or (l) of section 1837,</quote>; and</text></paragraph>
<paragraph id="H5DA3D8B971F743508CAC58D5D20E35BA"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> <quoted-block style="OLC" display-inline="no-display-inline" id="HD81C78E4EC88424AB6D5968405AD0F04"> <subsection id="HEB53EF3A32EC40B192BE12CE9E9FA70C"><enum>(k)</enum><header>Special rules for certain residents of Puerto Rico</header> <paragraph id="H666AC9A12AD94CB189181CEFF5293962"><enum>(1)</enum><header>Special enrollment period, coverage period for residents who are eligible but not enrolled</header> <subparagraph id="H9762FAE872014949B74D642C84CDF454"><enum>(A)</enum><header>In general</header><text>In the case of a transition individual (as defined in paragraph (3)) who is not enrolled under this part as of the day before the first day of the effective month (as defined in subparagraph (C)), the Secretary shall provide for a special enrollment period under section 1837 of 7 months beginning with such effective month during which the individual may be enrolled under this part.</text></subparagraph>
<subparagraph id="H1DE36D516BCC415BB343E521FB8F9CB3"><enum>(B)</enum><header>Coverage period</header><text>In the case of such an individual who enrolls during such special enrollment period, the coverage period under section 1838 shall begin on the first day of the second month after the month in which the individual enrolls.</text></subparagraph> <subparagraph id="H166184CDC4AE43299F44BF2ADF5922A4"><enum>(C)</enum><header>Effective month defined</header><text>In this section, the term <term>effective month</term> means a month, not earlier than October 2022 and not later than January 2023, specified by the Secretary.</text></subparagraph></paragraph>
<paragraph id="H3CC70DE991344C07B08BA199D46FCB4B"><enum>(2)</enum><header>Reduction in late enrollment penalties for current enrollees and individuals enrolling during transition</header>
<subparagraph id="H0D6CDED40C8945F2B6D86144EB1549E1"><enum>(A)</enum><header>In general</header><text>In the case of a transition individual who is enrolled under this part as of the day before the first day of the effective month or who enrolls under this part on or after the date of the enactment of this subsection but before the end of the special enrollment period under paragraph (1)(A), the amount of the late enrollment penalty imposed under section 1839(b) shall be recalculated by reducing the penalty to 15 percent of the penalty otherwise established.</text></subparagraph> <subparagraph id="HE7F40365ACBF409C9D00113A5D51746C"><enum>(B)</enum><header>Application</header><text display-inline="yes-display-inline">Subparagraph (A) shall be applied in the case of a transition individual who—</text>
<clause id="H440AC2A4D86340FF8E8752F3D8A78370"><enum>(i)</enum><text>is enrolled under this part as of the month before the effective month, for premiums for months beginning with such effective month; or</text></clause> <clause id="H5451E7DA4EE9455A8DB35CA9293735AE"><enum>(ii)</enum><text>enrolls under this part on or after the date of the enactment of this Act and before the end of the special enrollment period under paragraph (1)(A), for premiums for months during the coverage period under this part which occur during or after the effective month.</text></clause></subparagraph>
<subparagraph id="HBB0F4C2F24254EDF9AB5EFAA3B087499"><enum>(C)</enum><header>Loss of reduction if individual terminates enrollment</header><text>Subparagraph (A) shall not apply to a transition individual if the individual terminates enrollment under this part after the end of the special enrollment period under paragraph (1).</text></subparagraph></paragraph> <paragraph id="H4EC636856ED84525AA96D578D6728481"><enum>(3)</enum><header>Transition individual defined</header><text display-inline="yes-display-inline">In this section, the term <term>transition individual</term> means an individual who resides in Puerto Rico and who would have been deemed enrolled under this part pursuant to section 1837(f) before the first day of the effective month but for the fact that the individual was a resident of Puerto Rico, regardless of whether the individual is enrolled under this part as of such first day.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></subtitle>
<subtitle id="H1F6985ECA6234E12943E173D151012A3"><enum>D</enum><header>Medicare Advantage (Part C)</header>
<section id="H13378FE5DB6240B095142F48CAA51A6D"><enum>131.</enum><header>Adjustment in benchmark for low-base payment counties in Puerto Rico</header><text display-inline="no-display-inline">Section 1853(n) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-23">42 U.S.C. 1395w–23(n)</external-xref>) is amended—</text> <paragraph id="HB23B59654BB54E5E8C815A6A7FE9B160"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and (5)</quote> and inserting <quote>(5), and (6)</quote>;</text></paragraph>

<paragraph id="H43C9C4CEF0294BDDA3DC423F98FAD3FA"><enum>(6)</enum><header>Special rules for blended benchmark amount for territories</header>
<subparagraph id="H78C8CFD7811146AF9319057FE8DCD57E"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the blended benchmark amount for an area in a territory for a year (beginning with 2022) shall not be less than 80 percent of the national average of the base payment amounts specified in subparagraph (2)(E) for such year for areas within the 50 States and the District of Columbia.</text></subparagraph> <subparagraph id="H8B06FB3A9F8C420BA7175132E286FF95"><enum>(B)</enum><header>Limitation</header><text>In no case shall the blended benchmark amount for an area in a territory for a year under subparagraph (A) exceed the lowest blended benchmark amount for any area within the 50 States and the District of Columbia for such year.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></subtitle>
<subtitle id="H2ABF2C92F86D40F38A5F810C3A500C35"><enum>E</enum><header>Medicare part D</header>
<section id="HCDD8303D33D642179BD35052F6EC2EE5"><enum>141.</enum><header>Improved use of allocated prescription drug funds by territories</header><text display-inline="no-display-inline">Section 1935(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-5">42 U.S.C. 1396u–5(e)</external-xref>) is amended—</text> <paragraph id="id860E384FB1AE4502A23657D99DA2659B"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraph (5) as paragraph (6); and</text></paragraph>
<paragraph id="idA8042EC101F74E93B1EDFEA89337E09E"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (4) the following new paragraph:</text> <quoted-block style="OLC" id="H3128C77073C04A6FA889F4D87643CF54"> <paragraph id="HC371E264A3D6410BABA9EA14482FEFEA"><enum>(5)</enum><header>Improved use of funds for low-income part d eligible individuals</header><text>This subsection shall be applied beginning with fiscal year 2022 as follows, notwithstanding any other provision of this title:</text>
<subparagraph id="H8F1481FB66EB484486B365F97C4F5E0B"><enum>(A)</enum><header>Clarifying state flexibility to cover non-dual-eligible individuals</header><text>In this title, the term <quote>medical assistance</quote> includes financial assistance furnished by a State under this subsection to part D eligible individuals who, if they were residing in one of the 50 States or the District of Columbia, would qualify as subsidy eligible individuals under section 1860D–14(a)(3), and without regard to whether such individuals otherwise qualify for medical assistance under this title.</text></subparagraph> <subparagraph id="HE5B5D2AA4EAE48F1AE5389CA7073E279"><enum>(B)</enum><header>100 percent fmap to reflect no state matching required for part d low income subsidies</header><text>The Federal medical assistance percentage applicable to the assistance furnished under this subsection is 100 percent.</text></subparagraph>
<subparagraph id="H9589AC0A5D0345F7B16D2E1A1E3AB492"><enum>(C)</enum><header>Limited funding for special rules</header><text>Subparagraphs (A) and (B), and the provision of medical assistance for covered part D drugs to low-income part D eligible individuals for a State and period under this subsection, is limited to the amount specified in paragraph (3) for such State and period.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> <section id="H6C2DBB7804594C8986920D98AE5CD043"><enum>142.</enum><header>Report on treatment of territories under Medicare part D</header><text display-inline="no-display-inline">Paragraph (6) of section 1935(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-5">42 U.S.C. 1396u–5(e)</external-xref>), as redesignated by section 141, is amended to read as follows:</text>
<quoted-block id="H73B9180E24854267B2720447ADF48BCF" display-inline="no-display-inline" style="OLC">
<paragraph id="H04CAD21982D741818FAF2A28DB735165"><enum>(6)</enum><header>Report on application of subsection</header>
<subparagraph id="H8F323D1D54FC45B68A15854641C7CC0F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than February 1, 2023, the Secretary shall submit to Congress a report on the application of this subsection during the period beginning fiscal year 2006 and ending fiscal year 2022.</text></subparagraph> <subparagraph id="H733BBE8545FD45CC8F229E30DB5976B0"><enum>(B)</enum><header>Information to be included in report</header><text display-inline="yes-display-inline">Such report shall include—</text>
<clause id="H461D89D25D8C4881AAF6924D0189ACDF"><enum>(i)</enum><text>program guidance issued by the Secretary to implement this subsection;</text></clause> <clause id="H70D067BED46342B7846254380FBB7C15"><enum>(ii)</enum><text>for each territory, information on the increased amount under paragraph (3) and how the territory has applied such amount, including the territory’s program design, expenditures, and number of individuals (and dual-eligible individuals) assisted; and</text></clause>
<clause id="H2ACBE26B7B524FD5A83C9BD79159EFA8"><enum>(iii)</enum><text>differences between how such territories are treated under part D of title XVIII and under this title compared with the treatment of the 50 States and the District of Columbia under such part and this title for different fiscal years within the period covered under the report.</text></clause></subparagraph> <subparagraph id="HBFEC29112428429B83119985DF1B6F1A"><enum>(C)</enum><header>Recommendations</header><text display-inline="yes-display-inline">Such report shall include recommendations for improving prescription drug coverage for low-income individuals in each territory, including recommendations regarding each of the following alternative approaches:</text>
<clause id="H58EF33BFF788438DB481B64D1F056C98"><enum>(i)</enum><text>Adjusting the aggregate amount specified in paragraph (3)(B).</text></clause> <clause id="HCA9E6CA26A4447AC862E1A978EA9EDDC" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>Allowing residents of the territories to be subsidy eligible individuals under section 1860D–14, notwithstanding subsection (a)(3)(F) of such section, or providing substantially equivalent low-income prescription drug subsidies to such residents.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section></subtitle>
<subtitle id="idB90098F320044653B00C34C37708BC4D" style="OLC"><enum>F</enum><header>Miscellaneous</header>
<section id="H6721FBA9A60F44ECB79DBE00E99F3B15"><enum>151.</enum><header>Medicaid and CHIP territory transparency and information</header>
<subsection id="HB34578F402184936B348DB66EB057BDF"><enum>(a)</enum><header>Publication of information on Federal expenditures under Medicaid and CHIP in the territories</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Secretary of Health and Human Services shall publish, and periodically update, on the Internet site of the Centers for Medicare &amp; Medicaid Services information on Medicaid and CHIP carried out in the territories of the United States. Such information shall include, with respect to each such territory—</text> <paragraph id="H40838C14B4224C589A61C7C0E4FBFFC1"><enum>(1)</enum><text display-inline="yes-display-inline">the income levels established by the territory for purposes of eligibility of an individual to receive medical assistance under Medicaid or child health assistance under CHIP;</text></paragraph>
<paragraph id="H58FF9720E1BF481DA97142127B0855A3"><enum>(2)</enum><text>the number of individuals enrolled in Medicaid and CHIP in such territory;</text></paragraph> <paragraph id="H22C49A91C92E4E52913C1A230F5DC43A"><enum>(3)</enum><text display-inline="yes-display-inline">any State plan amendments in effect to carry out Medicaid or CHIP in such territory;</text></paragraph>
<paragraph id="H14729B4243364F898C5903E1A4EA9DAD"><enum>(4)</enum><text display-inline="yes-display-inline">any waiver of the requirements of title XIX or title XXI issued by the Secretary to carry out Medicaid or CHIP in the territory, including a waiver under section 1115 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1315">42 U.S.C. 1315</external-xref>), any application for such a waiver, and any documentation related to such application (including correspondence);</text></paragraph> <paragraph id="HA722250B790440A9816459128BC396D4"><enum>(5)</enum><text>the amount of the Federal and non-Federal share of expenditures under Medicaid and CHIP in such territory;</text></paragraph>
<paragraph id="H6832AAFB6B584C6FBF15470CB3F3979F"><enum>(6)</enum><text>the systems in place for the furnishing of health care items and services under Medicaid and CHIP in such territory;</text></paragraph> <paragraph id="HD07AA775FB1748BCABEA2383695F0727"><enum>(7)</enum><text>the design of CHIP in such territory; and</text></paragraph>
<paragraph id="H59DCD98C4DD042C488ADEBBD9B02778A"><enum>(8)</enum><text display-inline="yes-display-inline">other information regarding the carrying out of Medicaid and CHIP in the territory that is published on such Internet site with respect to carrying out Medicaid and CHIP in each State and the District of Columbia.</text></paragraph></subsection> <subsection id="H9D59021D08534F528AD18B397D45C4FC"><enum>(b)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HCCA9737D621D47A3A7B33DD1B50D4457"><enum>(1)</enum><header>CHIP</header><text display-inline="yes-display-inline">The term <term>CHIP</term> means the State Children’s Health Insurance Program under title XXI of the Social Security Act.</text></paragraph> <paragraph id="H099BE4E5C7DA41E1BBC6F2BCB7B018B5"><enum>(2)</enum><header>Medicaid</header><text display-inline="yes-display-inline">The term <term>Medicaid</term> means the Medicaid program under title XIX of the Social Security Act.</text></paragraph>
<paragraph id="HF4578FBF6DFA47B7BC513655F19AA087"><enum>(3)</enum><header>Territory</header><text display-inline="yes-display-inline">The term <term>territory of the United States</term> includes Puerto Rico, the Virgin Islands of the United States, Guam, the Northern Mariana Islands, and American Samoa.</text></paragraph></subsection></section> <section id="H1BD6905BB8834ED7822FB6276865725C"><enum>152.</enum><header>Report on exclusion of territories from Exchanges</header> <subsection id="H58B4EF067DB945C297C43272101AA98F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary of Health and Human Services shall submit to Congress a report that details the adverse impacts in each territory from the practical exclusion of the territories from the provisions of part II or III of subtitle D of title I of the Patient Protection and Affordable Care Act insofar as such provisions provide for the establishment of an American Health Benefit Exchange or the administration of a federally facilitated Exchange in each State and in the District of Columbia for the purpose of making health insurance more affordable and accessible for individuals and small businesses.</text></subsection>
<subsection id="HF2FF281BC66648EDA503F1ED8E1CFD31"><enum>(b)</enum><header>Information in report</header><text>The report shall include information on the following:</text> <paragraph id="HCF870FD5EF15464CB7FCDA114CD08C07"><enum>(1)</enum><text>An estimate of the total number of individuals residing in each territory with health insurance coverage, and the total number of individuals in each territory without health insurance coverage.</text></paragraph>
<paragraph id="H40C44BFA85EA4DAD99ED09675B5C64EF"><enum>(2)</enum><text>The number of health insurance issuers in each territory and the health insurance coverage each such issuer offers.</text></paragraph> <paragraph id="HC6AECBD17634405AB781CCC0276C90C7"><enum>(3)</enum><text>An estimate of the number of individuals residing in each territory who are denied premium and cost-sharing assistance that would otherwise be available to them for obtaining health insurance coverage through an Exchange if they resided in one of the 50 States or in the District of Columbia.</text></paragraph>
<paragraph id="H0EC50EBFC09A48BE9A91E5C74C726544"><enum>(4)</enum><text>An estimate of the amount of Federal assistance described in paragraph (3) that is not being made available to residents of each territory.</text></paragraph> <paragraph id="H13F30251C16541FABAD001C54F3126C9"><enum>(5)</enum><text>An estimate of the number of small employers in each territory that would be eligible to purchase health insurance coverage through a Small Business Health Options Program (SHOP) Marketplace that would operate as part of an Exchange if the employers were in one of the 50 States or in the District of Columbia.</text></paragraph></subsection></section>
<section id="idACC72F6CE0F746BF88ED423EE2577283"><enum>153.</enum><header>Access to coverage for individuals in certain areas without any available Exchange plans</header><text display-inline="no-display-inline">Part 2 of subtitle D of title I of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18031">42 U.S.C. 18031</external-xref> et seq.) is amended by adding at the end the following:</text> <quoted-block display-inline="no-display-inline" id="id7F132EA23A804C4EAFBB72DAC925C37A" style="OLC"> <section id="id086313C4D0394607843EEF837A374A0E"><enum>1314.</enum><header>Access to coverage for individuals in certain areas without any available Exchange plans</header> <subsection id="idB1F1CF5C638E4E769F586D4048841C14"><enum>(a)</enum><header>In general</header> <paragraph id="id6BFADB90AB774D2E9E96661BEE1F0A51"><enum>(1)</enum><header>Coverage through DC Exchange</header><text>Not later than 3 months after the date of enactment of this section, the Secretary, in consultation with the Secretary of the Treasury and the Director of the Office of Personnel Management, shall establish a mechanism to ensure that, for any plan year beginning on or after the date described in subsection (c), any individual described in paragraph (2) has access to health insurance coverage which is at least as broad as the coverage available to Members of Congress and congressional staff (as defined in section 1312(d)(3)(D)) through the Exchange operating in the District of Columbia. Such individuals shall be eligible for any premium tax credit under <external-xref legal-doc="usc" parsable-cite="usc/26/36B">section 36B</external-xref> of the Internal Revenue Code of 1986, reduced cost sharing under section 1402, and advance determination and payment of such credits or such reductions under section 1412 to be administered by the Secretary, in consultation with the Secretary of the Treasury and the Director of the Office of Personnel Management. The District of Columbia, its residents, and small businesses shall be held harmless from any increased costs resulting from the enactment of this section.</text></paragraph>
<paragraph id="idAAE2B1250CCF4CCBA62FD812D4D4FF25"><enum>(2)</enum><header>Individual described</header><text>An individual described in this paragraph is any individual who—</text> <subparagraph id="id4DDFFC2FE3B04EE5ADC94F88219D6446"><enum>(A)</enum><text>is not eligible to enroll in an employer-sponsored health plan (excluding such a plan that would not be considered minimum essential coverage due to the application of subparagraph (C) of <external-xref legal-doc="usc" parsable-cite="usc/26/36B">section 36B(c)(2)</external-xref> of the Internal Revenue Code of 1986 if such subparagraph applied to such plan); and</text></subparagraph>
<subparagraph id="id73FBB48A25394C46A28E497B013125EB"><enum>(B)</enum><text display-inline="yes-display-inline">is a bona fide resident of any possession of the United States (as determined under section 937(a) of such Code) in which the Secretary certifies that no qualified health plan is offered through an Exchange established under this title.</text></subparagraph></paragraph> <paragraph id="idD0D041D2FAE349588F2AF5709FF73D51"><enum>(3)</enum><header>Possession of the United States</header><text>For purposes of this section, the term <term>possession of the United States</term> shall include such possessions as are specified in <external-xref legal-doc="usc" parsable-cite="usc/26/937">section 937(a)(1)</external-xref> of the Internal Revenue Code of 1986.</text></paragraph></subsection>
<subsection id="id3B7A47FA559F4DF686B7D155D5F6E655"><enum>(b)</enum><header>Treatment of possessions</header>
<paragraph id="id4EB73AEEF0EC42968A896FC828E457EE"><enum>(1)</enum><header>Payments to possessions</header>
<subparagraph id="idB4BE215FC8034F06BE74692A90422047"><enum>(A)</enum><header>Mirror code possession</header><text>The Secretary of the Treasury shall periodically (but not less frequently than annually) pay to each possession of the United States with a mirror code tax system amounts equal to the loss to that possession by reason of the application of this section (determined without regard to paragraph (2)) with respect to taxable years beginning after the date described in subsection (c). Such amounts shall be determined by the Secretary of the Treasury based on information provided by the government of the respective possession.</text></subparagraph> <subparagraph id="id895AB4BD6D1046CB830E74521A36220D"><enum>(B)</enum><header>Other possessions</header><text>The Secretary of the Treasury shall periodically (but not less frequently than annually) pay to each possession of the United States which does not have a mirror code tax system amounts estimated by the Secretary of the Treasury as being equal to the aggregate benefits that would have been provided to residents of such possession by reason of the application of this section for any taxable years beginning after the date described in subsection (c) if a mirror code tax system had been in effect in such possession. The preceding sentence shall not apply with respect to any possession of the United States unless such possession has a plan, which has been approved by the Secretary of the Treasury, under which such possession will promptly distribute such payments to the residents of such possession.</text></subparagraph></paragraph>
<paragraph id="idBAFD33353D934146895AE2B9D80AECD1"><enum>(2)</enum><header>Coordination with credit allowed against united states income taxes</header><text>No credit shall be allowed against United States income taxes for any taxable year under <external-xref legal-doc="usc" parsable-cite="usc/26/36B">section 36B</external-xref> of the Internal Revenue Code of 1986 to any person—</text> <subparagraph id="idAB0345FBE98F4C00BC8158BD4293D626"><enum>(A)</enum><text>to whom a credit is allowed against taxes imposed by the possession by reason of this section (determined without regard to this paragraph) for such taxable year, or</text></subparagraph>
<subparagraph id="id493929A9D2274F009A4EE70122773B4B"><enum>(B)</enum><text>who is eligible for a payment under a plan described in paragraph (1)(B) with respect to such taxable year.</text></subparagraph></paragraph> <paragraph id="id0AB443513FF14193AD5D54AFE3C84BE3"><enum>(3)</enum><header>Mirror code tax system</header><text>For purposes of this subsection, the term <term>mirror code tax system</term> means, with respect to any possession of the United States, the income tax system of such possession if the income tax liability of the residents of such possession under such system is determined by reference to the income tax laws of the United States as if such possession were the United States.</text></paragraph>
<paragraph id="idC001D320A57A404994FBFC8430FAA3F6"><enum>(4)</enum><header>Treatment of payments</header><text>For purposes of section 1324(b)(2) of title 31, United States Code, or any similar rule of law, the payments under this subsection shall be treated in the same manner as a refund due from the credit allowed under <external-xref legal-doc="usc" parsable-cite="usc/26/36B">section 36B</external-xref> of the Internal Revenue Code of 1986.</text></paragraph></subsection> <subsection commented="no" display-inline="no-display-inline" id="id7DA3371D4FDB4A138EE6FC98E325CB9F"><enum>(c)</enum><header>Date described</header><text>The date described in this subsection is the date on which the Secretary establishes the mechanism described in subsection (a)(1).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></subtitle></title>
<title id="idC14DA5265FF44570814555FB1BCB30E2" style="OLC"><enum>II</enum><header>Inclusion of the territories in the supplemental nutritional assistance program</header>
<section id="HE9EC861B912F466EBF48F83505912000"><enum>201.</enum><header>Participation and transition of Puerto Rico, American Samoa, and the Northern Mariana Islands in supplemental nutrition assistance program</header>
<subsection id="H5041CD27739341F9980AF016AB6A7708"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 3 of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012</external-xref>) is amended—</text> <paragraph id="H33DBBEC6D215469181DC730C2BCFC157"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (r), by inserting <quote>the Commonwealth of Puerto Rico, American Samoa, the Commonwealth of the Northern Mariana Islands,</quote> after <quote>Guam,</quote>; and</text></paragraph>

<paragraph id="id7434B77A07164782A836C39986D3F9B9"><enum>(1)</enum><header>Definition of governmental entity</header><text>In this subsection, the term <quote>governmental entity</quote> means—</text> <subparagraph id="idD48359E1DEA64639A68C83621739604A"><enum>(A)</enum><text>the Commonwealth of Puerto Rico;</text></subparagraph>
<subparagraph id="id73F4AECD5D934467BAB6A97541D80ED1"><enum>(B)</enum><text>American Samoa; and</text></subparagraph> <subparagraph id="id1FABFA3018174FE6A104994A8126F4C8"><enum>(C)</enum><text>the Commonwealth of the Northern Mariana Islands.</text></subparagraph></paragraph>
<paragraph id="idce70e0f5c18243ae939a3e0dbf64a5c7"><enum>(2)</enum><header>Request for participation</header><text>A governmental entity may submit to the Secretary a request to participate in the supplemental nutrition assistance program, which shall include a plan of operation described in section 11(d), which shall include the date on which the governmental entity intends to begin participation in the program.</text></paragraph> <paragraph id="id0A6AFF332CCB43DE9A25DD349A9B088F"><enum>(3)</enum><header>Certification by Secretary</header> <subparagraph id="id0FC30A8106474310A2C5EC4AA2E3143F"><enum>(A)</enum><header>In general</header><text>The Secretary shall certify a governmental entity that submits a request under paragraph (2) as qualified to participate in the supplemental nutrition assistance program if the Secretary—</text>
<clause id="id3b79ec7e86544c649fa6876216727361"><enum>(i)</enum><text>approves the plan of operation submitted with the request, in accordance with this subsection; and</text></clause> <clause id="id3b45564960154a4abd0064f3cdcb0c16"><enum>(ii)</enum><text>approves the applications described in paragraph (5) in accordance with that paragraph.</text></clause></subparagraph>
<subparagraph id="idc63d2f2554304129b0f0fc87413918d4"><enum>(B)</enum><header>Submission of certification to Congress</header><text>The Secretary shall submit each certification under subparagraph (A) to Congress. </text></subparagraph> <subparagraph id="id970DB78FFB68422F8DFE74E3167C4FAE"><enum>(C)</enum><header>Certification decision</header><text>The Secretary shall certify or not certify a governmental entity that submits a request under paragraph (2) not later than 90 days after the date on which the Secretary receives the request.</text></subparagraph></paragraph>
<paragraph id="idf34babf8fba145de887afa0cfafbbffd"><enum>(4)</enum><header>Determination of plan of operation</header>
<subparagraph id="idbcb0874fb19e43c1a7b1a4dc172122ac"><enum>(A)</enum><header>Approval</header><text>The Secretary shall approve a plan of operation submitted with a request under paragraph (2) if the plan satisfies the requirements under this Act.</text></subparagraph> <subparagraph id="id34093e965b9a44ecafa6e07eb1089637"><enum>(B)</enum><header>Disapproval</header><text>If the Secretary does not approve a plan of operation submitted with a request under paragraph (2), the Secretary shall provide to the governmental entity a statement that describes each requirement under this Act that is not satisfied by the plan.</text></subparagraph></paragraph>
<paragraph id="iddf15820a640447799b9236661d801e08"><enum>(5)</enum><header>Retail food stores</header><text>If the Secretary approves a plan of operation under paragraph (4)(A) for a governmental entity, the Secretary shall accept applications from retail food stores located in that governmental entity to be authorized under section 9 to participate in the supplemental nutrition assistance program. </text></paragraph> <paragraph id="idF31EFE07B4BB4B538F87B96FC92FF9E1"><enum>(6)</enum><header>Puerto Rico</header><text>In the case of a request under paragraph (2) by the Commonwealth of Puerto Rico, notwithstanding subsection (g), the Secretary shall allow the Commonwealth of Puerto Rico to continue to carry out under the supplemental nutrition assistance program the Family Market Program established pursuant to this section.</text></paragraph>
<paragraph id="id674FA54D94404B0DA62736740B5272A3"><enum>(7)</enum><header>Temporary funding</header><text>Any governmental entity that has a request under paragraph (2) pending before the Secretary (including a plan of operation pending under paragraph (4)) shall receive block grants under this section, in amounts determined by the Secretary, until the date on which the Secretary certifies the governmental entity.</text></paragraph> <paragraph id="id3f2d96a8f5244312b146b879c109e3cc"><enum>(8)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Secretary such sums as are necessary to carry out this subsection for fiscal year 2021, to remain available until expended.</text></paragraph></subsection>
<subsection id="id6FA1FD8A36FA4BA1AA08EC28D426A0F2"><enum>(g)</enum><header>Technical infrastructure implementation</header>
<paragraph id="id838e2cac54ed48a0a39370cab2d54817"><enum>(1)</enum><header>In general</header><text>A governmental entity (as defined in subsection (f)) may request from the Secretary a 1-time grant to pay for the cost of the technology infrastructure necessary to implement the supplemental nutrition assistance program, including the cost of information technology, information technology personnel, and training relating to program implementation.</text></paragraph> <paragraph id="idc3b8c45d23524fe68b8e9a7e78932f03"><enum>(2)</enum><header>Application</header><text>A governmental entity making a request under paragraph (1) for a grant shall submit to the Secretary an application at such time, in such manner, and containing such information as the Secretary may require, including—</text>
<subparagraph id="id2F57315D186945DFBB818E75382F9DEF"><enum>(A)</enum><text> a description of the costs to be paid for by the grant; and</text></subparagraph> <subparagraph id="id1E1659252A524706A43A1F52C56C47C5"><enum>(B)</enum><text>a plan for implementing the technology infrastructure described in paragraph (1)—</text>
<clause id="idE9E0CC9E66824C85BE672AA2B79E4FCE"><enum>(i)</enum><text>within 1 year of receiving the grant; and</text></clause> <clause id="idCBE79126C1944941A84ABFC0D83D166B"><enum>(ii)</enum><text>that is reasonably cost efficient, as determined by the Secretary.</text></clause></subparagraph></paragraph>
<paragraph id="id5D34C4AD27A64989B1699A2E69275183"><enum>(3)</enum><header>Determination</header>
<subparagraph id="idB525C8255B86466FB987377BD534F03F"><enum>(A)</enum><header>Time limit</header><text>The Secretary shall approve or deny an application submitted under paragraph (2) not later than 90 days after the date on which the application is submitted.</text></subparagraph> <subparagraph id="id87242B8E45BB42ED8B39013BABC5394B"><enum>(B)</enum><header>Denial</header><text>If the Secretary denies an application submitted under paragraph (2), the governmental entity may amend the plan described in subparagraph (B) of that paragraph, in coordination with the Secretary, to resubmit to the Secretary for approval.</text></subparagraph></paragraph>
<paragraph id="id0fc65e806ae042bb80e5723c15f2bb82" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header>Funding</header>
<subparagraph commented="no" display-inline="no-display-inline" id="idD7B1C66B5F7046AC9978AEC7AADA0EC1"><enum>(A)</enum><header>In general</header><text>There is appropriated to the Secretary, out of funds in the Treasury not otherwise appropriated, $5,000,000 to carry out this subsection, to remain available until 3 years after the date of enactment of this subsection.</text></subparagraph> <subparagraph commented="no" display-inline="no-display-inline" id="idA13A2969B1144F87BE22CC8BC61F37E2"><enum>(B)</enum><header>Reversion of funds</header><text>Any funds appropriated to the Secretary under subparagraph (A) that remain available by the date described in that subparagraph shall revert to the Treasury. </text></subparagraph></paragraph></subsection>
<subsection id="idea53901e6b2d4c9aa9d38c1eef33218a"><enum>(h)</enum><header>Termination of effectiveness</header>
<paragraph id="id16b662427976435387acbe14d852e322"><enum>(1)</enum><header>In general</header><text>Subsections (a) through (e) shall cease to be effective with respect to the Commonwealth of Puerto Rico, American Samoa, and the Commonwealth of the Northern Mariana Islands, as applicable, on the date described in paragraph (2) if the Secretary submits to Congress a certification under subsection (f)(3)(B) for that governmental entity.</text></paragraph> <paragraph id="idf91eef3fe4bf4adba9af32ba012b6cf5" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Date described</header><text>The date referred to in paragraph (1) is, with respect to the Commonwealth of Puerto Rico, American Samoa, and the Commonwealth of the Northern Mariana Islands, the date established by the Commonwealth of Puerto Rico, American Samoa, or the Commonwealth of the Northern Mariana Islands, respectively, in the applicable plan of operation submitted to the Secretary under subsection (f)(2).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></title>
<title id="id50E1E4DB12F94147A4B44C02D85E324C" style="OLC"><enum>III</enum><header>Equitable treatment for Puerto Rico and the Virgin Islands with respect to tax credits</header>
<section id="idB1470F4ADDC44901BCE7C6B8D0124A5D"><enum>301.</enum><header>Equitable treatment for residents of Puerto Rico and the Virgin Islands with respect to the earned income tax credit and the child tax credit</header>
<subsection id="H037C4BD05BF0474A80C08491C47994BE"><enum>(a)</enum><header>Puerto Rico residents eligible for earned income tax credit</header>
<paragraph id="HF45B06253D484936B356762695536744"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/32">Section 32</external-xref> of the Internal Revenue Code of 1986, as amended by section 9621(a) of the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>), is amended by adding at the end the following new subsection:</text> <quoted-block id="H2F9521E3DE59431F8B0A8C6C40987B5E" style="OLC"> <subsection id="H10E61E1D1B994FA0A45C413269BB382B"><enum>(o)</enum><header>Residents of Puerto Rico</header> <paragraph id="HA4812FCD239B444C95FF7B9D54F2FE27"><enum>(1)</enum><header>In general</header><text>In the case of residents of Puerto Rico—</text>
<subparagraph id="H2282E765675548CB90611117C9215D85"><enum>(A)</enum><text>the United States shall be treated as including Puerto Rico for purposes of subsections (c)(1)(A)(ii)(I) and (c)(3)(C),</text></subparagraph> <subparagraph id="H073ED9EBAFF949CEBA68AA2F163729F3"><enum>(B)</enum><text>subsection (c)(1)(D) shall not apply to nonresident alien individuals who are residents of Puerto Rico, and</text></subparagraph>
<subparagraph id="H8BC042B884A140199E3723368C4ECF97"><enum>(C)</enum><text>adjusted gross income and gross income shall be computed without regard to section 933 for purposes of subsections (a)(2)(B) and (c)(2)(A)(i).</text></subparagraph></paragraph> <paragraph id="H87463959972046DAB29C67DEF3BBACFB"><enum>(2)</enum><header>Limitation</header><text>The credit allowed under this section by reason of this subsection for any taxable year shall not exceed the amount, determined under regulations or other guidance promulgated by the Secretary, that a similarly situated taxpayer would receive if residing in a State.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph>
<paragraph id="H5FC4D2D2C9FA4C0FA019197F3C3B200C"><enum>(2)</enum><header>Child tax credit not reduced</header><text>Subclause (II) of section 24(d)(1)(B)(ii) of such Code is amended by inserting before the period <quote>(determined without regard to section 32(n) in the case of residents of Puerto Rico)</quote>.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="HED9484CA509D40A3BAB26E3ADDE65A76"><enum>(3)</enum><header>Effective date</header><text>The amendments made this subsection shall apply to taxable years beginning after December 31, 2020.</text></paragraph></subsection>
<subsection id="HA1F28FA19CA64076AF2F44E660308013"><enum>(b)</enum><header>Equitable treatment for residents of Puerto Rico with respect to the refundable portion of the child tax credit</header>
<paragraph id="H54F29C84C78F479D88C54F37395A6F04"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/24">Section 24(d)(1)</external-xref> of the Internal Revenue Code of 1986 is amended by inserting <quote>or section 933</quote> after <quote>section 112</quote>.</text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="H0DBFD4CD1AEC425280895E2200A16CFB"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall apply to taxable years beginning after December 31, 2020.</text></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="id88FC3DEC3F6545639042006FF470F4E5"><enum>(c)</enum><header>Treatment of residents of the Virgin Islands</header>
<paragraph id="id5d3fa6894147477c87b8503f1d999323"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall pay to the government of the Virgin Islands amounts equal to the loss to that possession by reason of the application of—</text> <subparagraph id="id8F691D178C3C43AEA13D387ECB4DC31E"><enum>(A)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/26/32">section 32</external-xref> of the Internal Revenue Code of 1986 (determined as if subsection (o) of such section, as added by subsection (a), applied to bona fide residents of that possession), and</text></subparagraph>
<subparagraph id="idF9F3635CF91C43B9946D96B86AF673DB"><enum>(B)</enum><text>section 24(d) of such Code (determined as if the amendment made by subsection (b) applied to bona fide residents of that possession),</text></subparagraph><continuation-text continuation-text-level="paragraph">with respect to taxable years beginning after December 31, 2020. Such amounts shall be determined by the Secretary of the Treasury based on information provided by the government of the Virgin Islands.</continuation-text></paragraph> <paragraph commented="no" display-inline="no-display-inline" id="idc6acfe73322f43ca81a4bea2a04f22ff"><enum>(2)</enum><header>Treatment of payments</header><text>For purposes of section 1324(b)(2) of title 31, United States Code, the payments under this subsection shall be treated in the same manner as a refund due from the credit allowed under section 32 or 24 (by reason of subsection (d) thereof), whichever is applicable, of the Internal Revenue Code of 1986.</text></paragraph></subsection></section></title>

<section id="ida2a10744ec8146b5aa82601501947db8"><enum>401.</enum><header>Minimum wage for young employees in Puerto Rico</header><text display-inline="no-display-inline">Section 6(g) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/206">29 U.S.C. 206(g)</external-xref>) is amended—</text> <paragraph id="id45d5228fe34c4052b44565e19e056ae8"><enum>(1)</enum><text>by striking paragraph (2) and redesignating paragraphs (3) through (5) as paragraphs (2) through (4), respectively;</text></paragraph>
<paragraph id="id782d71c36aac47719440c34d89c89b32"><enum>(2)</enum><text>in paragraph (2), as so redesignated, by striking <quote>or (2)</quote>; and</text></paragraph> <paragraph id="id6796f1d4dc6d47b6b827c2424a203472"><enum>(3)</enum><text>in paragraph (4), as so redesignated, by striking <quote>20 years, except</quote> and all that follows through the period and inserting <quote>20 years.</quote>.</text></paragraph></section>
<section id="id9aaae8f55ee04fa1bb15a18ff0351cfe"><enum>402.</enum><header>Overtime hours protections for workers in Puerto Rico</header><text display-inline="no-display-inline">Section 404 of the Puerto Rico Oversight, Management, and Economic Stability Act (<external-xref legal-doc="usc" parsable-cite="usc/48/2193">48 U.S.C. 2193</external-xref>) is repealed.</text></section></title> <title id="id6D968788227D42298DF01087C4EBB653" style="OLC"><enum>V</enum><header>Extension of supplemental security income (SSI) program to all territories</header> <section display-inline="no-display-inline" commented="no" id="id9E2E4B15514C44008D8D65CBBB006D84"><enum>501.</enum><header>Extension of SSI program to all territories</header> <subsection display-inline="no-display-inline" commented="no" id="id0D05B8E73B3C40BBAED197A5F22F6CE3"><enum>(a)</enum><header>Application of Social Security Amendments of 1972 amendments and repeals to territories</header> <paragraph display-inline="no-display-inline" commented="no" id="id795D35083EF14528A8C50F505504416E"><enum>(1)</enum><header>In general</header><text>Effective January 1, 2022, the amendments made by sections 301 and 302 of the Social Security Amendments of 1972 (<external-xref legal-doc="public-law" parsable-cite="pl/92/603">Public Law 92–603</external-xref>) and the repeals made by section 303(a) of the Social Security Amendments of 1972 shall be applicable in the case of Puerto Rico, Guam, the Virgin Islands, and American Samoa.</text></paragraph>
<paragraph display-inline="no-display-inline" commented="no" id="idF61A5BB7F5ED4E3B9273E3E3EA42FC88"><enum>(2)</enum><header>Conforming amendment</header><text>Effective January 1, 2022, section 303 of the Social Security Amendments of 1972 (<external-xref legal-doc="public-law" parsable-cite="pl/92/603">Public Law 92–603</external-xref>) is amended by striking subsection (b).</text></paragraph></subsection> <subsection display-inline="no-display-inline" commented="no" id="idEA754548842247EBA08592C8737B9609"><enum>(b)</enum><header>Conforming amendments</header> <paragraph display-inline="no-display-inline" commented="no" id="idF3B15CEFFCE54B6EA06C11E5D2F29A7D"><enum>(1)</enum><header>Definition of State</header><text>Section 1101(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1301">42 U.S.C. 1301(1)</external-xref>) is amended by striking the fifth sentence and inserting the following: <quote>In the case of supplemental security income under title XVI, such term also includes the Virgin Islands, Guam, the Northern Mariana Islands, and American Samoa.</quote>.</text></paragraph>
