<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1223</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210420">April 20, 2021</action-date><action-desc><sponsor name-id="S287">Mr. Cornyn</sponsor> (for himself, <cosponsor name-id="S362">Mr. Kaine</cosponsor>, and <cosponsor name-id="S327">Mr. Warner</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To revise the treatment of urbanized areas experiencing population changes following a major disaster.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HA1E1647EF76D4DC698EC9C30FD12FCC7"><section section-type="section-one" id="idDF6856A33E1040F6AFA332B918D17504"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Giving Relief to American Communities in Emergencies Act</short-title></quote> or the <quote><short-title>GRACE Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="idF4A5D0A58A15432FA4BA324F812DF24D"><enum>2.</enum><header>Urbanized areas</header><subsection id="idF1118EB65EDB44D8AD60528186577FBC"><enum>(a)</enum><header>Extension of treatment of urbanized areas</header><text display-inline="yes-display-inline">Section 21101 of division B of the Bipartisan Budget Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/123">Public Law 115–123</external-xref>; 132 Stat. 103) is amended by striking <quote>and 2020</quote> and inserting <quote>2020, 2021, and 2022</quote>.</text></subsection><subsection id="id789D0E9DC75F4DFF91CB8BC7735B7C86"><enum>(b)</enum><header>Census discretion</header><text display-inline="yes-display-inline">Section 5324 of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id54ef5cfe96dd4bf380dda3746b1a7125"><subsection id="id4aa960574a0543a1b56f582e3ad7240e"><enum>(f)</enum><header>Census discretion</header><paragraph id="id22ABF0216B7047D49747B8C108A01E66"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="id7E7BBEF3E2B54CFA9325CB5AC7E6993F"><enum>(A)</enum><header>Disaster-related population decrease</header><text>The term <term>disaster-related population decrease</term>, with respect to an urbanized area, means that— </text><clause id="id054DA75ED63B471A8366E6C3A132E67E"><enum>(i)</enum><text>the population of the urbanized area decreases to be less than 50,000 individuals, as determined in a decennial census after the decennial census in which the area was designated as an urbanized area; and </text></clause><clause id="id4F5AADA456AA4F06BE3E352FD163C3EE"><enum>(ii)</enum><text>the decrease described in clause (i) is a result of a major disaster declared by the President under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>).</text></clause></subparagraph><subparagraph id="id647483FD07D84CD8844D2D3ACD29669C"><enum>(B)</enum><header>Urbanized area</header><text>The term <term>urbanized area</term> means an area designated in a decennial census as an urbanized area by the Secretary of Commerce.</text></subparagraph></paragraph><paragraph id="idE4C5ECB28FBB4200A2BEE60698A7A9E0"><enum>(2)</enum><header>Election</header><text>On request by the Governor of a State in which an urbanized area that experiences a disaster-related population decrease is located, the Secretary may elect for the purposes of this chapter, including for purposes of making apportionments under this chapter— </text><subparagraph id="idEB972E9009664011A42F9A020E39FB3C"><enum>(A)</enum><text>to use the population of the urbanized area, as determined in the decennial census before the most recent decennial census; and </text></subparagraph><subparagraph id="id2382960AEB394A78AD85EC4F960F287F"><enum>(B)</enum><text>to continue to treat the area as an urbanized area.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
