<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1221</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210420">April 20, 2021</action-date><action-desc><sponsor name-id="S375">Mr. Daines</sponsor> (for himself and <cosponsor name-id="S221">Mrs. Feinstein</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Director of the Office of Personnel Management to create a classification that more accurately reflects the vital role of wildland firefighters.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H7E2D4B7525F143B49BFF7CC44FC6AA21"><section section-type="section-one" id="HC970695279A444E29847ABCE57303CF0"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Wildland Firefighter Recognition Act</short-title></quote>.</text></section><section id="HD851BA4B7CEE4B6E88AED0F632620986"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="H4873C2AC0DA545328F06313A6FD0EE4E"><enum>(1)</enum><text>the term <term>Director</term> means the Director of the Office of Personnel Management;</text></paragraph><paragraph id="idEA5A43AE963C47F4B856FDA65BF280D8"><enum>(2)</enum><text>the term <term>employee</term> has the meaning given the term in section 2105 of title 5, United States Code;</text></paragraph><paragraph id="HAF77B8D1B89C40239C50A336D8BC8557"><enum>(3)</enum><text>the term <term>Federal land management agency</term> means—</text><subparagraph id="H490535B2B9A749DDAE36FF69C022E534"><enum>(A)</enum><text>within the Department of the Interior—</text><clause id="id8B91157AA74F4846AC6C676F68F456F7"><enum>(i)</enum><text>the Bureau of Land Management;</text></clause><clause id="id44277A1A2C7E4F5CB70030CF86490EA1"><enum>(ii)</enum><text>the Bureau of Indian Affairs;</text></clause><clause id="idB49F64D905F84BED8E752302D1A9C0B6"><enum>(iii)</enum><text>the National Park Service; and</text></clause><clause id="idDFE975DF473F4D04A8C87996E087407E"><enum>(iv)</enum><text>the United States Fish and Wildlife Service; and</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1CFC3F0938E24E6D8BABBB6EFE0A9EC8"><enum>(B)</enum><text>within the Department of Agriculture, the Forest Service;</text></subparagraph></paragraph><paragraph id="ide4a8947e0805475ea41d5d3c89cab718"><enum>(4)</enum><text>the term <term>wildland fire</term>—</text><subparagraph id="idccf8765636fb458d89ee4c016b3ace79"><enum>(A)</enum><text>means any non-structure fire that occurs in vegetation or natural fuels; and</text></subparagraph><subparagraph id="id19458c1831bc4442b55eab158babe375"><enum>(B)</enum><text>includes prescribed fire and wildfire; and</text></subparagraph></paragraph><paragraph id="H47981AD605804D92915A20C0C1FBE75F"><enum>(5)</enum><text>the term <term>wildland firefighter</term> means—</text><subparagraph id="idA6629280017041568C3448E34E374D7C"><enum>(A)</enum><text>an employee of a Federal land management agency, the duties of whose position are primarily to perform work directly related to the prevention, control, suppression, or management of wildland fires, including an employee of a Federal land management agency who is assigned to support wildland fire activities; and</text></subparagraph><subparagraph id="HBA97F0D5B1C849CC9528D72140FCBA80"><enum>(B)</enum><text>an employee of a Federal land management agency who is transferred to a supervisory or administrative position from a position described in subparagraph (A).</text></subparagraph></paragraph></section><section id="H9E09B9E1E0264EC1AD705FC2976463C2"><enum>3.</enum><header>Classification of
			 wildland firefighters</header><subsection id="H035E2802D3EB4B6CA4BD688A1F964510"><enum>(a)</enum><header>Requirements</header><paragraph id="HD8079966E5794F19A0DB5F908B74CBD9"><enum>(1)</enum><header>In
 general</header><text>Not later than 30 days after the date of enactment of this Act, the Director, in cooperation with the Federal land management agencies, shall commence development of a distinct wildland firefighter occupational series that more accurately reflects the variety of duties performed by wildland firefighters.</text></paragraph><paragraph id="H7CEE8914B4614C5B8A1B274D22DF8319"><enum>(2)</enum><header>Designation</header><text>The official title assigned to any occupational series established under paragraph (1) shall include the designation of <quote>Wildland Firefighter</quote>.</text></paragraph><paragraph id="H33CE30CABDB54CA5812AB86BF0C6E108"><enum>(3)</enum><header>Positions
 described</header><text>Paragraph (1) shall apply with respect to any class or other category of positions that consists primarily or exclusively of forestry technician positions, range technician positions, or any other positions the duties and responsibilities of which include—</text><subparagraph id="H6978E9CA2C0E4379BF43575D2F086E39"><enum>(A)</enum><text>significant prevention, preparedness, control, suppression, or management activities for wildland fires; or</text></subparagraph><subparagraph id="HC89DF532791B497E8EC5114783117A91"><enum>(B)</enum><text>activities necessary to meet any other emergency incident to which assigned.</text></subparagraph></paragraph><paragraph id="HF5245AE8640B4505A003152A3B0627ED"><enum>(4)</enum><header>Consultation</header><text>It is the sense of Congress that the Director should consult with employee associations and any other groups that represent wildland firefighters in carrying out this subsection.</text></paragraph><paragraph id="id56c59baa32304b31ad608b6c26b22896"><enum>(5)</enum><header>Implementation</header><text>Not later than 2 years after the date of enactment of this Act—</text><subparagraph id="id315987cc88b74e74812c587e74d46d0f"><enum>(A)</enum><text>the Director shall complete the development of the wildland firefighter occupational series required under paragraph (1); and</text></subparagraph><subparagraph id="idef3a8e164d894057a8e2cd2a9116e973"><enum>(B)</enum><text>the Secretary of the Interior and the Secretary of Agriculture shall use the wildland firefighter occupational series developed under paragraph (1) in the advertising and hiring of a wildland firefighter.</text></subparagraph></paragraph></subsection><subsection id="HB89DBEFD39434D0AA32DB4430991E73D"><enum>(b)</enum><header>Hazardous duty
 differential not affected</header><text>Section 5545(d)(1) of title 5, United States Code, is amended by striking <quote>except</quote> and all that follows and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="HF06F4442573F4D039D07BB70E7985BEB"><text>except—</text><subparagraph id="H09F8FFE5E6D44438AE037BB18F6C1421"><enum>(A)</enum><text>an employee in an occupational series covering positions for which the primary duties involve the prevention, control, suppression, or management of wildland fires, as determined by the Office; and</text></subparagraph><subparagraph id="H7AC53895F69B48DA930F325E75162612"><enum>(B)</enum><text>in such other circumstances as the Office may by regulation prescribe; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="iddc30f5530931444080bb1e1176974ee6"><enum>(c)</enum><header>Current employees</header><text>Any individual employed as a wildland firefighter on the date on which the occupational series established under subsection (a) takes effect may elect to—</text><paragraph id="idac8572903a00493490261c3b438e1099"><enum>(1)</enum><text>remain in the occupational series in which the individual is working; or</text></paragraph><paragraph id="id202bc32f84f747bfa244502f0c0dc671"><enum>(2)</enum><text>be included in the wildland firefighter occupational series established under subsection (a).</text></paragraph></subsection></section></legis-body></bill>
