which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To address the needs of workers in industries likely to be impacted by rapidly evolving technologies. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Investing in Tomorrow's Workforce Act of 2021</short-title></quote>.</text></section><section id="id848bfde3a45742e89990cb4805a0eaa5"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="id43a659443eb540eb9d29362b1cbb26ce"><enum>(1)</enum><text>In 2014, the United States spent just 0.1 percent of the Nation's Gross Domestic Product on labor market policies, less than half of what the United States spent on labor market policies 30 years ago.</text></paragraph><paragraph id="id3272bb654cc64e30b553b90bebe78646"><enum>(2)</enum><text>The number of workers receiving federally supported training has declined in the past 3 decades as advances in technology have simultaneously shifted labor market demand over time.</text></paragraph><paragraph id="id24d1d823a30545b7b9a7bf27d9948ebb"><enum>(3)</enum><text>Job losses from automation are more likely to impact women, people of color, and workers making less than $40,000 annually. </text></paragraph><paragraph id="ide33ab97f65da414eb62dc01e07b9ee22"><enum>(4)</enum><text>The COVID–19 pandemic has accelerated trends in automation, with 43 percent of businesses in the World Economic Forum’s Future of Jobs survey indicating they plan to reduce their workforce as a result of technology integration.</text></paragraph><paragraph id="id3b52c3f371c04ccf96bc05bd10a2d7d2"><enum>(5)</enum><text>Strong Federal investment in expanding training services for workers whose jobs may be lost due to automation could prepare the United States workforce to better adapt to changes in the labor market and enter into skilled positions in technologically oriented occupations and industries. </text></paragraph><paragraph id="id4827bac9f0664764bb65372ab3f869e9"><enum>(6)</enum><text>A focus on preparing the workforce of the United States for jobs that utilize advanced technologies could grow wages, increase economic productivity, and boost the competitiveness of the United States.</text></paragraph></section><section id="id7957f1db51a04ddda27fe45267b3db13"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id67c1bfa876094004b2fc19ae141a267f"><enum>(1)</enum><header>Automation</header><text>The term <term>automation</term> means a device, process, or system that functions without continuous input from an operator, including—</text><subparagraph id="ide9ad8c11c140406892cfe491a16160a6"><enum>(A)</enum><text>advanced technologies, such as—</text><clause id="id57B6ABFD692546219384663DE59B42E4"><enum>(i)</enum><text>data collection, classification processing, and analytics; and</text></clause><clause id="idD3818E8BD42345219C578B164F455E29"><enum>(ii)</enum><text>3–D printing, digital design and simulation, and digital manufacturing;</text></clause></subparagraph><subparagraph id="id39d253e18d394f7eb1f390ba707e1cbb"><enum>(B)</enum><text>robotics, including collaborative robotics, and worker augmentation technology;</text></subparagraph><subparagraph id="id067cec09fc2845a78d71608ba3c54496"><enum>(C)</enum><text>autonomous vehicle technology; or</text></subparagraph><subparagraph id="id1abb3605fa604ad281da61a9e600859d"><enum>(D)</enum><text>autonomous machinery technology.</text></subparagraph></paragraph><paragraph id="id201ede80a7464c89af23920dd54a2eff"><enum>(2)</enum><header>Dislocated worker</header><text>The term <term>dislocated worker</term> has the meaning given the term in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph><paragraph id="ide049bad3a1184bdd9881ea740034b518"><enum>(3)</enum><header>In-demand industry sector or occupation</header><text>The term <term>in-demand industry sector or occupation</term> has the meaning given the term in section 3 of that Act.</text></paragraph><paragraph id="id3e4ed2a8c8a044e7842efc9120694330"><enum>(4)</enum><header>Integrated education and training</header><text>The term <term>integrated education and training</term> has the meaning given the term in section 203 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3272">29 U.S.C. 3272</external-xref>).</text></paragraph><paragraph id="idF5422447E31C44B893813E50A855BE05"><enum>(5)</enum><header>Eligible partnership</header><text>The term <term>eligible partnership</term> means an industry or sector partnership, as defined in section 3 of that Act, except that—</text><subparagraph id="id13801D087CCD4C6285B208084513C93B"><enum>(A)</enum><text>for purposes of applying paragraph (26)(A)(iii) of that section, the term <term>institution of higher education</term> has the meaning given the term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>); and</text></subparagraph><subparagraph id="id0f4b94c1ae114bb0874834372b5f8efb"><enum>(B)</enum><text>the partnership shall include, in addition to the representatives described in clauses (i) through (iii) of paragraph (26)(A) of that section, representatives of—</text><clause id="idedc3bbaf1df94d9186c38aa6f8ec4c74"><enum>(i)</enum><text>a State workforce development board or a local workforce development board; and</text></clause><clause id="id0ab89ec27bc1461e953ce1943852c1b5"><enum>(ii)</enum><text>an economic development organization.</text></clause></subparagraph></paragraph><paragraph id="id3BB72DC10B264D82A460B7A40AF0618D"><enum>(6)</enum><header>GAO study on automation</header><text>The term <term>GAO study on automation</term> means the study on automation conducted by the Comptroller General of the United States, as directed in House Report 116–450 (incorporated in the explanatory statement regarding the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>) in accordance with section 4 of such Act). </text></paragraph><paragraph id="id5cb83d3270024bbca7bfc3e6d4a0c90a"><enum>(7)</enum><header>Local and State workforce development boards</header><text>The terms <term>local workforce development board</term> and <term>State workforce development board</term> have the meanings given the terms <quote>local board</quote> and <term>State board</term>, respectively, in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></paragraph><paragraph id="id87bdbdd4e124403fb48f436a32bb1b57"><enum>(8)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Labor.</text></paragraph><paragraph id="idaf82d2718ace4337bfde981c03d4ea58"><enum>(9)</enum><header>Training services</header><text>The term <term>training services</term> means training services described in section 134(c)(3)(D) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174(c)(3)(D)</external-xref>).</text></paragraph></section><section id="id0d4f24753d5b4623933e83f02182a547"><enum>4.</enum><header>Grants to improve training for workers impacted by automation</header><subsection id="idf6e722662c1c4ad3bafb9d6b5232def5"><enum>(a)</enum><header>Grants authorized</header><paragraph id="idB5CCD1A7B31D47F8B0D55FF4987F24B9"><enum>(1)</enum><header>In general</header><text>From the amounts appropriated under subsection (g) and beginning after the earlier of the date of submission of the GAO study on automation or October 1, 2022, the Secretary of Labor shall award grants, on a competitive basis, to eligible partnerships to support demonstration and pilot projects relating to the training needs of workers who are, or are likely to become, dislocated workers as a result of automation. </text></paragraph><paragraph id="idb7c66efb6178405eb3fea177d018fbd6"><enum>(2)</enum><header>Duration</header><text>A grant awarded under this section shall be for a period not to exceed 4 years.</text></paragraph><paragraph id="idC9A7FC6BF460414488DDA491D1142E32"><enum>(3)</enum><header>Use of report</header><text>The Secretary shall use the GAO study on automation to inform the grant program carried out under this section.</text></paragraph></subsection><subsection id="idfeb90d7b2abf4dd3adb526ffa0cb9713"><enum>(b)</enum><header>Applications</header><paragraph id="id2aa1470f81e24ec1bfb408131062ffb6"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant under this section, an eligible partnership shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary shall reasonably require.</text></paragraph><paragraph id="idb8cfdf4a2080433ab5d5556640dfbd80"><enum>(2)</enum><header>Contents</header><text>Each application submitted under paragraph (1) shall include a description of the demonstration or pilot project to be completed with the grant funds, which description shall include—</text><subparagraph id="id5834573c906a441bb9247c2e2e496073"><enum>(A)</enum><text>a description of the members of the eligible partnership who will be involved in the demonstration or pilot program and the services each member will provide;</text></subparagraph><subparagraph id="id2e581985c19e4e1596807a2638f31988"><enum>(B)</enum><text>a description of the training services that will be available to individuals participating in the demonstration or pilot project, which may include—</text><clause id="id689d38a3ee2045baa94c1806207ae5f1"><enum>(i)</enum><text>a plan to train dislocated workers from industries likely to be impacted by automation and transition the workers into regionally in-demand industry sectors or occupations; and</text></clause><clause id="id4a074b969ad846f7bee8773d64fe51d3"><enum>(ii)</enum><text>a plan to partner with local businesses to retrain, upskill, and re-deploy workers within an industry as an alternative to layoffs;</text></clause></subparagraph><subparagraph id="id43f040d884f44693ad926007405c44c9"><enum>(C)</enum><text>a plan to provide workers with technology-based skills training, which may include training to provide skills related to coding, systems engineering, or information technology security, in addition to other skills; and</text></subparagraph><subparagraph id="id1b0b22c385074638b3e7bacadef88ea4"><enum>(D)</enum><text>a description of the goals that the eligible partnership intends to achieve to upskill workers and prepare them for in-demand industry sectors or occupations.</text></subparagraph></paragraph></subsection><subsection id="idaa193c672cfe45898f512ca72be141a2"><enum>(c)</enum><header>Priorities</header><text>In awarding grants under this section, the Secretary shall give priority to—</text><paragraph id="idc6eede2886a54646aa777a13c9085b96"><enum>(1)</enum><text>eligible partnerships that are located in an area with a high concentration of—</text><subparagraph id="idb87b3b96dead4d7f9e360470dc82a4df"><enum>(A)</enum><text>industries with a higher likelihood of being impacted by automation; or</text></subparagraph><subparagraph id="id715ac73f87eb487fa33ecc032d2b08f7"><enum>(B)</enum><text>industries included in in-demand industry sectors, as determined under subparagraphs (A)(i) and (B) of section 3(23) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102(23)</external-xref>);</text></subparagraph></paragraph><paragraph id="idce36313220b24d8ba59bb98026816ce4"><enum>(2)</enum><text>eligible partnerships—</text><subparagraph id="id054D08DBB5E14151B6D5FEF7E6042BBD"><enum>(A)</enum><text>with a plan to provide incumbent worker training—</text><clause id="id6FB9713BDD9040C6BFC5552B1AA0BBC3"><enum>(i)</enum><text>to assist workers in obtaining the skills necessary to retain employment or avert layoffs; or</text></clause><clause id="id58535B7B39B144CAAA0455F2B06AD2B1"><enum>(ii)</enum><text>that allows a worker working for an employer to acquire new skills that allow the worker to obtain a higher-skilled or higher-paid position with such employer; and</text></clause></subparagraph><subparagraph id="id7AAF2FD25D7A4DDCBFDDA348873AE83F"><enum>(B)</enum><text>that partner with local employers that intend to backfill the pre-training positions of the incumbent workers by hiring new workers to fill those positions;</text></subparagraph></paragraph><paragraph id="idf2756f0bee084a0ea87dfe48620d63cf"><enum>(3)</enum><text>eligible partnerships that will provide workers with a transportation stipend, paid sick leave, paid family and medical leave, access to child care services, or other employment benefits; or</text></paragraph><paragraph id="id4d428c1565b944fb9c28f791da141e06"><enum>(4)</enum><text>eligible partnerships with a plan to develop a shared training curriculum that can be used across local and regional networks of employers and training providers.</text></paragraph></subsection><subsection id="id6251979c87334e099d41d4cd0380fdf1"><enum>(d)</enum><header>Use of funds</header><text>An eligible partnership that receives a grant under this section shall use the grant funds for 1 or more of the following:</text><paragraph id="idca65126ee8774f2789303364a6c5b7aa"><enum>(1)</enum><text>Providing training services under the demonstration or pilot project, which may include training services that prepare workers for in-demand industry sectors or occupations.</text></paragraph><paragraph id="idcd879f3cc2174d72a8505336f3c28e73"><enum>(2)</enum><text>Providing assistance for employers in developing a staff position for an individual who will be responsible for supporting training services provided under the grant.</text></paragraph><paragraph id="id651d94e240554b3a9b628925a69721ca"><enum>(3)</enum><text>Purchasing equipment or technology necessary for training services provided under paragraph (1).</text></paragraph><paragraph id="idb01e9f35fc094f5a84f54cb315443c9b"><enum>(4)</enum><text>Providing job search and other transitional assistance to workers in industries with high rates of job loss.</text></paragraph><paragraph id="idcdc1e0c8d2c94421bb0d3778d1254b12"><enum>(5)</enum><text>Providing a training stipend to workers for training services.</text></paragraph><paragraph id="ide255ebe618f24d209c7e85ecffb8736c"><enum>(6)</enum><text>Providing integrated education and training.</text></paragraph></subsection><subsection id="id4a784ac4d524400bae327d3ed03c0055"><enum>(e)</enum><header>Report</header><text>Not later than 1 year after an eligible partnership’s completion of a demonstration or pilot project supported under this section, the eligible partnership shall prepare and submit to the Secretary a report regarding—</text><paragraph id="id341f3a9472e74a9a8c9986f54ab0c8a0"><enum>(1)</enum><text>the number of workers who received training services through the demonstration or pilot project, disaggregated by type of training service and the age, gender, and race of the workers;</text></paragraph><paragraph id="id46ca6f582c0e4346adf54418799915f2"><enum>(2)</enum><text>the number of such workers who successfully transitioned into a new position following completion of the training services;</text></paragraph><paragraph id="id16917118579143f09cea47c135786a04"><enum>(3)</enum><text>the number of individuals who successfully transitioned into an in-demand industry sector or occupation following completion of the training services;</text></paragraph><paragraph id="id361e7e5c531b4c26b8b7d01b1c06cea1"><enum>(4)</enum><text>annual earnings data for individuals who have completed training services through the demonstration or pilot project;</text></paragraph><paragraph id="idde6018d5426a462aa49f89d46b30e99e"><enum>(5)</enum><text>the percentage of individuals described in paragraph (4) who are in education or training activities, or in employment, during the second quarter after exit from the training services;</text></paragraph><paragraph id="idc1317a7c4c174029bed06d5fe5221e90"><enum>(6)</enum><text>the percentage of individuals described in paragraph (4) who are in education or training activities, or in employment, during the fourth quarter after exit from the training services; and</text></paragraph><paragraph id="idf013d86845d545ae85274330819aad6f"><enum>(7)</enum><text>any practices used by the partnership that should be considered best practices with respect to training workers in industries that have, or are expected to have, high rates of job loss as a result of automation.</text></paragraph></subsection><subsection id="id6cb3e0cd606242d19d4c9fa6e6315117"><enum>(f)</enum><header>General requirements</header><text>An eligible partnership that receives a grant under this section shall use the grant funds in a manner that is consistent with the labor standards and protections described in section 181 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3241">29 U.S.C. 3241</external-xref>) and nondiscrimination provisions described in section 188 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3248">29 U.S.C. 3248</external-xref>).</text></subsection><subsection id="id54d2067e72cf43ba97540200beda113a"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for the first 5 full fiscal years beginning after the earlier of the date of submission of the GAO study on automation or October 1, 2022.</text></subsection></section><section id="iddbf69792999548a2a5f3e42615410d8c"><enum>5.</enum><header>Expansion of worker training services</header><subsection id="id9c05a5503b304fb4be610f7d59a6de2a"><enum>(a)</enum><header>Adult and dislocated worker employment and training</header><text>Section 134(d)(1)(A) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174(d)(1)(A)</external-xref>) is amended—</text><paragraph id="id622902F58EF1449E9E09C5DB1A2903BB"><enum>(1)</enum><text>in clause (xi), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="id8A4023491ECB4E139F9AE2490709EA25"><enum>(2)</enum><text>in clause (xii), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="id5D4B7C8F7C1A4221BB83E459F142F1B7"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id114CD29E69964292B22EA5DB0DE1519E"><clause commented="no" display-inline="no-display-inline" id="id2f7989b3ba954f52b8ed3ad62d46a1ed"><enum>(xiii)</enum><text>training programs for individuals who are, or are likely to become, dislocated workers as a result of automation, including activities that prepare the individuals for occupations in the technology sector.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id86b72856d00746489ef85826f1126365"><enum>(b)</enum><header>National dislocated worker grants</header><text>Section 170 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3225">29 U.S.C. 3225</external-xref>) is amended—</text><paragraph id="id6C2792786BCB4B5F8ECCD18DB2A4CCED"><enum>(1)</enum><text>in subsection (b)(1)(A), by inserting <quote>advances in automation technology,</quote> before <quote>plant closures,</quote>; and</text></paragraph><paragraph id="id905591D75F484E5F8EAD2385C01C74C9"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id60b80e7b04ee45678f3c3d7c4f290f34"><subsection id="id50c259485039412896f011ce09983036"><enum>(e)</enum><header>Authorization of appropriations</header><text>In addition to any funds reserved under section 132(a)(2)(A) to carry out this section, there are authorized to be appropriated to carry out this section $40,000,000 for each of fiscal years 2022 through 2026.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
