which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Cahokia Mounds Mississippian Culture National Historical Park in Collinsville, Illinois, Monroe, Madison, and St. Clair Counties, Illinois, and St. Louis City County, Missouri, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H9B6C3BF48A29493291F889E66B2B5083"><section section-type="section-one" id="H34FED45AA9174D9FB50B33732D6E8609"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cahokia Mounds Mississippian Culture National Historical Park Act</short-title></quote>.</text></section><section id="id1FF9AD8947F44622BCECD2F8F92224D9"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HAF331351CE984CD998138641370F0001"><enum>(1)</enum><header>Historical park</header><text>The term <term>historical park</term> means the Cahokia Mounds Mississippian Culture National Historical Park established by section 3(a).</text></paragraph><paragraph id="H4733F78A4601403C814FBB80379EC11F"><enum>(2)</enum><header>Map</header><text display-inline="yes-display-inline">The term <term>map</term> means the map entitled <quote>Cahokia Mounds Mississippian Culture National Historical Park, Boundary</quote>, numbered CMMC–NHP–107, and dated 05–31–2019.</text></paragraph><paragraph id="HF4FAA520241A4416BC03050A337EC68F"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB403C6CC3A8B424FA863936D2054A164"><enum>(4)</enum><header>States</header><text>The term <term>States</term> means the States of Illinois and Missouri.</text></paragraph></section><section id="HA128570120564A249FFEA4FD37234565"><enum>3.</enum><header>Cahokia Mounds Mississippian Culture National Historical Park, Illinois and Missouri</header><subsection display-inline="no-display-inline" id="H7989116E258C42ED86E46D5FA55B625D"><enum>(a)</enum><header>Establishment</header><paragraph id="H1189D09098B44B4E8C6BDF32E71E2BD1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), in order to preserve and interpret for the benefit of present and future generations the historical, cultural, and natural resources associated with the life of the Mississippian Culture and to preserve access for Native American spiritual practices and expressions, there is established, as a unit of the National Park System, the Cahokia Mounds Mississippian Culture National Historical Park in—</text><subparagraph id="id706CB87DA1AF45A8AEF5CBDBB4D8EA07"><enum>(A)</enum><text display-inline="yes-display-inline">Collinsville, Illinois;</text></subparagraph><subparagraph id="idAA2302BDE3AF40988B655521CD539851"><enum>(B)</enum><text display-inline="yes-display-inline">Monroe, Madison, and St. Clair Counties, Illinois; and </text></subparagraph><subparagraph id="id5C5BA02A1DEE45F9A196A33617FE0A5F"><enum>(C)</enum><text display-inline="yes-display-inline">St. Louis City County, Missouri.</text></subparagraph></paragraph><paragraph id="HFA39A58F8D504FE7B01D1DFA2256F93C"><enum>(2)</enum><header>Determination by Secretary</header><text>The historical park shall not be established until the date on which the Secretary determines that a sufficient quantity of land, or interests in land, has been acquired in accordance with subsection (c) to constitute a manageable unit.</text></paragraph><paragraph id="HDC373AE5A5EF400DA38AD1E3122D2295"><enum>(3)</enum><header>Notice</header><text>Not later than 30 days after the date on which the Secretary acquires sufficient land under subsection (c) to achieve compliance with paragraph (2), the Secretary shall publish in the Federal Register a notice of the establishment of the historical park.</text></paragraph><paragraph id="H7BFA3BDCEABA4BEBA3C37254456D1F85"><enum>(4)</enum><header>Availability of map</header><text>The map shall be on file and available for public inspection in the appropriate offices of the National Park Service.</text></paragraph></subsection><subsection id="H984968AB80E44884A7AF3CFC180170C9"><enum>(b)</enum><header>Boundary</header><text display-inline="yes-display-inline">The boundary of the historical park shall be the boundary as depicted on the map. </text></subsection><subsection id="H62BB9439976449AB9ACA7BE054EB5BF1"><enum>(c)</enum><header>Land acquisition</header><text display-inline="yes-display-inline"><?xm-replace_text text?></text><paragraph id="id6ADD89A5202643C0BA11738457C3C9E3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the Secretary may acquire land and interests in land within the boundary of the historical park by—</text><subparagraph id="id8D71AD4471E844518AEF9627D7FA54A6"><enum>(A)</enum><text display-inline="yes-display-inline">donation;</text></subparagraph><subparagraph id="id931CDC0368D2443F8056D7D63B325DAE"><enum>(B)</enum><text display-inline="yes-display-inline">purchase from a willing seller with donated or appropriated funds; or </text></subparagraph><subparagraph id="idDE013D0505D749EEA64CA872CB6DF8F6"><enum>(C)</enum><text display-inline="yes-display-inline">exchange.</text></subparagraph></paragraph><paragraph id="id6C7CEB67C33B4DAEB40D2A79BCD248E6"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">Any land owned by the States or a political subdivision of 1 of the States may be acquired only by donation. </text></paragraph></subsection><subsection id="H53808299206945F9AD559873F82D5565"><enum>(d)</enum><header>Administration</header><paragraph id="H5FC8C17CE86743B6B62FBFA9DC99A61E"><enum>(1)</enum><header>In general</header><text>The Secretary shall administer the historical park in accordance with—</text><subparagraph id="idDA3491FAFFB346668C5437927F70E0D0"><enum>(A)</enum><text>this section; and </text></subparagraph><subparagraph id="id7D3392275E304FE0A76C7769843AEA7B"><enum>(B)</enum><text>the laws generally applicable to units of the National Park System, including—</text><clause id="H14A4AD7FE0F74FAAB5F75A77CCF1610B"><enum>(i)</enum><text display-inline="yes-display-inline">sections 100101(a), 100751(a), 100752, 100753, and 102101 of title 54, United States Code; and</text></clause><clause id="HB05143B8D5914867AA60E653B26EC8A3"><enum>(ii)</enum><text display-inline="yes-display-inline">chapters 1003 and 3201 of title 54, United States Code.</text></clause></subparagraph></paragraph><paragraph id="HDE9BEC4A6C4D418BACB02303364BA084"><enum>(2)</enum><header>Cooperative agreements</header><subparagraph id="H2C7212A3E89D41419F0AF083D255E2C6"><enum>(A)</enum><header>In general</header><text>The Secretary may enter into cooperative agreements with the States and political subdivisions of the States, institutions of higher education, nonprofit organizations, Indian Tribes, and individuals—</text><clause id="H35868C2F17864395B74FF8CBBA81B748"><enum>(i)</enum><text>to identify, interpret, and restore nationally significant historical or cultural and natural resources relating to the life of the Mississippian Culture within the boundaries of the historical park, subject to the condition that such an agreement shall provide for reasonable public access; and</text></clause><clause id="H80B6F03BC12A45B1BD493CE0F13C228F"><enum>(ii)</enum><text>to conduct research relating to the Mississippian Culture.</text></clause></subparagraph><subparagraph id="H9183828FEB074632B172E6B5E020143E"><enum>(B)</enum><header>Cost-sharing</header><clause id="H83D231359539499987AF9B92CD0B8E90"><enum>(i)</enum><header>Federal share</header><text>The Federal share of the total cost of any activity carried out under this paragraph shall be not more than 50 percent.</text></clause><clause id="H8D2B529AAF934AD6978B2FCFB9406EB9"><enum>(ii)</enum><header>Form of non-Federal share</header><text>The non-Federal share of the cost of carrying out an activity under this paragraph may be in the form of—</text><subclause id="id2D8486B5B5D04F389F8AF8D1A35A536D"><enum>(I)</enum><text>in-kind contributions; or </text></subclause><subclause id="id58A68720ABD642F59C9D999F45B5B313"><enum>(II)</enum><text>goods or services fairly valued.</text></subclause></clause></subparagraph></paragraph></subsection><subsection id="H5DC3C730E2C94CD8ADCF73765D5370BD"><enum>(e)</enum><header>General management plan</header><paragraph id="HBFC70165BE834A5AB99358AC12935ABA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date on which funds are made available to carry out this section, the Secretary shall prepare a general management plan for the historical park in accordance with section 100502 of title 54, United States Code.</text></paragraph><paragraph id="H8DAAF2449EC341E4A4C982624502777D"><enum>(2)</enum><header>Consultation</header><text>In preparing the general management plan under paragraph (1), the Secretary shall consult with—</text><subparagraph id="id8F3A02E03D9F44AAB36F17CFEA75B69C"><enum>(A)</enum><text>the States and political subdivisions of the States;</text></subparagraph><subparagraph id="idAAB435D6EC5E424DB0B6A6E4F8E94331"><enum>(B)</enum><text>institutions of higher education;</text></subparagraph><subparagraph id="id3126417D588F45F697D362D9A056E1C0"><enum>(C)</enum><text>nonprofit organizations;</text></subparagraph><subparagraph id="idA39FF2E9E91049A5B488F95B3CA6BBDE"><enum>(D)</enum><text>Indian Tribes; and</text></subparagraph><subparagraph id="id787E44F6EB3443289CF31EAD53E7FD1D"><enum>(E)</enum><text>other affected individuals and entities, including—</text><clause id="H812A29F2786E4D9A8FF2C55DEB22410A"><enum>(i)</enum><text display-inline="yes-display-inline">the Illinois Department of Natural Resources;</text></clause><clause id="H40CF691FA3A847E5ABEDFA8AE6C239B1"><enum>(ii)</enum><text>the Osage Tribe; and</text></clause><clause id="H066861B74CAB42B19213D1CE79FF25CC"><enum>(iii)</enum><text>the HeartLands Conservancy.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
