<official-title>To amend the Lacey Act Amendments of 1981 to clarify provisions enacted by the Captive Wildlife Safety Act, to further the conservation of certain wildlife species, and for other purposes.</official-title>

<section id="H50505A134E06488AB2814AC7DE7A3AE3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Big Cat Public Safety Act</short-title></quote>.</text></section> <section id="H5C406454538A4440B3920A5FCE42C2E4"><enum>2.</enum><header>Definitions</header> <subsection id="H4BC03792046D475680A15A98919FB02C"><enum>(a)</enum><header>In general</header><text>Section 2 of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3371">16 U.S.C. 3371</external-xref>) is amended—</text>
<paragraph id="HD14DB3597DD7493E99C12C02C6272CB1"><enum>(1)</enum><text>by redesignating subsections (a) through (k) as subsections (b) through (l), respectively; and</text></paragraph> <paragraph id="HAEF34999F6154DB7AFADF14F193E587A"><enum>(2)</enum><text>by inserting before subsection (b) (as so redesignated) the following:</text>
<quoted-block id="H3577A791F92B47C5BC9B65AA78FE48B5" style="OLC">
<subsection id="H70AD391E327D47F7AD6264B2E1059488"><enum>(a)</enum><header>Breed</header><text display-inline="yes-display-inline">The term <quote>breed</quote> means to facilitate propagation or reproduction (whether intentionally or negligently), or to fail to prevent propagation or reproduction.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="HC6FA21E1242B4418B9103FD4C3DA8947"><enum>(b)</enum><header>Conforming amendments</header> <paragraph id="H4CB32E4918B049A3827C02AAA2B404ED"><enum>(1)</enum><header>Consolidated Farm and Rural Development Act</header><text>Section 349(a)(3) of the Consolidated Farm and Rural Development Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1997">7 U.S.C. 1997(a)(3)</external-xref>) is amended by striking <quote>section 2(a)</quote> and inserting <quote>section 2(b)</quote>.</text></paragraph>
<paragraph id="H0C7FEE47E9A04EC58CE466C911CACF1E"><enum>(2)</enum><header>Lacey Act Amendments of 1981</header><text display-inline="yes-display-inline">Section 7(c) of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3376">16 U.S.C. 3376(c)</external-xref>) is amended by striking <quote>section 2(f)(2)(A)</quote> and inserting <quote>section 2(g)(2)(A)</quote>.</text></paragraph></subsection></section> <section id="H766D99B2E97045039D277B260B791E5F"><enum>3.</enum><header>Prohibitions</header><text display-inline="no-display-inline">Section 3 of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3372">16 U.S.C. 3372</external-xref>) is amended—</text>
<paragraph id="H26E9F08392054DE5B9C5C41AB77156DE"><enum>(1)</enum><text>in subsection (a)—</text> <subparagraph id="HF298827782414429B0B0B9C93D0172D4"><enum>(A)</enum><text>in paragraph (2)—</text>
<clause id="HF168ED8E32DF434999A052622D9E6A35"><enum>(i)</enum><text>in subparagraph (A), by striking the semicolon at the end and inserting <quote>; or</quote>;</text></clause> <clause id="H888C4496D3AE4FACB9E0EFF09F0A12B3"><enum>(ii)</enum><text>in subparagraph (B)(iii), by striking <quote>; or</quote> and inserting a semicolon; and</text></clause>
<clause id="H8E8A72E5E23B4202B2332A82D06567B0"><enum>(iii)</enum><text>by striking subparagraph (C); and</text></clause></subparagraph> <subparagraph id="H8B4CE744FB8F4D44A7085E1FA506B2DD"><enum>(B)</enum><text>in paragraph (4), by striking <quote>(1) through (3)</quote> and inserting <quote>(1) through (3) or subsection (e)</quote>; and</text></subparagraph></paragraph>
<paragraph id="H9B8691F38BEF4A9E8220BB9B1361123A"><enum>(2)</enum><text>by amending subsection (e) to read as follows:</text> <quoted-block id="H7E3A2891BD964BACA7351D6F10C0E239" style="OLC"> <subsection id="H8F6A4D7C65904EE89422B069FAC014E2"><enum>(e)</enum><header>Captive wildlife offense</header> <paragraph id="HEE420D413EF040CE84164A4E5C4961D9"><enum>(1)</enum><header>In general</header><text>It is unlawful for any person to import, export, transport, sell, receive, acquire, or purchase in interstate or foreign commerce, or in a manner substantially affecting interstate or foreign commerce, or to breed or possess, any prohibited wildlife species.</text></paragraph>
<paragraph id="HF19C8A789A1E41DA9E78CFFA82DDE023"><enum>(2)</enum><header>Limitation on application</header><text>Paragraph (1) does not apply to—</text> <subparagraph id="H6E825546FEC94DE7B04734ACCF1C2828"><enum>(A)</enum><text>an entity exhibiting animals to the public under a Class C license from the Department of Agriculture, or a Federal facility registered with the Department of Agriculture that exhibits animals, if such entity or facility holds such license or registration in good standing and if the entity or facility—</text>
<clause id="H56B95B194A1D4C5084C913307141AB49"><enum>(i)</enum><text>does not allow any individual to come into direct physical contact with a prohibited wildlife species, unless that individual is—</text> <subclause id="H69504ABA93D444BBA3211560DA124D6D"><enum>(I)</enum><text display-inline="yes-display-inline">a trained professional employee or contractor of the entity or facility (or an accompanying employee receiving professional training);</text></subclause>
<subclause id="H4BACF1637AC44A66875CEB5F3B40C838"><enum>(II)</enum><text display-inline="yes-display-inline">a licensed veterinarian (or a veterinary student accompanying such a veterinarian); or</text></subclause> <subclause id="H1EA9236D5EAD4DE4A6BC11C0B93C02AA"><enum>(III)</enum><text display-inline="yes-display-inline">directly supporting conservation programs of the entity or facility, the contact is not in the course of commercial activity (which may be evidenced by advertisement or promotion of such activity or other relevant evidence), and the contact is incidental to humane husbandry conducted pursuant to a species-specific, publicly available, peer-edited population management and care plan that has been provided to the Secretary with justifications that the plan—</text>
<item id="HD96F5609729C4F70B3F779531915E227"><enum>(aa)</enum><text>reflects established conservation science principles;</text></item> <item id="HFD3D0E83847947D494C25D89FDCFF0DC"><enum>(bb)</enum><text>incorporates genetic and demographic analysis of a multi-institution population of animals covered by the plan; and</text></item>
<item id="HEF75F5B0D790413DAE09C0C092A78CAB"><enum>(cc)</enum><text>promotes animal welfare by ensuring that the frequency of breeding is appropriate for the species; and</text></item></subclause></clause> <clause id="H715DAF959795426F9F239534C47BFEC4"><enum>(ii)</enum><text>ensures that during public exhibition of a lion (Panthera leo), tiger (Panthera tigris), leopard (Panthera pardus), snow leopard (Uncia uncia), jaguar (Panthera onca), cougar (Puma concolor), or any hybrid thereof, the animal is at least 15 feet from members of the public unless there is a permanent barrier sufficient to prevent public contact;</text></clause></subparagraph>
<subparagraph id="HE9D499CC7DD34E419FA2CE95021F333E"><enum>(B)</enum><text>a State college, university, or agency, or a State-licensed veterinarian;</text></subparagraph> <subparagraph id="H6804D1004C924FD9B3A6E96A4DD409DD"><enum>(C)</enum><text>a wildlife sanctuary that cares for prohibited wildlife species, and—</text>
<clause id="H161009DAED954D99AD5FC019895DE40D"><enum>(i)</enum><text>is a corporation that is exempt from taxation under <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(a)</external-xref> of the Internal Revenue Code of 1986 and described in sections 501(c)(3) and 170(b)(1)(A)(vi) of such Code;</text></clause> <clause id="HE0238008C6F44FBEA4C9C98305D08A1B"><enum>(ii)</enum><text>does not commercially trade in any prohibited wildlife species, including offspring, parts, and byproducts of such animals;</text></clause>
<clause id="H28D71A0EEBB447AC82BDA18599498ADB"><enum>(iii)</enum><text>does not breed any prohibited wildlife species;</text></clause> <clause id="H93AEFED110DA4EEDB879E12241C8C8C2"><enum>(iv)</enum><text>does not allow direct contact between the public and any prohibited wildlife species; and</text></clause>
<clause id="H056FA1F7E068472CBD8E0ED8A2B3B102"><enum>(v)</enum><text>does not allow the transportation and display of any prohibited wildlife species off-site;</text></clause></subparagraph> <subparagraph id="HCD629B08EA514C9CAA9AAB7D27BD03AD"><enum>(D)</enum><text>has custody of any prohibited wildlife species solely for the purpose of expeditiously transporting the prohibited wildlife species to a person described in this paragraph with respect to the species; or</text></subparagraph>
<subparagraph id="HB7F358AC9A0543678447C824529C3EBA"><enum>(E)</enum><text>an entity or individual that is in possession of any prohibited wildlife species that was born before the date of the enactment of the Big Cat Public Safety Act, and—</text> <clause id="H98E94C99FAB64312AF0826A1B762E1CF"><enum>(i)</enum><text>not later than 180 days after the date of the enactment of the such Act, the entity or individual registers each individual animal of each prohibited wildlife species possessed by the entity or individual with the United States Fish and Wildlife Service;</text></clause>
<clause id="HB820620B1E794F9BBBB956501EEAB1D3"><enum>(ii)</enum><text>does not breed, acquire, or sell any prohibited wildlife species after the date of the enactment of such Act; and</text></clause> <clause id="H555E6D249F0747E5941A4A1DB20623E6"><enum>(iii)</enum><text>does not allow direct contact between the public and prohibited wildlife species.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
<section id="H1CA3D129B6F74FE3B68FDAFA3A583A27"><enum>4.</enum><header>Penalties</header>
<subsection id="HD1B58CA6D16D4A70925251C0B1E63212"><enum>(a)</enum><header>Civil penalties</header><text>Section 4(a)(1) of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3373">16 U.S.C. 3373(a)(1)</external-xref>) is amended—</text> <paragraph id="HFB5E8E5295F34F0C974CF20D31066741"><enum>(1)</enum><text>by inserting <quote>(e),</quote> after <quote>(d),</quote>; and</text></paragraph>
<paragraph id="H90D151F36298420491E86469175C723A"><enum>(2)</enum><text>by inserting <quote>, (e),</quote> after <quote>subsection (d)</quote>.</text></paragraph></subsection> <subsection id="HEB42C5ED6527488B9D0C283D50980B2B"><enum>(b)</enum><header>Criminal penalties</header><text>Section 4(d) of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3373">16 U.S.C. 3373(d)</external-xref>) is amended—</text>
<paragraph id="H1F92CE96A39A4D01A5C05ADADCAE03C1"><enum>(1)</enum><text>in paragraph (1)(A), by inserting <quote>(e),</quote> after <quote>(d),</quote>;</text></paragraph> <paragraph id="HEAEB365F19714958891EB8D82EBB0186"><enum>(2)</enum><text>in paragraph (1)(B), by inserting <quote>(e),</quote> after <quote>(d),</quote>;</text></paragraph>
<paragraph id="HCB942B7F3BD2447F926192CB3B840228"><enum>(3)</enum><text>in paragraph (2), by inserting <quote>(e),</quote> after <quote>(d),</quote>; and</text></paragraph> <paragraph id="HFA8CE2F8AA654B47A7B94264ECA2C8E8"><enum>(4)</enum><text>by adding at the end the following:</text>
<quoted-block id="HD7CCD41B246F4DF3B97A8E7B5BF182C7" style="OLC">
<paragraph id="HC5416FEFFBF94DC08A59B2C4AEA859DF"><enum>(4)</enum><text>Any person who knowingly violates subsection (e) of section 3 shall be fined not more than $20,000, or imprisoned for not more than five years, or both. Each violation shall be a separate offense and the offense is deemed to have been committed in the district where the violation first occurred, and in any district in which the defendant may have taken or been in possession of the prohibited wildlife species.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> <section id="HF0B2F91F04EB40D1829271A81054A18C"><enum>5.</enum><header>Forfeiture of prohibited wildlife species</header><text display-inline="no-display-inline">Section 5(a)(1) of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3374">16 U.S.C. 3374(a)(1)</external-xref>) is amended by inserting <quote>bred, possessed,</quote> before <quote>imported, exported,</quote>.</text></section>
<section id="H8E31869A887B4BB0985D11693DC6C5CB"><enum>6.</enum><header>Administration</header><text display-inline="no-display-inline">Section 7(a) of the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3376">16 U.S.C. 3376(a)</external-xref>) is amended by adding at the end the following:</text> <quoted-block id="H8ED08BF4DA5B43789686ED0295BF6DAE" style="OLC"> <paragraph id="HB76304DBA68942389A8F005400EBEC18"><enum>(3)</enum><text>The Secretary shall, in consultation with other relevant Federal and State agencies, promulgate any regulations necessary to implement section 3(e).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HF819CB1389A14E8E9A3F488A9AD369F0" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>7.</enum><header>Determination of budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text></section> </legis-body> </bill>
