<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 120</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210128">January 28, 2021</action-date><action-desc><sponsor name-id="S353">Mr. Schatz</sponsor> (for himself, <cosponsor name-id="S357">Mrs. Fischer</cosponsor>, <cosponsor name-id="S404">Mr. Scott of Florida</cosponsor>, <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>, and <cosponsor name-id="S402">Ms. Rosen</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prevent and respond to the misuse of communications services that facilitates domestic violence and other crimes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Connections Act of 2021</short-title></quote>.</text></section><section id="id6071b1618f354abe9c36ac768becafe8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline"> Except as otherwise provided in this Act, terms used in this Act that are defined in section 344(a) of the Communications Act of 1934, as added by section 4 of this Act, have the meanings given those terms in such section 344(a).</text></section><section id="idab41706ab0f24a3c916b0baea1eb75f0"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="idaa8d904a81ce47f5a62fb0a95ea4d678"><enum>(1)</enum><text>Domestic violence, dating violence, stalking, sexual assault, human trafficking, and related crimes are life-threatening issues and have lasting and harmful effects on individuals, families, and entire communities. Communications law can play a public interest role in the promotion of safety, life, and property in this regard.</text></paragraph><paragraph id="id3d4cae379e7a4782a9a74d9cff4c0604"><enum>(2)</enum><text>Survivors often lack meaningful support and options when establishing independence from an abuser, including barriers such as financial insecurity and limited access to reliable communications tools to maintain essential connections with family, social safety networks, employers, and support services.</text></paragraph><paragraph id="id1d4d34debbe04130a454d018514ea326"><enum>(3)</enum><text>Perpetrators of violence and abuse described in paragraph (1) increasingly use technological and communications tools to exercise control over, monitor, and abuse their victims. Independent access to a wireless phone plan can assist survivors in establishing security and autonomy.</text></paragraph><paragraph id="id99940d6caa1a419797058b98c8a2adbe"><enum>(4)</enum><text>Safeguards within communications services can serve a role in preventing abuse and narrowing the digital divide experienced by survivors.</text></paragraph></section><section id="id4f157c73ffae43c8abff4660576204f4"><enum>4.</enum><header>Protection of domestic violence survivors within communications services</header><text display-inline="no-display-inline"> Part I of title III of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/301">47 U.S.C. 301</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idd8f124f74a3445138b8be187b1eb27a4"><section section-type="section-one" id="id0e93c13995ac400781fdc2c9f8eb065b"><enum>344.</enum><header>Protection of survivors of domestic violence, human trafficking, and related crimes</header><subsection id="id6718aa9b1a034c05ac0998e7c2833e02"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id10d4b2ef55f3462494018ae626572279"><enum>(1)</enum><header>Abuser</header><text>The term <term>abuser</term> means an individual who has committed a covered act against—</text><subparagraph id="idCECB67AF9A1846448AF9CCA24ECBA997"><enum>(A)</enum><text>an individual who seeks relief under subsection (b); or</text></subparagraph><subparagraph id="idEB760A78BEA4468FB497C9137B344D31"><enum>(B)</enum><text>an individual in the care of an individual who seeks relief under subsection (b).</text></subparagraph></paragraph><paragraph id="id1ECDD5E9F3BC410F86CEF66B7847ECEA"><enum>(2)</enum><header>Covered act</header><subparagraph id="id210E9DAFFFEF4A5F938020F8B4819D48"><enum>(A)</enum><header>In general</header><text>The term <term>covered act</term> means conduct that constitutes—</text><clause commented="no" id="id872A91075D654BAEB035E149FE0CDEB9"><enum>(i)</enum><text>a crime described in section 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12291">34 U.S.C. 12291(a)</external-xref>), including domestic violence, dating violence, sexual assault, stalking, and sex trafficking;</text></clause><clause commented="no" id="idA86074F937E2483FAFD0A167F1BDD001"><enum>(ii)</enum><text>an act or practice described in paragraph (11) or (12) of section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>) (relating to severe forms of trafficking in persons and sex trafficking, respectively); or</text></clause><clause commented="no" display-inline="no-display-inline" id="id6CEAE0127B0F4632BFEE7AF260BFB055"><enum>(iii)</enum><text>an act under State law, Tribal law, or the Uniform Code of Military Justice that is similar to an offense described in clause (i) or (ii). </text></clause></subparagraph><subparagraph id="idadd59558024548fa962310e9a021b2fb"><enum>(B)</enum><header>Conviction not required</header><text>Nothing in subparagraph (A) shall be construed to require a criminal conviction or any other determination of a court in order for conduct to constitute a covered act.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE2F77814FB364E36B2606F679448F6C0"><enum>(3)</enum><header>Covered provider</header><text>The term <term>covered provider</term> means a provider of a private mobile service or commercial mobile service, as those terms are defined in section 332(d).</text></paragraph><paragraph id="idEC9C5A02DA38477E8FDA0CD10E20AD26"><enum>(4)</enum><header>Primary account holder</header><text>The term <term>primary account holder</term> means an individual who is a party to a mobile service contract with a covered provider.</text></paragraph><paragraph commented="no" id="idB4A8921DEBB7435B80AB4B62797C2377"><enum>(5)</enum><header>Survivor</header><text>The term <term>survivor</term> means an individual who is not less than 18 years old and—</text><subparagraph commented="no" id="idBD9BE6F99A19424C8F5957D0F4A8B2C9"><enum>(A)</enum><text>against whom a covered act has been committed; or</text></subparagraph><subparagraph commented="no" id="id4CCEBF98C8E549D2BC482A55AF197DE1"><enum>(B)</enum><text>who cares for another individual against whom a covered act has been committed (provided that the individual providing care did not commit the covered act).</text></subparagraph></paragraph></subsection><subsection id="idc6dcdc31dad340a58fbf930778126138"><enum>(b)</enum><header>Separation of lines from shared mobile service contract</header><paragraph id="id5D779391CE6B426492A053E5DCCD4D30"><enum>(1)</enum><header>In general</header><text>Not later than 48 hours after receiving a line separation request from a survivor under subsection (c), a covered provider shall, as applicable, with respect to a shared mobile service contract under which the survivor and the abuser each use a line—</text><subparagraph id="id14C9B8C81ABA40B491A08C3152756F55"><enum>(A)</enum><text>separate the line of the survivor, and the line of any individual in the care of the survivor, from the shared mobile service contract; or</text></subparagraph><subparagraph id="id078E71DCA75340A0A9A3823556103E93"><enum>(B)</enum><text>separate the line of the abuser from the shared mobile service contract.</text></subparagraph></paragraph><paragraph id="id42d2ed46855245d68c056341157f7929"><enum>(2)</enum><header>Limitations on penalties, fees, and other requirements</header><text>A covered provider may not make separation of a line from a shared mobile service contract under paragraph (1) contingent on any requirement other than the requirements under subsection (c), including—</text><subparagraph id="id6215bf4d4f1344f7a538b1ff3d4f1f3e"><enum>(A)</enum><text>payment of a fee, penalty, or other charge;</text></subparagraph><subparagraph id="id5e836cbb279b461196ccdb9a27476f52"><enum>(B)</enum><text>maintaining contractual or billing responsibility of a separated line with the provider;</text></subparagraph><subparagraph id="id01b52c07ff3b444cae064818cf6cde1f"><enum>(C)</enum><text>approval of separation by the primary account holder, if the primary account holder is not the survivor;</text></subparagraph><subparagraph id="id9385c5e98103423fabafe064cb861203"><enum>(D)</enum><text>a prohibition or limitation, including one described in subparagraph (A), on number portability, if such portability is technically feasible, or a request to change phone numbers;</text></subparagraph><subparagraph id="id843f21fc241647878423b0c103a65a44"><enum>(E)</enum><text>a prohibition or limitation on the separation of lines as a result of arrears accrued by the account;</text></subparagraph><subparagraph id="id08ef25d2715343258982a2eb4155c454"><enum>(F)</enum><text>an increase in the rate charged for the mobile service plan of the primary account holder with respect to service on any remaining line or lines; or</text></subparagraph><subparagraph id="idEDD3ABF499294951A9A41740D9411C25"><enum>(G)</enum><text>any other limitation or requirement not listed under subsection (c).</text></subparagraph></paragraph><paragraph id="id199735a3e83044108687853af4c7f435"><enum>(3)</enum><header>Notice to survivor</header><text>If a covered provider separates a line from a shared mobile service contract under paragraph (1) and the primary account holder is not the survivor, the covered provider shall notify the survivor of the date on which the covered provider intends to give any formal notice to the primary account holder.</text></paragraph></subsection><subsection id="id7d60246ea1cf486686b7c0f53c17cbaf"><enum>(c)</enum><header>Line separation request</header><paragraph id="idc6da38bc970544d9be5773815800e64d"><enum>(1)</enum><header>In general</header><text>A survivor seeking relief under subsection (b) shall submit to the covered provider a line separation request that—</text><subparagraph id="id22B72AAEB6B24BC89741D8AB6BEF680E"><enum>(A)</enum><text>verifies that an individual who uses a line under the shared mobile service contract has committed a covered act against the survivor or an individual in the survivor’s care, by providing—</text><clause id="id697aeab06edb4bfba7edce7b621643f9"><enum>(i)</enum><text>a copy of a signed affidavit from a licensed medical or mental health care provider, licensed military medical or mental health care provider, licensed social worker, licensed victim services provider, or licensed military victim services provider, or an employee of a court, acting within the scope of that person’s employment; or</text></clause><clause id="id0569d55131584ce3baf5ea192e43609a"><enum>(ii)</enum><text>a copy of a police report, statements provided by police, including military police, to magistrates or judges, charging documents, protective or restraining orders, military protective orders, or any other official record that documents the covered act; and</text></clause></subparagraph><subparagraph id="ide8e9b13a08994afa8dcacaaff5df163a"><enum>(B)</enum><text>requests relief under subparagraph (A) or (B) of subsection (b)(1) and identifies each line that should be separated.</text></subparagraph></paragraph><paragraph id="idbdb9a153c8a54d098c97ee0f2170a6ac"><enum>(2)</enum><header>Remote option</header><text>A covered provider shall offer a survivor the ability to submit an opt-out request under paragraph (1) through secure remote means that are easily navigable.</text></paragraph><paragraph id="id4fb21570f1f94ba095a8d53725c9abdd"><enum>(3)</enum><header>Enhanced protections under State law</header><text>This subsection shall not affect any law or regulation of a State providing communications protections for survivors (or any similar category of individuals) that has less stringent requirements for providing evidence of a covered act (or any similar category of conduct) than this subsection.</text></paragraph></subsection><subsection id="id5b7210851b8c48e3b574ecd788397824"><enum>(d)</enum><header>Confidential and secure treatment of personal information</header><text>A covered provider shall treat any information submitted by a survivor under subsection (c) as confidential and securely dispose of the information not later than 90 days after receiving the information.</text></subsection><subsection id="id3da43e17545148aabb956c012157c9d3"><enum>(e)</enum><header>Availability of information to consumers</header><text>A covered provider shall make information about the options and process described in subsections (b) and (c) readily available to consumers—</text><paragraph id="id53CDDB1323D740DD996CD69828FAEB17"><enum>(1)</enum><text>on the website and any mobile application of the provider;</text></paragraph><paragraph id="id0F19FACA718D4647AC18558A6C7C390D"><enum>(2)</enum><text>in physical stores; and</text></paragraph><paragraph id="idBA6845F6006F452E8858554603289C35"><enum>(3)</enum><text>in other forms of public-facing consumer communication.</text></paragraph></subsection><subsection id="idcd0c67289eda4173a8930b22c08bc446"><enum>(f)</enum><header>Liability protection</header><text>A covered provider and any officer, director, employee, vendor, or agent thereof shall not be subject to liability for any claims deriving from an action taken or omission made with respect to compliance with subsection (c).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idb0d1500152f14d6d955da0b7759b70bf"><enum>5.</enum><header>Rulemaking on protections for survivors of domestic violence</header><subsection id="idE2C054A3F99A47D785613006C53F1985"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idc26a869a860d4429bae94791299b5e0a"><enum>(1)</enum><text>the term <term>appropriate congressional committees</term> means the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives; </text></paragraph><paragraph id="id00424ED787F44E96A600E955FA482FC9"><enum>(2)</enum><text>the term <term>Commission</term> means the Federal Communications Commission; </text></paragraph><paragraph id="id537987E6AE894B8F9B6D7E876B7119EC"><enum>(3)</enum><text>the term <term>covered hotline</term> means a hotline related to domestic violence, dating violence, sexual assault, stalking, sex trafficking, severe forms of trafficking in persons, or any other covered act; and</text></paragraph><paragraph id="ida3f3baae789342fe886c08a7fd172c0d"><enum>(4)</enum><text>the term <term>text message</term> has the meaning given the term in section 227(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)</external-xref>).</text></paragraph></subsection><subsection id="id779D36E39F0F447194376F898DC6164E"><enum>(b)</enum><header>Rulemakings</header><paragraph id="idD4A6A571A34944A98BBD8B18EF9A10CF"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commission, after public notice and an opportunity for comment, shall adopt rules under paragraphs (2) and (3) that create safeguards for survivors within communications services.</text></paragraph><paragraph id="id4539ac60df814390884dbd7d338a63ad"><enum>(2)</enum><header>Hotline calls</header><subparagraph id="idF3E5CE6148034072A95ED1ED97F8F040"><enum>(A)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this Act, the Commission shall adopt rules that—</text><clause id="id117eca05d0e0424a8daa27774131d189"><enum>(i)</enum><text>require providers of wireless communications services or wireline voice services to omit from consumer-facing logs of calls or text messages any records of calls or text messages to covered hotlines, while maintaining internal records of those calls and messages; and</text></clause><clause id="id3a5d704f48fa4ef9b0f1cdd45a2bbdd8"><enum>(ii)</enum><text>establish, and provide for updates on a quarterly basis of, a central database of covered hotlines to be used by providers of wireless communications services or wireline voice services in complying with the rule described in clause (i).</text></clause></subparagraph><subparagraph id="id519a6476fc6443b99c3ee879d286d415"><enum>(B)</enum><header>No effect on law enforcement</header><text>Nothing in subparagraph (A) shall be construed to limit or otherwise affect the ability of a law enforcement agency to access a log of calls or text messages in a criminal investigation.</text></subparagraph></paragraph><paragraph id="id6fa7bc667cf74a71a58a63fb2616a894"><enum>(3)</enum><header>Line separation</header><subparagraph id="id2377309CD82543928E3B2B493DF0348F"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Commission shall adopt rules that clarify the process by which a covered provider separates a line under section 344 of the Communications Act of 1934, as added by section 4 of this Act.</text></subparagraph><subparagraph id="idD676CAE04FFA4CB691796B1C47309C64"><enum>(B)</enum><header>Considerations</header><text>The rules adopted under subparagraph (A) shall include consideration of—</text><clause id="idb17b07a05b0a45eb93c348cbe3df30c5"><enum>(i)</enum><text>privacy protections;</text></clause><clause id="idda9c76814b8a48d3a2bba683d39d6145"><enum>(ii)</enum><text>account security;</text></clause><clause id="id8d31e8d1e31646fca0d7b541b2115c93"><enum>(iii)</enum><text>account billing procedures;</text></clause><clause id="id643801904c184752886656873c784150"><enum>(iv)</enum><text>liability;</text></clause><clause id="id7774BFCAFCCD4A9DA3091476802513BA"><enum>(v)</enum><text>procedures for notification of survivors about line separation processes;</text></clause><clause id="idD5F1B73BBD3141DFACA5DA3B3A4C3C6E"><enum>(vi)</enum><text>timelines;</text></clause><clause id="idAD60621A8E4B4D2DA011E57D715A4327"><enum>(vii)</enum><text>notice to account holders; and</text></clause><clause id="idC0DEEC29089B48EE89609534B08CA439"><enum>(viii)</enum><text>situations in which a covered provider cannot operationally or technically effectuate a line separation request.</text></clause></subparagraph></paragraph><paragraph id="id24b78550801f46fbb3f3e180a0f94841"><enum>(4)</enum><header>Lifeline program</header><subparagraph id="id7D9567B183F84ABA97DA0BF8FB2945CE"><enum>(A)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of this Act, or as part of a general rulemaking proceeding relating to the Lifeline program set forth in subpart E of part 54 of title 47, Code of Federal Regulations (or any successor regulation), whichever occurs earlier, the Commission shall adopt rules that allow a survivor who meets the requirements under section 344(c)(1) of the Communications Act of 1934, as added by section 4 of this Act, without regard to whether the survivor meets the otherwise applicable eligibility requirements of the Lifeline program, to—</text><clause id="id0F522D629C8A472299CF07730A93334F"><enum>(i)</enum><text>enroll in the Lifeline program as quickly as is feasible; and</text></clause><clause id="id53BD7D517C3A48F5B1F3D633D7115C68"><enum>(ii)</enum><text>participate in the Lifeline program for not more than 6 months.</text></clause></subparagraph><subparagraph id="id6328ef4bd60a4c28a98dcdd78cf7268c"><enum>(B)</enum><header>Evaluation</header><text>Not later than 2 years after completing the rulemaking under subparagraph (A), the Commission shall—</text><clause id="id2DEC1C8B99584E78BBD494DBC5734BE1"><enum>(i)</enum><text>evaluate the effectiveness of the Commission’s provision of support to survivors through the Lifeline program;</text></clause><clause id="idFE2CF132ECF24B64BC360BC82A89D51D"><enum>(ii)</enum><text>assess the detection and elimination of fraud, waste, and abuse with respect to the support described in clause (i); and </text></clause><clause id="id611136db774b4631b1b01e68724b75bd"><enum>(iii)</enum><text>submit to the appropriate congressional committees a report that includes the evaluation and assessment described in clauses (i) and (ii), respectively.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
