<congress display="yes">117th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 120</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To prevent and respond to the misuse of communications services that facilitates domestic violence and other crimes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id52ca503bbae64513a3c0b4f0c2b71506" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safe Connections Act of 2022</short-title></quote>.</text></section><section id="id3ece376cc45d43049cad2e073d241f2d" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">Except as otherwise provided in this Act, terms used in this Act that are defined in section 345(a) of the Communications Act of 1934, as added by section 4 of this Act, have the meanings given those terms in such section 345(a).</text></section><section id="idae24c64bfd5340dfb4e25a9c09e2c035" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="id3a9afb37e63a4e89a45b87284012d412" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Domestic violence, dating violence, stalking, sexual assault, human trafficking, and related crimes are life-threatening issues and have lasting and harmful effects on individuals, families, and entire communities.</text></paragraph><paragraph id="idb2c78038e1f54a12bedc3b0fde64f778" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">Survivors often lack meaningful support and options when establishing independence from an abuser, including barriers such as financial insecurity and limited access to reliable communications tools to maintain essential connections with family, social safety networks, employers, and support services.</text></paragraph><paragraph id="idb62797ddadab4606998f42b39b98456a" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">Perpetrators of violence and abuse described in paragraph (1) increasingly use technological and communications tools to exercise control over, monitor, and abuse their victims. </text></paragraph><paragraph id="id916a115b71b242bdafea51266bdc54c4" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">Communications law can play a public interest role in the promotion of safety, life, and property with respect to the types of violence and abuse described in paragraph (1). For example, independent access to a wireless phone plan can assist survivors in establishing security and autonomy.</text></paragraph><paragraph id="ide3010705a9134f83a8047b8f72e5e483" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">Safeguards within communications services can serve a role in preventing abuse and narrowing the digital divide experienced by survivors of abuse.</text></paragraph></section><section id="id9ca672e4404e4637b5b00cb8bf64f9a6" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Protection of domestic violence survivors within communications services</header><text display-inline="no-display-inline">Part I of title III of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/301">47 U.S.C. 301 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA10056DB975E4EB6A61AA6419595D5FA"><section id="idaaddf527b04643c5a2c3d9660cd24334" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>345.</enum><header display-inline="yes-display-inline">Protection of survivors of domestic violence, human trafficking, and related crimes</header><subsection id="id5ba5fded9a3c4f4e8fc6dc39877406df" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id9f5da1aaa63543abb53edaac67f06f47" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Abuser</header><text display-inline="yes-display-inline">The term <term>abuser</term> means an individual who has committed or allegedly committed a covered act against—</text><subparagraph id="id68b744b1a4b34076a68c53b2ce71d8eb" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">an individual who seeks relief under subsection (b); or</text></subparagraph><subparagraph id="id91e323b103f5425f829c5137da826507" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">an individual in the care of an individual who seeks relief under subsection (b).</text></subparagraph></paragraph><paragraph id="id4df3900eba40462f80e3e31136890bfd" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Covered act</header><subparagraph id="idb1a6a8ca13fd4adea307ea38207fe139" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>covered act</term> means conduct that constitutes—</text><clause id="id9c2bc61e38674f04a85ed466da3ef06c" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">a crime described in section 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12291">34 U.S.C. 12291(a)</external-xref>), including domestic violence, dating violence, sexual assault, stalking, and sex trafficking;</text></clause><clause id="id9d7135a46f7f4419b1d53a3db12e04c3" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">an act or practice described in paragraph (11) or (12) of section 103 of the Trafficking Victims Protection Act of 2000 (<external-xref legal-doc="usc" parsable-cite="usc/22/7102">22 U.S.C. 7102</external-xref>) (relating to severe forms of trafficking in persons and sex trafficking, respectively); or</text></clause><clause id="id77528b204f164eff8ada01b7fa3f3c60" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">an act under State law, Tribal law, or the Uniform Code of Military Justice that is similar to an offense described in clause (i) or (ii).</text></clause></subparagraph><subparagraph id="ida80fb4ec208c40f1bfbaf76e67c01bc0" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Conviction not required</header><text display-inline="yes-display-inline">Nothing in subparagraph (A) shall be construed to require a criminal conviction or any other determination of a court in order for conduct to constitute a covered act.</text></subparagraph></paragraph><paragraph id="id6eedf366ee934263936e354beee1aa5a" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Covered provider</header><text display-inline="yes-display-inline">The term <term>covered provider</term> means a provider of a private mobile service or commercial mobile service, as those terms are defined in section 332(d).</text></paragraph><paragraph id="ida34f60a53e8a4171a3dffe6a9cc6f156" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Primary account holder</header><text display-inline="yes-display-inline">The term <term>primary account holder</term> means an individual who is a party to a mobile service contract with a covered provider.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idd427f41e001b47b59dd479c51ebc6198"><enum>(5)</enum><header display-inline="yes-display-inline">Shared mobile service contract</header><text display-inline="yes-display-inline">The term <term>shared mobile service contract</term>—</text><subparagraph commented="no" display-inline="no-display-inline" id="id7663C7BCC0B04F26836A0EA653315E49"><enum>(A)</enum><text display-inline="yes-display-inline">means a mobile service contract for an account that includes not less than 2 consumers; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9E1D58D76C4647C8AC70960CDC899521"><enum>(B)</enum><text display-inline="yes-display-inline">does not include enterprise services offered by a covered provider.</text></subparagraph></paragraph><paragraph id="id6048feaadc91496e8bac1386cada3b2b" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Survivor</header><text display-inline="yes-display-inline">The term <term>survivor</term> means an individual who is not less than 18 years old and—</text><subparagraph id="id0a89f6ede0684a16b9f88966b07b578e" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">against whom a covered act has been committed or allegedly committed; or</text></subparagraph><subparagraph id="id55ceafe06350494f8a2ab5dd756ca7c1" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">who cares for another individual against whom a covered act has been committed or allegedly committed (provided that the individual providing care did not commit or allegedly commit the covered act).</text></subparagraph></paragraph></subsection><subsection id="idc187d6db36be40b3abd46a8c7a025787" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Separation of lines from shared mobile service contract</header><paragraph id="id8dadfd44832b4e8485a4cf74fccea9a2" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 business days after receiving a completed line separation request from a survivor pursuant to subsection (c), a covered provider shall, as applicable, with respect to a shared mobile service contract under which the survivor and the abuser each use a line—</text><subparagraph id="id65002428d368481aa19c36676449c728" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">separate the line of the survivor, and the line of any individual in the care of the survivor, from the shared mobile service contract; or</text></subparagraph><subparagraph id="idad122638755b4a37af8103ee70639a0e" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">separate the line of the abuser from the shared mobile service contract.</text></subparagraph></paragraph><paragraph id="id009ebbb914054e8faad8e64509ace392" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Limitations on penalties, fees, and other requirements</header><text display-inline="yes-display-inline">Except as provided in paragraphs (5) through (8), a covered provider may not make separation of a line from a shared mobile service contract under paragraph (1) contingent on any requirement other than the requirements under subsection (c), including—</text><subparagraph id="idb9a69e0746ea449db160474d148912cc" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">payment of a fee, penalty, or other charge;</text></subparagraph><subparagraph id="id11a57dd85d11443b9167c95d86b583b1" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">maintaining contractual or billing responsibility of a separated line with the provider;</text></subparagraph><subparagraph id="idde155a2bfd934f8e9346316f2bd49dc3" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">approval of separation by the primary account holder, if the primary account holder is not the survivor;</text></subparagraph><subparagraph id="idcbbbefb0fb074962b50e52c011d5b4b2" commented="no" display-inline="no-display-inline"><enum>(D)</enum><text display-inline="yes-display-inline">a prohibition or limitation, including one described in subparagraph (A), on number portability, provided such portability is technically feasible, or a request to change phone numbers;</text></subparagraph><subparagraph id="id939399ab5ef44130ad59980859e3d8a9" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text display-inline="yes-display-inline">a prohibition or limitation on the separation of lines as a result of arrears accrued by the account;</text></subparagraph><subparagraph id="idf7e7767057f24716a328e092f6877f53" commented="no" display-inline="no-display-inline"><enum>(F)</enum><text display-inline="yes-display-inline">an increase in the rate charged for the mobile service plan of the primary account holder with respect to service on any remaining line or lines; or</text></subparagraph><subparagraph id="idc76016c817174d00ba3d9d6b54b54c22" commented="no" display-inline="no-display-inline"><enum>(G)</enum><text display-inline="yes-display-inline">any other limitation or requirement not listed under subsection (c).</text></subparagraph></paragraph><paragraph id="idf6e5e59c539a4b83a195bc1ee1384b54" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in paragraph (2) shall be construed to require a covered provider to provide a rate plan for the primary account holder that is not otherwise commercially available. </text></paragraph><paragraph id="idd3fc5a41c659401b9ba7675fabef8fea" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Remote option</header><text display-inline="yes-display-inline">A covered provider shall offer a survivor the ability to submit a line separation request under subsection (c) through secure remote means that are easily navigable, provided that remote options are commercially available and technically feasible.</text></paragraph><paragraph id="idd9b7c7080ee541328d32f7df4c558e24" commented="no" display-inline="no-display-inline"><enum>(5)</enum><header display-inline="yes-display-inline">Responsibility for transferred telephone numbers</header><text display-inline="yes-display-inline">Notwithstanding paragraph (2), beginning on the date on which a covered provider transfers billing responsibilities for and rights to a telephone number or numbers to a survivor under paragraph (1)(A) in response to a line separation request submitted by the survivor under subsection (c), unless ordered otherwise by a court, the survivor shall assume financial responsibility, including for monthly service costs, for the transferred telephone number or numbers.</text></paragraph><paragraph id="id711697c90b9d4df0855fa1715142b8b6" commented="no" display-inline="no-display-inline"><enum>(6)</enum><header display-inline="yes-display-inline">Responsibility for transferred telephone numbers from a survivor's account</header><text display-inline="yes-display-inline">Notwithstanding paragraph (2), upon the transfer of a telephone number under paragraph (1)(B) in response to a line separation request submitted by a survivor under subsection (c), the survivor shall have no further financial responsibilities to the transferring covered provider for the services provided by the transferring covered provider for the telephone number or for any mobile device associated with the telephone number.</text></paragraph><paragraph id="idddfa4a18954c45febf1eb1326ac296cb" commented="no" display-inline="no-display-inline"><enum>(7)</enum><header display-inline="yes-display-inline">Responsibility for mobile device</header><text display-inline="yes-display-inline">Notwithstanding paragraph (2), beginning on the date on which a covered provider transfers billing responsibilities for and rights to a telephone number or numbers to a survivor under paragraph (1)(A) in response to a line separation request submitted by the survivor under subsection (c), unless otherwise ordered by a court, the survivor shall not assume financial responsibility for any mobile device associated with the separated line, unless the survivor purchased the mobile device, or affirmatively elects to maintain possession of the mobile device.</text></paragraph><paragraph id="idd3ea18e6c49c4af3908c6fa3c53bdf03" commented="no" display-inline="no-display-inline"><enum>(8)</enum><header display-inline="yes-display-inline">Notice to survivor</header><text display-inline="yes-display-inline">If a covered provider separates a line from a shared mobile service contract under paragraph (1) and the primary account holder is not the survivor, the covered provider shall notify the survivor of the date on which the covered provider intends to give any formal notice to the primary account holder.</text></paragraph></subsection><subsection id="id5f827357c68648d997bbc395b17418b1" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Line separation request</header><paragraph id="id3106d1aa165746a987047c2fb6969dd7" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A survivor shall submit to the covered provider a line separation request that—</text><subparagraph id="idd3f4f55cfc2b432880e161c397fde12e" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">verifies that an individual who uses a line under the shared mobile service contract has committed or allegedly committed a covered act against the survivor or an individual in the survivor’s care, by providing—</text><clause id="id2915fc03257d4514bb8f2fe3f414cd6e" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">a copy of a signed affidavit from a licensed medical or mental health care provider, licensed military medical or mental health care provider, licensed social worker, victim services provider, or licensed military victim services provider, or an employee of a court, acting within the scope of that person’s employment; or</text></clause><clause id="idf9ce2f5f36b24b0e9fbff987a63fcc2e" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a copy of a police report, statements provided by police, including military police, to magistrates or judges, charging documents, protective or restraining orders, military protective orders, or any other official record that documents the covered act;</text></clause></subparagraph><subparagraph id="id4643909786d64d078053d2f1e94bf7ca" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of relief sought under subsection (b)(1)(A), with respect to—</text><clause id="id28E7712758664F389050F5CEF6FB304F" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">a line used by the survivor that the survivor seeks to have separated, states that the survivor is the user of that specific line; and</text></clause><clause id="id6cdb95e986ae455f88e4db15ac905f86" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">a line used by an individual in the care of the survivor that the survivor seeks to have separated, includes an affidavit setting forth that the individual—</text><subclause id="id85FB95A012A94887989CB8A645FF0E23" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">is in the care of the survivor; and</text></subclause><subclause id="idCB03642EF458426DA01877AF512E8359" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">is the user of that specific line; and</text></subclause></clause></subparagraph><subparagraph id="id0118556b74f643b586002a5dc1569567" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">requests relief under subparagraph (A) or (B) of subsection (b)(1) and identifies each line that should be separated.</text></subparagraph></paragraph><paragraph id="ida275d0fd1042460dafd501211d8833ff" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Communications from covered providers</header><subparagraph id="idDC217944E87F4005A827948B46536FDB" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A covered provider shall notify a survivor seeking relief under subsection (b) in clear and accessible language that the covered provider may contact the survivor, or designated representative of the survivor, to confirm the line separation, or if the covered provider is unable to complete the line separation for any reason, pursuant to subparagraphs (B) and (C).</text></subparagraph><subparagraph id="idEBDB0960FE804E22957D0ABD8AC29739" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Remote means</header><text display-inline="yes-display-inline">A covered provider shall notify a survivor under subparagraph (A) through remote means, provided that remote means are commercially available and technically feasible.</text></subparagraph><subparagraph id="id0F8A439960EF48FE8D10B6A2374C3C89" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Election of manner of contact</header><text display-inline="yes-display-inline">When completing a line separation request submitted by a survivor through remote means under paragraph (1), a covered provider shall allow the survivor to elect in the manner in which the covered provider may—</text><clause id="id0E599BD283774495884ED43FE1D3080B" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">contact the survivor, or designated representative of the survivor, in response to the request, if necessary; or</text></clause><clause id="idFEAC31243A724D039E9A7BA2E2BBE10A" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">notify the survivor, or designated representative of the survivor, of the inability of the covered provider to complete the line separation.</text></clause></subparagraph></paragraph><paragraph id="id9761505b9d724fe8b2953157bcd1e8c3" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Enhanced protections under State law</header><text display-inline="yes-display-inline">This subsection shall not affect any law or regulation of a State providing communications protections for survivors (or any similar category of individuals) that has less stringent requirements for providing evidence of a covered act (or any similar category of conduct) than this subsection.</text></paragraph></subsection><subsection id="id387513893d0b4493ae5ed94cdb640dd1" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Confidential and secure treatment of personal information</header><paragraph id="id79FF99AEC2FE496B864777263EABBB95" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding section 222(c)(2), a covered provider and any officer, director, employee, vendor, or agent thereof shall treat any information submitted by a survivor under subsection (c) as confidential and securely dispose of the information not later than 90 days after receiving the information.</text></paragraph><paragraph id="idC885419A08D84AFBAA327BBFEF8E29ED" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in paragraph (1) shall be construed to prohibit a covered provider from maintaining, for longer than the period specified in that paragraph, a record that verifies that a survivor fulfilled the conditions of a line separation request under subsection (c).</text></paragraph></subsection><subsection id="idc5ed5eb3af714a02a50c8d485d4fa5d2" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Availability of information to consumers</header><text display-inline="yes-display-inline">A covered provider shall make information about the options and process described in subsections (b) and (c) readily available to consumers—</text><paragraph id="id598fac98c7794e1daa9d610dc333d11e" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">on the website and the mobile application of the provider;</text></paragraph><paragraph id="id8f40517253e24f1ebf6a39d1421b2f40" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in physical stores; and</text></paragraph><paragraph id="id10e189a4abef48cdb9af0d9ff1cc48f3" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">in other forms of public-facing consumer communication.</text></paragraph></subsection><subsection id="id2fe702d5c8824cc18ebef7514c08eb94" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Technical infeasibility</header><paragraph id="id9a4a279e27fb412485e56f6a919ffec4" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The requirement to effectuate a line separation request pursuant to subsection (b)(1) shall not apply to a covered provider if the covered provider cannot operationally or technically effectuate the request.</text></paragraph><paragraph id="id7d2cdef040424338a08c16d4366dc42c" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Notification</header><text display-inline="yes-display-inline">If a covered provider cannot operationally or technically effectuate a line separation request as described in paragraph (1), the covered provider shall—</text><subparagraph id="id261B3098DB5F4C4B8A5D4FA72ADDFFE3" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">notify the survivor who submitted the request of that infeasibility—</text><clause commented="no" id="idF2C17BE266B14930884DB38BD060EEF0" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">at the time of the request; or</text></clause><clause id="idF9D902CD52B8405ABF294DA82F31E795" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a survivor who has submitted the request using remote means, not later than 2 business days after receiving the request; and</text></clause></subparagraph><subparagraph id="idB9D6745AEE9D4B1683393587433525CD" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">provide the survivor with information about other alternatives to submitting a line separation request, including starting a new line of service. </text></subparagraph></paragraph></subsection><subsection id="id27e22f0306ce4f41afa06ba6a025e430" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">Liability protection</header><paragraph id="id24505a3653a747888fef99b41f42a050" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A covered provider and any officer, director, employee, vendor, or agent thereof shall not be subject to liability for any claims deriving from an action taken or omission made with respect to compliance with this section and the rules adopted to implement this section.</text></paragraph><paragraph id="idac0ab16936b543dba2502f27a90b0ee1" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Commission authority</header><text display-inline="yes-display-inline">Nothing in this subsection shall limit the authority of the Commission to enforce this section or any rules or regulations promulgated by the Commission pursuant to this section.</text></paragraph></subsection></section><after-quoted-block display="yes">.</after-quoted-block></quoted-block></section><section id="idb5b5f216ae7c48acb47aa8391675fe9a" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Rulemaking on protections for survivors of domestic violence</header><subsection id="idcd84083547a743488d05648da3484e91" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text><paragraph id="id81C1A6C164434C649FFD339ABEEBFA82" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Affordable Connectivity Program</term> means the program established under section 904(b) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), as amended by section 60502 of the Infrastructure Investment and Jobs Act (<external-xref legal-doc="public-law" parsable-cite="pl/117/58">Public Law 117–58</external-xref>), or any successor program;</text></paragraph><paragraph id="id1e3d1cd29b864cffb1bd0809c15c6fb2" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>appropriate congressional committees</term> means the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives;</text></paragraph><paragraph id="id05ec07b7951941f2baa04a0f1f45a2a2" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>Commission</term> means the Federal Communications Commission;</text></paragraph><paragraph id="id685fbcdae3b0409d808d5584632a5c4c" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>covered hotline</term> means a hotline related to domestic violence, dating violence, sexual assault, stalking, sex trafficking, severe forms of trafficking in persons, or any other similar act;</text></paragraph><paragraph id="id89FAC987427C43D784768C7F57B1D8C6" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">the term <term>designated program</term> means the program designated by the Commission under subsection (c)(3)(A)(i) to provide emergency communications support to survivors;</text></paragraph><paragraph id="idE20D30E28D4F46A3A13287F4A2C13273" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">the term <term>Lifeline program</term> means the program set forth in subpart E of part 54 of title 47, Code of Federal Regulations (or any successor regulation); and</text></paragraph><paragraph id="idb21d9058bc1e450a9385fcb43dcb9ea2" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">the term <term>text message</term> has the meaning given the term in section 227(e) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/227">47 U.S.C. 227(e)</external-xref>).</text></paragraph></subsection><subsection id="idca188776f98d428386146bc513d002c8" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Rulemakings</header><paragraph id="idb7acbefee52d4748b0bb9df69f091cf7" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Line separations</header><subparagraph id="idcd6dfe56b81145828607083e70bd4641" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Commission shall adopt rules to implement section 345 of the Communications Act of 1934, as added by section 4 of this Act.</text></subparagraph><subparagraph id="idc22f3f5a78df4819bdd6c35b09203803" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">In adopting rules under subparagraph (A), the Commission shall consider—</text><clause id="id427c3d36e9454ddeb506bb1128e39f29" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">privacy protections;</text></clause><clause id="idc55e398b37f94e23a39a93f648f23c0f" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">account security and fraud detection;</text></clause><clause id="id40884e8b2a864ce3b934613332338ec2" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">account billing procedures;</text></clause><clause id="id7ecf7d42f8d7427f9a27a28367d69674" commented="no" display-inline="no-display-inline"><enum>(iv)</enum><text display-inline="yes-display-inline">procedures for notification of survivors about line separation processes;</text></clause><clause id="ida0bbc9eeaacc4e2a9eda7d7df829967c" commented="no" display-inline="no-display-inline"><enum>(v)</enum><text display-inline="yes-display-inline">notice to account holders;</text></clause><clause id="idee7dae2ff8004247b13ba6766df19293" commented="no" display-inline="no-display-inline"><enum>(vi)</enum><text display-inline="yes-display-inline">situations in which a covered provider cannot operationally or technically separate a telephone number or numbers from a shared service plan such that the provider cannot effectuate a line separation request;</text></clause><clause id="id727c6c22703f4f3382f6d56fedd3d0a4" commented="no" display-inline="no-display-inline"><enum>(vii)</enum><text display-inline="yes-display-inline">the requirements for remote submission of a line separation request, including how that option facilitates submission of verification information and meets the other requirements of section 345 of the Communications Act of 1934, as added by section 4 of this Act;</text></clause><clause id="id96376071F03D4D9A8F5638C62B114A33" commented="no" display-inline="no-display-inline"><enum>(viii)</enum><text display-inline="yes-display-inline">feasibility of remote options for small covered providers; </text></clause><clause id="id108c915950f848fda8fcda3b660c3612" commented="no" display-inline="no-display-inline"><enum>(ix)</enum><text display-inline="yes-display-inline">implementation timelines, including those for small covered providers;</text></clause><clause id="idc168d634fb3b46a4940ef296faf64517" commented="no" display-inline="no-display-inline"><enum>(x)</enum><text display-inline="yes-display-inline">financial responsibility for transferred telephone numbers; </text></clause><clause id="ida63d2a4d54bc4ddfb22c42f4ed743693" commented="no" display-inline="no-display-inline"><enum>(xi)</enum><text display-inline="yes-display-inline">whether and how the survivor can affirmatively elect to take financial responsibility for the mobile device associated with the separated line; </text></clause><clause id="id9ea1ac0aa3f74593815157daa889685c" commented="no" display-inline="no-display-inline"><enum>(xii)</enum><text display-inline="yes-display-inline">compliance with subpart U of part 64 of title 47, Code of Federal Regulations, or any successor regulations (relating to customer proprietary network information) or any other legal or law enforcement requirements; and</text></clause><clause id="id0d68639e12dd46148740d34641888707" commented="no" display-inline="no-display-inline"><enum>(xiii)</enum><text display-inline="yes-display-inline">ensuring covered providers have the necessary account information to comply with the rules and with section 345 of the Communications Act of 1934, as added by section 4 of this Act.</text></clause></subparagraph></paragraph><paragraph id="id3c88f35c771340ae89b4dae9f33861e2" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Emergency communications support for survivors</header><subparagraph id="idfdfaa39db76b4fa8bac6a2acaef8d5ef" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, or as part of a general rulemaking proceeding relating to the Lifeline program or the Affordable Connectivity Program, whichever occurs earlier, the Commission shall adopt rules that—</text><clause id="id88B84538405049528AE55ECF4A99C12D" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">designate a single program, which shall be either the Lifeline program or the Affordable Connectivity Program, to provide emergency communications support to survivors in accordance with this paragraph; and</text></clause><clause id="id8BA42C40D54B4D338EBEB8BF8D2BADA2" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">allow a survivor who is suffering from financial hardship and meets the requirements under section 345(c)(1) of the Communications Act of 1934, as added by section 4 of this Act, without regard to whether the survivor meets the otherwise applicable eligibility requirements of the designated program, to—</text><subclause id="id0cd49291c3f241c6b9e841414c74c15e" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">enroll in the designated program as quickly as is feasible; and</text></subclause><subclause id="id061a15bd75364b17bef406ed2ec86cca" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">participate in the designated program based on such qualifications for not more than 6 months.</text></subclause></clause></subparagraph><subparagraph id="id61933e11444f483aadeda7ad71cf3a29" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">In adopting rules under subparagraph (A), the Commission shall consider—</text><clause id="id9f2dde3c54364ebabebef6add2de0ad0" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">how survivors who are eligible for relief and elected to separate a line under section 345(c)(1) of the Communications Act of 1934, as added by section 4 of this Act, but whose lines could not be separated due to operational or technical infeasibility, can participate in the designated program; and</text></clause><clause id="id9fd8ac290cb843bcac70c03a1d6888f2" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">confidentiality in the transfer and retention of any necessary documentation regarding the eligibility of a survivor to enroll in the designated program.</text></clause></subparagraph><subparagraph id="id6328ef4bd60a4c28a98dcdd78cf7268c" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">Evaluation</header><text display-inline="yes-display-inline">Not later than 2 years after completing the rulemaking under subparagraph (A), the Commission shall—</text><clause id="id2DEC1C8B99584E78BBD494DBC5734BE1" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">evaluate the effectiveness of the Commission’s provision of support to survivors through the designated program;</text></clause><clause id="idFE2CF132ECF24B64BC360BC82A89D51D" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">assess the detection and elimination of fraud, waste, and abuse with respect to the support described in clause (i); and </text></clause><clause commented="no" display-inline="no-display-inline" id="id611136db774b4631b1b01e68724b75bd"><enum>(iii)</enum><text display-inline="yes-display-inline">submit to the appropriate congressional committees a report that includes the evaluation and assessment described in clauses (i) and (ii), respectively.</text></clause></subparagraph><subparagraph id="ida8b1046d6cdf4a6d9924b5a86bd47537" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this paragraph shall be construed to limit the ability of a survivor who meets the requirements under section 345(c)(1) of the Communications Act of 1934, as added by section 4 of this Act, to participate in the designated program indefinitely if the survivor otherwise qualifies for the designated program under the rules of the designated program.</text></subparagraph><subparagraph id="idde17be7af2694721bbe10df00e3c8992" commented="no" display-inline="no-display-inline"><enum>(E)</enum><header display-inline="yes-display-inline">Notification</header><text display-inline="yes-display-inline">A provider of wireless communications services that receives a line separation request pursuant to section 345 of the Communications Act of 1934, as added by section 4 of this Act, shall inform the survivor who submitted the request of—</text><clause id="idE7010FEF32114756AC9F47F0B5266440" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the existence of the designated program;</text></clause><clause id="idF96739BF8EB3405AA7D29FEAECEE9C8B" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">who qualifies to participate in the designated program under the rules adopted under subparagraph (A) that are specially applicable to survivors; and</text></clause><clause id="idB73CCC031F9E4EA69CAB25CDD4E3B4C0" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">how to participate in the designated program under the rules described in clause (ii).</text></clause></subparagraph></paragraph><paragraph id="id4fddf47becec49fbafac43acbae67527" commented="no" display-inline="no-display-inline"><enum>(3)</enum><header display-inline="yes-display-inline">Hotline calls</header><subparagraph id="id8897566cb7694b2d921c05ab2677ee6b" commented="no" display-inline="no-display-inline"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Commission shall commence a rulemaking proceeding to consider whether to, and how the Commission should—</text><clause id="id6A0C17BDAF9E47EF8CC80EE8CA5727A4" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">establish, and update on a monthly basis, a central database of covered hotlines to be used by providers of wireless communications services or wireline voice services; and </text></clause><clause id="id4493C6D18338475F886F6FC679D8E8F9" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">require providers of wireless communications services or wireline voice services to omit from consumer-facing logs of calls or text messages any records of calls or text messages to covered hotlines in the central database described in clause (i), while maintaining internal records of those calls and messages.</text></clause></subparagraph><subparagraph id="id4384c7195bfa47558def20f5677111d7" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">The rulemaking conducted under subparagraph (A) shall include consideration of—</text><clause id="idc53d6f1c5928438785b823ee6a1aa11b" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">the ability of law enforcement agencies or survivors to access a log of calls or text messages in a criminal investigation or civil proceeding;</text></clause><clause id="id6558082a37864da2a280dff91a633c8c" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">the ability of providers of wireless communication services or wireline voice services to—</text><subclause id="idcedb7ce7d1944454934ed5549529202d" commented="no" display-inline="no-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">identify logs that are consumer-facing; and</text></subclause><subclause id="idae623281b0054e01a49fc205f8a25e03" commented="no" display-inline="no-display-inline"><enum>(II)</enum><text display-inline="yes-display-inline">omit certain consumer-facing logs, while maintaining internal records of such calls and text messages; and</text></subclause></clause><clause id="idc41992fe4bf6449eb98ecb43a13d663f" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text display-inline="yes-display-inline">any other factors associated with the implementation of clauses (i) and (ii) to protect survivors of domestic violence, including factors that may impact smaller providers.</text></clause></subparagraph><subparagraph id="id5e143212487e46748bac36ca1d189d66" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header display-inline="yes-display-inline">No effect on law enforcement</header><text display-inline="yes-display-inline">Nothing in subparagraph (A) shall be construed to—</text><clause id="id50C9265C3B754F2783EABF5752854CC6" commented="no" display-inline="no-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">limit or otherwise affect the ability of a law enforcement agency to access a log of calls or text messages in a criminal investigation; or</text></clause><clause id="idDD4122AA931443D7B798EF2A519E7B31" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text display-inline="yes-display-inline">alter or otherwise expand provider requirements under the Communications Assistance for Law Enforcement Act (<external-xref legal-doc="public-law" parsable-cite="pl/103/414">Public Law 103–414</external-xref>; 108 Stat. 4279) or the amendments made by that Act.</text></clause></subparagraph><subparagraph id="id51ff0a81e5d94c3e9ccc40a5cdcad810" commented="no" display-inline="no-display-inline"><enum>(D)</enum><header display-inline="yes-display-inline">Compliance</header><text display-inline="yes-display-inline">If the Commission establishes a central database through the rulemaking under subparagraph (A) and a covered provider updates its own databases to match the central database not less frequently than once every 30 days, no cause of action shall lie or be maintained in any court against the covered provider or its officers, employees, or agents for claims deriving from omission from consumer-facing logs of calls or text messages any records of calls or text messages to covered hotlines in the central database.</text></subparagraph></paragraph></subsection></section><section id="id1C9BB3E7B92D427EA1CC843A0DB20BAE" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="no-display-inline">The requirements under section 345 of the Communications Act of 1934, as added by section 4 of this Act, shall take effect 60 days after the date on which the Federal Communications Commission adopts the rules implementing that section pursuant to section 5(b)(2) of this Act.</text></section><section id="idE7C0360BBF4C450BAABCD951AD2E716A" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Savings clause</header><text display-inline="no-display-inline"> Nothing in this Act or the amendments made by this Act shall be construed to abrogate, limit, or otherwise affect the provisions set forth in the Communications Assistance for Law Enforcement Act (<external-xref legal-doc="public-law" parsable-cite="pl/103/414">Public Law 103–414</external-xref>; 108 Stat. 4279) and the amendments made by that Act, any authority granted to the Commission pursuant to that Act or the amendments made by that Act, or any regulations promulgated by the Commission pursuant to that Act or the amendments made by that
