<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1206</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210419">April 19, 2021</action-date><action-desc><sponsor name-id="S303">Mr. Thune</sponsor> (for himself, <cosponsor name-id="S266">Mr. Crapo</cosponsor>, and <cosponsor name-id="S287">Mr. Cornyn</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To limit the authority of the Secretary of Labor to modify the pandemic unemployment assistance program, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PUA Eligibility Clarification Act of 2021</short-title></quote>.</text></section><section id="idEA887BA699634EB3AB8350DBA3439D2D"><enum>2.</enum><header>Pandemic unemployment assistance</header><subsection id="id7D4CF4748C924AFBB5A600D3AC35C619"><enum>(a)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 2102(a)(3) of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9021">15 U.S.C. 9021(a)(3)</external-xref>) is amended—</text><paragraph id="id378B9B901EF54C54A989C4B12C48EDD5"><enum>(1)</enum><text>in subparagraph (A)(ii)(I)—</text><subparagraph id="idDAD5DE0F5A364CBC9E3D5D3BDCECBB2F"><enum>(A)</enum><text>in item (ii), by adding <quote>or</quote> at the end; and</text></subparagraph><subparagraph id="id707980951FAA4C9D9FA21EE028C183D2"><enum>(B)</enum><text>by striking item (kk); and</text></subparagraph></paragraph><paragraph id="idD3767EB52C7040BE8BDD432116FD8985"><enum>(2)</enum><text>in subparagraph (B)(ii), by striking <quote>through (kk)</quote> and inserting <quote>through (jj)</quote>. </text></paragraph></subsection><subsection id="id0DECFB1B6DA3488F85AF8BA91FB56E2F"><enum>(b)</enum><header>Repeal of guidance</header><paragraph id="id2FDEFCF0230D439280D292723515DE20"><enum>(1)</enum><header>In general</header><text>The Secretary of Labor shall rescind the guidance entitled, Expanded Eligibility Provisions for the Pandemic Unemployment Assistance (PUA) Program, issued on February 25, 2021. </text></paragraph><paragraph id="idE2CC2027CD5148F0AD0FA5DEA3F1D6FC"><enum>(2)</enum><header>Repayment not required</header><subparagraph id="id34A9E069C5384F93A457EF21FD99EF57"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), in the case of an individual who received pandemic unemployment assistance amounts pursuant to the guidance described in paragraph (1) before the date of enactment of this Act, the individual shall not be required to repay the amounts. </text></subparagraph><subparagraph id="idB702F4D2926B42B3B74462D7F0835D0A"><enum>(B)</enum><header>Exception</header><text>Subparagraph (A) shall not apply to any individual who, as of the date of enactment of this Act, was approved to receive compensation amounts pursuant to the guidance described in paragraph (1)(A) but had not yet received the amounts. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
