which was read twice and referred to the <committee-name committee-id="SSAF00">Committee on Agriculture, Nutrition, and Forestry</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To release a Federal reversionary interest in Chester County, Tennessee, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause"><section commented="no" display-inline="no-display-inline" section-type="section-one" id="id1D79D410A7A14FD785E522A6422E3948"><enum>1.</enum><header display-inline="yes-display-inline">Chester County reversionary interest release</header><subsection commented="no" display-inline="no-display-inline" id="idFAB0494A3AC44E089A80E0D31565EF6F"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="id0F0FB58492B849E8BF0219D85E70BBE6"><enum>(1)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the Secretary of Agriculture.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id62F83BF5494C4C10AE65627CF71FAA77"><enum>(2)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <quote>State</quote> means the State of Tennessee.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD48C7F23D15B4945BFF63FF86BA2E6C0"><enum>(3)</enum><header display-inline="yes-display-inline">State forest land</header><text display-inline="yes-display-inline">The term <quote>State forest land</quote> means the approximately 0.62-acre parcel of land in Chickasaw State Forest that is identified as <quote>State Forest Land</quote> on the map prepared by the Forest Service entitled <quote>State Forest Land Detail Map</quote> and dated December 13, 2019.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id54EB03642E73490EA7DF10E0ADBE9025"><enum>(4)</enum><header display-inline="yes-display-inline">Webb property</header><text display-inline="yes-display-inline">The term <quote>Webb property</quote> means the approximately 0.90-acre parcel of land owned by Kirby and Leta Webb identified as <quote>Webb Property Lot 1</quote> on the map entitled <quote>Webb Property Detail Map</quote> and dated December 13, 2019.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id692D4C74C53A49769664F7B29090220A"><enum>(b)</enum><header display-inline="yes-display-inline">Release of reversionary interest</header><paragraph commented="no" display-inline="no-display-inline" id="ide63dfad86be74398aee9c8b84a14433b"><enum>(1)</enum><header display-inline="yes-display-inline">Release</header><text display-inline="yes-display-inline">On the transfer of ownership of the Webb property to the State for inclusion in the Chickasaw State Forest and the transfer of the State forest land to the State or a non-State entity, by request of the State, the Secretary shall release to the State, without consideration, the reversionary interest of the United States in and to the State forest land described in paragraph (2).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id72b48d8d968d4c2597f09dddc3917d54"><enum>(2)</enum><header display-inline="yes-display-inline">Description of reversionary interest</header><text display-inline="yes-display-inline">The reversionary interest referred to in paragraph (1) is the reversionary interest of the United States in and to the State forest land that—</text><subparagraph commented="no" display-inline="no-display-inline" id="idc63bf3ff2ac64b739c8b350d3b849f43"><enum>(A)</enum><text display-inline="yes-display-inline">requires that the State forest land be used for public purposes; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96a896c1d58e45ea95aa7cfe68fffaa4"><enum>(B)</enum><text display-inline="yes-display-inline">is contained in a deed—</text><clause commented="no" display-inline="no-display-inline" id="id656ee0eedca24371ae2c64020c261efb"><enum>(i)</enum><text display-inline="yes-display-inline">granting from the United States to the State the State forest land;</text></clause><clause commented="no" display-inline="no-display-inline" id="id9B74DAFCF9234896A5C734B0C4FC2E60"><enum>(ii)</enum><text display-inline="yes-display-inline">dated August 12, 1955; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id16683f3182ce4a148be8957ca79b93d3"><enum>(iii)</enum><text display-inline="yes-display-inline">registered on pages 588 through 591 of book 48 of the record of deeds for Chester County, Tennessee.</text></clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida17ab719eca14be2bba672f15c244f32"><enum>(c)</enum><header display-inline="yes-display-inline">Sale of mineral rights</header><paragraph commented="no" display-inline="no-display-inline" id="id3884abe8b29b47a897d4b4da7fd6c869"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to any valid existing rights of third parties, as soon as practicable after the date on which all actions described in subsection (b)(1) have been carried out, the Secretary shall offer to sell to the State the undivided mineral interests of the United States in and to the State forest land.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida0b6942546f248fe88cb862990e0ea5e"><enum>(2)</enum><header display-inline="yes-display-inline">Terms of sale</header><subparagraph commented="no" display-inline="no-display-inline" id="id2DDA3450860B487F9442A7C15A5A1B76"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall determine—</text><clause commented="no" display-inline="no-display-inline" id="id36d0120a80bd46c89097dafcb8559ad6"><enum>(i)</enum><text display-inline="yes-display-inline">the mineral character of the State forest land; and</text></clause><clause commented="no" display-inline="no-display-inline" id="ida09e58a4dde74777b2a276d336cf9839"><enum>(ii)</enum><text display-inline="yes-display-inline">the market value of the mineral interests referred to in paragraph (1), as determined by an appraisal conducted in accordance with subparagraph (C).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id25fdaf95f5484843964acdd65838af91"><enum>(B)</enum><header display-inline="yes-display-inline">Payment of costs</header><text display-inline="yes-display-inline">As a condition of any sale under this subsection, the State shall pay to the United States—</text><clause commented="no" display-inline="no-display-inline" id="id66EE26916FA54436A431E68BCE7D1908"><enum>(i)</enum><text display-inline="yes-display-inline">any administrative costs incurred by the United States in selling to the State the mineral interests referred to in paragraph (1), including the costs incurred by the Secretary in making the determinations required under subparagraph (A); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id2f66f71f05a644b9b0064ce12508a8c9"><enum>(ii)</enum><text display-inline="yes-display-inline">an amount equal to the market value of the mineral interests referred to in paragraph (1), as determined under subparagraph (A)(ii).</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9B1DF8FDEA04458E8DFAF94C6E4B2737"><enum>(C)</enum><header display-inline="yes-display-inline">Appraisal requirements</header><text display-inline="yes-display-inline">An appraisal conducted under subparagraph (A)(ii) shall be—</text><clause commented="no" display-inline="no-display-inline" id="id808a0ddfb09b4441822df39696e54692"><enum>(i)</enum><text display-inline="yes-display-inline">consistent with the Uniform Appraisal Standards for Federal Land Acquisitions and the Uniform Standards of Professional Appraisal Practice; and</text></clause><clause commented="no" display-inline="no-display-inline" id="iddff7ac3e087040cb9d1c269ef321c19d"><enum>(ii)</enum><text display-inline="yes-display-inline">subject to the approval of the Secretary.</text></clause></subparagraph></paragraph></subsection></section></legis-body></bill>
