<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1197</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210415">April 15, 2021</action-date><action-desc><sponsor name-id="S388">Ms. Hassan</sponsor> (for herself and <cosponsor name-id="S303">Mr. Thune</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to apply public-private talent exchange programs in the Department of Defense to quantum information sciences and technology research, to increase coordination across agencies and emphasize opportunities in the Department for quantum information sciences and technology research, and for other purposes.</official-title></form><legis-body><section id="id8CDB6494188F4F6E9F0B462A5B0D71FC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Quantum for Universal Advancement in Nationwide Technology Use and Modernization for National Security Act of 2021</short-title></quote> or the <quote><short-title>QUANTUM for National Security Act of 2021</short-title></quote>.</text></section><section id="id67F3598AA64B4B0DB985AC5FBD8F161A" section-type="subsequent-section"><enum>2.</enum><header>Application of public-private talent exchange programs in the Department of Defense to quantum information sciences and technology research</header><subsection id="id1a6043e5aeca4785b419af634b5e9963"><enum>(a)</enum><header>Quantum science and technology research as a modernization priority</header><text>Section 1102(b)(1) of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>) is amended by inserting <quote>, including quantum science and technology research</quote> after <quote>modernization priorities of the Department of Defense</quote>.</text></subsection><subsection id="id14b59a9fce834c57b0a19f25543f7941"><enum>(b)</enum><header>Establishment of public-Private exchange programs</header><text>In carrying out section 1599g of title 10, United States Code, the Secretary of Defense shall seek to achieve, in the Army, Navy, and Marine Corps, the establishment of public-private exchange programs, comparable to the Air Force Education with Industry Program, each with up to 10 program participants, focused on private sector entities working on quantum information sciences and technology research applications.</text></subsection><subsection id="idd0c647337d604e5ea9fd3c5e08161672"><enum>(c)</enum><header>Establishment of program billet office</header><text>The Secretary shall establish a public-private exchange program billet office to temporarily hold billets for civilian employees who participate in programs described in such section, to ensure that participating Department of Defense offices are able to retain their staffing levels during the period of participation.</text></subsection></section><section id="H273A508F2ED3498B872D6428DD22E209" section-type="subsequent-section"><enum>3.</enum><header>Modification of Science, Mathematics, and Research for Transformation (SMART) Defense Education Program</header><subsection id="HEBFA95F5F4054749A3B5E0E8FAA59043"><enum>(a)</enum><header>Pilot subprogram</header><text>Section 2192a of title 10, United States Code, as amended by section 242 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>), is amended—</text><paragraph id="H0B54EC8FBD674B2EB64E3D9DE235F876"><enum>(1)</enum><text>by redesignating subsections (b) through (h) as subsections (c) through (i);</text></paragraph><paragraph id="H93C6CD6EA90D401493D61BFB472C7B14"><enum>(2)</enum><text>by inserting after subsection (a) the following new subsection:</text><quoted-block style="USC" id="H400504C0C9F34E768836D558CBD87B63" display-inline="no-display-inline"><subsection id="H08F417B5A8794AB9B33CD8BBAB5DA505"><enum>(b)</enum><header>Requirement for pilot subprogram</header><paragraph commented="no" display-inline="yes-display-inline" id="id2B4A52F308634835B43CE81DFC68033F"><enum>(1)</enum><text>As a subprogram of the program under subsection (a), the Secretary of Defense shall carry out a pilot program to be known as the <quote>National Security Pipeline Pilot Program</quote> (referred to in this section as the <quote>Pilot Program</quote>) under which the Secretary shall seek to enter into partnerships with minority-serving institutions to diversify the participants in the program under subsection (a).</text></paragraph><paragraph id="H70F3DA5829D144AFB4AB2296D901660F" indent="up1"><enum>(2)</enum><text>Under the Pilot Program, the Secretary of Defense shall—</text><subparagraph id="HD97DC2E975ED4F2984CF35F8F7A70B50"><enum>(A)</enum><text display-inline="yes-display-inline">provide an appropriate amount of financial assistance under subsection (c) to an eligible individual;</text></subparagraph><subparagraph id="H3B952D2D8BF84719BF4E3FC0016122E8"><enum>(B)</enum><text display-inline="yes-display-inline">provide such financial assistance to recipients in conjunction with summer internship opportunities or other meaningful temporary appointments within the Department; and</text></subparagraph><subparagraph id="H6A54A0027E454E9D9F91A520F8AF3D9C"><enum>(C)</enum><text>periodically evaluate the success of recruiting individuals for scholarships under this subsection and on hiring and retaining those individuals in the public sector workforce.</text></subparagraph></paragraph><paragraph id="HB80FFA1035AC4563ABBEC34D29111859" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idC8DCC8A36FAB4979BC36D4B2002BF732"><enum>(A)</enum><text>Not later than the date that is three years after the date of the enactment of the <short-title>Quantum for Universal Advancement in Nationwide Technology Use and Modernization for National Security Act of 2021</short-title>, the Secretary of Defense shall submit to the congressional defense committees a report on the Pilot Program.</text></subparagraph><subparagraph indent="up1" id="idA12AF68D526446EEB4614F24324ABBED"><enum>(B)</enum><text>The report submitted under subparagraph (A) shall include the following:</text><clause id="id725CF43F573D449F89137C4B43928AB1"><enum>(i)</enum><text>Identification of the following:</text><subclause id="idFB884B84AFED478A84AEE7B7A820F2A2"><enum>(I)</enum><text>The number of students participating in the Pilot Program as of the date of the report.</text></subclause><subclause id="idF0E11E0A2D39480E8CAD5E07269022BA"><enum>(II)</enum><text>The fields of study pursued by such students.</text></subclause><subclause id="idD6542D4A95F4498A9E9589A4420641F9"><enum>(III)</enum><text>The minority-serving institutions at which such students are enrolled.</text></subclause></clause><clause id="H78323A27E2954888BD6FE736FB9A6738"><enum>(ii)</enum><text display-inline="yes-display-inline">An evaluation of the success of the Pilot Program in recruiting individuals for scholarships under this section and hiring and retaining those individuals in the public sector workforce.</text></clause></subparagraph></paragraph><paragraph id="H276A3756F2D740B0A96B55865A25EC3C" indent="up1"><enum>(4)</enum><text>After the date that is five years after the date of the enactment of the <short-title>Quantum for Universal Advancement in Nationwide Technology Use and Modernization for National Security Act of 2021</short-title>, the Secretary shall terminate the Pilot Program or continue the Pilot Program as the Secretary considers appropriate.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H11B28A50CE7E4DC4ADC0941AEE0968F6"><enum>(3)</enum><text>in subsection (c)(1), as so redesignated—</text><subparagraph id="H0CADDE69A7ED4939B688CCDD99812E32"><enum>(A)</enum><text>in subparagraph (A), by striking <quote>subsection (g)</quote> and inserting <quote>subsection (h)</quote>; and</text></subparagraph><subparagraph id="H8F5F744478E04276B35FE0B329370292"><enum>(B)</enum><text>in subparagraph (C), by striking <quote>subsection (c)</quote> and inserting <quote>subsection (d)</quote>; and</text></subparagraph></paragraph><paragraph id="HDB5532067C6C48E4A48C62D2B466B45D"><enum>(4)</enum><text>by amending subsection (i), as so redesignated, to read as follows:</text><quoted-block style="OLC" id="H2C76367F4B6A4CEAB246AA1D2EE20DBE" display-inline="no-display-inline"><subsection id="HBCE071A4F73846E3AB18F7880EFE27A3"><enum>(i)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H9758A8F106414250826019F53219773E"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>eligible individual</term> means an individual who—</text><subparagraph id="idBB6094A716A7451EBF0653D0D7DD48A8"><enum>(A)</enum><text display-inline="yes-display-inline">is pursuing an associate’s degree, undergraduate degree, or advanced degree; and</text></subparagraph><subparagraph id="idD9D3913F7E7E40FC97FD43054A0CB5B0"><enum>(B)</enum><text display-inline="yes-display-inline">is—</text><clause id="id233D51748A07491294F2278AF3D671C9"><enum>(i)</enum><text display-inline="yes-display-inline">a member of a group that is underrepresented in the fields of science and engineering, including women; or</text></clause><clause id="idF297E98E8D304AD294E35F5581053B08"><enum>(ii)</enum><text display-inline="yes-display-inline">is enrolled in a degree-program at a minority-serving institution. </text></clause></subparagraph></paragraph><paragraph id="id4620C852534E4B09815B4B6457DC0E0C"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph id="HEF878831A21E4BB78ECBC55A15B62D17"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>minority-serving institution</term> means an institution of higher education that is eligible under section 371(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067q">20 U.S.C. 1067q(a)</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HDB177E13117145B2B774890C20982D4C"><enum>(b)</enum><header>Additional modifications</header><text>Such section 2192a is further amended—</text><paragraph id="HD2CAA364CA0B4114BEDD785AC243CABD"><enum>(1)</enum><text>in subsection (d), as redesignated by subsection (a)(1), by adding at the end the following new paragraphs:</text><quoted-block style="USC" id="H6641A34CC2F94467985EC230482E6D28" display-inline="no-display-inline"><paragraph id="HBAF3CD98DFB446A0A214C4AFFE1EC7EA" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The Secretary shall, to the degree the Secretary considers practicable and appropriate, allow a person receiving financial assistance under this section to delay completion of the person's service obligation under this section until the person has completed—</text><subparagraph id="id41D99F92104D47518D3940E4E5BA4B5A"><enum>(A)</enum><text display-inline="yes-display-inline">the terminal degree program of education that is typically expected in the field the person is pursuing; or</text></subparagraph><subparagraph id="id7C76BC582E2745F586397ABB66C53C27"><enum>(B)</enum><text>a post-graduate fellowship at a non-Department laboratory.</text></subparagraph></paragraph><paragraph indent="up1" id="id1436698098194435AC8ED04120CBA947"><enum>(5)</enum><text display-inline="yes-display-inline">In employing participants during the period of obligated service, the Secretary shall strive to ensure that participants are compensated, to the extent practicable, at a rate that is comparable to the rate of compensation for employment in a similar position in the private sector.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H5F998DFD1FD3403ABE081894F77AAD0E"><enum>(2)</enum><text>by redesignating subsections (e) through (i), as redesignated by subsection (a)(1), as subsections (f) through (j), respectively;</text></paragraph><paragraph id="H2238F195A49C4C25875714CB713F84D5"><enum>(3)</enum><text>in subsection (h), as so redesignated—</text><subparagraph id="HFE197A78C51940DCB4B0853FD92DC1C6"><enum>(A)</enum><text>by inserting <quote>(1)</quote> before <quote>The Secretary of Defense shall</quote>; and</text></subparagraph><subparagraph id="H04C502D5442348019075A8943207FACD"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="USC" id="H3C8235C4D20C4D818C8B45F7B3DC9CFF" display-inline="no-display-inline"><paragraph id="HCDD954D636824571902ECEE9388FC218" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HCCE67DDEA1594B8C91877CE46A949291"><enum>(A)</enum><text>The Secretary of Defense shall establish or designate an organization within the Department of Defense which shall have primary responsibility for building cohesion and collaboration across the various scholarship and employment programs of the Department.</text></subparagraph><subparagraph id="H84BB688A1BE24459AF1E22AF8E79A6B4" indent="up1"><enum>(B)</enum><text>The organization described in subparagraph (A) shall have the following duties—</text><clause id="HB24917BAC92042B78F639ED128B48056"><enum>(i)</enum><text>establish an interconnected network and database across the science, technology, engineering, and mathematics scholarship and employment programs of the Department, including, at a minimum the SMART Defense Education Program, the Defense Civilian Training Corps, the National Defense Science and Engineering Graduate Fellowship, the Army AEOP apprenticeship program, and the Consortium Research Fellows Program;</text></clause><clause id="H3BBAF710FE714940ACFC6AF7FD8C6328"><enum>(ii)</enum><text>aid in matching scholarships to individuals pursuing courses of study in in-demand skill areas; and</text></clause><clause id="HC2ADA89E30F94645B55B8E4F952329AC"><enum>(iii)</enum><text>build a network of program participants, past, present, and future whom DOD departments can draw on to fill skills gaps.</text></clause></subparagraph><subparagraph id="H8DA5087B63FA421EA03468E5458A5702" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">On an annual basis, the organization described in subparagraph (A) shall publish, on a publicly accessible website of the Department of Defense, an annual report on the workforce requirements and expected future needs of the civilian workforce of the Department of Defense.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H406B5D5D342E4FEBABD1DEFA623B28D9"><enum>(4)</enum><text>by redesignating subsection (j), as redesignated by paragraph (2), as subsection (k); and</text></paragraph><paragraph id="H7A4798AA26E8437CBD43D47D996E0E91"><enum>(5)</enum><text>by inserting after subsection (i), as redesignated by paragraph (2), the following new subsection:</text><quoted-block style="USC" id="H359125FCABA349BF8B2365B0AD69FC15" display-inline="no-display-inline"><subsection id="HE95D87B18D41493D808ABFCFCEC9C18C"><enum>(j)</enum><header>Special rules</header><paragraph commented="no" display-inline="yes-display-inline" id="idE9633DFA083340749FB515B2B1E9FE91"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall strive, in each year of the program under this section and to the greatest extent feasible, to increase the number of applicants pursuing degrees in quantum sciences or a related field of study.</text></paragraph><paragraph indent="up1" id="idFB09A20222394C40A93184B3D7CC8193"><enum>(2)</enum><text>The Secretary shall strive to ensure that, in each year of the program under this section, at least one new graduate level participant is studying in an advanced quantum research field.</text></paragraph><paragraph id="idE25008B661A54D538E16214C475C3C5E" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary shall consider emerging technologies, such as quantum computing and information sciences and artificial intelligence, as skills and disciplines that are critical to the national security functions of the Department of Defense.</text></paragraph><paragraph indent="up1" id="idDEBBCA41C82D4F5FB491F305DBF8F124"><enum>(4)</enum><text display-inline="yes-display-inline">The Secretary shall encourage increased participation in the program under this section by students studying relevant cross-disciplinary educational tracks that touch on more than one area of science, technology, engineering, and mathematics.</text></paragraph><paragraph indent="up1" id="idE09AF559F7954E83B0EAA1DC1F7561F3"><enum>(5)</enum><text>The Secretary shall treat optics, photonics, and quantum information sciences as disciplines eligible for the program under this section. </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id8FD6A0A99D0D4DC6A3894246ED35139D"><enum>(c)</enum><header>Report</header><text>Not later than three years after the date of the enactment of this Act, the Secretary of Defense shall submit to Congress a report on participation and use of the program under section 2192a of title 10, United States Code, as amended by this subsection, with a particular focus on levels of interest from students engaged in studying quantum fields. </text></subsection></section><section id="id650E36B133084C5A9DBAE08CE2775829"><enum>4.</enum><header>Modification of authority of Secretary of Defense to award grants to support science, technology, engineering, and mathematics education</header><text display-inline="no-display-inline">Section 2036(g)(2) of title 10, United States Code, as added by section 513 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>), is amended—</text><paragraph id="idD508A7C3155E4F918FE4EA6EA812305E"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (J) through (M) as subparagraphs (K) through (N), respectively; and</text></paragraph><paragraph id="id565B0C4281AB4E4BB580EF459598C707"><enum>(2)</enum><text>by inserting after subparagraph (I) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4D482A2CA291479C92B27975F68D3822"><subparagraph id="idA27A8BC961564B78B53039C2D05847FB"><enum>(J)</enum><text>quantum information sciences;</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id79FCD469AF584CC3AF961610DCE6AB5F"><enum>5.</enum><header>Department of Defense fellowships in quantum information science and technology research and development</header><text display-inline="no-display-inline">Section 234 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2358">10 U.S.C. 2358</external-xref> note), as amended by section 214 of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>), is further amended— </text><paragraph id="id4264C275D5E9452C92DC85EAFCC5891D"><enum>(1)</enum><text>by redesignating subsection (f) as subsection (g); and</text></paragraph><paragraph id="idF581D43AD88A42199C0D6FCFEC8CFFA6"><enum>(2)</enum><text>by inserting after subsection (e) the following new subsection (f):</text><quoted-block id="id8291C49767DA4EF4845F3CBFC30B25D4" display-inline="no-display-inline" style="OLC"><subsection id="idD2567114225D416683ABFC16E7895E4A"><enum>(f)</enum><header>Fellowships</header><paragraph id="id15F91A5396324CCAA73054AA24A35CDF"><enum>(1)</enum><header>Program required</header><text>In carrying out the program required by subsection (a), the Secretary shall, pursuant to another provision of law or through another graduate and postdoctoral fellowship program that was in effect on the day before the date of the enactment of the <short-title>Quantum for Universal Advancement in Nationwide Technology Use and Modernization for National Security Act of 2021</short-title>, such as the National Defense Science and Engineering Graduate Fellowship Program, carry out a program of fellowships in quantum information science and technology research and development for individuals who have graduate or post-graduate degrees.</text></paragraph><paragraph id="idA257E02680E94D40BACFFE6477A538F0"><enum>(2)</enum><header>Guidelines</header><text>The Secretary shall award fellowships under the program required by paragraph (1) pursuant to guidelines that the Secretary shall establish.</text></paragraph><paragraph id="idd9d4332828dd4d3e9b37d7e82bc0bf1f" commented="no"><enum>(3)</enum><header>Reports</header><text>Each recipient of a fellowship under the program required by paragraph (1) shall submit to the Secretary a report on the experience of the recipient coming from a learning environment to a practical application of the recipient's knowledge, in order to contribute to the overall understanding of best practices in teaching and advising students on courses of study in quantum information science and technology research and development. </text></paragraph><paragraph id="id9A2DF750BC2042E9A3AA114D56FE1F57"><enum>(4)</enum><header>Equal access</header><text>In carrying out the program required by paragraph (1), the Secretary shall strive to ensure that minority and economically disadvantaged students have equal access to fellowships under such program.</text></paragraph><paragraph id="id584A4717227747C88D9754A8313FA1F4"><enum>(5)</enum><header>Period</header><text>A fellowship awarded under the program required by paragraph (1) shall be for a period of not more than three years.</text></paragraph><paragraph id="id95A8B4A333CB43C4B203FA43EE9E39F2"><enum>(6)</enum><header>Limitation</header><text>Amounts made available to carry out the program required by paragraph (1) may only be used for—</text><subparagraph id="idBDCD6DE4BBC54B44A746842B3F28CF8C"><enum>(A)</enum><text>the award of fellowships under such program; and</text></subparagraph><subparagraph id="idEDAC0BEB05F0448AB44B9CE3D3EE8408" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>the administrative costs of carrying out such program. </text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idF7C4266C650F42179B3295D63704A2F0"><enum>6.</enum><header>Improvements to defense quantum information science and technology research and development program</header><subsection id="id9E02CC03B9134957BC6B17D1725717F8"><enum>(a)</enum><header>Multidisciplinary partnerships with universities</header><text display-inline="yes-display-inline">Section 234 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2358">10 U.S.C. 2358</external-xref> note), as amended by section 5, is further amended—</text><paragraph id="id7D18C9D699DF4178861F9CB38690D01F"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (g) as subsection (h); and</text></paragraph><paragraph id="idEF63C6F1EA2944FD905890E83922FB61"><enum>(2)</enum><text>by inserting after subsection (f), as added by section 5, the following new subsection (g):</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7F0611D82F974F3F850B57553E25116C"><subsection id="idA284CF9BF72F49F4961594ECC33EF185"><enum>(g)</enum><header>Multidisciplinary partnerships with universities</header><text>In carrying out the program under subsection (a), the Secretary of Defense shall endeavor to develop partnerships with universities that are focused on encouraging students to engage in multidisciplinary courses of study.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id240B33863F3B419EBC60B0C127825C6F"><enum>(b)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text><paragraph id="id2EFC19EF38794CFF98A6D3D76F5E31A2"><enum>(1)</enum><text>funding research, development, and deployment of quantum information sciences and quantum information science-related technologies and systems is a priority; and</text></paragraph><paragraph id="idB15286A559004E6A9B5D363A7159CB73"><enum>(2)</enum><text>it is especially critical that the United States continue to prioritize such research, development, and deployment in consideration of the significant investment made by China in quantum information sciences.</text></paragraph></subsection><subsection id="id976E19E956CA4265AE718BE76289E85B"><enum>(c)</enum><header>Comptroller General of the United States assessment of program</header><paragraph id="id6364075ED639453ABC8CB54D549CB884"><enum>(1)</enum><header>Assessment and briefing</header><text>Not later than 180 days after the date of the enactment of this Act, the Comptroller General of the United States shall—</text><subparagraph id="id4B11DBECE3CD428AB0B58A740C414968"><enum>(A)</enum><text>commence an assessment of the program carried out under section 234 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2358">10 U.S.C. 2358</external-xref> note), as amended by section 5 and this section, with consideration of the report submitted under subsection (h) of such section (as redesignated by subsection (a)(1) of this section); and</text></subparagraph><subparagraph id="idA4B8FDFBCD194EB680DA36400CE686E2"><enum>(B)</enum><text>provide the congressional defense committees a briefing on the preliminary findings of the Comptroller General with respect to such program.</text></subparagraph></paragraph><paragraph id="idDB877E3FA11D4BEFA9EF487826F064FB"><enum>(2)</enum><header>Final report</header><text>At a date agreed to by the Comptroller General and the congressional defense committees at the briefing provided pursuant to paragraph (1)(B), the Comptroller General shall submit to the congressional defense committees a final report with the findings of the Comptroller General with respect to the assessment conducted under paragraph (1)(A).</text></paragraph><paragraph id="id0413E55E549D400590D416214FFB8FAB"><enum>(3)</enum><header>Congressional defense committees defined</header><text>In this subsection, the term <term>congressional defense committees</term> has the meaning given such term in section 101(a) of title 10, United States Code.</text></paragraph></subsection></section><section id="idB431B2B670E4447AB2373C18C6D2A041"><enum>7.</enum><header>Improvements to National Quantum Initiative Program</header><subsection id="idc7cbdf400f184b6fa35d0e06df8866ce" commented="no"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text><paragraph commented="no" id="idC7761CD98C8F4540BD81733D63B95C45"><enum>(1)</enum><text>the execution of the National Defense Strategy is critical to the functions of the Federal participants of the National Quantum Initiative Program; and</text></paragraph><paragraph id="id2CD0BC900AA848F3AF55B7013EAAEF5F" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>the success of the National Quantum Initiative Program is necessary for the Department of Defense to carry out the National Defense Strategy.</text></paragraph></subsection><subsection id="idF712F6B4C1DF48F38B4FC6DE417451EA"><enum>(b)</enum><header>Department of Defense participation in National Quantum Initiative Program</header><paragraph id="id5F5CC83E18294BFE8E20F96817C5A2C6"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The National Quantum Initiative Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/368">Public Law 115–368</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/15/8801">15 U.S.C. 8801</external-xref> et seq.) is amended by adding at the end the following new title:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id09E81C270C0349CAAA7950A84A86D36F"><title id="idE1C3C8D10EB44AAF83CFFD39A870FC3A" style="OLC"><enum>V</enum><header>Department of Defense quantum activities</header><section id="id93B79C0FE2BB4E5492F0F3B24A035713" section-type="subsequent-section"><enum>501.</enum><header>Defense quantum information science and technology research and development program</header><text display-inline="no-display-inline">The quantum information science and technology research and development program carried out under section 234 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (<external-xref legal-doc="public-law" parsable-cite="pl/115/232">Public Law 115–232</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2358">10 U.S.C. 2358</external-xref> note) shall be treated as part of the National Quantum Initiative Program implemented under section 101(a) of this Act.</text></section><section section-type="subsequent-section" id="id2718F1EE748E4907B03EF8FD482598A8"><enum>502.</enum><header>Coordination</header><text display-inline="no-display-inline">The Secretary of Energy, the Director of the National Institute of Standards and Technology, and the Director of the National Science Foundation shall each coordinate with the Secretary of Defense in the efforts of the Secretary of Defense to conduct basic research to accelerate scientific breakthroughs in quantum information science and technology.</text></section></title><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="idD9DAEB1F58F3443F9A884CA759F6A927"><enum>(2)</enum><header>Clerical amendment</header><text>The table of contents is section 1(b) of such Act is amended by adding at the end the following:</text><quoted-block style="OLC" id="id7f9c4435-3bff-4395-ae12-113546fba5c1"><toc><toc-entry level="title" idref="idE1C3C8D10EB44AAF83CFFD39A870FC3A">TITLE V—Department of Defense quantum activities </toc-entry><toc-entry level="section" idref="id93B79C0FE2BB4E5492F0F3B24A035713">Sec. 501. Defense quantum information science and technology research and development program. </toc-entry><toc-entry level="section" idref="id2718F1EE748E4907B03EF8FD482598A8">Sec. 502. Coordination.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idFA16ABF352D5422F8CE42E3954BDAEB6"><enum>(c)</enum><header>Assessment by Comptroller General of the United States of National Quantum Initiative Program</header><paragraph id="id7A655D6E6D28438F95B92A58FFED4CFA"><enum>(1)</enum><header>In general</header><text>The Comptroller General of the United States shall—</text><subparagraph id="id06D2D7A816674BB79B421B61DFC8AF18"><enum>(A)</enum><text>assess the National Quantum Initiative Program; and</text></subparagraph><subparagraph id="id1F76B23233714AC8AD798E8B63DB4883"><enum>(B)</enum><text>submit to Congress a report on the findings of the Comptroller General with respect to such assessment.</text></subparagraph></paragraph><paragraph id="id1EDA05B87A484565AC469E0E7D82D9EC"><enum>(2)</enum><header>Elements</header><text>The assessment required by paragraph (1)(A) shall cover the following:</text><subparagraph id="idfedc6e5d6cae48d3a3bf47a2a0ad1b89"><enum>(A)</enum><text>The effectiveness of the National Quantum Initiative Program.</text></subparagraph><subparagraph id="id77DD6B05BD3445E58BB3BECC62D64869"><enum>(B)</enum><text>Whether all of the programs, committees, and centers required by the National Quantum Initiative Act (<external-xref legal-doc="usc" parsable-cite="usc/15/8801">15 U.S.C. 8801</external-xref> et seq.) have been established.</text></subparagraph><subparagraph id="idCB00EB176A4742399EF15B4F36E2F25B"><enum>(C)</enum><text>Whether the agencies, programs, committees, and centers described in subparagraph (B) are effectively collaborating together and conducting joint activities where appropriate.</text></subparagraph><subparagraph id="id5750F8DF28DB4E4398D100CC86935B5B"><enum>(D)</enum><text>Identification of inefficiencies or duplications across the various programs of the National Quantum Initiative Program.</text></subparagraph></paragraph></subsection><subsection id="id5132ebcc098242cb8cc4edea314cc9d5"><enum>(d)</enum><header>Additional improvements in coordination</header><paragraph id="id6272144E9F1148978D7810F33309C0AF"><enum>(1)</enum><header>In general</header><text>The Secretary of Energy, the Secretary of Commerce acting through the Director of the National Institute of Standards and Technology, the Director of the National Science Foundation, and the heads of other Federal agencies participating in the National Quantum Initiative Program shall coordinate with each other and the heads of other relevant Federal agencies, including the Secretary of Defense, to carry out the goals of the National Quantum Initiative Program.</text></paragraph><paragraph id="id3e4f4ba3e4e54b5a98def0331ba926eb"><enum>(2)</enum><header>Subcommittee on the Economic and Security Implications of Quantum Science</header><subparagraph id="id30d8a7443b4d451c9e5580b329033aba"><enum>(A)</enum><header>Establishment</header><text>The President shall establish, through the National Science and Technology Council, the Subcommittee on the Economic and Security Implications of Quantum Science (in this paragraph referred to as the <quote>Subcommittee</quote>).</text></subparagraph><subparagraph id="idf62ddf8d7de74440b5eb3b53f535d2ab"><enum>(B)</enum><header>Membership</header><clause id="id7F3CBE1D037C4CDB90DE071D495057D3"><enum>(i)</enum><header>Composition</header><text>The Subcommittee shall be composed of members as follows:</text><subclause id="id6f72809881f54683a5ee96c1ded2c5cf"><enum>(I)</enum><text>One member appointed by the Director of the National Institute of Standards and Technology.</text></subclause><subclause id="id563a21c113cd41dbb020e897296873dc"><enum>(II)</enum><text>One member appointed by the Director of the National Science Foundation.</text></subclause><subclause id="id96473b9e971f47d5a2b4715da00efbee"><enum>(III)</enum><text>One member appointed by the Secretary of Energy.</text></subclause><subclause id="ide375c70c422444ecb155ac1d5bb43e4e"><enum>(IV)</enum><text>One member appointed by the Administrator of the National Aeronautics and Space Administration.</text></subclause><subclause id="idff9b9fd5b0a14f2299f6db013f02df09"><enum>(V)</enum><text>Three members appointed by the Secretary of Defense, of whom—</text><item id="id598FDE4F392B47D489A5BDF459818974"><enum>(aa)</enum><text>one shall be a representative of the Army;</text></item><item id="id1448B7A993814A1E9CEB814AC80F2045"><enum>(bb)</enum><text>one shall be a representative of the Navy; and</text></item><item id="idEF93A67B084E4CDCB60DFFB39EF18ABD"><enum>(cc)</enum><text>one shall be a representative of the Air Force.</text></item></subclause><subclause id="id68a080649cf04e35b061e73d7794830c"><enum>(VI)</enum><text>One member appointed by the Director of the National Security Agency.</text></subclause><subclause id="id126adf169f364465bd8105141dd55154"><enum>(VII)</enum><text>One member appointed by the Director of National Intelligence.</text></subclause><subclause id="id13aea09f8b024f918501f39f9608d41b"><enum>(VIII)</enum><text>One member appointed by the Director of the Office of Science and Technology Policy.</text></subclause><subclause id="idd642aff846db46e7a392406b719ec882"><enum>(IX)</enum><text>Such other members as the President considers appropriate.</text></subclause></clause><clause id="id1BC347D903784BEE84F48951CED46B9A"><enum>(ii)</enum><header>Requirement</header><text>Each member of the Subcommittee shall be an employee of the Federal Government.</text></clause></subparagraph><subparagraph id="id35835D6B02DC42019FFD08F1999B917C"><enum>(C)</enum><header>Chairpersons</header><text>The Director of the Office of Science and Technology Policy, the Secretary of Defense, the Secretary of Energy, and the Director of the National Security Agency shall jointly be chairpersons of the Subcommittee.</text></subparagraph><subparagraph id="id52513b48375e40d68ef4b2f997281213"><enum>(D)</enum><header>Duties</header><text>The Subcommittee shall—</text><clause id="id771ae1824d784e42b1a112b02716719f"><enum>(i)</enum><text>coordinate with the National Science and Technology Council and its subcommittees to ensure that the economic and national security implications of basic research and development in quantum information science, along with other related technologies, are reviewed and planned for;</text></clause><clause id="id4cd3c9f61a24454ebaaa8cf15ce6b4f0"><enum>(ii)</enum><text>analyze economic and national security risks arising from research and development in such areas and make recommendations on how to mitigate those risks; and</text></clause><clause id="id7365D435F9F9492DA53D8AC0A0E3369C"><enum>(iii)</enum><text>review new programs for national security implications, when feasible, prior to public announcement.</text></clause></subparagraph><subparagraph id="id16c2814796a24fc5825652b2accd7aec"><enum>(E)</enum><header>Report to Congress</header><text>Not later than 180 days after the date of the enactment of this Act, the chairpersons of the Subcommittee shall submit to Congress a report on the findings and assessments of the Subcommittee regarding economic and national security risks resulting from quantum information science and technology research.</text></subparagraph><subparagraph id="idBAE10564F5064D0EA25D2F3C31E3273B"><enum>(F)</enum><header>Termination</header><text>The Subcommittee shall terminate on the later of the following:</text><clause id="idDFFCBEB582114973804B70A416085EBF"><enum>(i)</enum><text>The date that is five years after the date of the enactment of this Act.</text></clause><clause id="id59CE63BD3A364A5EB3623C73CD3AEF51"><enum>(ii)</enum><text>Such date as the Subcommittee determines appropriate. </text></clause></subparagraph></paragraph><paragraph id="idd13af2e235ff4abd9e8572e2905b4b87"><enum>(3)</enum><header>Involvement of defense in National Quantum Initiative Advisory Committee</header><subparagraph id="idF3DE674EF9FA489A8458BA689C79C1FD"><enum>(A)</enum><header>Qualifications</header><text>Subsection (b) of section 104 of the National Quantum Initiative Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/368">Public Law 115–368</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/15/8814">15 U.S.C. 8814</external-xref>) is amended by striking <quote>and Federal laboratories</quote> and inserting <quote>Federal laboratories, and defense researchers</quote>.</text></subparagraph><subparagraph id="id6D83EEB4C65E4D8CACEE174C9BC14AB8"><enum>(B)</enum><header>Integration</header><text>Such section is amended—</text><clause id="id1AB562A55AFD4A33AF77DDD790164331"><enum>(i)</enum><text>by redesignating subsections (e) through (g) as subsection (f) through (h), respectively; and</text></clause><clause id="id09481BF06A904B7F85C174F23429C28E"><enum>(ii)</enum><text>by inserting after subsection (d) the following new subsection (e):</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD6B68E4FEFE04320A95EA4FA2F72D281"><subsection id="id872134650518498FA24BA3DBACE01C9F"><enum>(e)</enum><header>Integration of Department of Defense</header><text>The Committee shall take such actions as may be necessary, including by modifying policies and procedures of the Committee, to ensure the full integration of the Department of Defense in activities and programs of the Committee.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="idECF0B36854BE4F4A872F5C1B178DC33E"><enum>(4)</enum><header>Clarification of purpose of Multidisciplinary Centers for Quantum Research and Education</header><text>Section 302(c) of the National Quantum Initiative Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/368">Public Law 115–368</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/15/8842">15 U.S.C. 8842(c)</external-xref>) is amended—</text><subparagraph id="idE1295C1CF21542FDA684A94D63CA9C82"><enum>(A)</enum><text>in paragraph (2), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id96194455B6A043289CBC2B27D87111DC"><enum>(B)</enum><text>in paragraph (3), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id20B4C8B2321442FB9C8268D569647DC0"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2668BBEA7DAE4CF89A90E9DC2967C00C"><paragraph id="idB322883B85B942D7A55AEF3258FDEBE1"><enum>(4)</enum><text>encouraging workforce collaboration, both with private industry and among Federal entities, including national defense agencies.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idA2308AFEDCFE46838F3B2C05071A115F"><enum>(5)</enum><header>Clarifications regarding National Quantum Information Science Research Centers</header><subparagraph id="idF731AA118264410B85358FABFC9CC07C"><enum>(A)</enum><header>Requirements</header><text>Subsection (c) of section 402 of the National Quantum Initiative Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/368">Public Law 115–368</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/15/8852">15 U.S.C. 8852</external-xref>) is amended by inserting <quote>the national defense agencies,</quote> after <quote>industry,</quote>.</text></subparagraph><subparagraph id="id7450EF85897C4A7FB570B6761FC9F219"><enum>(B)</enum><header>Coordination</header><text>Subsection (d) of such section is amended—</text><clause id="id3310F75A76E34620BCB7C13D37D11232"><enum>(i)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (4), respectively; and</text></clause><clause id="idED08DC56EF8649BF9DB30A181FD9C545"><enum>(ii)</enum><text>by inserting after paragraph (1) the following new paragraph (2):</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9B405EFE6DAA48C99765E462E1D3166E"><paragraph id="idFBF215BB7DE842D3AD05ABE90FFE20E1"><enum>(2)</enum><text>other research entities of the Federal Government, including research entities in the Department of Defense;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="idE2DA844EAEE54AA7BC2AE3200F9A5CBF"><enum>(6)</enum><header>National Quantum Coordination Office</header><subparagraph id="id61EA937969F84C3892E49C902D2911E6"><enum>(A)</enum><header>Collaboration when reporting to Congress</header><text>Section 102 of the National Quantum Initiative Act (<external-xref legal-doc="public-law" parsable-cite="pl/115/368">Public Law 115–368</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/15/8812">15 U.S.C. 8812</external-xref>) is amended—</text><clause id="id2DDDAB3D3939429EBDF41E5F1A38F8F8"><enum>(i)</enum><text>by redesignating subsection (c) as subsection (d); and</text></clause><clause id="idE6F446166D4340E6B5C915F0F4152621"><enum>(ii)</enum><text>by inserting after subsection (b) the following new subsection (c):</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4CC02922C54B454684C0FB65E0803D03"><subsection id="id9F9CC496D414416B8FE3031EBDB63D08"><enum>(c)</enum><header>Collaboration when reporting to Congress</header><text>The Coordination Office shall ensure that when participants in the National Quantum Initiative Program prepare and submit reports to Congress that they do so in collaboration with each other and all appropriate Federal civilian, defense, and intelligence research entities.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idfce1e7a504254ac390cf6ba26052a2b4"><enum>(B)</enum><header>Adjustments</header><text>The National Quantum Coordination Office may make such additional adjustments as it deems necessary to ensure full integration of the Department of Defense into the National Quantum Initiative Program.</text></subparagraph></paragraph><paragraph id="id222E0772FF2B48EBB94FC19F47E28C93"><enum>(7)</enum><header>Reporting to additional committees of Congress</header><text>Paragraph (2) of section 2 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/8801">15 U.S.C. 8801</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBAF9AA305BE54181A5C7BFEB1791BBE6"><paragraph id="id029A50351D9F494D96623056DD5C7E2D"><enum>(2)</enum><header>Appropriate committees of Congress</header><text>The term <term>appropriate committees of Congress</term> means—</text><subparagraph id="id4B11129687924299BFFCA3E7A1EEE2E8"><enum>(A)</enum><text>the Committee on Commerce, Science, and Transportation, the Committee on Armed Services, and the Select Committee on Intelligence of the Senate; and</text></subparagraph><subparagraph id="id66578276248348E19CB923BCDC50ED71"><enum>(B)</enum><text>the Committee on Energy and Commerce, the Committee on Science, Space, and Technology, the Committee on Armed Services, and the Permanent Select Committee on Intelligence of the House of Representatives.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
