<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 1190</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210415">April 15, 2021</action-date><action-desc><sponsor name-id="S363">Mr. King</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title XIX of the Social Security Act to provide enhanced Federal matching payments for direct support worker training programs, and for other purposes.</official-title></form><legis-body><section id="id328B9575B7824B0B935BE83937D75AB6" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Direct Support Worker Training Reimbursement Act</short-title></quote>.</text></section><section id="idE4CC6162DBAC458DA334DDA15EA2743A"><enum>2.</enum><header>Medicaid funding for direct support worker training programs</header><text display-inline="no-display-inline">Section 1903 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b</external-xref>) is amended— </text><paragraph id="id6DA78B88254F4962B51D74998B1C73CA"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(2), by adding at the end the following new subparagraph: </text><quoted-block id="id24F5ACAECA8C44F3A1CC1FB799FC87BD" style="traditional" act-name=""><subparagraph indent="up1" id="idBEB27BA8059A4FA88853C92EAEEDCE1F"><enum>(F)</enum><text display-inline="yes-display-inline">for calendar quarters beginning on or after January 1, 2022, an amount equal to 75 percent of so much of the sums expended during such quarter for direct support worker training programs described in subsection (cc) (including the costs for eligible direct support workers (as defined in such subsection) to complete such programs); plus</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id5DF31FD506F147B2A2230D720CA421B7"><enum>(2)</enum><text>by adding at the end the following new subsection:</text><quoted-block id="id22A316C89A5D4250A4AB379C52CAFE03" style="OLC" act-name=""><subsection id="idD22B05FDC6A141DA866366C42A919A1E"><enum>(cc)</enum><header>Direct support worker training programs</header><paragraph id="idE4CC314A0051406ABB1A5D83AFC14364"><enum>(1)</enum><header>In general</header><text>A direct support worker training program described in this subsection is a program approved by the State under which eligible homecare workers are provided with— </text><subparagraph id="id806D2748B2274CD3B697A73D695BE2E4"><enum>(A)</enum><text>training in the core training competencies for personal or home care aides described in section 2008(b)(3)(A); and</text></subparagraph><subparagraph id="id956CED580BD946C9966D881323FF7FBD"><enum>(B)</enum><text>opportunities for education, training, and career advancement.</text></subparagraph></paragraph><paragraph id="idE3A9E596F39C46C9A0244046933BFB22"><enum>(2)</enum><header>Eligible direct support worker</header><text>The term <term>eligible direct support worker</term> means a personal or home care aide (as such term is defined in section 2008(b)(6)(C)), a direct support worker, a home health aide, a nursing assistant, or a direct support professional who—</text><subparagraph id="id591DCFE44F5E424A99EDA75399F68355"><enum>(A)</enum><text>has at least 30 percent of the worker's direct support client volume (as estimated in accordance with a methodology established by the Secretary) attributable to individuals who are receiving medical assistance under this title; or</text></subparagraph><subparagraph id="id5F639CC8A6F449C29AABDF2A42E94DA0"><enum>(B)</enum><text>is employed by an agency that is a provider of direct support services that has at least 30 percent of the agency's direct support client volume (as so estimated) attributable to such individuals.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
